Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 22nd day of February 2019. Present also were Ms. Vanessa Zapata, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.   AI-8602    Discussion and possible action to create a special revenue fund for the County Clerk Vital Statistics Program in accordance with Texas Local Government Code Chapter 118; Section 191.005 (Vital Statistics Account) and establish a budget by order for revenues and expenditures in the amount of $4,000.00; and transfer program available funds of $32,959.05 and any other matters incident thereto.  [Requested by Margie Ibarra, County Clerk, Fund #2030]

Issue: County Clerk has Vital Statistics fees and need to segregate and establish budget for revenue receipts received and expenditures to cover future Vital Statistics Program expenditures.

Solution: Create special revenue fund to account and segregate resources related to program.  Appropriate revenues and expenditures to be used for the purpose of Vital Statistics Program expenditures.

Result: Finalize special revenue fund and budget using proceeds for the purpose stated on this agenda item.

a.   AI-8613    Discussion and possible action to enter into a nineteen month (19) month (March 1, 2019 through September 30, 2020) Maintenance Agreement between Toshiba Business Solutions and Webb County for the Justice of the Peace, Precinct 4 for a Toshiba E-Studio 456 printer at a monthly cost of Seventy Six Dollars and Forty-Six Cents ($76.46), and a total cost of One Thousand Four Hundred Fifty Two Dollars and Seventy-Four Cents ($1,452.74), subject to annual budget appropriating and authorizing the County Judge to sign and execute all relevant documents. Issue: The Self-Help Center Program is a four (4) year grant that runs September 1, 2016-September 1, 2020.  Year end balances must be carried over and entered into the system in order to continue the availability of these grant funds. 

Solution: Commissioner's Court authorization for a Budget Amendment in order to carry over year end balances for the Self-Help Center grant. 

Result: Continued availability of Self-Help Center grant funds.

8.   Honorable Jose "Pepe" Salinas, Justice of the Peace Pct. 4
             
a.   AI-8629    Discussion and possible action to authorize payment not to exceed $1,025.00 to Tyler Technologies for programming services related to a financial script needed for the enhancement of our judicial software, Odyssey. Funds to be used will be from the Justice of the Peace Technology Fund pursuant to Article 102.0173 of the Texas Code of Criminal Procedure. [Account #2009-2180-001-460105 (Minor Tools - Technology Fund)]

Issue: Several Justices of the Peace cases have an expired fee that needs to be adjusted to zero in order charge defendants the appropriate fee. 

Solution: Once Tyler Odyssey programs and deploys the financial script, cases will have only the applicable court costs, fees and fines assessed. 

Result: Clerks will be able to continue to carry daily duties in an efficient manner and defendants will not be overcharged.
             
9.   Community Action Agency
             
a.   AI-8600    Discussion and possible action to approve Webb County Home-Delivered Meal (HDM) waiver to the inter-local agreement between Webb County (Community Action Agency - Meals on Wheels program) and the Texas Department of Health and Human Services Commission (HHSC) as required to provide 'emergency' hot, shelf stable, cool and/or frozen meals to HDM consumers; and authorizing the County Judge to sign all relevant documents; any other matters incident thereto. Fiscal Year:  October 1, 2019 - September 30, 2020. Agenda item will not have an impact to the General Fund. [Fund 2371]

Issue: The current inter-local agreement is set to expire on September 30, 2019. The F2027 Waiver is renewed on an annual basis as per federal requirements; this document will reflect this change.

Solution: The Commissioners Court approves the new F2027 to the inter-local agreement to reflect the change in the expiration date to October 1, 2019 through September 30, 2020.

Result: The Meals on Wheels program will continue to provide Home Delivered Meals to consumers in the case of an event as described and approved by state office Contract Manager.

10.   Honorable Marco Montemayor, County Attorney
             
a.   AI-8615    Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective February 25, 2019:

Result: Request to fill slot 1927 will allow the County Attorney's Office to continue to function efficiently and effectively.
             
11.   Economic Development
             
a.   AI-8607    Discussion and possible action to approve the submission of a grant application to the Office of National Drug Control Policy for the continuation of a High Intensity Drug Trafficking Area (HIDTA) Grant estimated at $530,150 over the term of the contract. This formal request shall authorize the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. There is no cash match requirement for this grant; however, the District Attorney's Office requests additional funding in the form of cash match to cover expenditures in excess of the grant award. The cash match in the amount of $100,125 is requested each year through the county's budget process. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract Term: January 1, 2019 to December 31, 2020. [Requested by Isidro "Chilo" Alaniz, District Attorney; Fund #2592]

Issue: There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.

Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.

Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.

b.   AI-8604    Discussion and possible action to authorize the ratification of acceptance of the grant as developed, written, and submitted by the Webb County Sheriff’s Office for the 2019 National Crime Victims’ Right Week (NCVRW) Community Awareness Project (CAP) grant award in the amount of $6,000 from the Office for Victims of Crime (OVC); and designating the Webb County Judge as the authorized official to sign all relevant documents; and any other matters incident thereto. This grant award was received on Thursday, February 7, 2019 at 11:33 am, and needed to be returned to the funding agency within ten (10) days or February 21, 2019, prior to this court date. This grant requires no financial match; and, therefore, will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Martin Cuellar, Webb County Sheriff; (Fund 2606)]

Issue: The rights of crime victims are enshrined in the federal code (Section 3771 of Title 18 of the U.S. Code, Crimes and Criminal Procedure), the Texas Constitution (Article I Section 30), and the Texas Code of Criminal Procedure (Chapter 56). However, many victims of crime are unaware of their mandated rights as well as the services that are specifically available to them to facilitate needed restitution, recovery, privacy, dignity, and justice.

Solution: Grant funds to highlight the rights of and services for crime victims in the Laredo/Webb County area during the 2019 National Crime Victims’ Right Week.

Result: The general public and any victims of crime will become more aware of the services available to them in the Laredo/Webb County area.
             
c.   AI-8605    Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to  the Office of the Governor Criminal Justice Division in the amount estimated at $54,006 for Body Worn Camera (BWCs) equipment, software, and supplies; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]


Issue: Tragic local, state, and national events have eroded public trust in law enforcement agencies and their officers.  Recent incidents has again focused attention on controversial confrontations between certain citizens and law enforcement officials; and, these specific incidents has further fomented distrust between community members and the officers sworn to protect them.
 
Solution: Grant application to expand and leverage grant resources so that the Webb County Sheriff’s Office will be able increase transparency and accountability through the utilization of body-worn cameras for its sworn officer force.
 
Result: The Webb County Sheriff’s Office will be able to achieve greater transparency and accountability in its service and protection of the Laredo/Webb County public and taxpayers.
             
d.   AI-8606    Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to the Office of the Governor Criminal Justice Division in the amount estimated at $65,010 for overtime and applicable fringe benefits for members of the Mental Health Unit to provide mental health services, including commitments, executions of court orders, and transports to mental health facilities; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.  [Requested by Martin Cuellar, Webb County Sheriff]

Issue:  The local Laredo/Webb County community continues to constitute a medically and mental health underserved area, which requires mentally ill youth and adults to travel to out-of-town facilities in order to receive these needed mental health services

Solution: Grant application to provide overtime and applicable fringe benefits for the members of the Mental Health Unit to transport mental health patients to these out-of-town facilities so that they may receive the care that they require.



Result:  Grant funding will allow members of the Mental Health Unit to undertake complex and time consuming activities and requirements, including execution of court orders, mental health commitments, and the actual transports to out-of-town mental health facilities, so that the mentally ill patients, their families, and the overall community can be better served.
             
12.   Planning & Physical Development
             
a.   AI-8610    Discussion and possible action to issue a “Certificate of Compliance with Plat Requirements” to authorize an electrical connection pursuant to Section 232.029(c)(2), Local Government Code, to an unplatted 0.50 acre, more or less, out of Tract 30, La Presa, also known as Tract 2 as described in Vol. 4521, Pgs. 206-208 of the WCDR (ID 9389).
 
Issue: Item is a regulatory compliance issue regarding real property development provisions of state law and local regulations with particular emphasis on the Model Subdivision Rules enacted for residential subdivisions.  Commissioners Court must certify to certain property conditions before utility service connections may be authorized.
                
Solution: As reflected in agenda backup, staff has verified compliance matters and recommends the Court’s approval of this certificate.
 
Result: If approved, applicant may connect property to electrical utility services.  If not approved, utility connection to property is prohibited.

13.   Purchasing
             
a.   AI-8614    Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.

Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments.

b.   AI-8617    Discussion and possible action to authorize the Purchasing Agent to advertise for formal bids for the Pueblo Nuevo Street Improvement Project in accordance with the Texas Local Government Code, Sub-Chapter C. (Competitive Bidding in General) and Section 262.027 (Awarding of Contract). [Requested by James Flores, Economic Development Director; TXCDBG Grant Account #7217491]

Issue: Colonia Pueblo Nuevo has streets that are dilapidated and unpaved, causing a potential threat to public safety and creating an impasse during inclement weather.

Solution: Secure Commissioners Court authorization for the solicitation of bids so reconstruction of the affected area may be scheduled.

Result: The roadway improvements shall alleviate hazards to public safety and provide access for colonia residents.
             
14.   Risk Management
             
a.   AI-8608    Discussion and possible action to approve the auto property damage payment of NINE THOUSAND NINE HUNDRED FORTY-SEVEN DOLLARS AND SIXTY-FIVE CENTS ($9,947.65) as a result of a motor vehicle collision which occurred on October 9, 2018 involving a Webb County Constable Precinct 3 Department vehicle. [Account #1001-1180-001-452007-105 (Claims Paid Account)]

Issue:   A vehicle collision involving a Constable Precinct 3 unit #16-10 on Hwy. 359.

Solution:  Vehicle was appraised by independent adjuster and taken to County approved vendor for repairs.

Result:  If approved vehicle will be repaired with no further issue.
  Judge Tano Tijerina stated item #5.a. needed to be corrected in the paragraph the amount reads $4,000 and it should be in the amount of $5,000.
  Judge Tano Tijerina requested for item #10.a. to be corrected where it reads issue the slot #1927 should reflect slot #1438, and on the result section slot #1927 should also reflect slot #1438.

15.   AI-8618    Discussion and possible action to authorize the Purchasing Agent to secure competitive quotes, as necessary, for the following maintenance equipment in an aggregate amount not to exceed $20,000.00 in accordance with the Webb County Purchasing Policy; [Account #7110-6040-001-474501 (Casa Blanca Golf Course Series 2013 Bond)]

Issue: This equipment is necessary for the routine operation of a golf course facility but currently is not in place. 
 
Solution: Utilizing bond monies available to improve the golf course as originally intended.

16.   AI-8619    Discussion and possible action to authorize the Purchasing Agent to secure competitive quotes, as necessary, for the purchase of rental golf club sets in an amount not to exceed $2,000.00 in accordance with the Webb County Purchasing Policy. [Account #7110-6040-001-474501 (Casa Blanca Golf Course Series 2013 Bond)]
 
Issue: The golf course has no rental sets.  Thus, as seen an increase in demand, visitors are unable to play the golf course and the course has seen a pick up in demand for rental sets.

Solution: Utilizing bond monies available to improve the golf course as originally intended.
 
Result: Additional revenue and guest satisfaction for the golf course.
  County Auditor, Mr. Rafael Perez stated to the Commissioners Court that he had been in contact with the Golf Operator and notified him that the expenditures should not come out from bond proceeds so he will be identifying an operational account.
  Judge Tano Tijerina stated for the Court to come back to this item once they have the account number.
             
Economic Development
             
17.   AI-8633    Discussion and possible action to ratify the submission and acceptance of grant application and to approve by order cash match funds for ONE HUNDRED SIXTY NINE THOUSAND EIGHT HUNDRED DOLLARS ($169,800) for the Fleet Replacement Grant (FR- 2018- WEBB CO- 00010). Webb County CAA El Aguila Rural Transit is requesting to accept a grant and authorize purchasing agent to purchase three (3) buses with a total cost of TWO HUNDRED SEVENTY THREE THOUSAND DOLLARS ($ 273,000). Texas Department of Transportation has allocated ONE HUNDRED THREE THOUSAND TWO HUNDRED DOLLARS ($103,200) with a required cash match in the amount of ONE HUNDRED SIXTY NINE THOUSAND EIGHT HUNDRED DOLLARS ($169,800); with additional action to designate a funding source for any pending amount not available in the account number listed and any other matters incident thereto. All required documents were sent for review to the Economic Development Department and the solicitation is compliant with Webb County Single Point of Contact (SPOC) procedures. Issue: Grant application was initiated before item was brought to Commissioner’s Court for approval and application was approved by Texas Department of Transportation for funding on September 1, 2018.  CAA El Aguila is requesting a total cash match of ONE HUNDRED SIXTY NINE THOUSAND EIGHT HUNDRED DOLLARS ($169,800) to cover the purchase of three (3) new vehicles.  Rural residents of Webb County depend on El Aguila Rural Transit to provide a safe and reliable mode of transportation. Currently, El Aguila’s fleet includes seven (7) buses that travel over three hundred (300) miles daily and are ten (10) years old.  These vehicles have an average of one hundred seventy five thousand (175,000) miles. 

Solution: Approval of cash match and authorization of payment for three (3) new vehicles as set forth above to ensure that Webb County CAA El Aguila Rural Transit can continue to operate a safe and reliable transportation service without the risk of any liability to Webb County and it's rural residents.

Result: El Aguila Rural Transportation will be able to provide continued, uninterrupted transportation service to the rural areas of the Webb County.

Issue: The golf course has no rental sets. Thus, as seen an increase in demand, visitors are unable to play the golf course and the course has seen a pick up in demand for rental sets.

Solution: Utilizing bond monies available to improve the golf course as originally intended.

Result: Additional revenue and guest satisfaction for the golf course.
