Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 7th day of February 2020. Present also were Ms. Vanessa Ramirez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  County Treasurer, Mr. Raul Reyes presented the Recap of Checks, Ratification of Checks, Liability Disbursements of County Payroll for 1/17/2020 – 1/30/2020, and Actual/ Estimated Requirements for Casa Blanca Golf Course.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: Engineering Department's Grant Fund No. 3720 County Transportation Infrastructure Fund Grant (C.T.I.F.) funds are being transferred into three (3) different accounts.  These will be used for employee payments, materials and equipment in order to do in-house work at the following C.T.I.F. project: Espejo Gates Road Project, Wormser Road Project and Mines Road Project.  Funds are being transferred at this time after insuring that there were no other items pending.  The Financial information has been certified by the Auditor's office.

Solution: Approval of Agenda Item.  This is required by Court Policy but does not impact the grant; and, therefore, does not require notification to approval by the Funding Agency in accordance with Texas Local Government Code Section 111.07075.

Result: Approval and availability of these Grant funds.

Issue: Future deficits on FY2020 budget fund 2465 Operation Stonegarden Grant 2018, due to an increase in the unemployment Tax and Retirement County Share rates.

Solution: Approving line item transfers will reclassify funds in the FY2020 budget fund 2465-Operation Stonegarden Grant 2018.

Result: By approving line item transfers FY2020 budget fund 2465 Operation Stonegarden Grant 2018 will be increased and will avoid any future deficits.

Issue: The OPSG budget for fringe benefits was based on rates from Fiscal Year 2019. The retirement and unemployment compensation rate increased in January 2020. Therefore, a line item transfer is needed to reflect those changes in the fringe benefits to avoid any budget deficits within theses grant accounts due to forecasted grant-funded fringe benefit disbursements during the remaining grant performance period.

Solution: Approval by the court for this requested budget line item transfer. 

Result: The budget balances for Unemployment and Retirement line items will have sufficient funds to cover increases.

No. 94, with the Foreign Trade Zone Board/U.S. Dept. of Commerce as requested by H.B. Logistics, Inc., Applicant & City of Laredo, by adding Lots 6 & 7, Block 6, San Isidro East Point Industrial Park, Unit 2, Laredo, Texas, also known as 822 Union Pacific Blvd., to F.T.Z. c.   AI-10152    Discussion and possible action to continue paying grant funded personnel under the High Intensity Drug Trafficking Area (HIDTA) Task Force Agreement, Narcotics Task Force until notification of grant continuation award from the U.S. Department of Justice. The Grantee (City of Laredo Police Department) has informed the Sheriff's Office that the grant will continue and is pending the official award letter from HITDA officials. This grant has been active for the past 27 years and is anticipated to continue throughout 2020 and beyond. [Requested by Martin Cuellar, Webb County Sheriff; Fund #2906]

Issue: HIDTA is a multi-agency task force that continues to gather intelligence and disrupts the illicit flow of narcotics and money laundering activities along the South Texas Border region. South Texas HITDA is an alliance of over 57 federal, state and local law enforcement agencies working together to combat drug trafficking and related crimes. Historically the Grantor has always submitted award letters to local law enforcement agencies between the months of February and March; Nonetheless, the grants are retroactive to January 1st of each calendar year.

Solution: For the Webb County Sheriff's Office to continue supporting HIDTA by employing grant funded investigators and continue corroborating with other law enforcement agencies to push forward the mission and goals of the South Texas HIDTA task force.

Result: The Webb County Sheriff's Office will continue to employ two (2) HIDTA funded investigators who will actively participate and help the task force fight against the continued flow of illicit drugs and related crime within the South Texas region.
             
d.   AI-10170    Discussion and possible action to approve the execution of a construction contract between Webb County and Southern Trenchless Solutions, LLC., in the amount of $850,774.00 pursuant to the Court’s prior approval and award of Buy Board Contract No. 555-18, for the rehabilitation and pump replacement of Webb County Lift Stations #1, #3, and Manhole Rehabilitation Phase II, in accordance with the Texas Local Government Code (Cooperative Purchasing Program Participation) and authorizing the Webb County Judge to execute any and all relevant documents; and any other matters incident thereto. e.   AI-10174    Discussion and possible action to approve a One (1) year Professional Service agreement with Recovery Monitoring Solutions, to provide continuous alcohol monitoring, breath-alcohol testing and/or drug patch services for the Webb County 406th District Court Sobriety Treatment Program commencing January 1, 2020 through December 31, 2020. Participants will directly pay the vendor when drug patch services are applied, therefore there is no impact to the general fund and authorizing the Webb County Judge to execute all relevant documents. [Requested by Judge Oscar Hale, 406th District Court]

10.   Community Action Agency
             
a.   AI-10156    Discussion and possible action to approve conducting Category "B" Elections to fill current vacancies as per the Governing Regulations of the Advisory Board of the Webb County Community Action Agency. (The Advisory Board shall be composed of membership that complies with the Community Services Block Grant-Texas Administrative Code Rule 5.215). Elections will be held on Wednesday, February 12, 2020 for a Representative and Alternate for the Area VII- Santo Nino in the Larga Vista Community Center, 5401 Cisneros and on Thursday 13, 2020 for a Representative and Alternate for the Area I- Lilia B. Perez, 4420 Santa Maria Road from 9:00 a.m. till 5:00 p.m.

Issue: To hold Elections to fill current vacancies for Representative and Alternate for Area VII- Santo Nino.

Solution: The Advisory Board shall be composed of membership that complies with the Community Services Block Grant- Texas Administrative Code Rule 5.215.

Result: Once the Election is held CAA will comply with the Texas Administrative Code Rule 5.215.
             
b.   AI-10160    Discussion and possible action to authorize the Purchasing Agent to solicit bids for Community Services Block Grant (CSBG) Program client tracking system software for the Webb County Community Action Agency. This action will have no impact on the General Fund.

Issue: The agreement with current client tracking system is set to expire. The agency is required to solicit bids to continue tracking clients through a system software.

Solution: The court approval will allow Webb County Community Action Agency to continue tracking clients through a system software.

Result: Authorization to solicit bids will allow the Agency to continue application intake through a client tracking system, offering an accurate and timely process for intake.
             
11.   Economic Development
             
a.   AI-10155    Discussion and possible action to ratify the acceptance of a grant awarded to Webb County in the amount of Fifty Thousand Dollars ($50,000) for the 2020 Census Funding Texas Counts Pooled Fund Grant Application from the Center for Public Policy Priorities and Communities Foundation of Texas, and authorizing the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Co-Sponsored by Cindy Liendo, Commissioner Pct. 4 and Rosaura "Wawi" Tijerina, Commissioner Pct. 2]
             
b.   AI-10169    Discussion and possible action to apply for a FY 2019 2020 Federal 5339 Discretionary Bus and Bus Facilities Grant for Webb County Community Action Agency from The Texas Department of Transportation (TxDOT) in the amount of THIRTY SEVEN THOUSAND TWO HUNDRED SEVENTY SIX DOLLARS ($37,276.00). This grant does NOT require a County Match. All required documentation has been submitted for review to the Economic Development Department and the solicitation is compliant with Webb County Single Point of Contact (SPOC) procedures. No impact to the General Fund. [Requested by James Flores, CAA Executive Director]

Issue: CAA- El Aguila Rural Transportation is a grant funded agency. TxDOT identified a vehicle which is projected to exceed it’s useful life benchmark (ULB) by 2021.   

Solution: This grant will allow us to upgrade fleet as designated by TxDOT. 

Result: Decrease in agency’s vehicle maintenance cost and continuation of services throughout the rural areas of Webb County.

c.   AI-10135    Discussion and possible action to authorize the submission of a grant application for the Fiscal Year (FY) 2019 Operation Stonegarden (OPSG) as prepared and submitted by the Webb County Sheriff’s Office to the Office of the Governor Homeland Security Grants Division in an amount not to exceed $7,408,356 for overtime, associated fringe benefits, equipment, supplies, fuel, helicopter maintenance/fuel, vehicle/tire maintenance, data services, Management & Administration (M&A), and maintenance of OPSG-acquired assets for local law enforcement agencies; and any other matters incident thereto. There is no cash match; and, thus, no cost to Webb County. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Complex and dynamic law enforcement challenges exist in the Southwest border area of the United States, including Laredo/Webb County. For example, transnational criminals seek to exploit existing law enforcement jurisdictional boundaries by conducting their illegal enterprises across traditional jurisdictional divisions. The 2014 Texas Gang Threat Assessment expounds, “Gang activity remains widespread throughout all regions of Texas…Gang activity is also prevalent in the Texas counties adjacent to Mexico and along the key smuggling corridors, since Texas-based gangs are used for cross-border smuggling and trafficking in the state. Many transnational gangs operating in Texas….engage in criminal activity in Mexico as well as in Texas and elsewhere” (Texas Department of Public Safety April 2014).

Solution: Grant application: (1) to ensure first responders are equipped with enhanced tools/equipment/resources needed to confront well-funded criminal organizations and (2) for the coordination of law enforcement efforts between various local and federal law enforcement agencies.

Result: Enhanced capabilities of local law enforcement responders; further coordination of response across local and federal jurisdictions.

This grant application does not require a cash match; thus, will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The grant application was submitted on February 5 so as not to lose the grant funds. Grant funds have already been awarded for the next 5 years. However, it is required by the funding agency to submit a non-competing continuation application for each individual year of the grant. Thus, since it is the intention of County Court-at-Law 2 to continue to renew services under the grant over the next 5 years, a non-competing continuation application will be submitted by the DWI Court Program to continue services for year 3.  

Solution: Ratify the submission of the Continuation application as submitted in order to allow DWI Court Program to continue to offer services under the grant for year 3.  

Result: County Court-at-Law 2 will remain in compliance with SPOC, and with the submission rules and regulations set forth by the funding agency.

Solution: Authorize the Purchasing Agent to solicit competitive sealed proposals for property and casualty and for workman’s compensation and liability third party administrator insurance for Webb County.
 
Result: With the consent of the Commissioners Court and in the best interest for Webb County, proceed with scheduled posting of sealed proposal as recommended by the Webb County Purchasing Agent and Risk Manager to secure competitive insurance proposals for consideration by the governing body.
             
c.   AI-10164    Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public and/or donated as permitted by law.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments.

Issue: In order to provide power to the parking management system a source of power is required. AEP has assigned an ESID number to the project site and requires the appropriate electrical infrastructure to be in place prior to connecting power.

Solution: Authorize the Purchasing Agent to secure the informal bids and issue a Purchase Order to lowest responsible bidder utilizing Bond money allocated to this project.

Result: Secure electrical power for the parking lot access system in order to operate accordingly.

Issue: Like other local law enforcement agencies, the Webb County Sheriff’s Office utilizes limited financial, operational, and manpower resources to grapple with, deter, mitigate, and/or resolve various serious criminal justice matters that stem from a confluence of deeply rooted, difficult, and often highly complex societal problems.
 
Solution: Leveraging of other federal, state, and local resources available to local law enforcement agencies allows the Webb County Sheriff's Office to be able to provide better and more enhanced law enforcement services with a positive financial impact to local taxpayers, who also pay state and federal taxes but do not always receive the same federal/state benefits/services as other communities. Acceptance of the donation of a Canine (K9) from the U.S. Department of the Army to acquire the K9’s services will leverage federal resources to assist Webb County Sheriff’s Office deputies with crime-fighting services in the Laredo/Webb County area to better serve local citizens.
 
Result: Requested K9 will assist the Webb County Sheriff’s Office to fight crime.

The Lyndon B. Johnson HS Cheerleaders were also awarded their third consecutive National Championship along with the specialty awards of Best Use of Stunts and CoEd Excellence.

The team is under the direction of Head Coach Andrea Herrera along with Assistant Coach Lesly Contreras.

Team Members include Senior, Karina Hernandez; Juniors: Captain-Brianna Merino, Paulina Perez, Jacqueline Neri, Victor Gutierrez; Sophomores: Melanie Garcia, Briana Chapa, Michelle Terrazas; Freshman: Nidia de la Rosa, Kaela Sandoval and Linzy Garcia.
