Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 8th day of March 2018. Present also were Mrs. Virginia M. Rodriguez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.   AI-7149    Discussion and possible action to approve the following budget amendment (line item transfer) within the following grant funds.  Financial information has been certified by the Auditor's office. No impact to General Fund.

b.   AI-7157    Discussion and possible action to approve the following budget amendment (line item transfer) by increasing the expense account in the amount of $6,000 from revenues received from the Drug Court Program Fees and Court Costs (Code Crim. Proc., Art. 102.0178) that have been collected. These expenditures are allowable as costs for the "development and maintenance of drug court programs operated within the county" as required under this Code.

Issue: Frequent Drug and and Alcohol testing is part of the 10-Key components of a Drug Court Program as indicated by the National Association for Drug Court Professionals Organization. Drug testing services are rendered to all participants of the Drug Court Program. 

Solution: The Drug Court Program Fees allows funds to be utilized for services provided to the Drug Court Program participants, specifically, drug and alcohol testing services. 

Result: Continue drug testing all participants for drug and alcohol to monitor abstinence and compliance while participating in the 406th Judicial District Adult Drug Court Program.

b.   AI-7161    Discussion and possible action to approve One (1) year manufacture warranty extension for the Webb County Sheriff’s Office Strongwatch Freedom on the Move (FOTM) system from the Strongwatch Corporation for the Webb County Sheriff’s Office for $19,000. [Requested by Sheriff Martin Cuellar; Account #2468-3010-001-452012 (Stonegarden Grant Funds FY 2016) ($9,500) and Account #1001-3010-001-444500 Equipment Rentals ($9,500)]

Issue: Strongwatch FOTM (Freedom on the Move) is a complex mobile scope truck. This is for border interdiction operations and scene security/crowd control-over-watch. Preventive Maintenance includes lubrication of pneumatic system, moving parts on skid plate, and all of the electronic /software updates needed to keep system running properly.

Solution: Purchase of extension warranty and preventive maintenance so that there is an uninterrupted use of the asset as well as securing the service and warranty at a lower rate that the ON CALL Rate.

Result: Strongwatch Freedom on the Move (FOTM) system will have coverage for all issues that arise out of the asset, pneumatic system, computer systems, and imaging system. As well as preventive maintenance scheduling to keep system in order. Strongwatch is a sole source provider for the service and repair of their systems.

8.   Community Action Agency
             
a.   AI-7147    Discussion and possible action to authorize the Webb County Community Action Agency to enter into an annual vendor agreement with Retail Energy Providers (list below) for the implementation of Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP). These vendors agreements are a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Issue: The Webb County CAA will enter into an annual vendor agreement with Retail Energy Providers for the implementation of the Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP).

Solution: These vendor agreements are a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Result: The Texas Department of Housing and Community Affairs (TDHCA) will provide funding to be used for payment of qualifying  low income clients home energy expenses.

Issue: As per the State CAA must use both grant CEAP and CSBG for expenses: space rental, materials & supplies, office supplies, equipment rental and postage.

Solution: To have enough funds in CEAP account to pay necessary expenses.

Result: To unsure funding for the remainder of the current fiscal year.
             
9.   Honorable Marco Montemayor, County Attorney
             
a.   AI-7140    Discussion and possible action to approve the addition of a 2006 Ford Expedition VIN: 1FMPU7579LA28973, as part of the Webb County Attorney's Office fleet inventory, including but not limited to revising Webb County vehicle inventory to reflect this addition, provide the necessary insurance coverage; and any other matters incident thereto.

Issue: The Webb County Attorney's Office is requesting to add this vehicle as part of its inventory to be used for official law enforcement purposes.  It was obtained by judicial forfeiture at the 49th Judicial District Court and was awarded to Webb County.

Solution: Approve the addition of this vehicle as part of the Webb County Attorney's Office vehicle inventory.

Result: Utilization of this vehicle for law enforcement operations that will assist in identifying and dismantling organized crime within Webb County.

Issue: New proceeds under Chapter 59.06 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The attorney representing the State can utilize the new proceeds for the official use of his Office.

a.   AI-7135    Discussion and possible action to approve the following budget amendment (line item transfer); and any other matters incident thereto. This budget line item transfer is for a grant; and, therefore, no impact on the general fund. Moreover, this does not need an actual budget amendment request to the funding agency since, under the actual grant budget, funding does not need to be moved from one line item budget to another. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. b.   AI-7136    Discussion and possible action to authorize the submission of a grant application submitted by the Webb County Sheriff’s Office to the Bureau of Justice Assistance (BJA) for a State Criminal Alien Assistance Program (SCAAP) grant for reimbursement of costs already incurred for the incarceration of undocumented criminal aliens at the Webb County jail; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any cash match; and, in fact, is a reimbursement of costs already incurred. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Although immigration matters, including illegal immigration, are constitutionally established as existing under the legal jurisdiction and regulation of the federal government, state prisons and local detention facilities, such as the Webb County jail, incurs significant costs incarcerating undocumented foreign aliens who commit crimes in the United States. This includes but is not limited to supervision, housing, feeding, clothing, any medical and transportation expenses, and other associated detention costs.
 
Solution: Grant application to obtain reimbursement of a small percentage of the incurred correctional officer salary costs associated with detaining undocumented criminal aliens who had at least one felony or two misdemeanor convictions for violations of state or local law and who were incarcerated at the Webb County jail for at least four (4) consecutive days during the reporting period of July 1, 2015 through June 30, 2016.
 
Result: Webb County will be reimbursed by the federal government a limited percentage of the amount of its already incurred costs of detained foreign criminals incarcerated at the Webb County jail.

c.   AI-7137    Discussion and possible action to approve the submission of a grant application to the Office of the Governor Homeland Security Grants Division for the Border Prosecution Grant estimated at $500,000 over the term of the contract. This formal request shall authorize the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. There is no cash match required for this grant. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract Term: September 1, 2018 to August 31, 2019. [Requested by Isidro "Chilo" Alaniz, District Attorney; Fund #2739-2260]

Issue: There is a need for resources to prosecute felony cases, provide technical assistance and training to law enforcement agencies and prosecute border crime cases along the Texas-Mexico Border. The Office of the Governor of Texas has provided available resources through a grant opportunity to enhance prosecution in the area of organized crime/criminal enterprise cases.

Solution: Authorize the submission of the grant application as set forth above to ensure that the Border Prosecution Unit at the District Attorney's Office can continue to successfully prosecute border crime cases along the Texas-Mexico Border.

Result: The District Attorney's Office will have the opportunity to receive additional resources to continue prosecution specifically in the area of organized crime / criminal enterprise cases.

d.   AI-7155    Discussion and possible action to approve a supplemental award in the amount of $60,000 from the Office of the Governor Homeland Security Grants Division for the Border Prosecution Grant. The supplemental award will be utilized to create a criminal investigator position. There is no matching funds required for this grant. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. e.   AI-7154    Discussion and possible action to authorize the acceptance of the first allocation of the High Intensity Drug Trafficking Areas Grant (HIDTA Program) from the Executive Office of the President, Office of National Drug Control Policy in the amount of $166,966 of the total $477,046 grant number for the continued salary and fringe benefits of seven Task Force Investigators; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Matching funds have already been committed for this grant in the amount of $100,121 through the budgetary process. Issue: There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.

Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.

Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.

f.   AI-7152    Discussion and possible action to approve the submission of a grant application to the Office of National Drug Control Policy for the continuation of a High Intensity Drug Trafficking Area (HIDTA) Grant estimated at $477,046 over the term of the contract. This formal request shall authorize the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. There is no cash match requirement for this grant; however, the District Attorney's Office requests matching funds to cover expenditures in excess of the grant award. The cash match in the amount of $100,121 is requested each year through the county's budget process. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. g.   AI-7146    Discussion and possible action to authorize the submission of a Fiscal Year 2019 Local Border Security Program (FY 19 LBSP) grant application as developed, written and submitted by Webb County Constable Pct. 3 Department to the office of Homeland Security Grants Division (HSGD) in the amount estimated at $50,000.00 for peace officers' overtime/applicable fringe benefits, fuel/vehicle maintenance and equipment. Grant funds shall be utilized to help provide enhanced border securtiy in Webb County and the Precinct 3 area, and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. This grant does not require a match; and thus, will not have and impact on the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Adrian Cortez, Webb County Constable Pct. 3]

Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fludidity of border crossings, heavy commercial activity, and interdependence of the international border communities' economies. These socio-economic  pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.

Solution: Grant application to provide enhanced border security in Webb County and the Precinct 3 area in order fulfill State of Texas Local Border Security Program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.

Result: Enhanced/increased patrol for certified peace officers working at Webb County Constable Pct. 3.
             
h.   AI-7150    Discussion and possible action to authorize the Economic Development Department to develop and submit a U.S. Department of Homeland Security, Fire Prevention and Safety grant application under the FY 2017 Assistance to Firefighters Grant Program for up to $50,000.00, and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request for Assistance to Firefighters Grant Program funding. If awarded this grant, Webb County Volunteer Fire Department will work in conjunction with the Texas A&M Colonias program to implement the goals of the grant. This application requires a five percent (5%) match, this will be in-kind provided by Webb County Volunteer Fire Department. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Fire safety campaign development to promote life safety initiatives by assisting rural households with early evacuation during home fires by providing smoke alarms.

Solution: Community risk reduction and education with the distribution of smoke alarms purchased through the AFG: FP&S grant and distributed to rural households.

Result: A more knowledgeable and better prepared rural population, aware of fire hazards, and provided an additional system for faster evacuation.

a.   AI-7151    Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code; Section 263.152 (Disposition) and authorizing the Purchasing Agent to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public.

Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through a and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.

Solution: Award the engineering contract in accordance with the adopted procurement rules for projects funded by the US Department of Transportation - Federal Highway Administration and monitored by TXDOT.
