Let it be remembered that a meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 6th day of March 2020. Present also were various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: The Texas Department of Housing and Community Affairs will be holding a Colonia Self-Help Center Workshop in Austin, Texas on March 24, 2020 through March 25, 2020.  The current balance in the Administrative Travel Account is insufficient to cover the travel costs for staff to attend this workshop.  Funds are also needed to advertise bid invitations and public hearing in the local newspaper.

Solution: Transfer funds to cover travel costs for staff and newspaper advertisements.

Result: Staff will attend workshop and receive necessary information and training regarding the Self-Help Center Program and required notices will be published in the local newspaper.

Issue: Line item transfer is needed to cover dues and membership that are annually budgeted but had an increase in cost for this fiscal year.  Dues and Membership payment is due before March 31, 2020.

Solution: With court approval of line item transfer, account will have the funds necessary to process payment of dues and memberships.

7.   Community Action Agency
             
a.   AI-10270    Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines. This position is grant funded by the Community Social Services Block Grant (CSBG).

Result: The filling os slot will allow department to effectively continue the flow of work for the Community Services Block Grant and the Comprehensive Energy Assistance Program.
             
8.   Economic Development
             
a.   AI-10241    Discussion and possible action to authorize the acceptance of the grant as developed, written, and submitted by the Webb County Sheriff’s Office for the 2020 National Crime Victims’ Right Week (NCVRW) Community Awareness Project (CAP) grant award in the amount of $5,000 from the Office for Victims of Crime (OVC); and designating the Webb County Judge as the authorized official to sign all relevant documents; and any other matters incident thereto. This grant requires no financial match; and, therefore, will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: The rights of crime victims are enshrined in the federal code (Section 3771 of Title 18 of the U.S. Code, Crimes and Criminal Procedure), the Texas Constitution (Article I Section 30), and the Texas Code of Criminal Procedure (Chapter 56). However, many victims of crime are unaware of their mandated rights as well as the services that are specifically available to them to facilitate needed restitution, recovery, privacy, dignity, and justice.

Solution: Grant funds to highlight the rights of and services for crime victims in the Laredo/Webb County area during the 2020 National Crime Victims’ Right Week.

Result: The general public and any victims of crime will become more aware of the services available to them in the Laredo/Webb County area.
             
b.   AI-10258    Discussion and possible action to approve Amendment #1 to Contract Number #61200003237 for the Community Services Block Grant Program (CSBG) from the Texas Department of Housing and Community Affairs (TDHCA) for the Program Year 2020, in the amount of One Hundred Forty-Four Thousand Five Hundred Twenty-Eight Dollars ($144,528.00). This Amendment #1 will increase funding from $82,736.00 to $144,528.00 and authorizing the County Judge to sign all relevant documents. This action will not have impact to the General Fund. All required documents were sent for review through the Economic Development Department and the solicitation with the Webb County Single Point of Contact (SPOC) procedures. [Requested by James Flores, CAA Executive Director and Economic Development]

Issue: Approve funding increase Amendment # 1  for the CSBG Program Grant from TDHCA for the Program Year 2020 in the amount of $144,528.00.

Solution: The Community Services Block Grant Program (CSBG) provides support services to eligible elderly, disabled and low income residents of Webb County.

Result: The support services are intended to assist eligible Webb County residents to transition out of poverty.
             
c.   AI-10259    Discussion and possible action to authorize the budget set up and expenditures of up to, but not more than, 50% of the forthcoming FY 2019 Operation Stonegarden grant award allocation in order to allow timely commencement of overtime operations for the Webb County Sheriff’s Office, the Offices of the Constables, Pct. 1-4, and the Webb County Attorney’s Office investigators; and any other matters incident thereto. Of the FY 2019 Operation Stonegarden total grant award allocation to Webb County, $2,277,567 has been allocated to the six (6) aforementioned Webb County law enforcement agencies. This grant requires no financial match; and, therefore, will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy.  [Requested by Martin Cuellar, Webb County Sheriff] 
 
Issue: Although the official grant performance period began on March 1, 2020, the FY 2019 Operation Stonegarden has not been official awarded by the funding agency.  However, the granting agency has authorized Webb County to spend up to, but not exceed, 50% of the FY 2019 Operation Stonegarden allocation issued out by FEMA. 

Solution:  Seek court authorization to have the budget set up and expenditures allowed for up to but not more than 50% of the FY 2019 Operation Stonegarden allocation. 

Result:  Overtime operations can commence in a timely manner.
             
d.   AI-10262    Discussion and possible action to submit Fiscal Year 2020 – 2021 Federal application 5311- 2020- WEBB CO- 00072 Rural Transit Grant for Webb County Community Action Agency- El Aguila to The Texas Department of Transportation (TxDOT) in the amount of Three Hundred Nine Thousand Sixty Four Dollars ($309,064.00). This grant includes a proposed County Match of 10% in the amount of Thirty Thousand Nine Hundred Seven Dollars ($30,907.00). All required documentation has been submitted for review to the Economic Development Department and the solicitation is compliant with Webb County Single Point of Contact (SPOC) procedures. [Requested by Mr. James Flores, CAA Executive Director; Account #2661- 5150- 337800 (Revenue Matching Funds)]

Issue: Webb Co CAA- El Aguila is a grant funded agency.
 
Solution: Application for Federal funds will benefit both administrative and operations expenses and will allow continued transportation service to the rural areas of Webb County.
 
Result: Continuation of transportation services throughout the rural areas of Webb County.

e.   AI-10263    Discussion and possible action to authorize the submission of a Fiscal Year 2020 Local Border Security Program (FY20 LBSP) grant application as developed, written and submitted by Webb County Constable Pct. 3 Department to the office of Homeland Security Grants Division (HSGD) in the amount estimated at $40,000.00 for peace officers' overtime/applicable fringe benefits, fuel/vehicle maintenance and equipment. Grant funds shall be utilized to help provide enhanced border security in Webb County and Precinct 3 area, and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. This grant does not require a match; and thus, will not have an impact on the general fund. All required documents were sent for review through the Economic Development and the solicitation is compliant with the Webb County single point of contact (SPOC) procedures. [Requested by Adrian Cortez, Webb County Constable Pct. 3] 

Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities' economies.  These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.

Solution: Grant application to provide enhanced border security in Webb County and the Precinct 3 area in order fulfill State of Texas Local Border Security Program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.

Result: Enhanced/increased patrol for certified peace officers working at Webb County Constable Pct. 3.
             
f.   AI-10264    Discussion and possible action to approve the acceptance of a grant award in the amount of $294,310, in response to an application submitted by the Webb County Sheriff’s Office in collaboration with the City of Laredo Health Department (MAT Provider), PILLAR (drug and alcohol screening and counseling), and the Webb County Community Supervision & Corrections Department (CSCD) from the Office of the Governor Criminal Justice Division for a FY 2020 Medication-Assisted Treatment (MAT) Pilot Program  to provide comprehensive Medication-assisted Treatment (MAT) and evidence-based services through a continuum of care model to a limited number of jail inmates who suffer from opioid dependence and/or alcohol and volunteer to participate in the program; and designating the Webb County Judge as the authorized official in all matters related to this grant; and any other matters incident thereto. This grant does not require any type of match and, thus, will have no impact on the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.  [Requested by Martin Cuellar, Webb County Sheriff]
 
Issue: The City of Laredo/Webb County is a medically underserved  community with a shortage of health professionals.  Furthermore, there are no significant detoxification centers and very limited substance use prevention/treatment programs available within 150 miles.
 
Solution: Start a grant-funded Pilot Program for Medication-Assisted Treatment and evidence-based services to a limited number of jail inmates for detoxification from their opioid and/or alcohol use.
 
Result: The community of Laredo/Webb County will have another resource to help its citizens deal with the critical epidemic of opioid dependency.
             
g.   AI-10269    Discussion and possible action to accept the Texas Community Development Program (TCDP) contract #7219095 from the Texas Department of Agriculture (TDA) in the amount of One Million Dollars ($1,000,000) grant funds and Two Hundred Thousand ($200,000) in matching funds for water system improvements in Mirando City and authorize Webb County Judge to sign all relevant documentation. This contract and agreement commences on February 1, 2020 and terminates January 31, 2022. [Requested by James Flores; Account #1001-1160-001-463904-015]

Issue: The Mirando City Water Supply Corporation has had numerous "deficiency findings" by the Texas Commission on Environmental Quality.

Solution: An increase in water volume by drilling an additional water well and water well system improvements for the Mirando City Water Supply Corporation will address this deficiency finding as per the Texas Commission on Environmental Quality.

Result: The performance of the water system improvements for the Mirando City Water Supply Corporation will address this deficiency finding.

9.   Planning & Physical Development
             
a.   AI-10308    Discussion and possible action to approve the PINNACLE INDUSTRY CENTER - FM1472, UNIT 10 PLAT subject to the following comments, and any other matters incident thereto.

1.  Update the description of the Offsite Easement 2 w recoding information.
2.  Provide financial guarantee acceptable to Webb County.

12.   Purchasing
             
a.   AI-10265    Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public and/or donated as permitted by law.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments.

b.   AI-10273    Discussion and possible action to authorize the Purchasing Agent to solicit formal Bids for master electrician services for an eighteen (18) month term ending September 30, 2021.
 
Issue: Currently, Webb County does not have a contracted electrician. County wide electrical services are exceeding $50,000 in the current fiscal year.
 
Solution: Authorize the Purchasing Agent to solicit for competitive sealed bids.
 
Result: Secure competitive bids and award to lowest responsible bidder(s).
             
d.   AI-10277    Discussion and possible action to approve the independent contractor agreement between Webb County and V.M. Golf Services, Inc., pursuant to the Court’s prior award of Request for Proposals (R.F.P. 2020-003 "Casa Blanca Golf Course Irrigation Project"), for the removal and installation on new irrigation equipment such as piping, electrical wiring and other related components, in an amount not to exceed $499,963.95, and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto. Issue: Commissioners Court secured bond series money to fund golf course improvements. The Purchasing Agent was authorized to solicit competitive sealed proposals for this project as per State law procurement rules.
 
Solution: Approve contract with highest ranking company as recommended by County staff to commence irrigation project.
 
Result: Awarded company can start the needed improvements to the County golf course. Irrigation improvements will help maintain greens and provide the Citizens of Webb County and their families a more presentable golf course.
