Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the virtual regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the18th day of March 2021. Present also were Mrs. Rosa E. Herrera, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: The Texas Veterans Commission approved a request to expand services available to veterans participating in the Veteran Treatment Court allowing participants to qualify for rental, mortgage and utility assistance using grant funds.

Solution: With Commissioners Court approval, funds that were previously allocated to support program will be used to directly support the success of veterans participating in the treatment court program.

Result: Providing direct financial support through payments made on behalf of the client, we will be able to allow veterans the opportunity to directly focus their attention on their treatment and court requirements and negate the burden of temporary employment displacement that they may encounter due to the current pandemic.

Issue: New proceeds under Chapter 59 of the Texas Code of Criminal Procedure have been awarded and may be spent by the Constable representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The Constable representing the State can utilize the new proceeds for the official use of his Office

Issue: Funds are needed to cover construction costs.

a.   AI-11656    Discussion and possible action to approve a Memorandum of Understanding between Webb County for the benefit of the Webb County District Attorney's Office and Homeland Security & Investigations for reimbursement of employee overtime incurred from joint law enforcement operations, for the performance period of October 1, 2020 through September 30, 2021, in the amount of Fifteen Thousand Dollars ($15,000.00). Issue: Collaboration between Federal, State and local law enforcement agencies is necessary to combat criminal organizations illegally exploiting America’s travel, trade, financial and immigration systems.

Solution: Accept Federal assistance to continue local participation in Homeland Security investigations, strategic initiatives and prosecution of organized crime.

Result: Disruption of organized criminal activity in Webb County and along the Texas border.

c.   AI-11687    Discussion and possible action to authorize the County Judge to sign a Division Order for the newly completed Webb County School Lands Wells, WCSL 504 #60H, 61H, and 62H (0.12500000 Interest) and any matters incident thereto; authorizing the County Judge to sign all related documents.

Issue: Division Order needs to be acknowledged for payment of royalty interest for producing wells to the School Land Fund.

Solution: Authorize County Judge to sign Division Order.

8.   Honorable Rosaura “Wawi” Tijerina, Webb County Commissioner Pct. 2
             
a.   AI-11689    Discussion and possible action to enter into an Agreement for Engineering Services with Porras Nance Engineering for design and construction administration services for the Welch Road Bridge in an amount not to exceed Forty-Seven Thousand Five Hundred Dollars ($47,500) and any matters incident thereto; authorizing the County Judge to sign all related documents. Issue: The Welch Road Bridge is impassable and a side road is being used to go around the damaged bridge structure.

Solution: The County's contribution of funds that would normally be paid to TxDOT for repair of bridges on the National Bridge System have been approved by TxDOT for a  Participation Waived Project for the design and re-construction of the bridge and an Engineering Services contract will provide for the plans, specifications and construction administration for a bridge/culvert.

Result: Plans, specification and construction administration will be acquired for the construction of a new culvert/bridge crossing.

9.   Community Action Agency
             
a.   AI-11666    Discussion and possible action to approve Amendment Number 1 to Contract Number 61210003468 -FY 2021 Community Services Block Grant Program (CSBG) from Texas Department of Housing and Community Affairs (TDHCA) in the amount of $440,518.00. This Amendment will add the second, third, and fourth quarter FY-2021 funds and our budget is FIVE HUNDRED EIGHTY EIGHT THOUSAND DOLLARS ($588,000.00) and authorizing the County Judge to sign all relevant documents. The Contract Term is January 1, 2021 through December 31, 2021. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact SPOC) procedures. This action will have no impact to the General Fund. [Account #2368-5170-3303000]

Issue: Approved funding $588,000.00 for the Community Services Block Grant (CSBG) from Texas Department of Housing and Community Affairs (TDHCA) for the Fiscal Year 2021.

Solution: This Grant Community Services Block Grant Program provides support to eligible elderly, disabled and low income residents of Webb County.

Result: The support services are intended to assist eligible Webb County residents to transition out of poverty.

b.   AI-11671    Discussion and possible action to authorize the Webb County Community Action Agency to enter into an annual agreement with Reliant Energy Retail Services, Limited Liability Company (LLC) for Consumers Affordable Resource for Energy (C.A.R.E.) Program. Reliant Energy is a certified Retail Electric Provider serving residential customers. Each year Reliant allocates funding to support its Consumers Affordable Resource for Energy (C.A.R.E.) Program. Within 60 days of receipt of this signed agreement, a completed IRS W-9 Form (required prior to first payment each year) Reliant will contribute $10,000.00 to the Agency in support of the 2021 Consumers Affordable Resource for Energy Program. Webb County Community Action Agency will utilize these funds to assist qualified Reliant Energy Retail Services clients and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This agreement will have no impact to the general fund. [Account #2368-5170-521-441210]

Issue: To approve to enter into an annual agreement with the Reliant Energy Retail Services, Limited Liability Company Program. The purpose of the contribution is to provide funding for energy assistance payment to Reliant Energy customers under the Consumers Affordable Resource for Energy Program (C.A.R.E.)

Solution: As per the letter of agreement from Reliant Energy Retail Services, Community Action Agency will be receiving a contribution of $10,000.00. The contribution will be providing funding for energy assistance payment to Reliant Energy customers under the Consumers Affordable Resource for Energy program (C.A.R.E.)

Result: Community Action Agency will accept the enrollment applications from potential clients and qualify Reliant Energy customers as eligible recipients in accordance with Reliant Energy Consumers Affordable Resource for Energy (CARE)  program requirements.
             
c.   AI-11667    Discussion and possible action to proclaim April 2021 as the 52nd Anniversary of Fair Housing Month, April 13-17, 2021 as Fair Housing Week and designating the Webb County Community Action Agency to monitor Fair Housing Webb County.

Issue: In order to continue to apply for grants, it is a federal requirement that Webb County promotes Fair Housing within its jurisdiction.

Solution: Promotion of Fair Housing in Webb County abd designating a week during the month of April will help citizens of Webb County to know their legal rights in housing discrimination.

Result: The federal requirement for Fair Housing will be me by promoting Fair Housing within Webb County's jurisdiction. This will allow Webb County to continue to apply for grants.
             
10.   Honorable Esther Degollado, District Clerk
             
a.   AI-11694    Discussion and possible action to enter into a historical civil and criminal file preservation project agreement/Phase IV, between Webb County for the District Clerks Office and Kofile Technologies, Inc. for an amount not to exceed $208,460.62, pursuant to the Texas Local Government Code; Section 271.103, Subchapter G (Purchases from Federal Schedule Sources of Supply), GSA Contract No. GS-35F-275AA, and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. [Account #2009-2290-001-460105 (Court Technology Fund-District Clerk-Administration - Minor Tools & Apparatus)]
 
Issue: Due to the historical nature and continued physical deterioration of these 7 boxes (out of the remaining 58) of the Webb County Historical Civil and Criminal Case Files, and the required permanent retention period requirements as per the Texas State Library & Archives Commission, 2011, these historical civil and criminal file records stored and located at the Webb County District Clerk’s Office need to be properly preserved, remediated, protected, archived, microfilmed and stored in order to prevent any further deterioration by providing for surface cleaning, tear repairs, removal of deposits, including dust, soot, airborne particulates, sedimentation, insect detritus, and/or biological mineral contaminants, archival imaging, indexing, microfilming, and binder storage of these files.
 
Solution: Approval of this Webb County Historical Civil and Criminal Case Files Preservation Project Agreement with Kofile Technologies, Inc., will provide for the proper preservation, archival imaging, indexing, and storage of these historical civil and criminal case files and records at the Webb County District Clerk’s Office.  Acquiring these services under a GSA contract will satisfy any State law requiring local governments to seek competitive bids for purchases of goods or services.
 
Result: Historical Civil and Criminal Case File preservation and physical deterioration preventive measures will ensure that these files and records are properly preserved, cared for and maintained by the Webb County District Clerk’s Office.

11.   Economic Development
             
a.   AI-11654    Discussion and possible action to authorize the acceptance of a 2021 National Crime Victims’ Right Week (NCVRW) Community Awareness Project (CAP) grant award in the amount of $5,000 from the Office for Victims of Crime (OVC) as developed, written, and submitted by the Webb County Sheriff’s Office, and designating the Webb County Judge as the authorized official to sign all relevant documents; and any other matters incident thereto. This grant requires no financial match, and, thus, will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: The rights of crime victims are enshrined in the federal code (Section 3771 of Title 18 of the U.S. Code, Crimes and Criminal Procedure), the Texas Constitution (Article I Section 30), and the Texas Code of Criminal Procedure (Chapter 56). However, many victims of crime are unaware of their mandated rights as well as the services that are specifically available to them to facilitate needed restitution, recovery, privacy, dignity, and justice.

Solution: Grant funds to highlight the rights of and services for crime victims in the Laredo/Webb County area during the 2021 National Crime Victims’ Right Week.

Result: The general public and any victims of crime will become more aware of the services available to them in the Laredo/Webb County area.
             
b.   AI-11659    Discussion and possible action to authorize the acceptance of a High Intensity Drug Trafficking Areas Grant (HIDTA Program) from the Executive Office of the President, Office of National Drug Control Policy in the amount of $530,150 for the continued salary and fringe benefits of seven Task Force Investigators; and authorizing the Webb County Judge to act as the County’s Executive Officer and Authorized Representative in all matters pertaining to the County’s participation in this grant. There is no cash match requirement for this grant; however, the District Attorney's Office requests additional funding in the form of cash match to cover expenditures in excess of the grant award. The cash match in the amount of $100,125 is requested each year through the county's budget process. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract Term: January 1, 2021 to December 31, 2021. [Requested by Isidro "Chilo" Alaniz, District Attorney; Account #1001-1160-001-463903-025 (Federal Matching Narcotics Task Force DEA)]

Issue: There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.

Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.

Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.

c.   AI-11673    Discussion and possible action to authorize the ratification of acceptance of the Self-Help Center Contract #7220013 grant award in the amount of $700,000 from the Texas Department of Housing and Community Affairs, and designating the Webb County Judge as the authorized official to sign all relevant documents; and any other matters incident thereto. All required documents were sent for review through the Economic Development Department and were found to be in compliance with the Single Point of Contact (SPOC) policy. [Requested by Community Action Agency]

Issue: A resolution was passed by the Commissioners Court on May 26, 2020 authorizing the submission of the grant proposal and appointing the Webb County Judge as the authorized signatory for all relevant contract documents. The County Auditor's office is requesting an agenda item in addition to the Resolution ratifying the acceptance of this grant award.     

Solution: Approve the ratification of acceptance of the Self-Help Center Grant, Contract #7220013.

Result: Self-Help Center Grant funds will be available to continue assistance through this grant.

Result: The approval of the purchase will allow the Justice of the Peace Court Pct. 1 Pl. 1 to continue to function efficiently and effectively.

Issue: International criminal organizations deftly exploit traditional jurisdictional boundaries across geographic areas and among different types/levels of law enforcement agencies, such as federal, state and local agencies, in order to carry on their illicit, highly lucrative and dangerous smuggling enterprises.

Solution: The Webb County Sheriff’s Office and federal agencies, such as the U.S. Department of Immigration and Customs Enforcement (ICE), seek to work collaboratively to conduct joint operational/task force objectives in order to disrupt the illegal activities regarding the illegal importations, distribution, manufacture and possession of illegal narcotics.

Result: Investigators from the Webb County Sheriff’s Office will be able to work cooperatively with ICE federal agents in conducting undercover operations, utilizing confidential informants, participating in special enforcement operations and conducting contraband smuggling investigations in order to detect, disrupt, deter, and help dismantle the illicit activities of these international criminal organizations.

Issue: Due to a miscommunication the golf courses' annual budget for fiscal year 2021 was not submitted timely and defaulted to fiscal 2020 budget. Casablanca Por shop has been selling significantly more goods than budgeted in fiscal year 2020 continuing into fiscal year 2021. The numbers above show final sales for FY 2020 and for the past three months into FY 2021. FY 2020 total was $77,476.00. FY 2021 currently were tracking close to $140,000.00 in sales for FY 2021.

25.   AI-11652    Discussion and possible action to authorize the Economic Development Department to submit a fiscal year 2022, multi-year grant application to the Texas Commission on Indigent Defense. The purpose of the grant is to request funding for staff and the possibility to purchase video-conferencing software and devices for the weekend magistrate process concerning the appointment of attorneys to indigent offenders that qualify. The necessary documents have been submitted for review to the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Webb County must provide a cash match 20% of the total project costs in the first funding year, 40% the second year, 60% the third funding year and 80% the fourth funding year. 

Issue: Webb County has implemented a weekend magistrate process at our jail. The Pre-Trial Services Department has been delegated to take charge of the manpower needed to support the appointment of attorneys to indigent offenders that qualify at the front-end of the magistrate process during the weekend.  This hinders our limited staff to provide effective, efficient and adequate services to indigent clients, the Courts and our office during our normal regular business hours of operation.

Solution: The acquisition of the grant funds will offset the Webb County personnel expenses for a period of four years and will provide adequate staffing for the weekend and our normal hour of operations. This will also eliminate Pre-Trial Services employees from earning accrued comp-time hours, that the county pays out, if an employee resigns. 

Result: Webb County is required to be in compliance with all local and state legislative mandates concerning indigent defense in order to continue to receive the Formula Grant Funding.
