Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 9th day of April 2015. Present also were Ms. Virginia Martinez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

County Auditor, Mr. Leo Flores presented the monthly report for March 2015.

AI-2585  Status report from county auditor regarding the allocation of monies for Fiscal Year 2014-15 to fund the contractual obligations, as stated by the Auditor, to comply with the Sheriff Deputies Collective Bargaining agreement; report to include amount of funds required and what line items were impacted; and any other matters incident thereto.

4. Approval of Bills, Payroll, and Monthly Report
  County Treasurer's Office, Mr. Cesar Guerra presented the checks to be approved for April 13, side bills, ratification of payroll for March 25 and April 10, and ratification for two (2) checks for $662 for Armandina Garcia for $597 and Today Craft for $65 pending approval.

5. Communications

Cmr. Canales sent out his heartfelt condolences to the family of Jesus M. Gutierrez, Sr., Jose Molina, Mario S. Martinez, Dr. Jose G. Garcia, and Grisell Garza Gongora. He congratulated United South High School Powerlifting Team on winning the 3rd place team trophy for the State of Texas High School Powerlifting Team Championships in Abilene, Texas on April 4. Cmr. Canales congratulated the Nixon High School senior, Marco Banda for claiming his first state title in the Division 1 6A and 5A 220 pounds weight class at the State Powerlifting Meet in Abilene, Texas. He congratulated United Middle School 6th grade student Kiren Malik on winning the 2015 Scripps Regional Spelling Bee. Cmr. Canales congratulated United High Lady Longhorns Golf Team on winning the District 29 6A title for seven years in a row. He congratulated LCC Performing Arts Department for hosting their dance and percussion concert. Cmr. Canales congratulated all Webb County radio dispatchers for being honored this week by the Sheriff's Office for Telecommunicator's Week. He congratulated Judge Beckie Palomo on her Sobriety Treatment Court Program Graduation coming up this Friday. Cmr. Canales invited all county employees to attend the 9th Annual Employee Appreciation Luncheon being held on Wednesday, April 15 from 11:30 a.m. to 1:30 p.m. at the courthouse.

Cmr. Galo mentioned that April is Autism Awareness Month. He congratulated Jesus Olivares for being chosen as the new Laredo City Manager. Cmr. Galo congratulated UISD Youth of Month winners; Walker Brown, Alexander High School, Hilda Martinez, LBJ High School, Jorge Arturo Solis, United High School, and Jonathan Pena, United South High School. He congratulated Gold Star Family; Francisca Martinez, Alicia Sosa Herrera, Yolanda Padilla Garcia, and Yolanda Venegas. Cmr. Galo congratulated the Laredo Commission of Women for recently inducting 101 honorees to their hall of fame. He congratulated Casa de Misericordia for hosting a fundraiser to help women and children victims of domestic abuse. Cmr. Galo congratulated the local Boy Scouts for kicking off their fundraiser with the community friends of scouting. He congratulated UISD League of Legends for United High School. Cmr. Galo congratulated all the students who competed in the 2015 Regional Final Spelling Bee and the winner United Middle School 6th grader Kiran Malik. He thanked all the TAMIU volunteers and the Love Committee for helping the South Texas Food Bank. Cmr. Galo congratulated all the young women and men of the Society of Renaissance who recently named their new duchesses and dukes. He congratulated Ms. Bonnie J. Tijerina for holding the District Title 5 in 1 for the United High School Softball Team. Cmr. Galo congratulated Beatriz Bea Benavides for recently signing a letter of intent with Sewanee University to play Division 3 Tennis. He congratulated United High School student, Erika Corona for winning a gold medal in the 110 meter and the 300 meter hurdles. Cmr. Galo congratulated Alexander High School student, Aisha Mohammed for winning All-State Honors for the third year in a row. He congratulated United Middle School Longhorn Basketball Team for winning 1st in the YBOA National Championships. Cmr. Galo congratulated Clark Middle School Lady Huskies for becoming the 2015 Basketball City Champs. He congratulated LULAC No.12 for recognizing Congressman Luis Gutierrez. Cmr. Galo reminded everyone of the Webb County Employee Appreciation Luncheon. He sent out his heartfelt condolences to the family and friends of George Neel, Javier Molina, Consuelo "Connie" Raymond Kazen, Maria de Jesus Ramos, Elsa Caso Martinez, Mario Martinez, Sr., Emma Grainger, Enrique Serna, Jr., Randy Falk, Grisell Garza Gongora, and Dr. Jose G. Garcia.

Cmr. Tijerina congratulated Jesus Olivares for be appointed as City Manager for the City of Laredo. She congratulated Cmr. Jaime Canales and Boy Scout Tristan Melendes on the ribbon cutting of the Ladrillito Activity Center in West Laredo. Cmr. Tijerina congratulated District Attorney, Chilo Alaniz for being honored as a Paul Harris Fellow by the Laredo Rotary Club. She congratulated Vidal Cantu on his outstanding freshman year at Texas A&M University College Station. Cmr. Tijerina welcomed and congratulated Chief Patrol Agent Mario Martinez, Laredo Border Patrol. She congratulated Diana Rendon and her All Star Dance Academy for bringing home five grand championship trophies. Cmr. Tijerina congratulated the family of Roberto Castro for having the LISD Lamar Middle School Gymnasium named after him in honor of his service to the school district. She congratulated Laredoan Jose Alfredo Perez, sophomore football player at the Southwestern University for being chosen as a representative for the NCAA Division 3 Student Athlete Advisory Committee. Cmr. Tijerina congratulated Judge Tijerina's daughter, Bonnie Tijerina on such a great job. She congratulated the Laredo Commission for Women on the 20th Anniversary of the Women's Hall of Fame. Cmr. Tijerina announced that the Community Action Agency currently has funds available for CDL training classes. She congratulated United Middle School student, Kiran Malik for winning the 2015 Regional Final Spelling Bee. Cmr. Tijerina congratulated the Women's City Club for another successful Sundays with Style Fashion Show. She congratulated the Laredo Medical Auxiliary for being honored on March 31 as the eighth recipient of the LCC President's Beacon Award. Cmr. Tijerina congratulated HEB on their 110th Anniversary. She congratulated Alexander High School Baseball Head Coach Mario Garcia on their 300th win. Cmr. Tijerina mentioned that the Laredo Webb County Domestic Violence Coalition will be presenting a resolution. She invited everyone to join the Webb County Sheriff's Office on their National Crime Victims Right Week on April 19 through April 25. Cmr. Tijerina congatulated Sheriff Martin Cuellar Commander, Ponce Trevino, and Webb County Jail Personnel on their perfect score received by the Texas Commission on Jail Standards. She wished all dispatchers a Happy National Telecommunications Week. Cmr. Tijerina reminded all employees that the Administrative Services Department would be hosting the G.I.F.T.S. on Thursday, April 16 at 5:30 p.m. She congratulated Alexander High School senior, Abhishek Gurnami on becoming the four time District Champion for District 29-6A on Tennis. Cmr. Tijerina congratulated the eight cancer survivors who have been chosen as ambassadors for the American Cancer Society Relay of Life event; Christian Angel Ramos, Pete Lara, Martha Ibarra, Ernesto Elizondo Elizarde, Armando Vega, Cassy Seca, Martha Gutierrez, and Dr. Maria Luisa Ortiz Cabrera. She sent out her heartfelt condolences to the family of George Neel, Consuelo Kazen, Aida Garza, Javier Molina, Pamela Andrews Rodriguez, Alicia Ramos, Juan Melendes, Maria de Jesus Novoa Ramos, Beverly Cantu, Lorraine Villarreal, Brother Tom Leonel Laurel, Enrique Serna, Elsa Caso Martinez, Dr. Jose Garcia, Grisell Garza Gongora, and Randy Falk.

Cmr. Sciaraffa welcomed everyone present. He congratulated all his directors and staff from all the community centers for their efforts during the Easter Holiday. Cmr. Sciaraffa congratulated County Attorney, Marco Montemayor for being recognized by the United ISD League of Legends. He congratulated Judge Tijerina for all his efforts during Autism Awareness Month. Cmr. Sciaraffa congratulated Judge Tijerina's daughter Bonnie Tijerina on all her athletic accomplishments.

Judge Tijerina reminded all employees to the Employee Appreciation Luncheon to be held on April 15. He thanked Congressman Henry Cuellar on the great he is doing on Capital Hill. Judge Tijerina mentioned that April is Child Abuse and Sexual Assault Awareness Month. He congratulated Cmr. Jaime Canales for the grand opening of the Ladrillito Community Center. Judge Tijerina congratulated the United South High School Cheerleaders for being named National Champions. He thanked the AT&T in San Antonio, Texas for their hospitality during Laredo Day. Judge Tijerina sent his heartfelt condolences to the family of Dr. Jose Garcia, Grisell Garza Gongora, George Neel, and all those who have lost a loved one. He reminded everyone that on April 30 the new campaign begins to stop the use of plastic bags. Judge Tijerina congratulated Cmr. Tijerina for being selected as an inductee for the Commission of Women. He congratulated Coach Mario Garcia for his 300th win. Judge Tijerina congratulated the Sheriff's Department for passing the jail inspection. He congratulated County Attorney, Marco Montemayor for being recognized as a Longhorn Legend.
             
6. Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member will be allowed a total of Three (3) minutes within which to make any/all public comments.

33. AI-2584  Discussion and possible action to instruct the Engineering Department, in coordination with the County Attorney, to resume the Roadway Right-of-Way acquisition process on pending properties on Colonias "Ranchitos Los Centenarios", "Los Fresnos", "Los Arcos", "Los Nopalitos" and Los Mesquites" to help and improve the road conditions for the residents of these Colonias.

Issue: These Colonias were platted in 1985 with 30 feet wide access road easement between existing lots. Residents living in these areas are requesting help from Webb County to build roads for better access to their properties.

Solution: Engineering Department to request, from the existing property owners, the acquisition by donation of the necessary parcel of land, to increase from 30 feet to 50 feet wide.

Result: Meet compliance with State Laws and Model Subdivision rules and provide the residents of these Colonias with Public Roads that will be maintained by Webb County. Roads will provide better access to their homes and to mobile units of public entities such as: School buses, Emergency vehicles, trash collection, etc.

Result: Line item transfer will help cover all these expenses in order to operate office efficiently.

AI-2571  Discussion and possible action to accept the recommendation of the Webb County Community Action Agency (CAA) Advisory Board Program Evaluation Committee to approve the following Texas Department of Housing and Community Affairs-Community Services Block Grant (CSBG) Program CDL Truck Driver Training Classes Service Provider bids and authorize the County Judge to sign all relevant documents pertaining to this contract. This action will not impact the General Fund. [Requested by Juan Vargas, Executive Director for Webb County CAA and Economic Development]

Issue: Webb County is contractually obligated for under CSBG grant monies to transition people out of poverty.

Solution: Service Provider  LHCT Training Center would conduct CDL Training acquisition. 

Result: By acquiring the CDL license client would be able to commence employment at and annual income of $45,000 and transition out of poverty.

Purchasing Agent, Dr. Cecilia Moreno stated that there was only one provider who submitted a bid for RFP 2015-011 awarded to LHCT Training Center.

AI-2577  Discussion and possible action to authorize Webb County, as Trustee for Webb County School Lands to grant a permit to MicroSeismic, Inc., (M.S.I.), to conduct geophysical survey operations (2-D Type) together with right of ingress and egress across the mineral (oil & gas) interests owned by Webb County School Lands, located on Texas State Hwy. 83 North in N.W. Webb County, also known as Prospect Lewis Energy-Owen, Permit No. 101.

Issue: The purposes of the survey are the acquire 2D seismic data for research purposes in development of a new imagining technique and are non-commercial in nature.

AI-2578  Discussion and possible action to enter into a Interlocal Agreement between Webb County on behalf of the Webb County Sheriff’s Office and the City of Laredo acting on behalf of the Laredo Police Department to enter into an agreement with Operation Stonegarden (“OPSG”) funded by the Department of Homeland Security (“DHS”) and led by the Customs and Border Protection Border Patrol to support overtime, fringe benefits, certain pre-approved law enforcement equipment for operational purposes and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. Issue:  Although immigration matters, including illegal immigration, are constitutionally established as existing under the legal jurisdiction and regulation of the federal government, state prisons and local detention facilities, such as the Webb County jail, incurs significant costs incarcerating undocumented foreign aliens who commit crimes in the United States. This includes but is not limited to supervision, housing, feeding, clothing, any medical and transportation expenses, and other associated detention costs.

Solution:  Grant application to obtain reimbursement of a small percentage of the incurred correctional officer salary costs associated with detaining undocumented criminal aliens who had at least one felony or two misdemeanor convictions for violations of state or local law and who were incarcerated at the Webb County jail for at least four (4) consecutive days during the reporting period of July 1, 2013 to June 30, 2014. 

Result:  Webb County will be reimbursed by the federal government a limited percentage of the amount of its already incurred costs of detained foreign criminals incarcerated at the Webb County jail.

43. AI-2561  Discussion and possible action to award Request For Proposals (RFP's) 2014-04 "Rio Bravo Regional Wastewater Treatment plant Chlorine System Replacement" to Environmental Improvements Inc.

Issue: Replacement and rehabilitation of existing equipment

Solution: The replacement and rehabilitation of existing equipment will return to service the initial design of the Chlorination facilities as its original operation.  And provide a safe but effective dosage of the Plant’s effluent discharge, and enabling us to comply with State requirements, eliminated additional violations.

Result: Compliance with TCEQ requirements and safe use of Chlorine gas for our employees and neighbors.

Issue: Webb County lacks approved policies and procedures on expenditure for non-travel meals, refreshments and related expenses.

Solution: An approved policy and approved procedures will allow for timely purchases.

Result: An approved policy and procedures will provide for timely payment of purchase orders and inform all users of allowable expenses.
