Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 2:30 p.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 19th day of April 2019. Present also were Ms. Vanessa Zapata, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. 4.   AI-8886    Discussion and possible action to enter an Order of the Commissioners Court declaring a public use, namely; the construction of roadway improvements in order to alleviate flooding concerns and provide safe ingress and egress to the Las Lomas Subdivision, and the necessity to acquire an easement for Public Roadway Right-Of-Way Purposes, and for the construction, laying, installation, operating, repairing and maintaining of drainage improvements and other public utilities (including, but not limited to, drainage structures of all types, and water, sewer, telephone, gas, electric and cable lines, and all related, necessary or desirable appurtenances) in perpetuity, in, under and across the following described property in Webb County, Texas: A 0.2287 Acre Tract being out of and part of Tract 24, Ranchito Las Lomas Subdivision Recorded in Volume 3, Page 13a, Plat Records Of Webb County, Texas and further authorizing staff to negotiate with the owners for the acquisition of said parcel by purchase at its market value established by an independent state certified real estate appraiser; and authorizing the Civil Legal Division to initiate condemnation proceedings to acquire said parcel if staff is unable to acquire due to inability to agree to a purchase price, conflict of ownership, owner refusal to sell, and/or inability to locate a listed owner; and any matters incident thereto.

5.   AI-8887    Discussion and possible action to enter an Order of the Commissioners Court declaring a public use, namely: the construction of surface drainage improvements in order to alleviate flooding concerns and provide safe ingress and egress to the Las Lomas subdivision, and the necessity to acquire a DRAINAGE EASEMENT across the following parcel necessary to advance the project: being a 1.2856 acre tract across and out of Tract 40, Ranchito Las Lomas Subdivision recorded in Volume 3, Page 13a, Plat Records Of Webb County, Texas and further authorizing staff to negotiate with the owners for the acquisition of said parcel by purchase at its market value established by an independent state certified real estate appraiser; and authorizing the civil legal division to initiate condemnation proceedings to acquire said parcel if staff is unable to acquire due to inability to agree to a purchase price, conflict of ownership, owner refusal to sell, and/or inability to locate a listed owner.

9.   AI-8892    Discussion and possible action to authorize the submission of a revised List of Transportation Infrastructure Projects (Prioritized List) to the Texas Department of Transportation for the County Transportation Infrastructure Fund (CTIF) Grant Program to include Eagle Pass Road and the realignment of Wormser Road east of Loop 20 and authorizing the County Judge to sign all relevant documents. 10.   AI-8895    Discussion regarding the current moratorium on tax abatements in Webb County with possible action to form a committee to review, update and modify current tax abatement guidelines, and any other matters incident thereto. [Requested by Tano E. Tijerina, County Judge]
 
Issue: Commissioners Court imposed a moratorium on all tax abatements within the county until tax abatement guidelines could be updated. 
 
Solution: By forming a committee and holding possible workshops, tax abatement guidelines can be reviewed, updated and modified to be better aligned with economic development opportunities in Webb County. 
 
Result: Tax abatement guidelines will be updated and current moratorium can be lifted to allow for further economic development in Webb County.

11.   AI-8889    Presentations by the two (2) Banks that submitted a proposal for the Depository Bank contract with Discussion and possible action to award Request for Application (RFA) 2019-001 “Bank Depository for Webb County” in accordance with the Texas Local Government Code, Chapter 113 (Management of County Money), Chapter 116 (Depositories for County Public Funds) and Chapter 117 (Depositories for Certain Trust Funds and Court Registry funds) and further authorizing the County Judge to sign all relevant documents and any other matters incident thereto.
 
Issue: The current Depository Bank contract expires at the end of May of 2019.  Commissioners Court authorized the solicitation of proposals for a Bank Depository contract.  All Banks within the boundaries of Webb County with home offices or branch facilities were invited to participate; only two (2) banks submitted a formal RFA.
 
Solution:  Interview the two (2) banks in order to determine which financial institution would serve Webb County the best as their designated bank depository.
 
Result: Award a new contract for a term of four (4) years with a two (2)-renewal term or any other term as approved by Commissioners Court in accordance with State law.
  President of Commerce Bank, Mr. Ignacio Urabazo presented proposal to the Commissioners Court.
  Senior Executive Vice-President of Falcon International Bank, Mr. Roy Gonzalez presented proposal to the Commissioners Court.
