Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 10th day of May 2024. Present also were Ms. Amber Lecea, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda. It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion. Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: Proceeds from equitable shared funds from the U.S. Department of Justice may be spent after a budget for the expenditure of the expenditure of the proceeds has been submitted to the governing body.

Solution: Submit a breakdown of monies distributed to the governing body that clearly list and defines the categories of expenditures.

Result: These funds will be available for official use to meet the needs of the office.

6.   Civil Legal Division
             
a.   AI-16164    Discussion and possible action to enter into a personal services contract with Timothy J. Tubbs for law enforcement consulting work, in accordance with Texas Local Government Code 262.024 (Discretionary Exemption) (a.) (4.) Personal Services for a performance period of Twelve (12) months at a cost of Eight Hundred Dollars ($800.00) per month, effective June 1, 2024 through May 31, 2025, for an amount not to exceed $9,600, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This professional services contract will be paid through forfeiture funds; and, thus, will have no impact to the general fund. [Requested by the Webb County Sheriff's Office, Account #2152-3010-001-432001 (Professional Services)]

Issue: The Webb County Sheriff's Office requires the services for specialized law enforcement training and Intel gathering.

Solution: Enter into contract for Intel gathering and specialized training. 

Result: The Webb County Sheriff’s Office will receive specialized training for law enforcement personnel, provide support with ongoing and future investigations, provide recommendations on standard operating procedures, consult on Border Security issues and serve as an advisor/liaison with federal, state, and local law enforcement authorities, provide research and recommendations concerning US federal and state legislative issues.

8.   Community Action Agency
             
a.   AI-16145    Discussion and possible action to enter into a two-year (May 13, 2024 to May 12, 2026) service agreement between Webb County and Grace CDL Truck Driving School, Inc., wherein said Truck Driving School will provide entry level CDL driver training to eligible Webb County residents referred to said Driving School by Webb County Community Action Agency with an enrollment fee to be paid by Webb County of Two Thousand Eight Hundred Fifty Dollars ($2,850.00) per student for a four (4) week course and authorizing and any matters incident thereto; authorizing the County Judge to sign all relevant documents. Issue: As a Texas Department of Housing and Community Affairs requirement, the agency must assist qualifying Webb County residents to transition out of poverty.
 
Solution: Webb County Community Action Agency would enter into service agreement and fund the Truck Driver Training Classes under the Grace CDL Truck Driving School, Inc.
 
Result: By providing the training to qualifying Webb County residents, it would increase the resident's probability of transitioning out of poverty.

b.   AI-16147    Discussion and possible action to accept and execute FY 22-23 Federal Rural Public Transportation Capital Grant; 5339-R-2022-WEBB CO-00011 from Texas Department of Transportation. The extension is to May 31, 2025, to allow carryover of FIFTEEN THOUSAND FIFTY-THREE DOLLARS ($15,053.00). No impact to General Fund. All required documentation has been submitted to the solicitation is compliant with Webb County (SPOC) Single Point Contact Procedures.

Issue: Rural Public Transportation is a grant-funded agency.

Solution: Through the capital carryover by Webb County, will allow the department to exhaust all funds.

Result: Approval of capital contract carryover will ensure continuation of transportation services to the rural areas of Webb County.

c.   AI-16149    Discussion and possible action to approve and execute FY 2023 STATE-R-2023-WEBB CO-000145 amendment for Webb County Community Action Agency - El Aguila Rural Transportation from the Texas Department of Transportation (TxDOT) in the amount of EIGHTY FIVE THOUSAND DOLLARS ($85,000) from administration to operations. This grant does not require a County match. All required documentation has been submitted to the solicitation to comply with Webb County (SPOC) Single Point Contact Procedures.

Issue: Rural Public Transportation is a grant-funded agency.

Solution: Through this amendment, Webb County will allow the department to exhaust all operational funds.

Result: Approval of the contract amendment will ensure continuation of transportation services to the areas of Webb County.

d.   AI-16198    Discussion and possible action to approve the acceptance of amendment #1 to Contract #61240004152 for the Community Services Block Grant (CSBG) from the Texas Department of Housing and Community Affairs (TDHCA) for the Program Year 2024 and authorizing the County Judge to sign all relevant documents. This amendment is a grant increase in the amount of Two Hundred Sixty-Eight Thousand, Two Hundred Sixteen Dollars ($268,216.00). This action will not have an impact to the County General Fund. Documentation has been reviewed by Webb County Economic Development Department and is in compliant with SPOC policies and procedures. [CAA Social Services Account #2368-5170-521]

Issue: TDHCA has awarded a grant increase under the CSBG program in the amount of $268,216.00.

Solution: The Court approval of CSBG Amendment #1 will benefit both operations and administrative expenses.

Result: Webb County CAA Social Services will continue to provide direct services to eligible low-income residents of Webb County under the CSBG program.

9.   Economic Development
             
a.   AI-16151    Discussion and possible action to approve Change Order No. 1 for the Texas Department of Housing and Community Affairs Resiliency Program Grant Contract No. 70800001013 for an increase of 10 days to the contract with AOC Calton, Ltd. d/b/a Summit Building & Design for the Southern Health Facility, due to rain days and difficulty accessing property and further authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto.

Issue: Contractor experienced rain days that delayed construction, as well as had issues accessing the property.

Solution: Approve change order that will allow the contractor to have extra days to finish construction.

Result: Contractor will finish construction within contract timeframe.

b.   AI-16144    Discussion and possible action to submit FY 2024 Federal Application 5339-R-2024- WBB CO 00044 from Webb County Community Action Agency to the State of Texas through IGX (TxDOT website) in the amount of EIGHTY-FOUR THOUSAND SEVEN HUNDRED FIFTY DOLLARS ($84,750.00) acting through Texas Department pf Transportation wherein Webb County El Aguila Rural Transit will be applying by meeting desire deadlines. All required documentation has been submitted to the Economic Development Department for review and were found to be complaint with the Single Point of Contact (SPOC) policy. c.   AI-16160    Discussion and possible action to authorize the acceptance of a High Intensity Drug Trafficking Areas Grant (HIDTA Program) from the Executive Office of the President, Office of National Drug Control Policy in the amount of $530,150 for the continued salary and fringe benefits of seven Task Force Investigators; and authorizing the Webb County Judge to act as the County’s Executive Officer and Authorized Representative in all matters pertaining to the County’s participation in this grant. There is no cash match requirement for this grant; however, the District Attorney's Office requests additional funding in the form of cash match to cover expenditures in excess of the grant award. The cash match is in the amount of $148,000 for the county's budget process. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.
 
Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.
 
Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.

d.   AI-16192    Discussion and possible action to accept grant funding and enter into an agreement with the U.S. Department of Housing and Urban Development (HUD) under Fiscal Year 2024 Economic Development Initiative (EDI) - Community Project Funding (CPF) for the project, State Highway 359 Colonias Street Improvements Project for $500,000. This grant award does not require a county cash/in-kind match.
 
Issue: The US Department of Housing & Urban Development awarded $500,000 to Webb County for the 359 Highway Colonias Street Improvement Project.
 
Solution: Webb County accepts $500,000 from the US Department of Housing & Urban Development for the HWY 359 Colonias Street Improvement Project.
 
Result: The US Department of Housing & Urban Development award will allow roadway improvements adjacent to Hwy 359. The Economic Development Department will ensure compliance with requirements from the funding agency.

e.   AI-16199    Discussion and possible action to authorize Community Action Agency to develop and submit an application for the Emergency Food Grant in the amount of Fifteen Thousand Dollars ($15,000) from Emergency Food and Shelter Program (EFSP) 2024 Phase 41 and authorizing the County Judge to sign all relevant documents. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: There is a greater demand for food assistance in the area of Webb County than there is funding.

Solution: Webb County CAA seeks to address the hunger needs of the community by applying for the Emergency Food Grant provided by EFSP.

Result: If awarded the grant, Webb County Community Action Agency will be able to continue assisting a potential of 500 eligible households with emergency meals.

10.   Fire Suppression & EMS Services
             
a.   AI-16163    Discussion and possible action to accept EMS County Assistance, first allocation of lapsed funds provided through the Seven Flags Regional Advisory Council (RAC) Trauma Service Area "T" in the amount of $19,686.82, to be utilized in the purchase of EMS/materials & supplies, training, travel, personnel cost, membership to professional/technical organizations, public education, vehicle maintenance and equipment for all stations of the Webb County Volunteer Fire Department, and authorizing the County Judge to sign all relevant documents; and any other matter incident thereto. [Accounts #2929-3140-001-456305; #2929-3140-001-464010; #2929-2140-001-460105 & #2929-3140-001-461000]

Issue: State funding provided through Seven Flags RAC for EMS needs/operations.

Solution: Accept funds, and utilize monies for purchase of supplies, training, travel, equipment and its maintenance.

Result: Properly stocked emergency units ready for response, and well-prepared personnel.

13.   Planning & Physical Development
             
a.   AI-16177    Discussion and possible action to issue a “Certificate of Compliance with Plat Requirements” to authorize an electrical service connection pursuant to Section 232.028(b)(2), & (b)(3), L.G.C., to an unplatted 0.4779 tract of land, more or less, known as the west half of Lot 8, Block 16, Pueblo Nuevo Subdivision, as further described in Vol. 787, Pgs. 425-426, of the Webb County Deed Records (ID 13455).

Issue: Regulatory compliance with development provisions of state and local regulations with particular emphasis on the Model Subdivision Rules.  Commissioners Court must certify to certain property conditions before any electrical connection may be authorized.

Solution: As reflected in agenda backup, staff has verified compliance and recommends approval.  Please note that water and sewer services are in place to authorize electrical connection.
 
Result: If approved, the applicant may connect the property to electrical services.  If not approved, electrical connection to the property is prohibited.

a.   AI-16141    Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to the public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose of or destroy property that cannot be sold through public auction because it has been deemed worthless or disposed of through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

b.   AI-16168    Discussion and possible action to approve the purchase of one (1) 2023 Ford F150 4x4 XL Super-Crew Cab truck from low bidder Whitmoyer Ford, Inc., for an amount not to exceed $53,000.00 includes a standard 5-year, 60,000-mile warranty for the Webb County Attorney’s Office and any other matters incident thereto. [Account #2465-2270-001-470000 (2023 Operation Stone-garden Gr-County Attorney-Administration-Capital Outlay)]

Issue: The County Attorney’s Office is utilizing grant funds for the purchase of a law enforcement unit through the Operation Stone Garden Grant.

Solution: Authorize the purchase to the lowest responsible bidder meeting all the requirements requested by the County Attorney’s Office.

Result: If approved by the Commissioners Court, the order will be issued on the same day of approval. The estimated time of delivery is expected between 15–30 days.

c.   AI-16201    Discussion and possible action to authorize the Purchasing Agent to solicit Requests for Proposals for Emergency Ambulance Services with an initial term of three (3) years effective October 1, 2024, to include two (2) additional options to extend ending September 30, 2029, pursuant to the Texas Local Government Code; § 262.030 Alternative Competitive Proposal Procedure for Certain Goods and Services and any other matters incident thereto. Issue: The existing Emergency Ambulance Extension agreement will expire September 30, 2024. 
 
Solution: Authorize the Purchasing Agent to solicit competitive formal proposals for these services.
 
Result: Continuing the Emergency Ambulance Services for the Citizens of Webb County located outside the incorporated areas will provide health, safety and general welfare of its citizens in the critical area of emergency medical care.
             
15.   Honorable Martin Cuellar, Sheriff
             
a.   AI-16143    Discussion and possible action to enter into an agreement with the Department of Defense (DOD) to allow the Webb County Sheriff's Department to apply for and accept surplus property, subject to Commissioners Court approval, deemed excess by the Secretary of Defense, from the Department of Defense (“DOD”) and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto.  There is no monetary match required and therefore no impact to the general fund.
 
Issue: The Secretary of Defense is authorized by 10 USC §2576a to transfer to State Law Enforcement Agencies, surplus personal property that is suitable for use by law enforcement agencies. 
 
Solution: The Governor of the State of Texas has, designated in writing, an effective date of May 24, 2024, to implement this agreement.

Result: Webb County may receive excess property from the DOD, suitable for law enforcement purposes, that will reduce the cost of obtaining such equipment through the use of Webb County taxpayer funds.

Issue: Impaired driving remains an issue that affects Americans every day. On average, three in five people will be involved in a crash due to impaired driving in their lifetime. Impaired driving can have serious consequences, including injury and death. About one in four teen car crashes involves an underage drinking driver and the National Highway Traffic Safety Administration found that 7% of all teen motor vehicle crash fatalities in 2020 involved distracted driving.

Solution: Purchase of driving simulator to educate teenagers about the dangers of impaired/distracted driving and demonstrate its effects.

Issue: Border security and the real time crime center need expansion capacity to fully develop the FUSUS/AXON system capabilities. The FUSUS system manages the real time crime center and border security assets. Urban and rural areas of Webb County would benefit from enhancements to increase coverage, storage and capability.  Vast geographical areas coupled with different platforms for the management of remote camera assets pose a challenge to effective and streamlined operations. 
FUSUS is both a sole source and a patented proprietary system, FUSUS/AXON Hardware are only available from FUSUS/AXON there are no third party vendors.

Solution: Operation LONE STAR allows for the purchase of equipment for $134,900.00 from FUSUS/AXON that augments border security efforts. The purchase of FUSUS hardware to expand the capabilities of the real time crime center/ border security operations center are needed. The purchase would allow for further development and enhancement of public safety projects in Webb County, and of our current assets and data in our current system.
 
Result: The public safety enhancements made by purchase of AXON/FUSUS hardware through Operation LONE STAR will greatly benefit Webb County Law Enforcement efforts by allowing a common operating picture for multiple asset types and multiple data types into one system.

Solution: At its April 22, 2024 meeting, the Webb County Commissioners Court awarded Competitive Sealed Proposal (CSP) 2024-001 “ARPA Project No. 1-Rio Bravo Wastewater Treatment Facility Improvements” to JMC Contractors to undertake facility upgrades to the Rio Bravo Waste Water Treatment Facility. 

Result: Upgrades will increase treatment plant capacity in order to meet future demands.

37.   AI-16203    Presentation and discussion by the Rio Grande International Study Center to collaborate jointly with Webb County and the City of Laredo for the $3,799,996 grant award from the national park service for its Outdoor Recreation Legacy Partnership (ORLP) program for the purposes of a project referred to as Project Uno – Conservation Park Project located in the Zacate Creek Watershed; with possible action to provide the $2,000,000 Webb county cash match; and any other matters incident thereto.
 
Issue: This City/County project was 1 of 14 grants awarded across the United States.  The ORLP grant award federal share is for $3,799,996.  The City and County have partnered to come up with the dollar for dollar match to this amount for a total project cost of $7,599,996. City of Laredo has committed $1.8 million and Webb County has committed $2 million if awarded.
 
Solution: Identify $2 million dollars in County matching funds for this awarded grant.
 
Result: Once City and County commit their cash match, project can commence.
  The Rio Grande International Study Center group gave a presentation regarding the grant that was awarded for Project Uno – Conservation Park Project located in the Zacate Creek Watershed. County matching funds,2 million for this grant is pending.

Result: Once the settlement is approved, Ricardo Bonilla Martinez , as Claimant, will release Webb County for all property claims regarding his 2008 White Cadillac.

Issue: A two-vehicle minor collision involving Sheriff motor vehicle unit #27-475 (2023 Chevrolet Tahoe) and a (2020 Chevrolet Silverado) Pearce Renewables Energy Company motor vehicle driven by Luis Fernando Diaz, damage sustained on both vehicles. The County was not at fault. 

Solution: To approve the property settlement regarding the Sheriff's motor vehicle unit #27-475.

Result: Once property settlement is approved, Webb County, as claimant, will release Pearce Renewables Energy Company (Luis Fernando Diaz) and their insurance (The Hartford) for all property claims regarding unit #27-475.
