Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 17th day of August 2017. Present also were Mrs. Virginia M. Rodriguez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4. Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member will be allowed a total of Three (3) minutes within which to make any/all public comments.
  No one signed up for Public Comment.

5. AI-6296  Discussion and possible action to approve/ratify any pending bills as presented by the County Treasurer; and any other matters incident thereto.
 
Issue: There is a time gap between regularly scheduled commissioners court meetings wherein certain bills become due and require court approval.
 
Solution: Present pending bills to the court for approval at special meeting.
 
Result: Ensure that all scheduled payments will be processed timely.
  County Treasurer, Ms. Delia Perales presented the Recap of Checks and Recap of Immediate Released for Payments pending approval. Ms. Perales stated that the Side Bills that she presented were not ready to be released and asked that they be disregarded.

6. AI-6312  Discussion and possible action to approve a professional service contract between Webb County for the Webb County Sheriff’s Office and Strother & Company, Consultant, for consulting services to conduct law enforcement related informational gathering, analysis, strategic planning, and informational dissemination to public, including gathering of factual data/dissemination related to public safety, jail overcrowding, cost-benefit analysis of contracting detention services to other jail facilities, jail repair costs, and other  matters related to the proposed new jail facility and by order of Commissioners Court to grant an exemption to competitive bidding pursuant to Section 262.024, (a)(4) Texas Local Government Code, Discretionary Exemption-Professional Services and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. The effective date of this contract shall be August 21st, 2017 through November 8th, 2017. The contract amount shall not exceed $6,250.00 to be paid on a monthly basis over two and one-half (2.5) months at a rate of $2,500.00 per month or as services are rendered. Issue: Additional funds are needed to pay outstanding bills.

Solution: Approve to fund the accounts that will be in deficit.

Result:  Funding will pay  outstanding invoices and any other expenses to be incurred in those same line items thru year end  09/30/2017.

8. AI-6313  Discussion and possible action to authorize the Purchasing Agent to open and re-solicit Request for Competitive Sealed Proposal for RFP #2017-001 “Webb County Fair Grounds Complex Project” to accept donations and/or to purchase a tract of land containing no less than One Hundred Fifty (150) acres to identify the future site location of the Webb County Fair Grounds Complex. The process to accept a donation and/or to purchase land for the future construction of this project is contingent upon the recommendations of the Webb County Fair Grounds Committee, availability of funding and final approval by Commissioners Court.

Issue: On March 27, 2017 the Honorable Judge Tijerina presented an Agenda Item to authorize the Purchasing Agent to Solicit Request for Proposals to accept donations and/or to purchase a tract of land containing no less than one hundred fifty (150) acres to identify the future site location of the Webb County Fair Grounds Complex. On April 24, 2017 sealed proposals were accepted, however, Webb County is extending the time for additional proposers.

Solution: Authorize the Purchasing Agent to re-solicit proposals from the public for possible donation of land, purchase or a combination of both.  

Result: Securing a land for this project will assist Project Architects with development of final Master Plan and Design for the Webb County Fair Grounds Facility. Site location is critical for overall design and master plan development which will serve our community today and for future generations.
  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 3 John C. Galo to ask whoever has an interest in working with the county in these parcels whether it be through donation, sale, or combination thereof, talk to them and score that property

  Judge Tijerina stated that time would be given to each department wishing to address the Commissioners Court regarding the proposed budget instead of only 3 minutes under Public Comment.

  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 3 John C. Galo to look into who would like to join the Voluntary Separation for those who have twenty (20) plus years of service and under the age of sixty-five (65) with the caveat that they'll also voluntarily not go on to the retirees setting September 30 as the deadline

  Motion by Commissioner, Pct. 4 Jaime Alberto Canales, seconded by Commissioner, Pct. 3 John C. Galo to not allow those individuals to return ever as a Webb County employee if they are to accept the Voluntary Separation unless they are elected/appointed to office, the department must use their payroll funds to exhaust any accruals that the individuals has subject to statutory laws

  Motion by Commissioner, Pct. 4 Jaime Alberto Canales to allocate $30,000 in Part-Time monies for the PIO Office

Cmr. Canales withdrew his motion.
  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 1 Jesse Gonzalez to place the repair and maintenance of vehicles under the Road & Bridge/Motor Pool Department excluding the Fire Department

  Motion by Commissioner, Pct. 4 Jaime Alberto Canales to approve the reclassification requested by Ms. Virginia Aranda, Public Defender

No action taken.
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 1 Jesse Gonzalez to make September 1 the deadline for departments to come back into the Condrey Plan

9. AI-6307  Discussion and possible action to conduct an annual performance review of Webb County Department Heads who are subject to the authority of the Webb County Commissioners Court, to wit:

Veterans Services Officer, David Garza
 
Action to be taken by Commissioners Court may include continuation of employment, reassignment, and modification of duties, disciplinary action, dismissal or other actions. The Commissioners Court may take such other action as may be necessary to implement its decisions including, but not limited to, appointment of interim department heads and/or permanent appointment of department heads; and any other matters incident thereto.[Closed Meeting/Executive Session is requested pursuant to Texas Government Code, Title 5, Subchapter D, Sections 551.071 ((A)(B) Consultation with Attorney) and 551.074 (Personnel Matters)]
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by County Judge Tano E. Tijerina to defer the performance review for the Human Resources Director until Monday
