Commissioners Court Special Meeting

Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 9:30 a.m. at the regular meeting place with the following members present to wit:

Jaime Alberto Canales,                           Commissioner, Pct. 4

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 16th day of September 2014. Present also were Ms. Virginia Martinez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.
 
             
CALL TO ORDER BY THE HONORABLE DANNY VALDEZ, WEBB COUNTY JUDGE

Judge Valdez wished Cmr. Tijerina a very Happy Birthday.

4. Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member will be allowed a total of Three (3) minutes within which to make any/all public comments.

Constable Adrian Cortez, Pct. 3
Constable Cortez asked the Commissioners Court to please consider the approval of the two (2) positions that were heard for consideration during the Budget Workshop. He also asked that Slot# 2815 Deputy Administrator be changed to Captain Executive Secretary.

Sara Coffman on behalf of Ms. Esther Degollado, District Clerk
Ms. Coffman asked that the Commissioners Court to please consider the approval of the two (2) Clerk positions that were heard for consideration during the Budget Workshop.

Judge Monica Notzon, 111th District Court
Judge Notzon asked the Commissioners Court to please allow her employee under Slot# 1561 Assistant Coordinator, who was left out of the Wage and Classification Study, to receive a $13,000 promotional raise with a new title.

Judge Joe Lopez, 49th District Court
Judge Lopez addressed the Commissioners Court on the placement of the Associate Judge/ Magistrate Judge position and the order adopting the salaries for the County Auditor's Office.

Judge Rebecca Palomo, 341st District Court
Judge Palomo thanked the Commissioners Court for the positions that were heard for consideration during the Budget Workshop and urged them to approve the slots beginning October 1.

Patricia Barrera, Tax Assessor-Collector
Ms. Barrera asked the Commissioners Court to please approved the position that were heard for consideration during the Budget Workshop.

Delia Perales, County Treasurer
Ms. Perales asked the Commissioners Court to please consider the approval of the part-time monies that were heard for consideration during the Budget Workshop. She also asked the court for their support in negotiating with Condrey and Associates on the misgrade of her Executive Administrator position.

Hugo Martinez, County Court al Law #1 Judge Elect
Mr. Martinez asked the Commissioners Court to please leave things as they are in regards to the Associate Judge position and for it to remain under the providence of both County Court at Laws.

Chief Ricardo Rangel, Fire and EMS
Chief Rangel addressed the Commissioners Court on the issues with the proposed budget under the General Order for Personnel and Operations Part-Time line item 5005 Webb County Volunteer Fire Dept. He stated that as of today it does not reflect Condrey and Associates' pay plan for the EMTs and Firefighters.

Jose Luis Rodriguez, Road and Bridge Superintendent
Mr. Rodriguez advised the Commissioners Court of the errors in the General Order under his department.

Virginia Aranda, Public Defender
Ms. Aranda thanked the Commissioners Court for two (2) positions that were heard for consideration during the Budget Workshop.

Carol Sherwood, Executive Director for Habitat for Humanity
Ms. Sherwoord asked the Commissioners Court to please consider the approval of $20,000 on their 3rd party funding.

Victor Garcia, on behalf of Laredo Main Street
Mr. Garcia asked the Commissioners Court to please consider their request for 3rd party funding of $40,000; $20,000 for Streets of Laredo and $20,000 for Farmers Market.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
  Discussion on file at the Webb County Clerk's Office September 19, 2014 Commissioners Court Special Meeting DVD.

County Attorney, Mr. Marco Montemayor mentioned that the portion on the agenda that included the language on closed session under Section 551.071(2) should have included Section 551.074 as well. Mr. Montemayor recommended the Commissioners Court adjourn and go into Executive Session.
  Motion by County Judge Danny Valdez, seconded by Commissioner, Pct. 3 John C. Galo to go to Executive Session on item #6

6. AI-1836  Status report by the county attorney office's regarding the suspension order of Ricardo Rangel, Justice of the Peace Pct. 2, Pl. 2, issued by the State Commission on Judicial Conduct; with discussion and possible action to recommend that a formal petition to appoint a temporary replacement be filed with the District Court, or, in the alternative, if a letter of resignation letter is received and accepted, to initiate a process to name a permanent replacement; and any other matters incident thereto.

Judge Valdez stated that he had received a letter of resignation from Judge Rangel.

County Attorney, Mr. Marco Montemayor recommended that the Commissioners Court formally accept the letter of resignation from Judge Rangel effective immediately.

 
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 4 Jaime Alberto Canales to officially accept the letter of resignation effective immediately and start the process to find a temporary replacement

Discussion and possible action to review and finalize the County Auditor's proposed fiscal year 2014-2015 budget with discussion and possible action to recommend any changes, if necessary, before the final adoption of the budget on September 22, 2014; and any other matters incident thereto.

Commissioners Court Executive Administrator, Mr. Leroy Medford, County Auditor, Mr. Leo Flores, outside counsel, Mr. Robert Bass, Judge Oscar Hale, Jr., 406th District Court, and Ms. Patricia Barrera, Tax Assessor-Collector were all present to address the Commissioners Court on item #5.

Mr. Bass recommended that the Commissioners Court accept the Judges order with the exception of those salaries that exceed 5% and attach chart to order.
 
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 4 Jaime Alberto Canales to set the maximum increase at no more than 5%

  Motion by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina, seconded by Commissioner, Pct. 1 Linda R. Ramirez to add $8,500 to Habitat, $10,000 for Main Street, and $54,000 for LDF
  Vote: 5 - 0 Motion Carried
  Motion by Commissioner, Pct. 4 Jaime Alberto Canales, seconded by Commissioner, Pct. 3 John C. Galo to take item #5 under advisement
