Commissioners Court Special Meeting

Monday, September 7, 2021 at 9:00 AM
Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:
 
Tano E. Tijerina, County Judge
Jesse Gonzalez,     Commissioner, Pct. 1
Rosaura "Wawi" Tijerina,   Commissioner, Pct. 2
John C. Galo, Commissioner, Pct. 3
Cindy Liendo, Commissioner, Pct. 4

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 3rd day of September 2021. Present also were Mrs. Rosa E. Herrera, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.
 
             
CALL TO ORDER BY THE HONORABLE TANO E. TIJERINA, WEBB COUNTY JUDGE
             
1.   Roll Call by Honorable Margie Ramirez-Ibarra, Webb County Clerk
  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 1 Jesse Gonzalez to excuse Commissioner Pct. 4 Cindy Liendo
  Vote: 4 - 0 Motion Carried

2.   Pledge of Allegiance
  Led by Commissioner Pct. 1 Jesse Gonzalez.
             
3.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
             
4.   AI-12463    Discussion and possible action to establish a Salary Grievance Committee, pursuant to §152.014 of the Texas Local Government Code, being a committee consisting of:
 
  • the sheriff, county tax assessor-collector, county treasurer, county clerk, district clerk, county attorney or criminal district attorney, and the number of public members (and alternates) necessary to provide nine voting members; or
  • nine public members (and alternates), if the commissioners court votes to have nine public members.
  Motion by Commissioner, Pct. 1 Jesse Gonzalez, seconded by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina to go with the hybrid option that includes six (6) elected officials and three (3) public members

  Motion by Commissioner, Pct. 1 Jesse Gonzalez, seconded by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina to select the criminal district attorney

5.   AI-12464    Discussion and possible action to, pursuant to §152.015 of the Texas Local Government Code, determine the manner of selection of the public members and alternates to the Salary Grievance Committee:
 
  • By lot (§152.015(b) Tex. Loc. Govt. Code ), or
  • By randomized list (§152.015(b-1) Tex. Loc. Govt. Code).
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina to go with the the randomized list  (§152.015(b-1) Tex. Loc. Govt. Code) to pick the first three names of the randomized list who would be considered for the Public Hearing and the rest of the list would be  the alternates. 
  Vote: 4 - 0 Motion Carried

6.   AI-12465    Selection of public members and alternates to the Salary Grievance Committee.
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina to choose the first three names on the randomized list which are Irma J. Barbarena, Dominique Richele Sanchez and Briana Preslee Cruz to be on the Salary Grievance Committee and the remainding names of the list would be the alternates
  Vote: 4 - 0 Motion Carried

7.   AI-12466    Chairman of the Grievance Committee (County Judge) shall announce the date and time of the public hearing on the Salary Grievance of Honorable Patricia Barrera, Webb County Tax Assessor Collector.
  Motion by County Judge Tano E. Tijerina, seconded by Commissioner, Pct. 3 John C. Galo scheduled the Salary Grievance Committee to take place at the Webb County Courthouse on Wednesday, September 15, 2021 at 9:00 a.m.
  Vote: 4 - 0 Motion Carried

8.   AI-12467    Discussion and possible action ratifying the termination of the Sale and Purchase Agreement with Tyomax Services, Inc., Manuel Garcia, Jr., and Maria Guadalupe Garcia for the purchase and sale of a tract of land legally described as: The “Surface Only” of Tract Nos. 18, 19, 20, 21, and Tract No. 22, Tanquecitos South Acres Subdivision, being out of Abstract 296, Porcion 32, Webb County, Texas, and commonly known as and located at 7226 TX-Hwy-359 East, Laredo, Texas, 78043.
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by County Judge Tano E. Tijerina to ratify and cancel the Sale and Purchase Agreement with Tyomax Services, Inc.
  Vote: 4 - 0 Motion Carried
