Discussion and possible action to approve the use of the contingency allowance as stipulated under §4.3 (allowances) under the construction agreement between Webb County and JMJ Constructors, in an amount not to exceed $46,130.19 to pay for Tariff charges for merchandise purchased in Canada for ARPA Project No. 0001 - Webb County Rio Bravo Wastewater Treatment Facility Improvements; and to further authorize the Webb County Judge to sign any relevant documents; and any other matters incident thereto. [Account #2703-5205-001-474501-103 (Construction in Progress-Rio Bravo WW Treatment Upgrades)]

Issue: As part of this project, a 5 ft x 5 ft opening was added to the chlorine contract basin effluent slab to improve operational accessibility. This opening allows for direct access to the existing effluent low meter for routine maintenance, calibration, and potential replacement activities. The opening is outfitted with removable aluminum grating, provided in two sections for ease of handling. During procurement, tariffs were imposed on the blowers that were enacted after the bid date and represent an unforeseen cost that could not have been anticipated by the contractor during the bid preparation.

Solution: Consideration to authorize the use of $46,130.19 from the owner’s contingency allowance funds.

Result: If approved, the contractor will be authorized to use the owner's contingency amount as approved by Commissioners Court. There will be no increase or decrease to the original contract sum.
