On March 16, 2020 at the Attorney General's request, Gov. Greg Abbott utilized Section 418.016 of the Government Code to suspend certain requirements of the Texas Open Meetings Act (TOMA) in light of the ongoing COVID-19 emergency. Tex. Gov't. Code Ann. Section 418.016 (Vernon 2017). The Governor suspended provisions of TOMA that require a quorum of the governing body and the general public to be together in a single location in order to allow videoconference or telephonic meetings.

CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: Currently Webb County’s Collections Services Agreement will end April 30, 2021 to collect delinquent fines and fees assessed by the Justice of the Peace Courts and the District Courts.
 
Solution: Approve a discretionary exemption for a professional service agreement and renew the agreement with the firm to collect delinquent fees and fines.
 
Result: Collect delinquent fines and fees utilizing services from a professional service provider. Provider will be paid a percentage of total delinquent fees and fines collected for Webb County in accordance rules and regulations permitted by State and Local laws.

f.   Discussion and possible action to ratify the execution of Change Order No. 1 to the Espejo Molina Road Overlay Project, (original contract of March 30, 2021) increasing the contract Sixty-One Thousand Five Hundred Eighty-Six Dollars ($61,586) which adds an additional 1200 linear feet of paving to the project for a total contract cost of Eight Hundred Fifty-Four Thousand Six Hundred Eighty Two Dollars and Seventy Cents ($854,682.70) and any matters incident thereto. 9.   Community Action Agency
 
a.   Discussion and possible action to approve and pass a resolution regarding various compliance matters required by the Texas Department of Housing and Community Affairs, Self-Help Center Grant 7220013 and authorizing the Webb County Judge to sign all relevant documents. This action will have no impact on the County's General Fund. 

Issue: Civil Rights and other compliance requirements must be implemented by Webb County in order to comply with grant funding agency program requirements. 

Solution: Civil Rights, Citizen Participation Planned Grievance Procedures, Section 3 Policy, Excessive Force Policy, Section 504 Policy, Limited English Proficiency and Fair Housing Policies must be implemented. 

Result: The Self-Help Center Program will be in compliance with funding agency requirements.

b.   Discussion and possible action to authorize the Webb County Community Action Agency to enter into an annual vendor agreement with Retail Energy Providers for the implementation of the Community Services Block Grant (CSBG) and the Comprehensive Energy Assistance Program (CEAP). This vendor agreement are a Texas Department of Housing and Community Affairs (TDHCA) requirement for the implementation of the programs.

Result: Texas Department of Housing and Community Affairs (TDHCA) will provide funding to be used fpr payment of qualifying low income home energy expenses.

10.   Honorable Harold Devally, Constable Pct. 4
 
a.   Discussion and possible action to authorize the acceptance of a "Click It or Ticket" Grant from the Texas Department of Transportation in the amount of $5,000.00 for overtime during the "Click It or Ticket" Campaign, the County will need to match 20% of said grant (Approximately $1,000.00 for fringe benefits). The grant would be designating Webb County Judge as the authorized official in all matters related to this grant, and any other matters incident thereto. All required documents will be sent for review through the Economic Development Department and the solicitation will be compliant with the Webb County Single Point of Contact (SPOC) procedure. Issue: Approval from Commissioners Court is necessary to accept grant.

Solution: Approval by Commissioners Court.

Result: Webb County Constable Precinct 4 will be enforcing seat belt law for the public safety.

11.   Economic Development
 
a.   Discussion and possible action to submit application for the Emergency Food and Shelter Program (EFSP) Phase 38 and authorizing the County Judge to sign all relevant documents. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. There is no County Match and will not have impact on the County's General Fund. [Requested by James Flores, CAA Director and Economic Development Department]

Issue:
There is a greater demand for food assistance in the area of Webb County than there is funding.

Solution: By applying Emergency Food grant Webb County Community Action Agency sees to address the hunger needs of the community using a partnership method with the local food banks.

Result: If awarded the grant, Community Action Agency will be able to assist eligible household with emergency food items.

b.   Discussion and possible action to authorize the submission of a grant application to the Office of the Texas Attorney General in the amount at $4,550 as developed and submitted by the Webb County Sheriff's Office for computer equipment and specialized software for the Webb County Sheriff’s Office Internet Crimes Against Children (ICAC), and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The psychological, emotional, and physical damage caused by child predators and inflicted on innocent victims, their families, and communities can be deeply destructive and have far-reaching consequences that can last a lifetime. Furthermore, throughout the United States, criminal cases built against child predators can be extremely complex, technologically challenging, and legally complicated.
 
Solution: The Webb County Sheriff’s Office cybercrimes law enforcement unit has successfully worked with multiple federal, state, and local law enforcement agencies, including the Office of the Attorney General, to arrest child predators in the Laredo/Webb County area. Grant application to supplement the successful endeavors of the Webb County Sheriff’s Office cyber crimes against children task force to protect the children and youth of the Laredo/Webb County community against child predation.

Result: The Webb County Sheriff’s Office will continue to enhance its ability to work proactively not only to catch individual child predators, but to produce an overall inhospitable environment for cyber crimes against children in Laredo/Webb County for the further prevention of child predation in our community.

c.   Discussion and possible action to ratify the development and submission of the application for the Meals on Wheels America "Make Good Go Further" Grant in the amount of Twenty Five Thousand Dollars ($25,000.00) for CAA Meals on Wheels program, and authorizing the County Judge to sign all related documents. Grant does not require a county match.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single point of Contact (SPOC) procedures. Issue: The Community Action Agency Meals on Wheels program kitchen equipment is not functioning correctly as it is outdated and in need of replacement.

Solution: By Applying the MOW "Make Good Go Further" Grant, Meals on wheels program will be able to update its kitchen equipment. 

Result: If awarded the grant, Meals on Wheels program will be able to function more efficiently with proper working equipment which will allow us to better service the eligible seniors citizens of Webb County.

15.   Planning & Physical Development
 
a.   Discussion and possible action to issue a “Certificate of Compliance with Plat Requirements” to authorize an electrical and water service connection pursuant to Section 232.029(c)(2), Local Government Code., to an unplatted 2.2395 acres, more or less, also known as Ranchitos Los Minerales Annex, Tract 56, as further described 0541, Pgs. 134-136 of the Webb County Deed Records (ID 11013).
 
Issue: Item is a regulatory compliance issue regarding real property development provisions of state law and local regulations with particular emphasis on the Model Subdivision Rules enacted for residential subdivisions.  Commissioners Court must certify to certain property conditions before utility service connections may be authorized.

Solution: As reflected in agenda backup, staff has verified compliance matters and recommends the Court’s approval of this certificate.

Result: If approved, applicant may connect property to electrical utility services.  If not approved, utility connection to property is prohibited.

16.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage or surplus property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value or some usefulness for the intended purpose is no longer needed by the department.
 
Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by State law.
 
Result: Generate revenue from public sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

b.   Discussion and possible action to authorize the Purchasing Agent to solicit formal Request for Proposals (RFP's) for a "501 (c)(3) Non-Profit Corporation" to partner with the Self-Help Center Program to construct not less than two (2) and not more than four (4) homes under the Self-Help Center Contract #7220013 and in accordance with the Texas Local Government Code; Section 262.030 Alternative Competitive Proposal Procedure for Certain goods and services. This activity is grant funded and will not impact the County's General Fund.
 
Issue: The Self-Help Center has been awarded a grant which includes funds for new construction. 

Solution: Solicit RFP's to seek a partnership with an organization that has the capacity to carry out the new construction activity.

Result: Webb County’s Investment Portfolio will be diversified and obtain higher coupon rates.

Issue: Independent auditors, Cascos & Associates, performed the single audit of Federal and State awards and issued isolated grant award findings for an internal control deficiency and not following procurement policies and procedures because department used a separate bank account with single signature authority for grant proceeds and disbursements.

Solution: With Court approval grant proceeds and disbursement shall only use the General Operating bank account and follow County’s internal controls and procurement policies and procedures.

Result: Webb County will comply with contractual grant terms and conditions, grant resolutions, procurement policies and procedures, and Federal/State guidelines.

Issue: Election Security has been an issue for the last few years, and the Elections office has taken the initiative of implementing new voting equipment as well as cyber security training to help combat this issue.
 
Solution: Through the acceptance of this award, Webb County will expend funds from the EAC awarded to prevent, prepare for, and respond to the Cyber-attacks, domestically and internationally for the 2021 Elections cycle.
 
Result: The Webb County Elections Office will have additional resources to protect the 2021 elections from the effects of the Cyber-attacks.
