COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

8.   Community Action Agency
 
a.   Discussion and possible action to ratify the approval of contract term extension, and reclassification of fund allocation for Amendment No. 4 for the Comprehensive Energy Assistance Program (CEAP) Contract Number #58230003850 from the Texas Department of Housing and Community Affairs (TDHCA) FY-2023. Amendment will extend contract from March 31, 2024, to June 30, 2024, and reallocate funds from Administration into Direct Services authorizing the County Judge to sign all relevant documents for request and approval of contract amendment. This action will not have an impact on the General Fund. Issue:
 Texas Department of Housing and Community Affairs (TDHCA) has awarded Amendment No. 4 to Contract Number #58230003850 under the (CEAP) Program.

Solution: The court approval will allow Webb County CAA to continue providing emergency assistance to low-income households in Webb County under the CEAP program.

Result: These funds are intended to assist eligible Webb County residents meet their immediate household energy needs.

b.   Discussion and possible action to ratify the approval of contract term extension for Amendment #3 to Contract #58930004003 for the Comprehensive Energy Assistance Program (CEAP) from Texas Department of Housing and Community Affairs (TDHCA) for the program year 2023. Extending contract from March 31, 2024, to June 30, 2024. Authorizing the County Judge to sign all relevant documents. Issue: Texas Department of Housing and Community Affairs (TDHCA) presented CAA Social Services with a three-month contract term extension through the CEAP Supplemental Contract Amendment No.3.

Solution: The Court approval will allow the Webb County Community Action Agency to continue providing direct services to eligible low-income residents of Webb County under the CEAP program.

Result: Approval of the amendment will ensure the continuation of services to qualifying low-income clients.

c.   Discussion and possible action to approve the extension of FY 22-23 Federal Rural Public Transportation Grant; 5339-R-2022-WEBB CO-00011 from Texas Department of Transportation. The extension is to May 31, 2025, to allow carryover of FIFTEEN THOUSAND FIFTY-THREE DOLLARS ($15,053.00). No impact to General Fund. All required documentation has been submitted to the solicitation is compliant with Webb County (SPOC) Single Point Contract Procedures. 

Issue: Rural Public Transportation is a grant-funded agency. 

Solution: Through the carryover by Webb County, will allow the department to exhaust all funds. 

Result: Approval of contract carryover will ensure continuation of transportation services to the rural areas of Webb County.

d.   Discussion and possible action to amend FY 2023 STATE-R-2023-WEBB CO-000145 for Webb County Community Action Agency - El Aguila Rural Transportation from the Texas Department of Transportation (TxDOT) in the amount of EIGHTY FIVE THOUSAND DOLLAR ($85,000) from administration to operations. This grant does NOT require a County Match. All required documentation has been submitted to the solicitation to comply with Webb County (SPOC) Single Point Contact Procedures. 

Issue: Rural Public Transportation is a grant-funded agency. 

Solution: Through this amendment, Webb County will allow the department to exhaust all operational funds. 

Result: Approval of the contract amendment will ensure continuation of transportation services to the rural areas of Webb County.

e.   Discussion and possible action to appoint Roxanna Gaona to the Webb County Community Action Agency Advisory Board as Representative for Webb County Precinct 1 Commissioner Jessie Gonzalez. Click to View
 
f.   Discussion and possible action to authorize the renewal of the agreement between Webb County Community Action Agency and Reliant Energy Retail Services, Limited Liability Company (LLC) for Consumers Affordable Resource for Energy (C.A.R.E.) Program. The purpose of these contributions is to provide funding for energy assistance payments to Reliant customers under the CARE program. Webb County Community Action Agency will continue to utilize these funds to assist qualified Reliant Energy Retail Services clients and authorizing the County Judge to execute all relevant documents and any other matters incident thereto. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. Issue:
WCCAA has a remaining balance of $1,003.00 under the Reliant Energy Retail LLC CARE program.

Solution: To approve the renewal of the agreement between WCCAA and Reliant Energy Retail LLC CARE program.

Result: Community Action Agency will continue to accept enrollment applications from potential clients and qualify Reliant Energy customers as eligible recipients in accordance with Reliant Energy Consumers Affordable Resource for Energy (CARE) program requirements, in order to expend remaining funds.

h.   Discussion and possible action to authorize the renewal of the agreement between Webb County Community Action Agency and Direct Energy Neighbor-to-Neighbor (N2N) Bill Assistance Program. The purpose of these contributions is to provide funding for energy assistance payments to Direct Energy customers. Webb County Community Action Agency will continue to utilize these funds to assist qualified Direct Energy clients and authorizing the County Judge to execute all relevant documents and any other matters incident thereto. 9.   Honorable Tano E. Tijerina, Webb County Judge
 
a.   Discussion and possible action to authorize the donation of four (4) used Dell Opti-plex computers (Asset numbers 2081, 2233, 5212, and 7577) to Ruthe B. Cowl Rehabilitation Center pursuant to the Texas Local Government Code; §263.152. Disposition (a)(4) dispose of the property by donating it to a civic or charitable organization located in the county if the commissioners court determines that the donation services a public purpose and any other matters incident thereto.
 
Issue: Ruthe B. Cowl is in need of computers to be utilized for the non-profit’s operation. The donation of County computers will provide the non-profit organization additional computer equipment to support their operation and the community in need of their services. 
 
Solution: Consideration to authorize donation as per the Texas Local Government Code a total of four (4) reconditioned surplus computers to Ruthe B. Cowl Rehabilitation Center.
 
Result: If approved, the surplus computers will be donated to Ruthe B. Cowl Rehabilitation Center and donation will be reflected on the County’s controlled asset records.

10.   Fire Marshal
 
a.   Discussion and possible action authorizing the Purchasing Agent to add (5) new radio devices and phone lines including data service in accordance with the current approved AT&T FirstNet Plan for the Webb County Fire Marshal's Office pursuant to Sections 271.101 and 271.102 Texas Local Government Code cooperative purchasing program DIR Agreement TSO-3420 at a monthly rate of $139.95 plus surcharges and other fees; and subject to annual budgetary appropriation. Issue: Lack of radio devices poses a potential risk to the operational efficiency and safety of the Webb County Fire Marshal's Office.

Solution: This action will ensure that the Fire Marshal's Office has adequate communication tools to effectively coordinate operations, respond to calls, and enhance overall safety measures.

Result: If approved, equipment will enhance department's operations.

Issue: Road and Bridge is requesting new heavy equipment for general road maintenance.   

Solution: Use a reputable vendor with a cooperative contract for heavy equipment purchase.  Utilizing cooperative contracts will meet the competitive bidding requirements of the state.    

Result: The new equipment will help improve general road maintenance and improvements to county roads and will eliminate manual labor, making day-to-day operations more efficient.  ETA on delivery is April 30, 2024.

b.   Discussion and possible action to authorize the purchase of fourteen (14) APX6500 Enhanced VHF Mobile units and thirty-seven (37) APX N50 VHS Model 2 Portable radios including accessories and installation for a total not to exceed $291,197.64 from Motorola (HGAC Contract No. RA05-21) for the Webb County Sheriff's Office and in accordance with the Texas Local Government Code; Sub-Chapter F. Cooperative Purchasing Program, §271.101, §271.102 (Cooperative Purchasing Program Participation) and any other matters incident thereto. Issue: Senate Bill (SB) 22 establishes a grant program that provides financial assistance to sheriff’s departments in eligible counties to ensure professional law enforcement and legal representation of the people’s interests throughout the State of Texas. This purchase of equipment is supported through the Rural Law Enforcement Grant Fund.
 
Solution: Consideration to authorize grant funded equipment for law enforcement use. Motorola has a cooperative contract with HGAC, meeting all competitive bidding requirements of the State of Texas. 
 
Result: If approved, proceed with placing the order. This equipment will enhance existing and continued efforts to protect citizens in Webb County.

15.   Risk Management
 
a.   Discussion and possible action to authorize a request for a 2nd amendment to the Standard supplemental group life insurance ("Plan 2") so that a Webb County Employee, Spouse, and Dependent with group life insurance who reach the “Age Reductions” will be effective January 1 of each year rather than on their respective date to “Age Restrictions for Life and AD&D and Standalone AD&D will be effective January 1 of each year.” This amendment will become effective January 1, 2024, through December 31, 2025; and authorize the Webb County Judge to sign all relevant documents and any other matters incident thereto.  [Account #6100-1090-001- 432057 (Cafeteria Administration)]

Issue: The current amendment does not include AD&D and Standalone AD&D life insurance available to the Webb County Employees is subject to an Age Reduction when the employee reaches a specific age, making the amount of coverage and premium vary throughout the year.
 
Solution: Authorize the consultant to seek an amendment from the Insurance Provider to include to set a date of Jan 1st of every year.
 
Result: Both the rate band and age reduction will take place on January 1st. Anyone aged 64-69 who turns 70 during the year would not be age-reduced until Jan 1st of the following year.

19.   Discussion and possible action to enter into a contractual agreement with Midas Contractors, LLC for a renovation project of the Justice of the Peace Precinct 1, Place 2 Courtroom in an amount not to exceed SIXTY-NINE THOUSAND NINE HUNDRED FIFTY DOLLARS ($69,950.00) and any other matters incident thereto; authorizing the County Judge to sign all relevant documents.  [Account #1001-2150-470000 (JP Pct. 1 Pl. 2 Capital Outlay]

Issue: Justice of the Peace Precinct 1, Place 2 courtroom is in need of renovations. The Commissioners Court authorized the Purchasing Agent to send out an Invitation to Bid (ITB) 2024-005 for such work.

Solution: At the Commissioners Court meeting of April 8, 2024, the court awarded ITB 2024-005 to Midas Contractors, LLC to do the renovation work.  

Result: The Contractor will substantially complete the renovation work within sixty (60) calendar days from the issuance of the "Notice to Proceed" by the Engineering Department.

Community Action Agency
 
20.   Discussion and possible action to approve an eight percent (8%) wage increase to the Webb County Community Action Agency for the following lines of business: Community Social Services Program, Self-Help Center Program, Rural Transit Program (El Aguila), and Meals-On-Wheels/Elderly Nutrition Program. The State funding Agencies have noted that approval of staff salary increase are subject to approval at the local level only and contingent that it does not include an increase request in state funding. 

Issue: Webb County Community Action Agency staff are not under the Condrey Plan and not subject to the step increase approved on Commissioners Court meeting of 09/13/2022.

Solution: The Webb County Community Action Agency is proposing grant staff wage adjustment of 8%.

Result: The Webb County Community Action Agency staff wages be adjusted for the following programs, subject to the approval of the program funding agencies: The Community Social Services Program, Self-Help Center Program, Rural Transit Program (El Aguila), and Meals-On-Wheels Program.

21.   Discussion and possible action to approve additional Civil Engineering services in the amount of $13,700.00 to Cavazos & Associates Architects PLLC, for the Southern Fire Station project; these services were necessary to address issues identified during the value engineering process and ensure the project aligned with the budget constraints. And have the County Judge sign any relevant documents, and any other matters incident thereto.  [Account # 2703-5205-001-432001-206 (Professional Services-Southern Fire Station)

Issue: During the value engineering process several aspects of the project's civil engineering required improvement to bring the project within budget. These include Dimensional Plan, Grading Plan, Utility Plan, Stormwater Pollution Prevention Plan, Lighting & Striping Plan, and Sidewalks/ADA Plan.

Solution: By developing a series of geometric engineering analysis to improve the site's civil-related improvements, the Engineer helped reduce the overall cost and improve emergency vehicles maneuverability and accessibility on site.

Result: Submit 100% revised plans to the Architect for inclusion in the final project documents delivered to Webb County, Texas.

22.   Discussion and possible action to approve the purchase of a Dell VX-Rail Server Solution and Microsoft Licenses from Insight and SHI pursuant to Sections 271.101 and 271.102, Texas Local Government Code, Cooperative Purchasing program DIR-TSO-3763 and DIR-CPO-5237 respectively in the amount of Five Hundred Fifty Thousand Two Hundred Ninety-Two Dollars and Fifty Cents ($550,292.50), and to further authorize a budget amendment from the General Operational Fund #1001-1130-001-431007-010 (Operational Reserve) to the I.T.'s Department Captital Outlay Account #1001-1280-001-470000. The General Operational Reserve shall only be used after utilizing all of the remaining balances in the following mentioned funds. Issue: Existing equipment is reaching the end of support.

Issue: Road and Bridge is requesting new heavy equipment for general road maintenance.
 
Solution: Use a reputable vendor with a cooperative contract for heavy equipment purchase. Utilizing cooperative contracts will meet the competitive bidding requirements of the state. 
 
Result: The new equipment will help improve general road maintenance and improvements to county roads and will eliminate manual labor, making day-to-day operations more efficient.  Equipment is ready for delivery after approval of purchase by Commissioners Court.

24.   Discussion and possible action to approve a professional service agreement between Webb County and Steve Land Tillotson FAIA pursuant to the Texas Professional Services Act to provide architectural and engineering services to include representation and coordination with the Texas Historic Commission, preparation of design & schematics, preparation of construction documents for bidding process, and Construction administration to replace and restore the Casa Ortiz roof located at 915 Zaragoza Street in the amount of $54,000.00 (Basic A/E Services), supplemental services of $13,500.00 and not to exceed reimbursable expense of $8,500.00 for a total contract sum of $76,000.00 and to further authorize General Counsel to execute the professional service agreement and any other matters incident thereto. Issue: Casa Ortiz has been a designated RTHL (Recorded Texas Historic Landmark) since 1963 and is listed as a Significant Property in the 1973 San Agustin de Laredo National Register Historic District.  A portion of the building was constructed in 1830 which makes it one of the oldest historic structures in Webb County and in post-Spanish Colonial Texas.  A recent roof inspection report dated 01/04/2024, concluded extensive wear & considerable deterioration throughout the roof structure, which includes the built-up roof system, metal roof panels, & gutters/downspouts.
 
Solution: Webb County, as the building owner, will be required to notify the THC within 60 days of any work planned for the building that may have an adverse effect on the historic integrity of the building.  The Texas Historic Commission is required to comment on any perceived adverse effects relative to both the RTHL and NRHD designations.  Therefore, roof replacement and repairs will need to be sufficiently investigated, documented and detailed to be in conformance with the US Secretary of the Interior Standards for Rehabilitation.
 
Result: If approved by Commissioners Court, finalize the execution of the professional service agreement and authorize Mr. Tillotson as a representative of Webb County to coordinate with the Texas Historic Commission to review and secure approval of all design plans and construction documents prior to formal advertisement for bids to repair roof.

25.   Discussion and possible action to accept the rankings and award Competitive Sealed Proposal (CSP) 2024-001 “ARPA Project No. 1 – Rio Bravo Wastewater Treatment Facility Improvements” to the highest ranking company JMJ Contractors for an amount not to exceed $10,699,365.00 for base bid with optional deducts for consideration totaling $424,850.00 pursuant to the Texas Government Code; CSP Sec. 2269.155 (Selection of Offeror) and to further authorize General Counsel to proceed with the preparation of the construction contract for the awarded amount and any other matters incident thereto. [Account #2703-5205-001 (ARPA Project No. 1)]

Issue: Webb County Rio Bravo Waste Water Treatment Plant (WWTP) Upgrades are necessary to improve operations, ensure regulatory compliance and meet future demand for capacity.

Solution: Two competitive proposals were submitted by deadline.  Proposals were evaluated by the Scoring Committee as per weighted criteria published.  This project is funded through the American Rescue Plan Act – Federal funds.

Result: If approved, proceed with the execution of construction contract to include any applicable federal contract provisions, insurance and payment and performance bonds.

26.   Discussion and possible action to award a seventeen (17) month Temporary Staffing Agency Service Agreement effective May 1, 2024, through September 30, 2025, to supply the Elections Office with quality, cost-effective employees on a temporary basis during each election cycle to the top two (2) recommended agencies providing the best value proposals for requested services and to further authorize the County Judge to sign all relevant documents and any other matters incident thereto. [Account #1001-1110-001-451201-005 (General Fund - Election Administration - Administration - Election Expense - Webb County)]
 
Issue: The Elections Department hires hundreds of temporary Election Workers for short periods of time throughout the year utilizing the Webb County employee hiring process.  This process requires the processing of job applications for temporary workers, pre-employment screening, drug and alcohol testing and payroll process along with any liability borne on the County during the temporary employment period.
 
Solution: Outsourcing this process will expedite the process of hiring Election Judges and Election Clerks, reduce the liability, & outsource the administrative tasks.  Consideration to award to the top two (2) ranking agencies as recommended by the Scoring Committee, in order to have a primary and secondary agency to service Webb County on an as needed basis during each election cycle.
 
Result: If approved by Commissioners Court, the Elections Office will have the ability to expedite their staffing needs for each election cycle for temporary election workers (Election Judges & Clerks) for each election site pursuant to the service agreement(s) being fully executed as authorized by Commissioners Court.

28.   Discussion and possible action, pursuant to Section 251.051 of the Texas Transportation Code entitled “General County Authority Relating to [County] Roads and Bridges,” to authorize by Resolution and Order of the Webb County Commissioner’s Court to grant, convey, assign, deed, or quitclaim any interest (beneficial or otherwise) that it may own, if any, in the property described as an approximately 1.4 acre tract along the Southern boundary of Wright Ranch subdivision, which tract is a portion of what had historically been referred to as “Wormser Road”, to the record title owner of the property, Laredo Four Winds II, Inc.; and any other matters incident thereto.

Issue: Webb County relocated a 1.4 acre tract along the Southern boundary of Wright Ranch subdivision, located in Webb County, Texas which is referred to as Wormser Road. Said alteration, movement, and relocation of such road was in the best interest and benefit of the public and Webb County and done in order to facilitate traffic flow, provide for a better and more adequate road infrastructure.
 
Solution: Section 251.051 of the Texas Transportation Code allows the Court relocate and replace a road with a new road and is authorizing any interest in the property be convey, assigned, deeded, or quitclaimed to surface owner.
 
Result: Complete process of relocation of property.
