CALL TO ORDER BY THE HONORABLE TANO E. TIJERINA, WEBB COUNTY JUDGE

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: The  HIDTA Task Force Grant has provided supplemental funds for overtime (OT) operations by the two (2) grant-funded HIDTA Office at the Webb County Sheriff's Office.

Solution: Submit a budget increase request to utilize this new grant revenue.

Result: The investigators can conduct overtime (OT) operations with the task force for the increased security of the local community.

Issue: New proceeds under Chapter 59 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

b.   Discussion and possible action to approve conducting Category “B” Elections to fill current vacancies as per the Governing Regulations of the Advisory Board of the Webb County Community Action Agency. The Advisory Board shall be composed of membership that complies with the Community Services Block Grant-Texas Administrative Code Rule 5.215. Three Elections will be held. One on Wednesday, July 27th for a Representative and Alternate for Area V - Fernando A. Salinas Community Center, 520 Reynolds from 9:00 a.m. till 5:00 p.m. The other Election will be held on Thursday, July 28th for Representative and Alternate for Area IV-Azteca-Guadalupe in the Lulac Haven- located at 4601 Juarez Avenue from 9:00 a.m. till 5:00 p.m. The other Election will be held on Thursday, July 28th for Representative and Alternate for Area I- Lilia Perez - located in Lulac Haven-located in 4601 Juarez Avenue from 9:00 a.m. till 5:00 p.m.

Issue: To hold Elections to fill current vacancies for Representative and Alternate for Area V-, Area IV, and Area I.

Solution: The Advisory Board shall be composed of membership that complies with the Community Services Block Grant- Texas Administrative Code Rule 5.215.

Result: Once the Election is held the CAA will comply with the Texas Administrative Code Rule 5.215.

c.   Discussion and possible action to approve an Amendment from the Texas Department of Housing and Community Affairs (TDHCA) Comprehensive Energy Assistance Program budget and transfer a total of $56,308.00 from Administration account to the Direct Services account for a total of $106,247.37 from the Program Services account to the Utilities Assistance account; and any other matters incident thereto.

Issue: To amend the CEAP budget to transfer funds from one account to another account.

Solution: To obtain approval from the Commissioners Court.

Result: To gain approval from TDHCA to transfer the funds.

8.   Economic Development
 
a.   Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to the Office of the Governor Homeland Security Grants Division in the amount estimated at $2,500,000 for the FY 2023 Operation Lone Star (OLS) Grant Program (Grant No. 4376702) for overtime/applicable fringe benefits, part-time/temporary employees salary/fringe benefits, equipment/software, training/travel, and supplies; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires no match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Local law enforcement working in international border communities must work within limited budgetary constraints to provide both proactive and responsive law enforcement services while transborder criminal organizations possess unlimited funding to access the latest technology and equipment to avoid detection/disruption of their activities utilizing their proceeds obtained through illegal but highly lucrative drug trafficking and other unlawful enterprises.

Solution: Supplemental grant award to provide supplemental resources to assist in combating illegal drug trafficking and provide enhanced border security for the residents/citizens of Laredo/Webb County.

Result: The Webb County Sheriff’s Office and its sworn officer force will be equipped with needed additional resources.

Result: Continue working relationship with ETT, and meet department needs.

Issue: The Local Provider Participation Fund (LPPF) accounts listed above were adopted at amounts less than the current available and projected balances for FY2022 due to the fund balance rolled over from FY2021, the mandatory payments received from providers as well as reimbursements received from the Health and Human Services Commission (HHSC).  

Solution: Expenditure accounts need to be increased to take in account the actual funding available through the LPPF for IGT transactions.

Result: By amending the expenditure amounts, pending and future intergovernmental transfers (IGTs) will be able to be processed.

11.   Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

12.   Honorable Patricia Barrera, Tax-Assessor- Collector
 
a.   Discussion and possible action to approve a refund in the amount of $32,077.92 to Palafox Hospitality, Ltd. dba La Posada Hotel, Account #20041320314500 that was erroneously paid; and any other matters incident thereto.
 
Issue: Change in exemptions for a previous occupant of the hotel has caused in overage of tax payments on the above-mentioned account. Due to audit, State Comptroller has ordered the refund of the amount mentioned.
 
Solution: Refund said amount to Palafox Hospitality Ltd.
 
Result: The monies will be reimbursed to the appropriate taxpayer as per Comptroller of Texas.

13.   Honorable Martin Cuellar, Sheriff
 
a.   Discussion and possible action to approve the payment of membership for a non-profit state association as required by Local Government Code Section §89.002 for the Webb County Sheriff's Office in the amount of Forty ($40.00) Dollars to the Texas Narcotics Officer Association (TNOA) annual membership dues. [Account #1001-3010-001-464010 (Dues & Membership)]
 
Issue: Local Government Code Section §89.002 requires that the Commissioners Court may spend, in the name of the county, money from the county's general fund for membership fees and dues of a nonprofit state association of counties if:
 
(1) a majority of the court votes to approve membership in the association;
(2) the association exists for the betterment of county government and the benefit of all county officials;
(3) the association is not affiliated with a labor organization;
(4) neither the association nor an employee of the association directly or indirectly influences or attempts to influence the outcome of any legislation pending before the legislature, except that this subdivision does not prevent a person from providing information for a member of the legislature or appearing before a legislative committee at the request of the committee or the member of the legislature; and
(5) neither the association nor an employee of the association directly or indirectly contributes any money, services, or other valuable thing to a political campaign or endorses a candidate or group of candidates for public office.
 
Solution: Obtain court approval as required by State Law to pay for membership dues.
 
Result: General Request for Payment for non-profit state association fee will be processed for payment.

17.   Discussion and possible action to request the Webb County Purchasing Agent issue a Request for Qualifications (RFQ) for a Golf Course Architect to assist the County in preparing for and re-designing the Casa Blanca Golf Course due to the impending acquisition of approximately 9.226 acres out of the golf course by the State and any matters incident thereto. Issue: TxDOT will be acquiring acreage out of the golf course due to the expansion of Loop 20 which will take acreage from the golf courses (irrigation pond, part of fairway and green as well as the storage building) and the course will need to be reconfigured.

Solution: Retain the services of a golf course architect to assist the County in the reconfiguration and redesign of the golf course to remediate the damage to the golf course caused by the TxDOT taking.

18.   Discussion and possible action to authorize the Webb County Purchasing Agent issue a Request for Qualification (RFQ) for a law firm to assist the County in developing a public private partnership agreement/s as it relates to a new international bridge, and any matters incident thereto. Issue: In anticipation of a presidential permit for a new international bridge, public private partnerships must be developed.

Solution: A law firm specializing in public private partnership agreements is needed and the first step is to Request Qualifications from interested, qualified law firms.

19.   Discussion and possible action to enter into Amendment No. 1 to the Professional Services Contract with Garver LLC in the amount of Twenty-Four Thousand Six Hundred Thirty-Eight Dollars ($24,638.00) for a Point Cloud Survey of Webb County’s Wastewater Treatment Plant (WWTP) which will capture three-dimensional (3D) images of facilities, composed of millions of data points and any matters incident thereto; authorizing the County Judge to sign all relevant documents. [Coronavirus State and Local Fiscal Recovery Funds (SLFRF)]

Issue: Survey work is needed so that the engineering firm designing improvements to the County's wastewater treatment plant can be accurately designed.

Solution: Enter into contract amendment to have the survey services provided.

20.   Discussion and possible action to ratify a thirty (30) year term “Well Pad, Facility Pipeline, and Subsurface Easement Agreement” concerning the Webb County School Lands (Penjamo Pasture) located off Highway 44 with Lewis Petro Properties, Inc. in an amount payable to Webb County of Two Hundred Seventeen Thousand Two Hundred Sixteen Dollars ($217,216.00) with said amount increased by 2.5% if said Easement is renewed by Lewis Petro Properties at end of easement term, and any matters incident thereto.
 
Issue: Lewis Energy is seeking to place an offsite drill pad on the Penjamo Pasture so it can develop its mineral leases adjacent and north to the Pasture. 
 
Solution: Grant Lewis Energy a thirty-year easement for an offsite drill pad with accompanying pipeline and road right of way with Webb County being compensated in the amount of $217,216.00 for said easement. Lease is automatically renewed every 30 years as long as said payment is made which is increased by 2.5%. Court approved the Pricing amount at its June 27th commissioners court meeting.

Issue: Clayton Homes of San Antonio has submitted a request to waive liquidated damages incurred as a result of delays to the contract that were outside their control and no fault of their own.  

Solution: Grant requested waiver to Clayton Homes of San Antonio and acknowledge that acted in good faith to complete the projects and the delays were beyond their control.  

Result: Close out three Reconstruction projects and compensate Clayton Homes of San Antonio for services rendered.

25.   Discussion and possible action for Commissioners Court to approve a Burn Ban Order for a maximum of Ninety (90) days of all outdoor burning in all the unincorporated areas of Webb County commencing July 25, 2022 pursuant to Local Government Code §352.081 and other applicable statutes, a violation of this Order is a Class C misdemeanor, punishable by a fine not to exceed $500.00; and any other matters incident thereto.

Issue: The current Keetch-Byram Drought Index (KBDI) average for Webb County is 663 and may reach a maximum of 762 within the next fourteen days. (KBDI scale ranges from 0-800 with 800 representing extremely dry conditions) These conditions create a high risk of wildfires with danger to damage life and property.

Solution: Order an immediate burn ban for a maximum of 90 days (or until conditions are considered safe) to be enforced by the Sheriff’s Office to discourage outdoor burning in order to prevent spread of wildfires and loss of life and property.

Result: Discourage citizens from outdoor burning in the unincorporated areas of Webb County in order to prevent wildfires and enforce a fine of up to $500 by the Sheriff’s Office for those citizens that do not abide by burn ban.

Issue: The Texas Veterans Commission Grant ended on June 30, 2022. Both employees were in grant funded slots.  Employee in slot #2836 had annual leave plus compensatory time and employee in slot #2949 only had annual leave when the grant ended.  The grant agency does not allow cost after employment service as per Code of Federal Regulations CFR 200 §200.403.  
 
Solution: Approve payment to cover cost of annual leave and compensatory time.
 
Result: Former employees will receive compensation for annual leave and compensatory time earned.
