Discussion and possible action to ratify the Agreement between Webb County and S&B Infrastructure, LTD, to provide professional services related to the County Energy Transportation Zone (CERTZ) that was executed in Commissioner Court on April 28, 2014.
Issue: Commissioner Court approved the execution of an agreement with Totem, LLC on February 10, 2014 to provide management and oversight services related to the County Energy Transportation Reinvestment Zone (CETRZ) but the agenda item approved did not include the authority to execute an agreement with the subcontractor S&B Infrastructure, Ltd. Under the agreement approved, "Totem shall subcontract provision of all engineering services including PS&E for work under the grant to S&B Infrastructure, Ltd" and "Owner [Webb County] shall be responsible for the payment of all engineering services." In order for Webb County to pay the Subcontractor (S&B) directly, a separate agreement was executed between Webb County and S&B.
Solution: Commissioner Court approval to ratify the agreement with S&B Infrastructure for professional services related to the County Energy Transportation Zone (CETRZ).
Result: Proper record of the approval to execute the agreement with S&B Infrastructure will ensure that invoices are processed for payment and enable the County to submit requests for reimbursement of 90% of the amount paid for services to the Texas Department of Transportation (TxDOT) County Transportation Infrastructure Fund (CTIF) that falls under the CERTZ umbrella.
