Discussion and possible action to approve and authorize a proposed settlement agreement and compliance supplemental environmental project in lieu of penalty in the amount of $36,150 for the pending enforcement action/litigation between the Texas Commission on Environmental Quality (“TCEQ”) and Webb County regarding the Webb County Wastewater Treatment Plant in Docket No. 2016-0612-MLM-E, by and between “TCEQ” and Webb County, and authorizing the County Judge to execute any and all relevant documents; and any other matters incident thereto. Issue: These are violations incurred in 2014 and 2015 primarily due to sanitary sewer overflows occurring due to ineffective notification equipment and/or faulty lift station operation.
Solution: This agreement includes a compliance supplemental environmental project that upon agreement through this document will allow us to re-invest the assessed fines towards improvements greatly needed within our system. Compliance with this agreement and reduce sanitary sewer overflows.
Multiple situations can occur in which leads to raw sewage overflowing out of underground collection systems; however, under most circumstances it is due to power loss or pump failures at station structures we call Lift Stations. This infrastructure is a scheduled improvement on our capital improvements listing in which we expect to proceed with in this existing year.
