COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. Issue: Meals On Wheels Requires Funds to be Transfer into the In Bulk Food do to the raise in cost of food and the increase in new clients to be able to purchase food. 

Solution: By Commissioners Court ratification of the approval, we will have funds to cover cost.

Result: With funds available, the department will be able to cover the cost for the home delivered meals.

7. Business Office
 
a.   Discussion and possible action to authorize the Budget Officers and Auditors Office to enter and post-budget amendments for fiscal year-end transactions necessary to process payment of all invoices dated or services rendered on or before September 30, 2022. Line item transfers are to be determined by the Business Office in coordination with the Auditors Office and presented for ratification.

Issue: Various departments and offices have depleted departmental budgets nonetheless there are invoices pending to be processed that must be paid with FY 2021-2022 funds. Invoices cannot be validated if the accounts are negative.

Solution: In order to timely process and pay invoices, Business Office will identify line items transfers and perform administrative budget amendments as needed to process invoices. A list of invoices pending process due to insufficient funds will be generated and provided to the Budget Officers by the Business Office.

Result: Invoices will be processed and sent to the Auditors for approval.
 
b.   Discussion and possible action to approve the transfer of employees within the following Slots with salary changes and approve the filling of the vacant Slot, subject upon the availability of payroll funds and any applicable Civil Service guidelines, effective September 30, 2022.

8. Civil Legal Division
 
a.   Discussion and possible action to enter into a three-year (3) extension to a Master Software License and Service Agreement (September 10, 2022 through September 9, 2025) between GOVOS, Inc. and Webb County for the County Clerk’s Court Case Management System at an annual cost of Sixty Nine Thousand Dollars ($69,000.00) for a total cost of Two Hundred Seven Thousand Dollars ($207,000.00) over the three year term extension, subject to annual budget appropriations, and authorizing the County Judge to sign and execute all relevant documents; and any matters incident thereto. [Requested by Margie Ramirez Ibarra, Webb County Clerk; Account #2006-2310-001-432001 (County Clerk Records Management Account)]
 
Issue: Webb County Clerk had their court case management system installed under a 2017 contract with a company that was taken over by Kofil Technologies, Inc. However, Kofil has assigned its software license maintenance services to the court case management system over to this new company called GOVOS. The current agreement needs to be extended so the software license and maintenance service for the court case management system can continue.
 
Solution: Enter into a three-year extension with GOVOS, Inc. for the County Clerk to be able to continue its license as well as maintenance service for its court management system at a cost of $69,000.00 per year for a total cost of $207,000.00 over the term extension. 
 
Result: Webb County Clerk will continue to be able to use the court case management system under an extended license agreement as well as maintenance of the system for another three years.
 
b.   Discussion and possible action to enter into a Lease Extension with GODOT Ltd., for office space used by Constable Precinct 4, for an additional four months (through February 28, 2023) and a rent escalation of approx. 8.3% (from $3,375.00 to $3,655.13) and any other matters incident thereto; authorizing the County Judge to sign all relevant documents. c.   Discussion and possible action to enter into a one (1) year (September 1, 2022 through August 31, 2023) Participating Entity Services Agreement between APPRISS, Inc. and Webb County. The agreement is by and through the State of Texas, Department of Information Resources for products and related services with APPRISS, Inc. and will provide appropriate maintenance to the software used with VINE (Victim Information and Notification Everyday Program) at a total cost of Twenty-Nine Thousand Four Hundred and three dollars with sixteen cents ($29,403.16) that will be paid by the Office of The Attorney General. There is no impact to the General Fund, authorizing the County Judge to execute any and all relevant documents; and any other matters incident thereto. [Requested by Martin Cuellar, Webb County Sheriff, Account #2712-3010-001-443000-035]
 
d.   Discussion and possible action to enter into a 12 month (October 1, 2022 through September 30, 2023) subscription agreement (Document Q-04057536) with West Publishing Corporation for the use of CaseLines Limited Jurisdiction Cases for the digital exchange of proposed exhibits and online evidence in an amount not to exceed Three Thousand Seven Hundred Fifty Dollars ($3,750.00) and any other matters incident thereto; authorizing the County Judge to sign all relevant documents. [Requested by Judge Victor Villarreal, County Court at Law 2; Account #1001-2070-001-464005]
 
9. Honorable Rosaura “Wawi” Tijerina, Webb County Commissioner Pct. 2
 
a.   Discussion and possible action to appoint Miss Pilar De La Fuente as the Webb County Community Action Agency Advisory Board Representative for Precinct 2 Commissioner Rosaura "Wawi" Tijerina.
 
10. Commissioners Court
 
a.   Discussion and possible action to authorize the purchase of a congratulatory advertisement for WBCA's 125th year Celebration festivities in the amount of $600.00. The Webb County Commissioners Court would be featured on the official WBCA Program Book. [Account #2004-1010-001-463526 (Community Promotions)]
 
b.   Discussion and possible action to authorize the purchase of an advertisement in the ByGeorge Magazine to promote tourism in Webb County during the Washington’s Birthday Celebration festivities in the amount of $2,295. The Webb County Commissioners Court would be featured on said advertisement.  [Account #1001-1310-001-454000 (Advertising)]
 
11. Community Action Agency
 
a.   Discussion and possible action to approve amendment #2 for the PY21 Comprehensive Energy Assistance Program (CEAP) American Rescue Plan Act (ARP Act) from the Texas Department of Housing and Community Affairs (TDHCA) for a budget transfer of $162,555.37 to the Utilities Assistance account; and authorizing the County Judge to sign any relevant documents and any other matters incident thereto.

Issue: The TDHCA has provided the agency with contract amendment to move Administrative funds to Direct Services funds.   

Solution: Commissioners Court approves contract amendment under PY21 CEAP ARP Act.  

Result: The agency will be able to cover additional energy bills under the program.
 
12. Honorable Marco Montemayor, County Attorney
 
a.   Discussion and possible action to approve a renewal of Title IV-E Child Welfare Services Contract #HHS000285000043 and Title IV-E Legal Services Contract #HHS000285100042 with the Texas Department of Family and Protective Services for a term of One (1) year (October 1, 2022 through September 30, 2023) requiring Webb County to maintain a Child Welfare Board and providing for the reimbursement for certain expenditures made by Webb County relating to foster children, and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto.
 
13. Economic Development
 
a.   Discussion and possible action to rescind the prior award of American Rescue Plan Act of 2021 Non-Governmental Organizations ARPA Sub-Award fund in the amount of Two Hundred Thousand Dollars ($200,000.00) to Texas A&M University Colonia; and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto.

Issue: The Texas A&M University Colonias declined the sub-award of $200,000 under the American Rescue Plan Act of 2021. 

Solution: Rescind the funds awarded to the Texas A&M University Colonias.

Result: Awarded funds to Texas A&M University Colonia will be returned to Webb County.
 
b.   Discussion and possible action to accept the Texas Indigent Defense Commission (TIDC) Improvement Grant #212-23-C17, for fiscal year 2022-2023, in the amount of $21,674.00, with a 40% county match of $8,669.00. The cash match was presented and approved during the budget hearing on 9/12/2022, and to authorize the Webb County Judge to sign all pertinent documents. This grant will be renewed for a possible 3rd year for FY 2023-2024 with a 60% county cash match. The necessary documents have been submitted for review to the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact procedures. Issue: Webb County has identified the need to hire weekend staff for the pre-trial services department to handle the front-end indigent defense process the magistrate hearings at the jail. 

Solution: Pre-trial services will carry out judicial activities during the weekend magistrate process in accordance to state legislative rules, local rules and guidelines in reference to indigent defense. 

Result: Our goal is to have an efficient and effective indigent defense process at the front-end of the criminal justice proceedings during the week. This will provide indigent offenders qualified attorneys to represent them in accordance with stat legislative and local rules.
 
14. Emergency Management
 
a.   Discussion and possible action to authorize the Webb County Commissioners Court to rescind and lift the prior July 25, 2022 outdoor fire/Burn Ban Order prohibiting all outdoor burning in all the unincorporated areas of Webb County commencing September 26, 2022 pursuant to Local Government Code §352.081; authorizing the Webb County Judge to sign any and all relevant documents and any other matters incident thereto. [Requested by Felix Nunez, Webb County Fire Marshal]

Issue: The recent heavy rains that fell throughout Webb County during the past 3 weeks have greatly reduced the current Keetch-Byram Drought Index (KBDI) average for Webb County and the plentiful rain totals in Webb County has alleviated this past summers extremely dry conditions) these heavy rains have greatly improved conditions for farmers and ranchers in the field all over Webb County, thereby significantly reducing the risk of wildfires and/or danger to damage to the life and property of our citizens.

Solution: Order an immediate lift and rescind the prior 90 days burn ban previously approved by the Court on July 25, 2022.

Result: Due to the recent heavy rains received in Webb County over the past several weeks Webb County Citizens will no longer be banned from outdoor burning in the unincorporated areas of Webb County.
 
15. Head Start
Disclaimer: All Head Start monies are 100% Federal funds
 
a.   Discussion and possible action to accept the 2022 - 2023 United States Department of Agriculture Child and Adult Care Food Program (USDA CACFP) continuation grant for the Head Start and Early Head Start program from October 1, 2022 through September 30, 2023.  This program provides reimbursement of meals (Breakfast, Lunch, Snack) to enrolled children and salaries of kitchen staff.  Acceptance of this grant includes a salary adjustment of 3% for all USDA CACFP staff.
 
             
16. Public Defender
 
a.   Discussion and possible action to approve the posting and filling of slot #2617, as well as any remaining vacant slot created by promoting from within, subject to the availability of payroll funds and any applicable Civil Service guidelines as well as any and all Wage Plan Policies, effective October 3, 2022.

Issue: Slot #2617 has become vacant. The Legal Assistant slot may be filled from within, thus creating a vacant position.

Solution: Request is being made to post and fill the vacant slot and any remaining vacant slot created from promoting from within.

Result: This action will allow our department to promote from within, fill the remaining vacant slot and allow our department to continue to function efficiently and effectively.
 
17. Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.
 
b.   Discussion and possible action to award Request for Qualifications (RFQ) 2022-006 Three (3) Year Contract for Dental Services to Asclepius Dental Center P.L.L.C. for services to include but not limited to dental consultations, x-rays and any dental related services required by a licensed Dentist for the Webb County Jail, Juvenile Detention Center and Head Start Programs and to further authorize the Civil Legal Division to negotiate the terms and conditions, fees and any other matters incident thereto.

Issue: The above-mentioned contract is set to expire on September 30, 2022.  Formal Request for Qualifications were published.

Solution: Consider awarding professional services to sole proposer Asclepius Dental Center P.L.L.C.

Result: If approved by Commissioners Court, professional services agreement(s) will be effective October 1, 2022.  Subject to Court approval on final terms and conditions and applicable fees for professional service agreement.
 
c.   Discussion and possible action to authorize the following two County vehicles previously approved for auction to be transferred on a temporary basis to the Fire Marshal’s Department pending the delivery of new fleet ordered through leasing program and any other matters incident thereto. [Account #1001-3130-001-462605 (Fuel and Lubricants)]

Issue: On September the 12th, Commissioners Court authorized the Purchasing Agent to order three (3) new lease vehicles for the newly created Fire Marshal Department.  Due to delivery lead time of approximately 21-22 weeks, the Fire Marshal will need some temporary units for operational purposes.   
 
Solution: Authorize the transfer of two (2) vehicles identified above, previously approved for auction, to be temporarily assigned to the Fire Marshal’s Department until arrival of leased units.  
 
Result: Approval of transfer will allow the Fire Marshal to establish a temporary fleet for Department use.

20.   Discussion and possible action to approve, by Order, the following budget amendment in the amount of $105,000 to cover Golf Course contractual payroll deficits for FY-2021 from payroll savings; and any other matters incident thereto.
 
Issue: Payroll for the Golf Course is projected to finish the fiscal year in a deficit.
 
Solution: 4th quarter County payroll savings will be used to cover this projected deficit in order to close out the fiscal year.
 
Result: Payroll expense will be covered until the end of the fiscal year.

Civil Legal Division
 
22.   Discussion and possible action to enter into a tax abatement agreement, pursuant to the county's guidelines and criteria under the Property Redevelopment and Tax Abatement Act, Chapter 312 of the Texas Tax Code, as requested by Siete Wind, LLC, for approximately $480,000,000 in improvements related to the production of renewable energy utilizing wind turbines for a ten year period and being a 100% tax abatement of ad valorem taxes (maintenance and operation only), with payments in lieu of taxes (PILOT payments) to be made annually to Webb County and any other matters incident thereto, and authorizing the county judge to sign all relevant documents.
 
23.   Discussion and possible action to enter into a tax abatement agreement, pursuant to the County's Guidelines and Criteria under the Property Redevelopment and Tax Abatement Act, Chapter 312 of The Texas Tax Code, as requested by Pradera Solar, LLC, for approximately $173,000,000 in improvements related to the generation and storage of electricity utilizing solar panels and batteries for a ten year period and being a 100% tax abatement of ad valorem taxes (maintenance and operation only), with payments in lieu of taxes (pilot payments) to be made annually to Webb County and any other matters incident thereto, and authorizing the county judge to sign all relevant documents.
 
24.   Discussion and possible action to enter into a professional services agreement with Ardurra Group, Inc., to prepare a Water & Wastewater Master Plan over a twelve (12) month period for a cost of Four Hundred Sixty Thousand Seven Hundred Dollars ($460,700.00) and any matters incident thereto; authorizing the County Judge to sign all relevant documents. Result: Webb County qualified GDL Engineering, LLC to provide consulting work on county engineering projects as well as identifying funding opportunities involving the Laredo & Webb County Metropolitan Planning Organization (“MPO”) and the Texas Department of Transportation (“TXDOT”)
 
33.   Discussion and possible action to approve “Work Authorization Number 1” with GDJ Engineering (“Consultant”) wherein under the Work Authorization, Consultant will be providing Advanced Planning MPO Coordination and Preliminary Project Development for county designated infrastructure projects and as more specifically detailed in Exhibit A to the Work Authorization Number 1 at a monthly cost for said services in the amount of EIGHT THOUSAND FIVE HUNDRED NINE DOLLARS ($8,509.00) with a maximum amount payable under Work Authorization Number 1 of THREE HUNDRED SIX THOUSAND THREE HUNDRED TWENTY FOUR DOLLARS ($306,324.00) over the term of the contract, and authorizing the County Judge to sign and execute all relevant documents; and any matters incident thereto.   • the sheriff, county tax assessor-collector, county treasurer, county clerk, district clerk, county attorney or criminal district attorney, and the number of public members (and alternates) necessary to provide nine voting members; or
  • nine public members (and alternates), if the commissioners court votes to have nine public members.
 
35.   Discussion and possible action to, pursuant to §152.015 of the Texas Local Government Code, determine the manner of selection of the public members and alternates to the Salary Grievance Committee:
