COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

7. Civil Legal Division
 
a.   Discussion and possible action acknowledging the continuation of the Memorandum of Understanding (MOU) between Webb County for the benefit of the Webb County Sheriff's Office and Homeland Security & Investigations (HSI) for reimbursement of employee overtime (OT) incurred from joint law enforcement operations, for the performance period of October 1, 2023 through September 30, 2024, in the amount of Fifteen Thousand Dollars ($15,000.00) and approve the use of the Webb County Sheriff’s Office State Forfeiture funds to cover the applicable fringe benefits associated with this project's employee(s) overtime; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Requested by Webb County Sheriff, Martin Cuellar; Fund-2601 Homeland Security and Fund 2150 State Forfeiture Funds for Fringe, (there will be no impact to the General Fund)]
 
Issue: The MOU renews automatically annually, however, fringe benefits must be covered by the Webb County Sheriff’s Office.

Solution: Approve the continuation of the MOU with HSI and authorize the funding of fringe benefits to Overtime employees.

Result: Fringe benefits that are owed to the employee that performed Overtime under this MOU will be covered by the Webb County Sheriff’s State Forfeiture Fund at no cost the County’s General Fund.
 
b.   Discussion and possible action to renew the "Webb County Stop Loss, Assumptions and Caveats” Agreement with Aetna for the performance period of January 1, 2024 – December 31, 2024; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Requested by Webb County Risk Department; Account #6100-1090-001-432056 (Administrative Fees)]
 
c.   Discussion and possible action to enter into a OCDETF Agreement Waiver in an amount of Five Thousand Six Hundred Twenty-Five Dollars ($5,625.00) with the United States Department of Justice, Drug Enforcement Agency and Webb County for the benefit of the Webb County Sheriff's Office for the performance period of (July 1, 2023 - September 30, 2023, being FY 2023), said agreement (Operation "BP") will provide additional funding needed to close out the FY 2023 balance for task force duties and overtime reimbursement payments to Webb County; authorizing the Webb County Judge to sign all relevant documents and any matters incident thereto. d.   Discussion and possible action to approve a professional services agreement from (September 30, 2023 through September 29, 2024) between Webb County for the benefit of the Adult Drug Court Treatment Program and La Familia Consulting and Counseling Services L.C. for services associated with the evaluation of Webb County’s Adult Drug Court program funded by the SAMHSA grant #1H79TI085855-1 in the amount of Two Thousand Eighty-Three Dollars ($2,083.00) per month for a total cost not exceed Twenty-Five Thousand Dollars ($25,000.00) for the year; authorizing the County Judge to sign all relevant documents, and all other matters incident thereto. [Requested by Commissioners Court for the Adult Drug Court Program; Account #2353-1020-003-432001 (Professional Services)]
 
Issue: The approval by the commissioners court the evaluation agreement is need under SAMHSA grant in which a treatment provider can provide the evaluation of the local drug court program.
 
Solution: The Commissioners Court approving the agreement so that a license treatment provider can submit evaluations to the Drug Court Program.
 
Result: The Adult Drug Court Program will be able to continue to provide services and operate fully as a treatment program that is evaluated by a treatment provider.
 
e.   Discussion and possible action to enter into a twelve (12) month Professional Services Agreement (September 30, 2023 through September 29, 2024) between Webb County for the Webb County Adult Drug Court Program and PILLAR to provide treatment services under SAMHSA Grant #1H79TI085855-01, specifically to allow P.I.L.L.A.R. to receive payment for personnel support services that will be provided in accordance with the terms of the grant application in an amount of not more than One Hundred Nine Thousand Two Hundred Dollars ($109,200.00) of which Nine Thousand One Hundred Dollars ($9,100.00) is allocated for time in providing out-patient services; and authorizing the County Judge to execute all relevant documents and any other matters incident thereto. [Requested by Commissioners Court, for the Adult Drug Court Program; Account #2353-1020-003-432001 Professional Services (SAMHSA Adult Drug Court Grant)]
 
f.   Discussion and possible action to enter into a Memorandum of Understanding (MOU) for the FY 2023 Edward Byrne Justice Assistance Grant (“JAG”) funded by the Department of Justice (“DOJ”) between Webb County for the benefit of the Webb County Sheriff’s Office and the City of Laredo acting on behalf of the Laredo Police Department, which will support equipment, training/travel, and supplies for law enforcement operational purposes. The proposed amount Webb County Sheriff’s Office will receive is Thirty-Four Thousand Six Hundred Ninety-Three Dollars ($34,693.00). There are no matching funds required and therefore there will be no impact to the general fund; authorizing the County Judge to execute all relevant documents and any other matters incident thereto. [Requested by Sheriff Martin Cuellar; JAG Grant Funds]
 
g.   Discussion and possible action to enter into a Professional Services Agreement (September 1, 2023, through August 31, 2024) between Webb County for the benefit of the Webb County Adult Drug Court Program and PILLAR to provide treatment services under Grant #4448102 from the Office of the Governor (OOG), specifically to allow P.I.L.L.A.R. to receive payment for personnel support services that will be provided in accordance with the terms of the grant application in the total amount of not more than Eighty-Two Thousand Seven Hundred Forty-Six Dollars ($82,746.00), including an amount of not more than Six Thousand Eight Hundred Ninety-Five Dollars and Fifty Cents ($6,895.50) for time in providing family out-patient therapy services; authorizing the County Judge to execute all relevant documents and any other matters incident thereto. h.   Discussion and possible action enter into an agreement between Webb County for the benefit of the Webb County Medical Examiner’s Office and NMS Labs for the performance period of (October 1, 2023 – September 30, 2024) for services in amounts ranging from Sixty-Four Dollars ($64) to Four Hundred Twenty-Five Dollars ($425.00) per lab test conducted. Said agreement sets the fee schedule for performing specific lab tests requested by the Webb County Medical Examiners Office; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. k.   Discussion and possible action to enter into a State and Local HIDTA Task Force Addendum Agreement with the United States Department of Justice, Drug Enforcement Agency and Webb County for the Webb County District Attorney's Office which extends the performance period of one year to (October 1, 2023 - September 30, 2026, being FY 2026), said agreement will provide funding for task force duties and overtime reimbursement payments to Webb County; and authorizing the Webb County Judge to sign all relevant documents and any matters incident thereto. l.   Discussion and possible action to enter into Work Authorization #9 with Capex Consulting Group for Tax Abatement consulting services related to the Guajillo Energy Storage, LLC and any matters incident thereto; authorizing the County Judge to sign all relevant documents. [No effect on County budget]
 
m.   Discussion and possible action to enter into a twelve (12) month renewal agreement (September 9, 2023 through September 8, 2024) “Application Software User-Based Annual Renewal Support Services Agreement” with Hamer Enterprises for computer software and support services for the Webb County Tax Office’s Real Estate and Personal Property Tax Administration, Billing, Collection, and Distribution System, Vehicle Inventory Tax Processing, and Tax Website Credit Card billing/Collection, in the amount not to exceed TWENTY THOUSAND ONE HUNDRED SIXTY DOLLARS ($20,160.00) and any other matters incident thereto; authorizing the Webb County Judge to execute any and all relevant documents. n.   Discussion and possible action to approve a One (1) year Professional Service agreement between Webb County (for the benefit of the Adult Drug Court Program) with Recovery Monitoring Solutions (RMS), to provide continuous alcohol monitoring, breath-alcohol testing and/or drug patch services commencing September 1, 2023, through August 31, 2024. Services will include various services at a cost of Six Dollars ($6.00) to Eighty Dollars ($80.00) depending on the application of the SCRAM CAM, SCRAM CAM via Ethernet, Blood Alcohol Testing, and Participants will also directly pay the vendor for damages to RMS equipment; and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. [Requested by Judge Tano E. o.   Discussion and possible action to enter into a Sixty (60) month State and Local Term Rental Agreement (Buy Board #656-21) between Webb County (for the benefit of the Webb County Tax Office) and Pitney Bowes for the performance period of August 29, 2023 thru September 28, 2028 in an amount of Two Hundred Sixty-Seven Dollars and Sixty-Six Cents ($267.66) per month; subject to annual budgetary appropriations and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto. p.   Discussion and possible action to accept the “Surface Estate” of Lot Number 1, Block 1, San Rafael Subdivision, Laredo, Webb County Texas, located at 1301 Paseo De Los Santos/U.S. Hwy. 83 S, from Charco Land Sales, LLC. to Webb County, Texas, as per the terms of the Charco Land Sales, LLC./Killam Family Coves” TIRZ Development Agreement dated December 13, 2021 between Webb County and Charco Land Sales, LLC to be used for “public purpose uses ”, said Lot shall be the location of the Webb County Southern Public Health Facility and/or and authorizing the Webb County Judge to execute any and all relevant documents; and any other matters incident thereto. q.   Discussion and possible action to authorize and approve payment to the members of the Webb County Deputy Sheriffs’ Association as agreed in the Collective Bargaining Agreement between Webb County and the Webb County Deputy Sheriffs’ Association which allows the annual leave buy back, to include those hours accrued and exceeding 20 hours of annual leave after the buy-back, calculated as of October 31 of the fiscal year for which the buy-back is available (FY2022-2023), provided that the member has submitted the Annual Leave Buy-Back Application by October 31, 2023 and any matters incident thereto.

Issue: CBA permits applications for Annual Leave Buy Back to be submitted by a Member no later than Oct 31st. 

Solution: The Collective Bargaining Agreement with the Deputy Sheriff's Association Agreement specifically permits the Commissioners Court to resolve these and Court action authorizes payment. 

Result: Maintain the Collective Bargaining Agreement that was entered into in good faith with the Deputy Association pursuant to Chapter 174 of the Texas Local Government Code.
 
r.   Discussion and possible action to ratify the execution of Change Order No. 1 between Webb County, Texas on behalf of their CAA Self-Help Center and Midas Contractors, LLC., for Rehabilitation Contract Number- SHC 7220013-REHAB-03, in the amount of One Thousand Three Hundred and No/100 Dollars ($1,300.00) thereby increasing the total contract amount to the new total amount of Seventy-Two Thousand Seven Hundred Dollars ($72,700.00). The change order is needed by contractor to repair and replace 10 linear feet of copper water line and patch and paint the affected interior walls; and authorizing the County Judge to execute any and all relevant documents and any other matters incident thereto. s.   Discussion and possible action to approve the execution of the "Webb County Fairgrounds - Restaurant & Concession Operator Lease" with sole proposer Suarez Restaurant as per (RFP) 2023-014, for a two year (2yr.) term, commencing November 15, 2023, as per the terms and conditions set forth therein; and authorizing the Webb County Judge to sign all relevant document and any other matters incident thereto. [Requested by Alberto Torres, Webb County Fairgrounds Director]
 
Issue: One (1) sealed proposal was submitted in response to this public solicitation for restaurant and concession operations at the Webb County Fairgrounds facility.
 
Solution: Consideration to approve the execution of the "Webb County Fairgrounds - Restaurant & Concession Operator Lease" with sole proposer Suarez Restaurant as per (RFP) 2023-014 award. Suarez Restaurant has serviced the Laredo community for over 30 years in the food industry and has provided related services in the past to LIFE fair and other local government entities.
 
Result: If approved, he will begin operations on November 15, 2023 upon approval of the lease and restaurant service agreement by the Webb County Commissioners Court.
 
t.   Discussion and possible action to approve the execution of the "Webb County Fairgrounds – Special Events Decorating Services Agreement between Webb County and sole proposer Odisa Enterprises, LLC., as per prior award of (RFP) 2023-015, for a two year (2yr.) term commencing November 15, 2023, as per the terms and conditions set forth therein; and authorizing the Webb County Judge to sign all relevant document and any other matters incident thereto. Issue: One (1) sealed proposal was submitted in response to this public solicitation for special events decorating services at the Webb County Fairgrounds facility.
 
Solution: Consideration to approve the execution of the "Webb County Fairgrounds – Special Events Decorating Services Operator Lease" with sole proposer Odisa Enterprises, LLC., as per prior award of (RFP) 2023-015. Odisa Enterprises, LLC., has serviced the Laredo community for over 30 years in the special events, decorating and food catering industry and has provided related services in the past to LIFE fair and other local government entities.
 
Result: If approved, he will begin operations on November 15, 2023 upon approval of the lease and restaurant service agreement by the Webb County Commissioners Court.
 
8. Hon. Guadalupe Gomez, Constable Precinct 1
 
a.   Discussion and possible action to approve a rental agreement between Store it all Storage and Webb County for Constable Pct. 1 in the amount of TWO HUNDRED FIFTY-ONE DOLLARS ($251.00) per month for a total of TWO THOUSAND EIGHT HUNDRED THIRTY-THREE ($2,833.00) and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Issue: Previous agreement was funded within forfeiture funds. Request to transfer funding source was presented, however, requires Commissioners Court approval.

Solution: Accept and approve transfer of funding source. 

Result: Storage space will remain available to maintain and secure the items currently stored by Constable Pct. 1 office.
 
 
9. Commissioners Court
 
a.   Discussion and possible action to ratify an Interlocal Agreement between Regional Public Defender Office Local Government Corporation (RPDO) and Webb County to provide court-appointed counsel for individuals charged with capital murder offenses for the fiscal year 2023-2024, in an amount not to exceed One Hundred Nine Thousand Nine Hundred Twenty-Seven ($109,927.00) per year; and authorizing the County Judge to execute all relevant documents; with additional action to approve the budget amendment of $40,000 from the operational reserve; and any other matters incident thereto. [Requested by Civil Legal Dept., Account #1001-1130-001-452001-035 (Capital Murder Insurance)]
 
b.   Discussion and possible action to authorize the payments in the amount not to exceed Forty Thousand Dollars ($40,000) to the vendors listed for the Webb County Employee Christmas Dance scheduled for Friday, December 1, 2023, with further action to release check upon court approval and authorizing County Judge to sign any associated service agreements; and any other matters incident thereto. 10. Community Action Agency
 
a.   Discussion and possible action to authorize the Purchasing Agent to advertise for formal bids for Commercial Driver’s License Training. This action will not impact the County General Fund.  [Account #2368-5170-521-457008-010 (Community Service Block Grant - Social Service - C.A.A. Contractual Skills Training)]

Issue: Texas Department of Community Affairs (TDHCA) requires the Agency solicit procurement process for the Community Services Block Grant.

Solution: Approve the solicitation of procurement process.

Result: To secure the selection of a vendor that will provide the CDL Driver Training to CAA clients participating in the transition out of poverty program.
 
11. Economic Development
 
a.   Discussion and possible action to authorize the submission of a FY 2024 National Crime Victims’ Right Week (NCVRW) Community Awareness Project (CAP) grant application in the amount of $5,000 to the Office for Victims of Crime (OVC) as developed, written, and submitted by the Webb County Sheriff’s Office Grant Writer, and designating the Webb County Judge as the authorized official to sign all relevant documents; and any other matters incident thereto. This grant requires no financial match, and, thus, will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: The rights of crime victims are enshrined in the federal code (Section 3771 of Title 18 of the U.S. Code, Crimes and Criminal Procedure), the Texas Constitution (Article I Section 30), and the Texas Code of Criminal Procedure (Chapter 56). However, many victims of crime are unaware of their mandated rights as well as the services that are specifically available to them to facilitate needed restitution, recovery, privacy, dignity, and justice.

Solution: Grant application to highlight the rights of and services for crime victims in the Laredo/Webb County area during the National Crime Victims’ Right Week.

Result: The general public and any victims of crime will become more aware of the services available to them in the Laredo/Webb County area.
 
b.   Discussion and possible action to accept the award and enter into an agreement with the Texas Office of the Governor - Criminal Justice Division (CJD) DC- Specialty Courts Program Grant #4448102, in the amount of ONE HUNDRED NINETY THREE THOUSAND THREE HUNDRED TWENTY FIVE DOLLARS ($193,325.00) beginning September 1, 2023 - August 31, 2024, for the Webb County Adult Drug Court Program, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. There is no cash/in-kind match required, therefore there is no financial impact to the general fund. All required documents were sent for review to the Economic Development Department and the acceptance of the grant award is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Notice of Award from the Office of the Governor for the Adult Drug Court Program was received on October 23rd, 2023, acceptance by Commissioners Court is required to activate grant funding.

Solution: Accept the Notice of Award to proceed with additional treatment services to eligible Drug Court participants.

Result: If accepted, funding will provide services without interruption to eligible clients.
 
c.   Discussion and possible action to approve the acceptance of a Violent Crimes Against Women Criminal Justice and Training (VAWA) grant award from the Criminal Justice Division (CJD) Office of Governor (OOG) in the amount of $7,000 as developed, written, presented, and submitted by the Webb County Sheriff’s Office Grant Writer for training and supplies for investigators and patrol officers working at the Webb County Sheriff’s Office serving victims of violent crimes against women and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires a Thirty (30%) percent cash match, or a $3,000 cash match of the $10,000 (=$7,000 grant+$3,000 cash match) total project cost. This $3,000 cash match will be met by the Webb County Sheriff's Office forfeiture funds. Thus, this grant will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. Issue: Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area. According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766. That's almost double the amount of casualties lost during wars in Afghanistan and Iraq. Women who will be victims of severe violence by an intimate partner in their lifetimes number 1 in 4.  (“30 Shocking Domestic Violence Statistics That Remind Us It’s An Epidemic” Vagianos 10/23/2014).

Solution: Grant award to enhance the tools, techniques, and training to those investigators who follow-up to calls for assistance, conduct interviews with these victims, file incident reports, provide these victims information/referrals to service providers, initiate arrests of perpetrators, refer cases for prosecution, and prepare testimony/evidence for trial in cases of domestic violence, sexual assault, dating violence, and stalking.

Result: Enhanced law enforcement services, including investigative techniques, to deal with emergent criminal trends, such as cyber stalking, and improved efficacy of the law enforcement response to the needs of victims of violent crime.
 
d.   Discussion and possible action to authorize the acceptance of a grant award in the amount of $29,119.93 from the Office of the Governor Criminal Justice Division as developed, written, and submitted by and for the Webb County Sheriff's Office Grant Writer for overtime and applicable fringe benefits for members of the Mental Health Unit to provide mental health services to the citizens of Laredo/Webb County; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The local Laredo/Webb County community continues to constitute a medically and mental health underserved area, which requires mentally ill youth and adults to travel to out-of-town facilities in order to receive these needed mental health services.

Solution: Grant award to provide training and consultant services to provide supplemental instruction on responding to crisis intervention/mental health matters for the officers of the Webb County Sheriff's Office as well as overtime and applicable fringe benefits for the Mental Health Unit to transport mental health patients to these out-of-town facilities so that they may receive the care that they require.

Result: Grant funding will allow officers of the Webb County Sheriff's Office Mental Health Unit to undertake complex and time consuming activities and requirements, including execution of court orders, mental health commitments, and the actual transports to out-of-town mental health facilities, so that the mentally ill patients, their families, and the overall community can be better served.
 
e.   Discussion and possible action to authorize the acceptance of a grant award in the amount of $27,535 from the Office of the Governor Criminal Justice Division as developed, written, and submitted by the Webb County Sheriff's Office Grant Writer for equipment, minor tools, training/travel, and supplies for the Webb County Sheriff's Office peace officers and canines of the K9 unit; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: K9s and the Officers who handle them perform a myriad of important law enforcement duties. However, due to the complexity, diversity, and wide depth/breadth of important law enforcement/criminal justice functions all Sheriff’s Offices perform, there are finite financial resources available to provide for these types of specialized divisions.

Solution: Grant award to provide supplemental resources for equipment, minor tools, and supplies in support of the K9 unit.

Result: Grant funding will allow members of the K9 Unit to be equipped with supplemental resources.
 
f.   Discussion and possible action to authorize the acceptance of a grant award in the amount of $26,456.25 from the Office of the Governor Criminal Justice Division (CJD) as developed, written, and submitted by the Webb County Sheriff's Office Grant Writer for Body Worn Camera (BWCs) equipment, software, and supplies for the Webb County Sheriff's Office peace officers; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires cash match of 25% or $8,818.75, which will be met utilizing the Sheriff’s Office forfeiture funds (Fund #2152) for a total project cost of $35,275; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The use of Body Worn Cameras have been shown in studies to be an effective strategy for law enforcement agencies, and their use has grown to be a standard and beneficial practice for sworn officers. 

Solution: Grant award to expand and leverage grant resources so that the Webb County Sheriff’s Office will be able increase transparency and accountability through the continued utilization of body-worn cameras for its sworn officer force.

Result: The Webb County Sheriff’s Office will be able to achieve greater transparency and accountability in its service and protection of the Laredo/Webb County public and taxpayers.
 
g.   Discussion and possible action to accept a Fiscal Year (FY) 2023 Justice Assistance Grant (JAG) grant award from the Department of Justice as prepared, written, coordinated by the Webb County Sheriff’s Office Grant Writer in conjunction with the City of Laredo in the amount of $34,693 for equipment, minor tools, and supplies; and authorizing the Webb County Judge to execute all relevant documents related to this grant; and any other matters incident thereto. This grant does not require any type of match, and, thus, has no impact to the general fund. Issue: Supplemental equipment, training/travel, and supplies will allow the Webb County Sheriff’s Office to provide better and more enhanced law enforcement services.
 
Solution: Grant award to provide supplemental equipment, training/travel, and supplies for the Webb County Sheriff’s Office. 
 
Result: The Webb County Sheriff’s Office and its staff will be equipped with needed new equipment, training/travel, and supplies.
 
h.   Discussion and possible action to authorize by order a line-item transfer from American Rescue Plan Act (ARPA) Revenue Replacement line item to Non-Governmental Organizations (NGO) line item in the amount of $147,708.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures and authorizing the County Judge to sign all relevant documents and any other matters thereto.  No impact to the general fund.
 
Issue: Webb County has a surplus of $352,292 in funds available through the Non-Government Order (NGO) line item.  In order to enter into an agreement with NeighborWorks, $147,708 needs to be transferred from ARPA Line Item to NGO Line Item.
 
Solution: Transfer $147,708 from ARPA line item to NGO line item to increase the budget to $500,000 thus being able to enter into contract with NeighborWorks.
 
Result: NGO budget will increase to $500,000.
 
i.   Discussion and possible action to authorize an amendment of the American Rescue Plan Act Sub-Recipient Assistance Grant Program Sub-Recipient Monitoring Policy, Goals and Procedures Handbook to update the award limit from $200,000.00 to $500,000.00.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures and authorizing the County Judge to sign all relevant documents and any other matters thereto.  No impact to the general fund.

Issue: NGO ARPA has surplus funds available from the NGO line-item balance and additional; revenue replacement ARPA funds.   
 
Solution: To approve award and enter into agreement with the Neighborworks Laredo.

Result: NGO ARPA funds will allow Neighborworks Laredo to construct infrastructure and other improvements for the Three Points Village 24 project.

a.   Discussion and possible action to submit to the Administration for Children and Families Office of Head Start a request for release of Federal Interest in five modular units that are classified as equipment. These modular units are known to this program as Jesus Garcia I, II, and III and Magic Corner I and II.  If approved for disposition by the Webb County Commissioners Court and the Office of Head Start, the program will follow the Webb County Purchasing Rules and Regulations for property disposal/auction for three modular units (Jesus Garcia I, II, and II) and donationa (no value to be received) of two modular units (Magic Corner I and II) to a local, non-profit agency named Volunteers Serving the Need (VSTN). 

Issue: As of August 2011, the Webb County Head Start Program has been gradually integrating classrooms with the two local independent school districts (ISD).  Currently, the program has twenty-three (23) classrooms integrated with Laredo ISD and twenty-four (24) classrooms integrated with United ISD.  With each new integration, the use of dated modular buildings that are placed on rented proberty is being phased out. 

Solution: Approve the submission of a Request to Remove Federal Interest in Five Modular Units to the Administration for Children and Families Office of Head Start.

Result: The Head Start program will benefit from a cost saving (space rental) and continue to increase the number of integrated classrooms with the local ISDs for augmented services to enrolled students and families.

Issue: Cellular phones are needed for Planning’s field personnel to ensure communication while out on inspections around Webb County (extensive rural area). Currently field staff have to rely on personal devices to communicate with applicants and respond to any emergency or complaints.  Additionally, new file management software will integrate with mobile device for real-time inspection information.
 
Solution: Approval of cell phones will ensure that the staff out in the rural areas is able to communicate with the office and applicants at all times as well as provide real-time inspection data.
 
Result: Staff will be able to communicate with the office and respond to any calls on a daily basis.
 
15. Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.
 
16. Webb County Fairgrounds
 
a.   Discussion and possible action to authorize the Purchasing Agent to advertise a formal Request for Proposal for Markerting Advertising Services for the Webb County Fairgrounds Facility for year round venue marketing as needed for a minimum of a one (1) year term pursuant to the Texas Local Government Code; §262.030 Alternative Competitive Proposal Procedures for Certain Goods and Services and any other matters incident thereto.

Issue: Request RFP for Marketing Advertising Services to promote venue. 

Solution: Authorize the Purchasing Agent to seek competitive sealed proposals pursuant to the Local Government Code for these requested services.
 
Result: Return to Court with a recommendation of award to the respondent that submit the best value proposal to Webb County and if need be, best and final offer.

Issue: Currently the exhibit barn is utilized for different events for vendor point of sales and exhibition purposes. Making the area a high traffic location for community events. The building has poor ventilation and during the hot summer months creating potential health hazard.

Result: Provide a safe exhibit barn for public use.

19.   Discussion and possible action to correct the appoint/re-appoint the Civil Service Commissioners that was approved on November 14, 2022 under Item 21, for a Two – year term, commencing January 1, 2023 – December 31, 2025 to January 1, 2023 – December 31, 2024 and any other matters incident thereto.
 
Issue: The term for each Civil Service Commissioner is two years and due to a clerical error the date of 2025 was used instead of 2024.
 
Solution: Correct the appointment term to January 1, 2023 – December 31, 2024 in conformance with Civil Service Rules and Regulations for the appointment of a Commissioner for 2 years.
 
Result: The appointment or re-appointment of the commissioners will insure smooth and efficiently run commission, and will provide good continuity for such an important function.

21.   Discussion and possible action to enter into a Memorandum of Understanding with the City of Laredo for a five-year period to refer Webb County Drug Court candidates to the City of Laredo Drug Court Based Substance Use Treatment Program funded by the U.S. Department of Health and Human Services for detox services and any matters incident thereto; authorizing the County Judge to sign all relevant documents. Issue: The Purchasing Agent secured two (2) sealed bids.  Both bids exceed the budgetary limits of this project.  Staff, Project Architect and ARPA Consultant are recommending that all bids be rejected and for project scope to be modified in order to secure pricing that will not exceed ARPA funding allocated for this project.
 
Solution: Reject all bids, modify scope of work, and re-advertise using the CSP delivery method as per Government Code Chapter 2269, contracting and delivery procedures for construction projects.
 
Result: The Purchasing Agent will re-advertise using the CSP delivery method contingent upon construction bid documents revised and subject revisions approved by Commissioners Court.
 
26.   Discussion and possible action to approve Invitation to Bid No. 2023-010 “Webb County Southern Health Facility – Project No. 70800001013” to the lowest and responsible bidder pursuant to the Texas Government Code; §2269.101 (Contracts for Facilities: Competitive Bidding and if applicable with the Code of Federal Regulations §200.318 - §200.327 (General Procurement Standards) and to further authorize the County Judge to sign all relevant construction contract documents for execution and any other matters incident thereto. [Account #3520-7230-001-470000 (TDHCA CARES Rio Bravo Health Center-Construction In Progress-Administration-Capital Outlay)]
 
Issue: The Southern Health Facility project will provide residents access to the first time freestanding public health center in southern Webb County with a proposed area of 10,585 SF.  The land is approximately 4.0208 acres northeast of Rio Bravo, Texas west right-of-way line of U.S. Hwy 83.  In addition, the health center will be the new location for the Webb County Health Department, who shall operate and facilitate the center.  The Department will have the opportunity to provide an array of medical and health services to the rural residents of the non-entitlement area of Webb County
 
Solution: Consideration to approve the award to the lowest and responsible bidder as recommended by the Purchasing Agent and Project Architect.   This project is funded by the Texas Department of Housing and Community Affairs (TDHCA) under the U.S. Department of Housing and Urban Development Community Development Block Grant CARES Act (CDBG-CV) program project number 70800001013.
 
Result: If approved, authorize General Counsel to finalize the construction documents for execution by the County Judge contingent upon all Performance and Payment bond and insurance requirements are met by the awarded bidder.

27.   Discussion and possible action to approve the Webb County Jury Selection Plan in accordance with Texas Government Code 62.011 with an effective date of November 1, 2023.

Issue: Jury plan needs to be updated.

Solution: Recommendation to Commissioner's Court for approval and to be adopted.

Result: Jury Plan will be up-to-date.

28.   Presentation by Dub Taylor with Texas Pace Authority with discussion and possible action to approve the Resolution of Intent to establish the Webb County Property Assessed Clean Energy (PACE) Program, in accordance with the requirements of the Property Assessed Clean Energy Act as set forth in Texas Local Government Code Chapter 399; and any other matters incident thereto.
 
Issue: Limited funding opportunities for property owners who want to make property upgrades while remaining budget neutral. Developers want to take advantage of a low-cost, long-term replacement to expensive equity partner financing. Service or capital provider who want to offer more services to customers with low risk. Local government interested in creating jobs and improving the environment but have limited resources.
 
Solution: Property Assessed Clean Energy (TX-PACE) is a proven financial tool that incentivizes Texas’ property owners to upgrade facility infrastructure with little or no capital outlay. Approved by State legislation and established by local governments, TX-PACE programs enable owners to lower their operating costs and use the savings to pay for eligible water conservation, energy efficiency, resiliency, and distributed generation projects. Owners gain access to private, affordable, long-term (typically 10-20 years) financing that is not available through traditional funding avenues.

Result: 92 PACE Programs Established in Texas, 80 Projects Completed, $ 448,582,427 Dollars Invested, 5,702 Jobs Created, 44,563 CO2 Reduced (tonnes/yr), 77,485,416 Energy Saved(kWh/yr), 79,929 Natural Gas Saved (mmBTU/yr), 118,483,293 Water Saved (Gal/yr).
 
29.   Discussion and possible action to designate Mrs. Monica Flores with Human Resources as interim director of Risk Management; with additional action requesting the authorization to reclassify the current Risk Management Director slot #317, grade 26 to a Risk Manager position, grade 24, to oversee the Risk Management operations and functions; and any other matters incident thereto.
