COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: There are excess funds under Unemployment Tax and Worker's Compensation that can be utilized to cover future expenditures under  the categories of Overtime, FICA, and Retirement. 

Solution: Seek a line item transfer to use excess grant funds in certain budget categories to cover future expenditures under other budget categories. 

Result: The grant funds will be used effectively, efficiently, and fully.

6. Civil Legal Division
 
a.   Discussion and possible action to approve an amendment to the Substance Abuse Treatment Services Operation Agreement between People with Ideas of Love, Liberty, Acceptance, and Respect (P.I.L.L.A.R.) and Webb County for the 406th Judicial District Court-Veterans Treatment Program for professional counseling services for eligible court participants as previously approved by the Commissioners Court on February 12, 2018; item no. 5k., by amending Article  IV, of the agreement entitled Professional Service and Duties, to provide for a revised, updated and corrected scope of services in new Article IV, Professional Services and Duties, to remove and/or add professional services and/or duties that were erroneously included or excluded from the original agreement, and also amending Article V., entitled Compensation, to provide for and authorize the payment for counseling services by Webb County to (P.I.L.L.A.R.) at the rate of $250.00 per counseling session, and at a cost not to exceed Three Thousand Three Hundred Thirty Three Dollars and Thirty-Three Cents ($3,333.33) per month with a total cost not to exceed Forty Thousand Dollars ($40,000.00) over the term of the agreement, upon approval and execution of this item, the amendments shall be effective retroactively to July 1, 2017, the date of approval of the 406th Judicial District Court-Veterans Treatment Program/Grant; and authorizing the County Judge to sign and execute all relevant documents, and any other matters incident thereto. Issue: Due to a higher volume of community recognitions and use of the Commissioners Courtroom for meetings, there is a shortfall in the Goods for Public Events account.

Solution: Transferring funds will pay pending invoices and leave small amount to complete end of year expenses.

Result: The commissioners court and county judge will be able to continue with meetings and community recognitions until the end of this fiscal year.
 
10. Economic Development
 
a.   Discussion and possible action to authorize the submission of a grant application for the Internet Crimes Against Children (ICAC) as prepared and submitted by the Webb County Sheriff’s Office to the Office of the Texas Attorney General in an amount estimated at $5,000; and any other matters incident thereto. There is no cash match; and, thus, no cost to Webb County. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: The psychological, emotional, and physical damage caused by child predators and inflicted on innocent victims, their families, and communities can be deeply destructive and have far-reaching consequences that can last a lifetime. Furthermore, throughout the United States, criminal cases built against child predators can be extremely complex, technologically challenging, and legally complicated.
 
Solution: The Webb County Sheriff’s Office cyber crimes law enforcement unit has successfully worked with multiple federal, state, and local law enforcement agencies, including the Office of the Attorney General, to arrest numerous child predators in the Laredo/Webb County area. Grant application to supplement the successful endeavors of the Webb County Sheriff’s Office cyber crimes against children task force to protect the children and youth of the Laredo/Webb County community against child predation.
 
Result: The Webb County Sheriff’s Office will continue to enhance its ability to work proactively not only to catch individual child predators, but to produce an overall inhospitable environment for cyber crimes against children in Laredo/Webb County for the further prevention of child predation in our community.
 
b.   Discussion and possible action to approve the submission of a supplemental grant application as prepared and submitted by the Webb County Head Start and Early Head Start Program to the Department of Health and Human Services Administration for Children & Families for a Fiscal Year 2018 - 2019 Refunding grant in the amount of $274,511 (Federal) and $68,628 (Non Federal) for a Total Amount of $343,139 for a cost of living adjustment (COLA) of 3.0 percent to all Head Start and Early Head Start full-time and part-time employees; and authorizing the Webb County Judge to execute all relevant documents related to this grant; and other matters thereto.  Furthermore, this grant does not require a cash match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Aliza Oliveros, Head Start Director]
 
c.   Discussion and possible action to approve the submission of a supplemental grant application as prepared and submitted by the Webb County Head Start and Early Head Start Program to the Department of Health and Human Services Administration for Children & Families for a Fiscal Year 2018 - 2019 Refunding grant in the amount of $19,548 (Federal) and $4,887 (Non Federal) for a Total Amount of $24,435 for 3 percent cost of living (COLA) adjustment; and authorizing the Webb County Judge to execute all relevant documents related to this grant; and other matters thereto.  Furthermore, this grant does not require a cash match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. d.   Discussion and possible action to authorize the acceptance of the 2nd allocation of the High Intensity Drug Trafficking Areas Grant (HIDTA Program) from the Executive Office of the President, Office of National Drug Control Policy in the amount of $310,080 of the total $477,046, for the continued salary and fringe benefits of seven Task Force Investigators; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Matching funds have already been committed for this grant in the amount of $100,121 through the budgetary process. Issue: There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.

Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.

Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.

16. Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code; Section 263.152 (Disposition) and authorizing the Purchasing Agent to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through a and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments.
 
b.   Discussion and possible action to enter into a historical civil and criminal case file preservation project agreement/phase III, between Webb County and Kofile Technologies, Inc. for an amount not to exceed $149,993.13, pursuant to Section 271.103, Subchapter G (Purchase Federal Schedule Sources of Supply), GSA Contract No. GS-35F-275AA, and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. [Requested by Esther Degollado, District Clerk;Account #2009-2290-001-460105 (Court Technology Fund – District Clerk – Administration – Minor Tools & Apparatus)]
 
Issue: Due to the historical nature and continued physical deterioration of these 8 boxes (out of the remaining 67) of the Webb County Historical Civil and Criminal Case Files, and the required permanent retention period requirements as per the Texas State Library & Archives Commission, 2011, these historical civil and criminal case file records stored and located at the Webb County District Clerk’s Office need to be properly preserved, remediated, protected, archived, microfilmed and stored in order to prevent any further deterioration by providing for surface cleaning, tear repairs, removal of deposits, including dust, soot, airborne particulates , sedimentation, insect detritus, and/or biological/mineral contaminants, archival imaging, indexing, microfilming, and binder storage of these files.
 
Solution: Approval of this Webb County Historical Civil and Criminal Case Files Preservation Project Agreement with Kofile Technologies, Inc., will provide for the proper preservation, archival imaging, indexing, and storage of these historical civil and criminal case files and records at the Webb County District Clerk’s Office.
 
Result: Historical Civil and Criminal Case File preservation and physical deterioration preventive measures will ensure that these files and records are properly preserved, cared for and maintained by the Webb County District Clerk’s Office.
 
c.   Discussion and possible action to authorize the purchase of audiovisual equipment with installation from Audio Dynamics, Inc. with funding from the court technology fund to be used for Justice of the Peace Pct. 4 Judge Jose R. Salinas in the amount of $7,500 (Seven Thousand Five Hundred Dollars). [Requested by Judge Jose “Pepe” Salinas; Account #2009-2180-001-460105 (Court Technology Fund)]
 
Issue: The Justice of the Peace Precinct 4 department is in need of updated audiovisual equipment for their court operations.
 
Solution: By using available Technology funds, the department can procure audiovisual equipment with installation needed for daily court operations.
 
Result: Obtained audiovisual equipment will better equip department for all court needs.
 
REGULAR AGENDA
 
Economic Development
 
17.   Discussion and possible action to authorize the submission of a grant application for the Fiscal Year (FY) 2018 Operation Stonegarden (OPSG) as prepared and submitted by the Webb County Sheriff’s Office to the Office of the Governor Homeland Security Grants Division in an amount not to exceed $9,375,029 for overtime, full-time personnel, associated fringe benefits, equipment, supplies, mileage, helicopter maintenance/fuel, vehicle/tire maintenance, data services, Management & Administration (M&A), and maintenance of OPSG-acquired assets for local law enforcement agencies; and any other matters incident thereto. There is no cash match; and, thus, no cost to Webb County. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Complex and dynamic law enforcement challenges exist in the Southwest border area of the United States, including Laredo/Webb County. For example, transnational criminals seek to exploit existing law enforcement jurisdictional boundaries by conducting their illegal enterprises across traditional jurisdictional divisions. The 2014 Texas Gang Threat Assessment expounds, “Gang activity remains widespread throughout all regions of Texas…Gang activity is also prevalent in the Texas counties adjacent to Mexico and along the key smuggling corridors, since Texas-based gangs are used for cross-border smuggling and trafficking in the state. Many transnational gangs operating in Texas….engage in criminal activity in Mexico as well as in Texas and elsewhere” (Texas Department of Public Safety April 2014).

Solution: Grant application: (1) to ensure first responders are equipped with enhanced tools/equipment/resources needed to confront well-funded criminal organizations and (2) for the coordination of law enforcement efforts between various local and federal law enforcement agencies.
 
Result: Enhanced capabilities of local law enforcement responders; further coordination of response across local and federal jurisdictions.
 
             
Engineer
 
18.   Discussion and possible action for approval of a change order in the construction contract for the Webb County Fire Station (Los Botines) between Webb County and Hydroworks, Inc. for the installation of an On-site Sewage Facility at a cost not to exceed One Hundred Twenty Five Thousand Dollars ($125,000.00) and authorizing the County Judge to execute all relevant documents and any other matters incident thereto. Fire Suppression & EMS Services
 
19.   Discussion and possible action for Commissioners Court to order a burn ban for a maximum of Ninety (90) days of all outdoor burning in all the unincorporated areas of Webb County pursuant to Local Government Code §352.081 and other applicable statutes, a violation of this Order is a Class C misdemeanor, punishable by a fine not to exceed $500.00.

Issue: The current Keetch-Byram Drought Index (KBDI) average for Webb County is 575 and may reach a maximum of 641 within the next fourteen days. (KBDI scale ranges from 0-800 with 800 representing extremely dry conditions) These conditions create a high risk of wildfires with danger to damage life and property.

Solution: Order a burn ban for a maximum of 90 days (or until conditions are considered safe) to be enforced by the Sheriff’s Office to discourage outdoor burning in order to prevent spread of wildfires and loss of life and property.

Result: Discourage citizens from outdoor burning in the unincorporated areas of Webb County in order to prevent wildfires and enforce a fine of up to $500 by the Sheriff’s Office for those citizens that do not abide by burn ban.
 
20.   Discussion and possible action for Commissioners Court to order and enforce local government code §352.051 “Regulation of Restricted Fireworks” for a maximum of Ninety (90) days of all outdoor burning in all the unincorporated areas of Webb County and other applicable statutes, a violation of this Order is a Class C misdemeanor, punishable by a fine not to exceed $500.00.

Issue: The current Keetch-Byram Drought Index (KBDI) average for Webb County is 575 and may reach a maximum of 641 within the next fourteen days. (KBDI scale ranges from 0-800 with 800 representing extremely dry conditions) These conditions create a high risk of wildfires with danger to damage life and property.

Solution: Order a restricted fireworks ban on those items classified under 49 C.F.R. Sec. 173.100(r)(2) (10-1-86 edition), “skyrockets with sticks” and “missiles with fins” for a maximum of 90 days (or until conditions are considered safe) to be enforced by the Sheriff’s Office to discourage outdoor burning in order to prevent spread of wildfires and loss of life and property.


Result: Discourage citizens from outdoor burning in the unincorporated areas of Webb County in order to prevent wildfires and enforce a fine of up to $500 by the Sheriff’s Office for those citizens that do not abide by firework ban.

Civil Legal Division
 
23.   Discussion and possible action to enter into additional negotiations and enter into two separate agreements CoreCivic for the detention of federal inmates/detainees of the department of Immigration and Customs Enforcement (“I.C.E.”) at the Laredo Processing Center and the Webb County Detention Center; pursuant to the Texas Local Government Code Sec. 262.003, these contracts known as I.G.S.A. are set to establish the reimbursement for the detention of federal prisoners on a tiered per diem basis; and any other matters incident thereto, and authorizing the County Judge to sign any relevant documents incident thereto. [Requested by Webb County Sheriff Martin Cuellar]
 
Issue: Representatives of the federal government (I.C.E.) have approached the County requesting we enter into two I.G.S.A. contracts with them. Texas Local Government Code §272.005 permits the county to enter into agreement without violating the purchasing act. The previous I.G.S.A. Contract is set to expire February 28, 2018 and without an agreement, the County will not receive reimbursement for I.C.E. detainees or prisoners. Two separate contracts will be needed in relation to the Laredo Processing Center and the Webb County Detention Center which are owned and operated by CoreCivic that has obtained the agreement with the I.C.E. for the detention of federal detainees and prisoners. The Webb County Sheriff is the keeper of the jail in Webb County and his authority is needed by CoreCivic in order to hold and detain federal prisoners. 

Solution: Enter into a new agreement with the CoreCivic that will set a reimbursement amount for the detention of federal detainees/prisoners.

Result: Two new IGSA agreements will allow Webb County reimbursement for the detention of I.C.E. prisoners/detainees that are being held at either the Laredo Processing Center or the Webb County Detention Center. The public will be served by and through this agreement by protecting the community from individuals who have been detained for committing offenses and the federal government will bear the burden of paying for the detention of the individual.
 
Presentations
 
24.   Presentation by members of South Region Prairie View A&M Cooperative Extension Agents, to promote the Agriculture Awareness Field Day and explain the importance of possible career choices in the agriculture/nutrition fields to the youth in our community and other counties. [Requested by Tano E. Tijerina, County Judge]
 
25.   Presentation of a Distinguished Service Award (DSA) certificate to Webb County Historical Commission by the Texas Historical Commission to commend Webb County Historical Commission's dedicated service and its active well-rounded preservation programs and efforts that celebrate and save the history and character of Texas.
