COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.   Discussion and possible action to approve, by order, a budget amendment to the District Attorney State forfeiture fund by increasing the expenditure budget by $53,000; said amount is available from seized funds pursuant to Chapter 18 of the Texas Code of Criminal Procedure. [Requested by Isidro "Chilo" Alaniz, District Attorney; Fund #2161-2260]

a.   Discussion and possible action to adopt an Order of Acceptance for the dedication of FIVE (5) Roadway Right-of-Way and/or Public Utility Easements, (1) out of the Ranchitos Los Fresnos Subdivision, (3) out of the Ranchitos Los Nopalitos Subdivision, & (1) from the Ranchitos Los Arcos Subdivision for the purpose of acquiring these necessary easements by Webb County to perform road maintenance and improvements in order to facilitate transportation needs for residents including emergency medical services and school bus pickups for students, and for use, extension and/or provision of proper drainage, and/or utility services and any other matters incident thereto; authorizing the Webb County Judge to execute all relevant documents. 8. Community Action Agency

9. Economic Development
 
a.   Discussion and possible action to accept a grant award from the Texas Parks and Wildlife Department Community Outdoor Outreach Program in the amount of $60,000.00 with no cash match and authorize Webb County to enter into a grant agreement with Texas Parks and Wildlife Department for a series of recreational workshops that will be held on site at several State Parks and Natural areas to expose youths of our community; and authorize the Webb County Judge to sign all relevant documentation. This contract and agreement commences on March 1, 2022 and terminates September 1, 2023. All required documents were reviewed by the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Economic Development]

Issue: Webb County submitted a COOP grant application to TPWD.
 
Solution: Accept award and enter into an agreement.

Result: Webb County is able to implement project.
 
b.   Discussion and possible action to authorize the submission of a Fiscal Year 2023 Local Border Security Program (FY23 LBSP) grant application as developed, written and submitted by Webb County Constable Pct. 3 Department to the office of Homeland Security Grants Division (HSGD) in the amount estimated at $55,000.00, for peace officers' overtime/applicable fringe benefits, fuel/vehicle maintenance and equipment. Grant funds shall be utilized to help provide enhanced border security in Webb County and Precinct 3 area, and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. This grant does not require a match; and thus, will not have an impact on the general fund. All required documents were sent for review through the Economic Development and the solicitation is compliant with the Webb County single point of contact (SPOC) procedures. [Requested by Adrian Cortez, Webb County Constable Pct. 3]

Issue:
The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities' economies.  These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.
 
Solution:
Grant application to provide enhanced border security in Webb County and the Precinct 3 area in order fulfill State of Texas Local Border Security Program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.
 
Result:
Enhanced/increased patrol for certified peace officers working at Webb County Constable Pct. 3.
 
c.   Discussion and possible action to accept the $10,000,000 (TEN MILLION DOLLARS) standard option under the American Rescue Plan Act (ARPA) Final Rule for loss revenue replacement as recommended by the ARPA Review Committee; and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto.
 
Issue: Local government budgets experienced substantial cost increases and revenue decreases in result of the COVID-19 pandemic.
 
Solution: Webb County may allocate a “standard allowance” of $10 million for the entire period of performance under the ARPA grant.
 
Result: With the funds provided by the ARPA grant, Webb County will be able to minimize the impact associated with revenue losses caused by the pandemic.
 
10. Engineering
 
a.   Discussion and possible action to approve the Title Change and Job Description modification for Slot #2203, from Senior Engineering Project Coordinator to Executive Assistant, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective February 21, 2022. [No Financial Impact]

Issue: The Engineering Department is requesting title change and job description modification.

Solution: Approval from Commissioners Court. 

Result: Title change and future Civil Service presentation for approval.
 
11. Head Start

12. Planning & Physical Development
 
a.   Discussion and possible action to issue a “Certificate of Compliance with Plat Requirements” to authorize electrical service connection pursuant to Section 232.029(c)(2), Local Government Code., to an unplatted 0.24 acre tract of land, more or less, being part of Tract 02, La Presa Subdivision, containing 316.282 acres, more or less, located in Porcion 42, as further described in Vol. 3723, Pgs. 178-180 of the Webb County Deed Records (ID 11750).
 
Issue:
Item is a regulatory compliance issue regarding real property development provisions of state law and local regulations with particular emphasis on the Model Subdivision Rules enacted for residential subdivisions. Commissioners Court must certify to certain property conditions before utility service connections may be authorized.
 
Solution: As reflected in agenda backup, staff has verified compliance matters and recommends the Court’s approval of this certificate.
 
Result: If approved, applicant may connect property to electrical utility services. If not approved, utility connection to property is prohibited.
 
13. Public Defender
 
a.   Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, as well as any and all Wage Plan Policies, effective March 14, 2022.

14. Purchasing
 
a.   Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.
 
b.   Discussion and possible action to reject all bids for “Invitation to Bid (ITB) No. 2022-006 Self Help Center Housing Rehabilitation Program-Texas Department of Housing (TDHCA) Contract #7220013” and resolicit to secure new proposals and any other matters incident thereto. 

Issue: Two (2) Bids were secured but will re-solicit to secure additional vendor participation. 

Solution: Authorize the Purchasing Agent to re-solicit for ITB's
 
Result: Secure new Bids for Self Help Center Housing Rehabilitation Project.

Issue: Due to increased fuel prices the vendor with the lowest fixed pricing can no longer provide the services needed by Road and Bridge Department. The remaining annual contractors fixed pricing exceeds budgetary limits to finish up the orders for the current fiscal year. 

Solution: Authorize the Purchasing Agent to notify all vendors awarded Bids for Flexible Base and Road Construction Materials in accordance with section eleven (11) Termination for Convenience also known as a no-fault termination.

Result: Purchasing Agent will notify all vendors under this Bid award in accordance with contract notification requirements. New bids will be published if authorized by Commissioners Court.
 
d.   Discussion and possible action to authorize the Purchasing Agent to solicit formal bids for Flexible Base and Road Materials for a contract term to terminate September 30, 2023, pursuant to the Texas Local Government Code; Section 262.021 (The County Purchasing Act) and any other matters incident thereto.
 
Issue: Seek new bids for flexible base and road materials for a term that would terminate September 30, 2023. 
 
Solution: Publish an Invitation to Bid for flexible base and road materials as per State Procurement Law.
 
Result: Secure bids and return to Commissioner Court with recommendation on award(s).
 
15. Santa Teresita Community Center
 
a.   Discussion and possible action to accept a donation in the amount of $250.00 from Medina Electric Cooperative, Inc. for the Santa Teresita Community Center to benefit programs and activities sponsored by the center. Funds to be deposited into Santa Teresita Community Center's Materials & Supplies account #1001-6300-001-461000.  Funds to remain in said account until completely exhausted.

17.   Discussion and possible action to allow an exemption and approve current and new postings of Part-Time nurses hourly rate to $26.49, higher than the rate currently allowed by Webb County policy for part-time employees, to work at the Webb County Jail and any other matters incident thereto.  [Account #1001-4070-001-412000 (Jail Bargaining Unit Administration Part-Time)]

Issue: Due to competitive labor market in the nursing field, the Sheriff's Office is seeking a rate increase to recruit nurses to work part-time at the Webb Count Jail. 

Solution: Webb County Commissioner Court approval to increase the hourly rate paid to part-time nurses. 

Result: The Webb County Jail will maintain sufficient staffing in the medical division.

Economic Development
 
19.   Discussion and possible action to approve projects to be funded by the American Rescue Plan Act State and Local Fiscal Recovery Funds as presented, ranked by the Webb County ARPA Review Committee, or modified by the Court; authorizing the County Judge to sign all relevant documents; and any other matters incident thereto.

Issue: Projects need to be approved by Commissioners Court.

Solution: Obtain Commissioners Court approval for projects, allowing implementation to begin.
 
Result: Webb County may begin implementing approved projects.

20.   Discussion and possible action to authorize the reclassification of the following slot, job title, with a modified job description and an increase in pay in the amount not to exceed $6,000.00, within the Webb County Youth Village payroll funds, and subject to approval by Civil Service Commission and any applicable civil service guidelines, and any other matters incident thereto, effective April 1, 2022. Issue: Slot #2457 is currently classified as a Custodian. Solution: The reclassification of Slot #2457 from Custodian to Maintenance Technician position will resolve the issue presented above.

Result: The Webb County Youth Village will be able to provide a safe, clean, and sanitary facility for its visitors, supervision officers, civilian employees, and residents.

Issue: The election’s fuel account only has a balance of $73.01, Road & Bridge submitted a total charge of $313.50 from February 23 – March 1, 2022. No sufficient fund available to cover for this expense and future expenses.

Solution: Budget amendment line item transfer to increase revenues and expenditure will address the condition.

Result: Election department will be able to cover the pending expenditure plus any future expenditures throughout the end of the fiscal year.
 
Information Technology
 
23.   Discussion and possible action to enroll eligible County Employees and all Elected Officials in the Texas Association of Counties' (TAC) Cybersecurity Course in order to comply with HB 3834; with additional action to approve the appointment of required Primary Assigned Course Administrator and Additional Course Administrators; and any other matters incident thereto.

Issue: Under a new state law, Tex. Gov't Code §2054.5191, effective June 14, 2019, requires all local government employees and elected officials who have access to a local government computer system or database to annually complete a cybersecurity training program certified by the Texas Department of Information Resources (DIR).

Solution: Enroll eligible employees and all County Officials in TAC's DIR certified cybersecurity course at no cost to the County.

Result: Compliance with State mandate.
 
Purchasing
 
24.   Discussion and possible action to rescind the award to C-A Native Contractors for the building relocation project for the Laredo and Lobo Tower Sites in an amount not to exceed $173,142.50 and any other matters incident thereto.
 
Issue: On December 20, 2021, C-A Natives Contractors was awarded this project.  Contractor has communicated with the Purchasing and Legal Departments that they will not be able to commit after all due to scheduling conflicts. 
 
Solution: Approve the item as presented and consider award to next lowest bidder listed as an approved vendor by AEP.
 
Result: Terminate negotiations and contract execution with C-A Native Contractors and move to next lowest bidder as recommended by the Purchasing Agent.
 
25.   Discussion and possible action to approve a construction contract with High West Construction (HIWESCO) for the building relocation project for the Laredo and Lobo Tower Sites in an amount not to exceed $198,775.00 and to approve by order an exemption under the Texas Local Government Code; Section 262.024 (Discretionary Exemptions)(a)(7) sole source by using AEP approved vendors and to authorize the transfer of funds from the General Operating Reserve Account (001-1130-001-431007-010) to the Sheriff’s Administration – Capital Outlay Account (1001-3010-001-470000) for the awarded amount and to further authorize the Civil Legal Department to execute a construction contract for the awarded amount and any other matters incident thereto. [Account #1001-3010-001-470000 General Fund-Sheriff’s Bargaining Unit – Administration - Capital Outlay]
 
Issue: Under the current System Purchase Agreement between Webb County and Motorola, these tower and site improvements are the responsibility of Webb County.
 
Solution: Use AEP approved vendors, AEP shelters are being transferred over to Webb County.  Three (3) price proposals were secured from AEP approved vendors.  Recommendation to award to the 2nd lowest bidder.  Low bidder has retracted their bid due to scheduling conflicts. 
 
Result: Proceed with awarded vendor to initiate the removal, transportation and installation of two (2) AEP shelters for tower sites at both Laredo and Lobo locations pursuant to Systems Purchase Agreement approved by Commissioners Court on October 26, 2020.
 
26.   Discussion and possible action to authorize the purchase of livestock equipment for The Webb County Sheriff's Office for the improvements of the livestock holding pens from Priefert Manufacturing Inc., (The Interlocal Purchasing System (TIPS) #200-501) in an amount not to exceed $50,070.52 in accordance with the Texas Local Government Code; Sections 270.001 and to further authorize the transfer of funds from the General Operating Reserve Account to the Sheriff’s Bargaining Capital Outlay account for the amount authorized by Commissioner Court and any other matters incident thereto. Issue: The Livestock Division’s holding pens and related structures require upgrades and adequate housing for the stray livestock impounded in Webb County by the Sheriff’s Office.

Result: If authorized by Commissioners Court, order will be placed on March the 14th, by the Purchasing Agent for Webb County.
 
27.   Status report by Project Architects on the final plans, specifications and project cost estimates for the Webb County Casa Blanca Golf Course Palapa and Patio improvements located at 3900 Casa Blanca Road and to further authorize the Purchasing Agent to secure competitive bids in accordance with the Texas Government Code; Section 2269.101, Contracts For Facilities: Competitive Bidding and any other matters incident thereto. Issue: Project Architects (Able City) has finalized the plans for the improvements to the Golf Course’s patio and construction of a palapa and has completed an opinion of probable cost for review by Commissioners Court.
 
Solution: Finalize the approval of the proposed plans / opinion of probable cost and to authorize the Purchasing Agent to start the solicitation process based on the construction documents presented by project architect to include any changes authorized by Commissioners Court as a Competitive Bid.
 
Result: The solicitation process will be initiated after Commissioners Court gives approval on final construction documents/plans presented by project architect subject to any changes requested by Court through formal action.
 
28.   Discussion and possible action to authorize the purchase of office furniture for the Medical Examiner’s Office from Office Source Ltd., (Region 4 OMNIA Contract No. R191804 (HON)) in an amount not to exceed $18,274.94 in accordance with the Texas Local Government Code; Sections 270.001 and to further authorize the transfer of funds from the General Operating Reserve Account to the Medical Examiners Minor Tools and Apparatus account for the amount authorized by Commissioner Court and any other matters incident thereto. Issue: Recent expansion of the Medical Examiner’s Office included office space for six (6) investigators. Office furniture for each employee was requested to include six (6) individual cubicles, one (1) printer desk and eleven (11) filing cabinets.
 
Solution: Vendor selected provided a cooperative price proposal based on the architectural plans provided and will also be responsible for delivery and assembly. 
 
Result: Order furniture based on final approval and direction from Commissioners Court.
