On March 16, at the Attorney General's request, Gov. Greg Abbott utilized Section 418.016 of the Government Code to suspend certain requirements of the Texas Open Meetings Act (TOMA) in light of the ongoing COVID-19 emergency. Tex. Gov't. Code Ann. Section 418.016 (Vernon 2017). The Governor suspended provisions of TOMA that require a quorum of the governing body and the general public to be together in a single location in order to allow videoconference or telephonic meetings.

CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. Issue: New proceeds under Chapter 18 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The attorney representing the State can utilize the new proceeds for the official use of his Office.

7. Civil Legal Division
 
a.   Discussion and possible action retain the law firm of Allison, Bass, and Magee, LLC, as legal counsel to represent District Attorney Isidiro R. Alaniz and Assistant District Attorney Pedro Morales in Cause Number 2020CVK001190D1 in the 49th District Court, in accordance with the Texas Local Government Code; Section 262.024 (Discretionary Exemptions)(A)(4) a personal or professional service, subject to annual budget Appropriations; and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto. c.   Discussion and possible action to approve a Resolution authorizing and approving the issuance of a Certificate of Incumbency in the total amount of $26,264.16 as needed for “Webb County Request for Proposal (R.F.P. 2020-006) Casa Blanca Golf Course Equipment Lease” between Webb County and Textron/PNC Financing/Lease Number 98992100-1, and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto.
 
d.   Discussion and possible action to readopt the Title VI 1964 Civil Rights Plan (Title VI) for the benefit of the Webb County Community Action Agency (El Aguila Rural Transportation) and submit the Title VI Plan that incorporates a Limited English Proficiency Plan (LEP) to the Federal Transit Administration (FTA) Region Office; said plan will be presented for review and possible approval by the Webb County CAA Advisory Board and Texas Department of Transportation. There will be no impact to the General Fund.

Issue: FTA requires that every three (3) years transit systems receiving federal financial assistance to update their Title VI Plan (LEP included) in the form of a revised Title VI circular to grant recipients, which requires careful evaluation of the impact of proposed services and fare changes on minority riders.

Solution: Obtain approval by the respective designated board/court, submit Title VI Program/LEP Plan to FTA to continue grant funding.

Result: Compliance with FTA with proper documentation fully executed with approvals that secures grant funding for the next three years.
 
e.   Discussion and possible action to reinstate and extend the Engineering Services Contract with Dannenbaum Engineering Corporation for the Environmental Assessment of the Reuthinger Extension of the Hachar Reuthinger Road project from 0.1 miles east of Beltway parkway (northern ND Hachar tract limit - southern Reuthinger tract limit) to the west 1-35 frontage road through July 1, 2021 and any matters incident thereto; and authorizing the County Judge to sign all relevant documents.

Issue: With the ongoing pandemic, planned events are not foreseeable and a line item transfer would allow for the one-time monies to be used elsewhere.

Solution: Approve line item transfer.

Result: Sufficient funding to continue the efforts for Census 2020 awareness.
 
9. Community Action Agency
 
a.   Discussion and possible action to approve to create 14 Temporary Part-Time Case Workers positions. Webb County Community Action Agency will utilize funds from the Comprehensive Energy Assistance Program (CEAP) CARES ACT and the Community Services Block Grant (CSBG) CARES ACT from Texas Department of Housing and Community Affairs (TDHCA). The Community Social Services Program is not part of the County's Wage Plan, Grant Funded.

Issue: Additional staff will be hired to assist eligible Webb County residents that have been economically impacted by COVID-19. Fourteen (14) Temporary Part-Time Caseworkers will be hired using the CSBG CARES ACT and CEAP CARES ACT grant funds. 

Solution: After Court approval C.A.A. would be able to create fourteen (14) Temporary Part-Time Case Worker positions.

Result: The creation of Temporary Part-Time Case Workers will help Webb County residents economically impacted by the COVID-19. The residents will be assisted up to 12 months of energy consumption.
 
b.   Discussion and possible action to accept two (2) checks from Grainger Industrial Supply in the amount of $624.50 each for a total amount of $1,249.00. [Grant funds]

Issue: The Webb County Self-Help Center is receiving these funds for an extended warranty claim filed for two (2) brush trimmers.

Solution: Deposit funds received from the warranty claim and repurchase two (2) new brush trimmers. 

Result: The Webb County Self-Help Center Tool Library will have new functioning brush trimmers.
 
10. Economic Development
 
a.   Discussion and possible action to authorize Economic Development to develop and submit a County Essential Services grant application on behalf of the District Attorney's Office to the Office of the Governor, Public Safety Office in an amount estimated at $500,000. This grant will cover extraordinary costs associated with investigation or prosecution of a capital murder or crimes committed because of bias or prejudice as defined in Article 104.004 of the Code of Criminal Procedure. This formal request shall authorize the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. There is no cash match requirement for this grant; All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract Term: September 1, 2020 to August 31, 2021. [Requested by Isidro "Chilo" Alaniz, District Attorney]

Issue: 
Costs associated with investigation / or prosecution of a capital murder or crimes committed because of bias or prejudice can be extraordinary. Some expenditures that may be incurred within these types of cases are costs related to expert witness, prosecution costs, courtroom security, juror expenses, and investigative services resulting in a need for additional financial resources.

Solution: Approval by the Governing Body to submit the grant application for funding. 

Result: The District Attorney’s Office will have an opportunity to request financial assistance to help defray the costs associated with the investigation / or prosecution of a capital murder or crimes committed because of bias or prejudice as defined in Article 104.004 of the Code of Criminal Procedure.
 
             
11. Purchasing
 
a.   Discussion and possible action to approve a Non-Appropriation Addendum to the Casa Blanca Golf Course Master Equipment Lease Agreement #1 between Wells-Fargo Financial Leasing, Inc/Lessor and Webb County/Lessee in the amount of $204,000.00 for a term of 48 months, (R.F.P. 2020-006), between Webb County and Austin Turf #1/Wells-Fargo Financial Leasing Inc./Master Agreement Number: 603-0230658/Schedule Number: 603-02300658-000, and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. 12.   Discussion and possible action to authorize a change in the job title and description for Slot #427 from Commander to Assistant Deputy Chief, subject to any applicable Civil Service guidelines; and any other matters incident thereto. There is no salary changes, therefore no impact to the Webb County Budget.

Issue: The Webb County Sheriff’s Office needs to modify slot #427 to add more duties.

Solution: Seeking authorization from Commissioners Court to change job description.

Result: The Webb County Sheriff’s Office will better serve Law Enforcement and the community.
 
13.   Discussion and possible action to approve the Purchase of two (2) new 2020 Kawasaki's Mule Trans 4010 not to exceed the amount of $22,504.00. The Webb County Sheriff's Office will use the ATV's for Security purposes. [Account #1001-4070-001-470000 (Capital Outlay)]

Issue: The Webb County Sheriff's office needs to assign personnel to use ATV's for border security and downtown court security.

Solution: Seeking Authorization from Courts to approve purchase.

Result: Use ATV to keep the community safe.
 
Casa Blanca Golf Course
 
14.   Discussion and possible action to approve the repairs and maintenance to the Casa Blanca Golf Course Club House and to further allocate the amount of $15,000.00 with action to create a sub-account under Building and Maintenance department and authorizing a transfer from Account #1001-1130-001-431007-010 (Operational Reserve); and any other matters incident thereto.

Issue: In preparation of the upcoming 2020-2021 flu season, our office will be purchasing a higher number of flu vaccines to be administered to Webb County employees, eligible dependents and the public. There are insufficient funds in the line item to cover the total cost.

Solution: Approval of requested funds will allow our office to have the necessary funding to cover expenses.

Result: A larger number of flu vaccines will be made available for Webb County employees, eligible dependents, and the public for the upcoming 2020-20201 flu season.

Engineer

19.   Discussion and possible action to instruct the Engineering Department, in coordination with, the County's Civil Legal Division and other Departments as necessary, to initiate the Roadway Right-of-Way acquisition process on Botello Road of La Coma Subdivision, to help improve the life of residents of this Colonia. La Coma Subdivision is a platted subdivision of Webb County. (Requested by Luis Perez Garcia, Webb County Engineer, Co-Sponsored by Rosaura "Wawi" Tijerina, Commissioner Pct. 2)

Issue: La Coma Subdivision was platted in 1971 with a 60 ft., wide access road easement between existing lots. Residents living in the area are requesting assistance from Webb County to build this road for better access to their properties.

Solution: Commissioner Court's approval to assign the Engineering Department the task of obtaining the acquisition, by donation, of the necessary parcel of land from property owners. Acquisition must follow State laws and Model Subdivision rules.

Result: The residents of La Coma Subdivision on Botello Road will have a public road provided by Webb County which will provide better access to their homes as well as provide access to mobile units such as; school buses, emergency vehicles, trash collection, etc.
 

Planning

 
20.   Discussion and possible action to adopt an Order Regulating Coin-Operated Machines and Game Rooms (“Order”), as authorized by the Webb County Commissioners Court on June 22, 2020; establish effective dates for existing and new businesses; appoint the Planning Director as the “Game Room Administrator” as established by the provisions of said Order; authorize the Webb County Judge to execute the Resolution and Order; and any matter incident thereto.
 
Staff recommends the following effective dates:
  1. Order is effective immediately for any new business not in operation on August 10, 2020.
  2. Existing businesses in operation on or before August 9, 2020 shall:
  1. Be allowed up to 60-days (October 10, 2020) to file required applications with the Game Room Administrator to initiate the administrative process to bring business into compliance with the Order; and
  2. Attain full compliance with Order no later than December 31. 2020.
 
21.   Discussion and possible action to adopt a Resolution and Order appointing the “Game Room Enforcement Official” to serve as lead law enforcement entity as established by the provisions of the Webb County Order Regulating Coin-operated Machines and Game Rooms; authorize the Webb County Judge to execute the Resolution and Order; and any matter incident thereto.

23.   Discussion and possible action to request the assistance of the Webb County Attorney’s Office or other prosecuting attorney with jurisdiction to take all necessary legal enforcement action against the subdivider and/or the subdivider’s agent to ensure that certain unlawfully subdivided property located off State Hwy 359 known as the Los Cazadores Subdivision in Webb County, Texas (more particularly described below) owned or sold by Mr. Arn Ramirez, Los Cazadores Subdivision, L.L.C. and/or Bandera Property Management, Inc.; is brought into compliance with all applicable state platting laws, the state’s model subdivision rules (border colonia legislation), and the county’s regulatory orders governing the subdivision of land and/or the development of real property including, but not limited to, the applicable enforcement provisions of Chapter 232 of the Tex. Local Govt Code, Chapter 16 of the Tex. Water Code, the Webb County Model Subdivision Rules, the Webb County Flood Damage Prevention Order, and the Webb County Private Sewage Facility Order; and any other matters incident thereto. [Executive Session/Closed Session may be requested pursuant to Texas Government Code §551.07, Consultation with Attorney, pending or contemplated litigation.]
 
Said Los Cazadores Subdivision and its divided tracts are comprised of all of that certain Tract A, a 120.09 acre tract of land (called to be a 120.0624 acre tract of land), conveyed by deed to Margarita Flores Nutt Trust, as recorded in Volume 260, Pages 557-580, Deed Records, Webb County, Texas, out of a 3,799.4425 acre tract of land, situated in Porcion 22, Jose Dionisio Trevino, Original Grantee, Abstract 3084, and Porcion 34, Jose Antonio Diaz, Original Grantee, Abstract 762, Webb County, Texas.

24.   Discussion and possible action to authorize the final lease payout and purchase for two (2) Caterpillar Backhoe Loaders - Model 416F2ST - Serial No. HWB01022 and HWB01023 from Caterpillar Financial Services Corporation in an amount not to exceed $66,720.00 as per Government Equipment lease Purchase Agreement Transaction No. 2954725 for operational use for the Road and Bridge Department and any other matters incident thereto. [Account #4100-9060-001-483003-220 Capital Lease Road and Bridge]

Issue:
One of the leased backhoes requires a new engine.  Webb County is responsible for the repairs of non-working lease equipment.  It is recommended to purchase the unit so the investment to repair engine is not returned to LESSOR. Payout option is available under Capital lease purchase agreement No. 2954725.  The Road and Bridge Department is also recommending the purchase of the second unit under this agreement for operational use.

Solution: Approve final lease payout to purchase two (2) backhoe loaders from Caterpillar Financial Services CorporationFunding is available under the Capital Lease account under Road and Bridge.

Result: Investment to repair engine will remain with Webb County.  Both Units will be utilized by Road and Bridge for county road improvements and maintenance.

Solution: Approval of multiple annual contracts for the goods and services advertised for Bids listed above. All annual contracts approved will start October 01, 2021.
 
Result: County departments will be able to use annual contracted vendors throughout the fiscal year that have met the competitive bidding requirements.
 
             
Risk Management
 
26.   Status and recommendation by the Insurance Committee with Discussion and possible action to award Request for Proposal (RFP) 2020-008 "Webb County Medical, Prescription Drug, Dental and Vision Plan - Third Party Administration" and to further authorize the Civil Legal Department to negotiate the terms and conditions of legal agreement and any other matters incident thereto. [Requested by Dr. Pedro Alfaro, Webb County Risk Department Director; Account #6100-1090-001]

Issue: Webb County currently contracts with Aetna to administer its self-funded employee benefit plans.  The existing contract expires on December 31, 2020, and there are no additional extension options available for this contract.  Providing a comprehensive medical plan to all eligible employees, retirees and their dependents is an important part of the total compensation that the County provides to its employees.
 
Solution: T
he Purchasing Department with Commissioners Court approval secured formal proposals from qualified firms offering Third Party Administrator (TPA) services for Employer Sponsored Medical, Dental, and Pharmacy benefits and related services; Pharmacy Benefit Management Services; Provider Network Access Administration for Medical, Dental, and Pharmacy Benefits; and COBRA Administration Services.  The Insurance committee is prepared to present a recommendation for award.
 
Result: 
After award and execution of legal agreement for TPA services the effective date of the contract will be January 1, 2021.
