Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 24th day of March 2017. Present also were Mrs. Virginia M. Rodriguez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  County Treasurer, Ms. Delia Perales presented the Recap of Checks, Recap of Released Immediate Payments, Ratification of Payroll for March 10, and the monthly report for February 2017.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.      Discussion and possible action to approve a check contribution in the amount of $500.00 from Medina Electric to the Santa Teresita Community Center. [Account #1001-6300-001-461003 (Goods for Public Events)]

a.      Discussion and possible action to approve a budget amendment by increasing revenues and expenditures in the amount of $20,318.76 for new revenues received from the Department of Justice from seized funds in accordance with Texas Local Government Code; Section 111.07075 (Special Budget for Revenue Received after Start of Fiscal Year). [Fund #2202 (Forfeiture)]

Issue: New revenue receipts received as a result of previous seizures conducted between the Constable Pct. 4 and Federal Law Enforcement agency(s). These amounts have now been forfeited and awarded to the collaborating agencies for official use. 

Solution: Appropriate new revenues and expenditures not currently budgeted for FY 2016-2017.

Result: Utilize new revenues for law enforcement purposes and in accordance with Equitable sharing guidelines.  All forfeiture budgets should be used only as a supplement source and not to supplant current budgets approved through the General fund or other non-forfeiture sources.
  
 
7.   Honorable Marco Montemayor, County Attorney
 
a.      Discussion and possible action to enter into a Forty-Two (42) month (March 27, 2017 through September 26, 2020) Lease with Maintenance Agreement between Toshiba Business Solutions and Webb County for the Webb County District Attorney for Two (2) Toshiba E-Studio 7506ACT Copiers at a cost of One Thousand Eighty Seven Dollars and Fifty-One Cents ($1,087.51) per month for a total amount of Forty Five Thousand Six Hundred Seventy Five Dollars and Forty-Two Cents ($45,675.42) over the term of the agreement, subject to annual budget appropriating, and authorizing the County Judge to sign and execute all relevant documents. b.      Discussion and possible action to ratify a Sixty (60) month (September 1, 2016 through September 1, 2021) rental agreement between Stor-More LTD #2 and Webb County Head Start, for Two (2) storage units at a cost of Three Thousand Eight Hundred Fifty Dollars ($3,850.00) per year for the total amount of Nineteen Thousand Two Hundred Fifty Dollars ($19,250) over the term of the agreement, subject to annual budget appropriating, and authorizing the County Judge to sign and execute all relevant documents.  [Requested by Aliza Oliveros, Webb County Head Start Director; Account #2357-5150-531-444100 (Space Rental)]

Issue: The Webb County Head Start program had previously processed payments for storage space rental via an invoice attached to a General Request for Payment. 

Solution: Ratify the attached proposed Rental Agreement between Stor-More LTD #2 and Webb County Head Start and pay past due months.

Result: The Head Start program will be in a legal contract with Stor-More LTD #2 and will be current with rental payments.
  
 
d.      Discussion and possible action to exercise the extension of Two (2) years as negotiated in the Emergency Ambulance Service Agreement contract between Webb County and Angel Care Ambulance Service, LLC to become effective October 1, 2017 through September 30, 2019, subject to annual budget appropriations, and authorizing the County Judge to sign and execute all relevant documents; and any other matters incident thereto.

Issue:  Due to payroll savings from leave without pay, vacant positions, employees on a baseline salary, FMLA, and the like, funds are available in the Payroll line item that will be returned to the Federal Government if not used for allowable grant expenses.  

Solution:  Approve Line Item Transfer request.

Result:  The Head Start program will use all grant funds for allowable expenses.
  
 
b.      Discussion and possible action to approve the Early Head Start - Child Care Partnership Grant Carryover Request Application in the amount of $138,930 (Federal) and $34,733 (Non Federal) for a total amount of $173,633. [Account #2367-5200-531]

Issue: The 2015 - 2016 Early Head Start - Child Care Partnership Grant fund has an non-obligated amount of $138,930 for which the program is requesting to be used as a carryover fund for the 2016 - 2017 fiscal year.

Solution: Approve the Early Head Start - Child Care Partnership Carryover Request Application. 

Result: The Early Head Start - Child Care Partnership grant will purchase two vans, educational supplies, child computers, and classroom supplies.  Additional funds will be allocated to building maintenance, vehicle maintenance, travel for trainings, staff development, and local staff trainings.
  
 
11.   Purchasing
 
a.      Discussion and possible action to approve payment for memberships of non-profit state associations as required by Local Government Code Section  §89.002 for Constable Precinct 4 in the amount of $40 for the Texas Narcotic Officers Association, $110 for the National Narcotic Detector Dog Association, Inc., and $60 for the Texas Association of Counties in regards to Justices of the Peace and Constables Association (JPCA) Memberships Dues for both Constable Precinct 3 and 4. These annual membership fees will be added to the Master List.  [Requested by Constable Harold Devally, Account #1001-3170-001-464010 (Dues and Memberships) and Constable Adrian Cortez, Account #1001-3160-001-464010 (Dues and Memberships)]


Issue: Local Government Code §89.002 requires that the Commissioners Court may spend, in the name of the county, money from the county's general fund for membership fees and dues of a nonprofit state association of counties if:

(1)  a majority of the court votes to approve membership in the association;
(2)  the association exists for the betterment of county government and the benefit of all county officials;
(3)  the association is not affiliated with a labor organization;
(4)  neither the association nor an employee of the association directly or indirectly influences or attempts to influence the outcome of any legislation pending before the legislature, except that this subdivision does not prevent a person from providing information for a member of the legislature or appearing before a legislative committee at the request of the committee or the member of the legislature;  and
(5)  neither the association nor an employee of the association directly or indirectly contributes any money, services, or other valuable thing to a political campaign or endorses a candidate or group of candidates for public office.
 
Solution: Obtain court approval as required.

Result: Purchase Orders for associations approved by the Court will be processed for payment.
  
 
12.   Honorable Martin Cuellar, Sheriff
 
a.      Discussion and possible action to  authorize the acceptance of a grant award from the Office of Texas Attorney General in the amount of $6,000 for technology supplies for the Webb County Sheriff’s Office Internet Crimes Against Children (ICAC); and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. The grant was officially awarded to Webb County on Friday, March 17, 2017 at 2:42 P.M.; and the grant performance period runs from February 1, 2017 to May 31, 2017. This grant requires no match, and thus is at no cost to the Webb County budget. 
 
Issue: The psychological, emotional, and physical damage caused by child predators and inflicted on innocent victims, their families, and communities can be deeply destructive and have far-reaching consequences that can last a lifetime. Furthermore, throughout the United States, criminal cases built against child predators can be extremely complex, technologically challenging, and legally complicated.

Solution: The Webb County Sheriff’s Office cybercrimes law enforcement unit has successfully worked with multiple federal, state, and local law enforcement agencies, including the Office of the Attorney General, to arrest over fifty (50) child predators in the Laredo/Webb County area. Grant application to supplement the successful endeavors of the Webb County Sheriff’s Office cybercrimes against children task force to protect the children and youth of the Laredo/Webb County community against child predation.

Result: The Webb County Sheriff’s Office will continue to enhance its ability to work proactively not only to catch individual child predators, but to produce an overall inhospitable environment for cybercrimes against children in Laredo/Webb County for the further prevention of child predation in our community.
  
 
13.   Honorable Patricia A. Barrera, Tax-Assessor- Collector
 
a.      Discussion and possible action to approve a refund in the amount of $3,450.98 to Anderson Columbia Co Inc. Accounts #90090101146 through #1001-209415 had over-payments for tax year 2016. [Account #1001-209415]

Issue: Upon receiving Check #170208 from Anderson Columbia Co Inc, the above-mentioned accounts had been previously paid by another entity resulting in the over-payment of taxes for year 2016.

Solution: Refund said amount to Anderson Columbia Co Inc for the over-payments.

Result: The monies will be reimbursed tot he appropriate taxpayer.

c.      Discussion and possible action to amend the Thirty Six (36) month (July 11, 2016 through July 10, 2019) Software Subscription Agreement between Thomson Reuters and Webb County for the Webb County Management Information Technology Department for Online/Practice Solutions/Software (WestlawNext) that was approved by the court on July 11, 2016 at a total cost of Three Thousand Nine Hundred Sixty Seven Dollars and Forty-Nine Cents ($3,967.49). A more inclusive Government Plan is now available that will exclude extra fees over the term of the agreement at a cost of Four Thousand Four Hundred Thirty Three Dollars and Sixty-Five Cents ($4,433.95), subject to annual budget appropriating, and authorizing the County Judge to sign and execute all relevant documents. 14.      Status report from the District Attorney's Office regarding the 24-7 jail intake program; with further discussion and possible action to authorize the continued funding of the 24-7 jail intake program in the amount not to exceed $120,000, subject to availability of funds; and any other matters incident thereto.

Issue: The funds allocated to administer the DA 24-7 jail intake will be depleted at the beginning of April 2017. Without the continued funding, the DA 24-7 jail intake will be interrupted thereby preventing Webb County from savings and from the opportunity to bring in additional revenue.

Solution: Continue funding the program by transferring funds from available savings.

Result: Webb County will continue to capitalize on the opportunity to save money and to bring in additional revenues.

Solution: Submit revised resolution for review and approval.

25.      Discussion and possible action to authorize the budget office to identify incentive line item options within the Sheriff’s budget in an effort to assist the department with payroll alternatives for the following slots; and any other matters incident thereto:

Issue: Requesting to increase pay for the Public Information Officer (PIO) Slot # 0547 to an hourly rate of $23.97 and the Finance Director Slot # 0533 to an hourly rate of $36.04.

Solution: Increase the salary of both slots, accordingly, in an effort to properly compensate these two positions.
 
Result: Both salaries will match the requested amounts.

15.      Discussion and possible action to proclaim April 2017 as the 49th Anniversary of Fair Housing Month and April 10th – 14th 2017 as Fair Housing Week and continue to designate the Webb County Community Action Agency as the agency responsible for monitoring Fair Housing in Webb County: 
 
Issue: In order to continue applying for grants, Webb County needs to promote Fair Housing in Webb County which is a grant requirement.    
 
Solution: Promoting Fair Housing in Webb County and designating a week during the month of April will help citizens of Webb County know their legal rights in housing discrimination.

16.      Discussion and possible action to approve amendments to the Personnel Policies namely, Section 9.09 Family and Medical Leave Act (FMLA), to be in compliance with Federal Law; and any other matters incident thereto:

Issue: During a recent visit by the wage and hour personnel it was pointed out that we had elements missing from our personnel policy and that we were not in full compliance. 

Solution: Incorporate changes as indicated in the federal law and federal law posters.

20.      Discussion and possible action to approve a Resolution for the purpose of authorizing a public property finance contract issued under Local Government Code Section 271.005 (Authority to Contract for Personal Property) between Government Capital Corporation (GCC) and Webb County for the purpose of financing Six (6) 2017 Chevrolet Tahoe - Police Pursuit Vehicles and Six (6) APX 7500 Duel Band High Power mobile radios in an amount not to exceed $383,085.78, with a proposed financing term of Five (5) annual payments of $85,014.01 at an interest rate of 3.219%, and authorizing the County Attorney’s office to prepare and finalize all related documents with final authorization from the County Judge; and any other matters incident thereto.

Issue: County law enforcement departments are in need of replacing existing units with high mileage.

Solution: Consider approval of a finance agreement with GCC to finance the purchase of 6 units and 6 mobile radios.  3 units for Sheriff's Office and 1 unit for Constables Pct. 2, 3, and 4.  Constable Pct 1 will be receiving 2 non high pursuit units through a leasing contract for the gaming and licensing division.

Result: Replace old units with high mileage and improve safety for Officer and for the general public.

Issue: Since commencement of the 2014 Rehabilitation and Improvements efforts associated with the Water Plant and System, operation of facilities has successfully been completed through manual operation of the facilities. In order to return to full operation and maintain State Compliance, an effective technology improvement must be undertaken to include radio communications of the pumps, chemicals, and filters; as well as the monitoring consistency required to maintain a compliance water system for the community.

Solution: This project consists of the first steps of hiring a team of experts in the field of SCADA (Supervisory Control and Data Acquisition), radio and remote communication, electrical integrity and backup power, and automation design and programming to evaluate existing system.  And determine the best method of proceeding to a effective system for now and in the future expansion of the plant.

Result: Develop cost alternatives and proceed to selection of an Engineer to provide a project design for low bid construction project phase.

23.      Discussion and possible action to enter into a Memorandum of Understanding between the United States Army 277th Engineer Company/980th Engineer Battalion and Webb County for La Presa Community Center to document that both parties agree to house construction heavy equipment that will be used for the 2.5 Mile Roadway Improvement/South Road-La Presa construction project. Construction is set to begin in mid-June and requires housing of this equipment from June 12, 2017 through July 2, 2017, with security access to enter gates when necessary. Solution:  Order the County Auditor adhere to the budget officers timeline request for financial information.

The process to accept a donation and/or to purchase land for the future construction of this project is contingent upon the recommendations of the Webb County Fair Grounds Committee, availability of funding and final approval by Commissioners Court.

Issue: Webb County is in the process of developing a Master Plan and Design for the Webb County Fair Grounds Complex that will serve our community today and for future generations.

Solution: Authorize the Purchasing Agent to solicit proposals from the public for possible donation of land, purchase or a combination of both.  

Result: Securing a land for this project will assist Project Architects with development of final Master Plan and Design for the Webb County Fair Grounds Facility.  Site location is critical for overall design and master plan development.

Issue: The condition of Casa Ortiz has declined throughout the years and, as per Webb County’s responsibility to maintain this building, is in need of repair and maintenance.  Currently the building is in need of mechanical, electrical, plumbing and structural repair.  Maintenance to the air conditioning units and other items are also needed.
 
Solution: Purchase the necessary materials, equipment and supplies needed to complete these upgrades.
 
Result:  Restore this building to its original appearance for use by TAMIU and the local community.
