Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 5th day of October 2018. Present also were Ms. Kassandra L. Cavazos, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  HR Director, Mr. Ernesto Guajardo presented the Wage and Pay Scale Budget Amendments Report from 09/24/18 to 10/05/18.
 
  Risk Management, Dr. Pedro Alfaro announced that the Cafeteria Plan will take place on October 22nd - October 25th at the Central Jury Room.
 
  Tax Assessor-Collector, Ms. Norma Farabough presented an end of the Fiscal Year Collection Report.
 
4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

5.   Honorable Oscar Hale, 406th District Court Judge
 
a.      Discussion and possible action to execute a Resolution for the expansion of the 406th Judicial District Court Adult Drug Court Program to assist and serve all eligible participants in Webb County and the adjacent counties of Jim Hogg, Starr and Zapata, by establishing a Regional Adult Drug Court Program pursuant to Texas Government Code §123.003, as per the Webb County Commissioners Court approval of the acceptance of the Substance Abuse and Mental Health Services Administration (SAMHSA) Grant Award No.1H79TI081059-01 (TI-18-008) on September 10, 2018.   
 
b.      Discussion and possible action to execute a Resolution for the expansion of the 406th Veterans Treatment Court Program, a component of the 406th Judicial District Adult Drug Court, to assist and serve all eligible veterans in Webb County and the adjacent counties of Duvall, Jim Hogg, Jim Wells, Starr and Zapata by establishing a Regional Veterans Treatment Program pursuant to Texas Government Code §124.002, as per the Webb County Commissioners Court approval and acceptance of the Texas Veterans Commission Fund for Veterans' Assistance Grant No.VTC_18_0607 on October 24, 2016, and any other matters incident thereto.

Issue: New proceeds under Chapter 18 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The attorney representing the State can utilize the new proceeds for the official use of his Office.

10.   Civil Legal Division
 
a.      Discussion and possible action to approve a 2018 - 2019 reimbursement agreement between Webb County Sheriff's Office (“WCSO”) and the Organized Crime Drug Enforcement Task Force (OCDETF) Investigation/Strategic Initiative for the performance period of November 1, 2018 through September 30, 2019 for an amount not to exceed $18,343.75 in overtime pay for Webb County Sheriff’s Office deputies; and the estimated applicable fringe benefits in the amount of $4,881.86 for this overtime agreement will be covered by the WCSO federal forfeiture funds resulting in no impact to the general fund; and authorizing the County Judge to sign all relevant documents and any other matters incident thereto.  [Fund Account #2600 (overtime) and Fund Account #2153 (fringe) (Federal Forfeiture Funds)]
 
Issue: Collaboration between federal, state and local law enforcement agencies is necessary to pursue and dismantle organized crime organizations along the Texas border and within our community.
 
Solution: Accept federal assistance to continue local participation in OCDETF investigations, strategic initiatives, and prosecution of organized crime. Texas Government Code Sec. 771 authorizes such agreement.
 
Result: Disruption of organized crime activity along the Texas border and in Webb County; prosecution of individuals responsible for organized crime.
  
 
b.      Discussion and possible action to authorize the Webb County Civil Legal Division to enter into a Three (3) year forensic software license agreement with Open Text Inc. for security access software keys beginning on (September 26, 2018 through September 25, 2021) for the quoted total amount of $1,267.92, subject to annual appropriations and available funds; and authorizing the Webb County Judge to sign any relevant documents; and any other matters incident thereto.  [Requested by Martin Cuellar, Sheriff; Account #1001-3010-001-443000-110]
 
Issue: The forensic software license agreement with Open Text, Inc. utilized to perform law enforcement investigations and was already purchased by the Webb County Sheriff’s Office, however, as with all software it needs to be renewed in order to maintain its functionality. The vendors name prior to reformation was known as Guidance and was subsequently reorganized into Open Text Inc. effective July 1, 2018. 

Solution: Purchase the security keys to keep the software up-to-date. Texas Local Government Code Section §262.003 authorizes purchases from a sole source. Open Text, Inc. is the sole source of security keys for the forensic software.

Result: Acquire the necessary support and maintenance of the forensic software.
  
 
c.      Discussion and possible action to authorize the Webb County Civil Legal Division to enter into negotiations for a Three (3) year agreement with the City of Laredo for Jail Inmate Services for the performance period of (October 1, 2018 through September 30, 2021) and authorizing the Webb County Judge to sign any relevant documents; and any other matters incident thereto. [Requested by Martin Cuellar, Sheriff; Account #1001-4070-330010 (prisoner revenue)]
 
Issue: The Jail Inmate Agreement has expired

Solution: Enter into a new agreement pursuant to Chapter 791 of the Texas Local Government Code.

Result: The County will be reimbursed a reasonable fee for municipal detentions.
  
 
d.      Discussion and possible action to enter into a Memorandum of Understanding (MOU) for the FY 2018 Edward Byrne Justice Assistance Grant (“JAG”) funded by the Department of Justice (“DOJ”) between Webb County on behalf of the Webb County Sheriff’s Office and the City of Laredo acting on behalf of the Laredo Police Department, which will support equipment, contractual services and supplies for law enforcement operational purposes. The proposed amount Webb County Sheriff’s Office will receive is Thirty Six Thousand Three Hundred Seventy Four Dollars ($36,374.00). There are no matching funds required and therefore there will be no impact to the general fund; and authorizing the County Judge to execute all relevant documents and any other matters incident thereto. [Requested by Martin Cuellar, Webb County Sheriff Account No. to be determined based on the grant]   
 
e.      Discussion and possible action to approve construction contract between Webb County and SAL Construction Company, LLC., pursuant to the prior approval and award of bid proposal for the Webb County “El Cenizo Control Valve Improvements Project, Invitation to Bid (ITB#2018-003), Bid Proposal, Plans & Technical Specifications”, as needed to meet all Texas Commission on Environmental Quality (T.C.E.Q.) statutory requirements for the Webb County/El Cenizo Water/Wastewater Treatment Plant Elevated Water Storage Tank  in the amount of $120,504.00, and authorizing the Webb County Judge to execute any and all relevant documents; and any other matters incident thereto. [Construction-in-Progress/Requested by Adrian Montemayor, Webb County Utilities Deptartment Director; Funding Source Water Utilities 2016 Bond #7220-001-474501]   
 
f.      Discussion and possible action to correct the amount of a twelve (12) month (November 1, 2018 through October 31, 2019) Software Subscription Agreement between Management Information Technology USA, Inc. D/B/A ChildPlus Software and Webb County for the Webb County Head Start/Early Head for program management Software that was passed by the Webb County Commissioners Court on September 10, 2018 (Item 7 cc) at a total cost of Seventeen Thousand Two Hundred Eighteen Dollars and Ninety-Nine Cents ($17,218.99), and authorizing the County Judge to sign and execute all relevant documents. The correct amount is Seventeen Thousand Six Hundred Forty Nine Dollars and Forty-Eight Cents ($17,649.48). g.      Discussion and possible action to enter into a Twenty Four (24) month (September 1, 2018 through August 31, 2020) Professional Services Agreement between the University of Texas Health Science Center at San Antonio (UTHSCSA) Pediatric Dentistry and Advance General Dentist and Webb County for the Webb County Head Start/Early Head Start Program to provide dental health consultant services for the Webb County Head Start/Early Head Start Program population at a cost set forth in the fee schedule within the agreement, subject to annual budget appropriations and authorizing the County Judge to sign and execute all relevant documents. h.      Discussion and possible action to ratify and approve a Twelve (12) month (September 30, 2018 through September 29, 2019) contract between Webb County for the 406th District Court Adult Drug Program and Cordant Forensic Solutions for participant monitoring. The scope of services and fee schedule are attached. There is no impact to the county budget, and authorizing the County Judge to sign and execute all relevant documents. i.      Discussion and possible action to approve a Two (2) year (September 1, 2018 through August 31, 2020) Non-Financial Memorandum of Understanding (MOU) between Texas A&M AgriLife Extension Service and Webb County. The purpose of the MOU is to document the parties’ understanding and responsibilities with regard to Information Technology Services at the County Extension Office, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. j.      Discussion and possible action to approve an Annual (November 1, 2018 through October 31, 2019) Software Support Services Agreement between Avotus and Webb County for network software maintenance at a total cost of Thirteen Thousand Seven Hundred Fifty Nine Dollars and Forty-Four Cents ($13,759.44) and authorizing the County Judge to sign and execute all relevant documents; and any other matters incident thereto. l.      Discussion and possible action to enter into a One (1) Year (September 28, 2018 through September 27, 2019) Cloud Services Contract between Insight Public Sector and Webb County for the 406th District Court Veteran’s Treatment Program at a total cost of One Thousand Three Hundred Twenty Four Dollars and Thirty-Two Cents ($1,324.32) and authorizing the County Judge to sign and execute all relevant documents, and any other matters incident thereto. Issue: On August 27, 2018, Commissioners Court approved item #39 in which slot #0072 (Chief Deputy County Treasurer) was to be transferred from dept. 1250 (Treasury) into dept. 1230 (Human Resources). As per the motion, the said slot is to be transferred temporarily until December 31, 2018.

Solution: Approve budget amendment to transfer payroll amounts including fringe to department as motioned by the court.

Result: Slot will be paid from appropriate department.
  
 
12.   Honorable Isidro Alaniz, District Attorney
 
a.      Discussion and possible action to continue paying grant funded personnel under Criminal Justice Division (CJD) Grant No. 2466308, Region 2 Border Prosecution Unit Grant, for Thirty (30) days, until notification about grant continuation award from the Homeland Security Grants Division of the Governor's Office. All personnel cost will be reimburse with grant funds. [Fund #2739-2260]

Issue: Current grant funding expired August 31, 2018. The District Attorney’s Office has not received notice of award for new grant. Unless this item is approved, prosecutors working under said grant will not be paid after September 30, 2018.

Solution: Grant an additional 30-day payroll extension for employees working under this grant.


Result: The District Attorney’s Office will continue to improve quality of prosecuting criminals charged with border crimes as defined by Texas Government Code 772.007(a)(1).
  
 
b.      Discussion and possible action to approve a reimbursement agreement between the District Attorney’s Office and the Organized Crime Drug Enforcement Task Forces program (OCDETF) for an amount not to exceed $157,206.25. The total reimbursable amount covers overtime for investigators assigned to the Task Force ($128,406.25) and payments related to 3 leased vehicles ($28,800). The period of performance for this award is October 1, 2018 through September 30, 2019. Forfeiture funds will be utilized to cover the fringe benefits allocated to the overtime therefore no impact to the General Fund. [Account #2587-2260-001-413000]

Issue: Collaboration between Federal, State and local law enforcement agencies is necessary to pursue and dismantle organized crime organizations along Webb County and the Texas Border.

Solution: Accept Federal assistance to continue local participation in Joint Operations under the Organized Crime Drug Enforcement Task Forces Program.

Result: Disruption of organized crime activity along the Texas border and in Webb County.

Webb County has already been notified of said agreement and returned it to OCDETF with the required signature by the authorized official for Webb County, the Webb County Judge, in reference to this agreement.  OCDETF will cover $18,343.00 in overtime from Fund Source 2602. Also to increase fringe benefits accounts of $4,206.00 by Constable Pct.4 Federal Forfeiture Fund #2202 to cover fringe benefits.

b.      Discussion and possible action to authorize the acceptance of a Violent Crimes Against Women Criminal Justice and Training (VAWA) grant award as developed, written, presented, and submitted by the Webb County Sheriff’s Office to the Criminal Justice Division (CJD) Office of Governor (OOG) in the amount of $7,100 for training, equipment, and supplies for investigators and patrol officers working at the Webb County Sheriff’s Office serving victims of violent crimes against women and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires a Twenty-Nine (29%) percent cash match, or a $2,900 cash match, which will be met by the Webb County Sheriff's Office forfeiture funds. Thus, this grant will have no impact to the general fund. .  All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. Issue: Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area. According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766. That's almost double the amount of casualties lost during wars in Afghanistan and Iraq. Women who will be victims of severe violence by an intimate partner in their lifetimes number 1 in 4.  (“30 Shocking Domestic Violence Statistics That Remind Us It’s An Epidemic”  Vagianos 10/23/2014).

Solution: Grant award to enhance the tools, techniques, and training to those investigators who follow-up to calls for assistance, conduct interviews with these victims, file incident reports, provide these victims information/referrals to service providers, initiate arrests of perpetrators, refer cases for prosecution, and prepare testimony/evidence for trial in cases of domestic violence, sexual assault, dating violence, and stalking.

Result: Enhanced law enforcement services, including investigative techniques, to deal with emergent criminal trends, such as cyber stalking, and improved efficacy of the law enforcement response to the needs of victims of violent crime.
  
 
c.      Discussion and possible action to authorize the submission of a grant application to the NRA Foundation estimated at $30,100 as developed, written, and submitted by and for the Webb County Sheriff's Office for firearms equipment for its certified peace officers, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue:  The Webb County Sheriff’s Office must continually equip its sworn officer force with an important array of duty gear, other critical safety equipment, and essential, but costly expendable supplies, such as ammunition, utilizing limited local funds.  Moreover, the vast majority of federal and state grants do not allow for the purchase of firearms and/or ammunition as an eligible grant expense.
 
Solution: Grant application to the Friends of the National Rifle Association (NRA) Foundation by the Webb County Sheriff's Office to provide firearms as a supplemental source of this needed equipment.
 
Result: The Webb County Sheriff’s Office's sworn officer force will be provided with additional firearms.
  
 
d.      Discussion and possible action to authorize the submission of a grant application completed and submitted by the Webb County Sheriff’s Office to the Bureau of Justice Assistance (BJA) for a State Criminal Alien Assistance Program (SCAAP) grant for reimbursement of costs already incurred for the incarceration of undocumented criminal aliens at the Webb County jail; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any cash match; and, in fact, is a reimbursement of costs already incurred. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Although immigration matters, including illegal immigration, are constitutionally established as existing under the legal jurisdiction and regulation of the federal government, state prisons and local detention facilities, such as the Webb County jail, incurs significant costs incarcerating undocumented foreign aliens who commit crimes in the United States. This includes but is not limited to supervision, housing, feeding, clothing, any medical and transportation expenses, and other associated detention costs.
 
Solution:  Grant application to obtain reimbursement of a small percentage of the incurred correctional officer salary costs associated with detaining undocumented criminal aliens who had at least one felony or two misdemeanor convictions for violations of state or local law and who were incarcerated at the Webb County jail for at least four (4) consecutive days during the reporting period of July 1, 2016 through June 30, 2017.
 
Result: Webb County will be reimbursed by the federal government a limited percentage of the amount of its already incurred costs of detained foreign criminals incarcerated at the Webb County jail.

Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments.
  
 
b.      Discussion and possible action to approve payment for memberships of non-profit state associations as required by Local Government Code Section §89.002 dependent on funding availability and pending of any association fee increases, list attached.
 
Issue: Local Government Code §89.002 requires that:

The Commissioners Court may spend, in the name of the county, money from the county's general fund for membership fees and dues of a nonprofit state association of counties if:
 
(1)  a majority of the court votes to approve membership in the association;
(2)  the association exists for the betterment of county government and the benefit of all county officials;
(3)  the association is not affiliated with a labor organization;
(4)  neither the association nor an employee of the association directly or indirectly influences or attempts to influence the outcome of any legislation pending before the legislature, except that this subdivision does not prevent a person from providing information for a member of the legislature or appearing before a legislative committee at the request of the committee or the member of the legislature;  and
(5)  neither the association nor an employee of the association directly or indirectly contributes any money, services, or other valuable thing to a political campaign or endorses a candidate or group of candidates for public office.
 
Solution: Obtain court approval as required.
 
Result: Purchase Orders for associations approved by the Court will be processed for payment.

Issue: Various departments and offices have depleted departmental budgets nonetheless there are invoices pending to be processed that must be paid with FY 2017-2018 funds. Invoices cannot be validated if the accounts are in negative.

Solution: In order to timely process and pay invoices, Business Office will identify line items transfers and perform administrative budget amendments as needed to process invoices. A list of invoices pending process due to insufficient funds will be generated and provided to the Budget Officers by the Business Office.

Result: Invoices will be processed and sent to the Auditor's for approval.

Issue: The Highway 59 Colonias are impacted by a significant Special Flood Hazard Area that impedes access to emergency services and evacuation during inclement weather and flood events.  The remaining funds in Account #3180-470000-165 is inadequate to pay for the additional engineering services and thus, additional funding needs to be identified and allocated to this project.

Solution: Fund and exercise the optional provisions of the contract to provide for additional engineering services to secure the first phase of drainage improvements and evacuation routes to enhance public health and safety and emergency services and operations during inclement weather.

Result: The engineering plans and design will provide a “shovel-ready” project offering the county with an opportunity to apply for grants, state-aid and/or federal support for the completion of a project that is already designed, engineered and studied.  Alternatively, the County can undertake the project if local funds are adequate and set aside for this purpose.
