Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. through a virtual meeting with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 9th day of April 2020. Present also were Ms. Kassandra Cavazos, Co-Chief Deputy representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  HR Director, Mr. Ernesto Guajardo presented the Wage and Pay Scale Budget Amendments Report for 03/06/2020 to 04/08/2020.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: Recent purchases have been made by the Building Maintenance Department due to the COVID-19 situation. Request additional funds to purchase consumable products for cleaning and sanitizing county buildings.

7.   Civil Legal Division
 
a.      Discussion and possible action to approve the amendment of the Inter Governmental Service Agreement (IGSA) Federal Contract 70DCR18DIG000010 that increases the level of detention facility standards, incorporates robotics processing automation, and a bed space tracking initiative; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. b.      Discussion and possible action to enter into an agreement between Webb County and Kofile Technologies, Inc., for the preservation of Webb County Plat Records in an amount not to exceed Three Hundred Ninety-Six Two Hundred Thirty-nine and eighty-two cents ($396,239.82) pursuant to Local Government Code Section 271.103, (a) & (b) (Purchases from Federal Schedule Sources of Supply), Kofile Technologies, Inc., GSA Schedule 70, GSA Contract No. GS-35F-275AA pursuant to Option 1 in the Quote and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. 9.   Commissioners Court Administrator
 
a.      Discussion and possible action to proclaim the month of April 2020 as National County Government Month in Webb County, Texas; and any other matters incident thereto.   
 
10.   Community Action Agency
 
a.      Discussion and possible action to approve Amendment #1 to Contract Number #58200003175 for the Comprehensive Energy Assistance Program (CEAP) from the Texas Department of Housing and Community Affairs (TDHCA) for the Program Year 2020, in the amount of ONE MILLION EIGHT HUNDRED TWELVE THOUSAND NINE HUNDRED AND THIRTY SEVEN DOLLARS ($1,812,937.00). This Amendment #1 will increase funding from $1,541,275.00 to $1,812,937.00 and authorizing the County Judge to sign all relevant documents. This action will not have impact to the General Fund. All required documents were sent for review through the Economic Development Department and the solicitation with the Webb County Single Point of Contact (SPOC) procedures. [Requested by James Flores, CAA Executive Director and Economic Development Department]

Issue: Approve funding increase Amendment # 1 for the CEAP Program Grant from TDHCA for the Program Year 2020 in the amount of $271,662.00.

Solution: The Comprehensive Energy Assistance Program (CEAP) provides direct client serves to eligible, disabled and low income residents of Webb County.

Result: The services are intended to assist eligible Webb County residents with up to 12 highest remaining calendar months of energy consumption.
  
 
b.      Discussion and possible action to ratify the acceptance of the award and check #0003814279 from H-E-B My Community Investment Program for the Webb County Community Action Agency-Meals on Wheels Program in the amount of TWENTY FIVE THOUSAND DOLLARS ($25,000.00) and authorizing the County Judge to sign all relevant documents. This award does NOT require a County match. However, a County match of $25,000 is requested to maximize the benefit to Webb County's vulnerable populations. All required documentation has been submitted for review to the Economic Development Department and the solicitation is compliant with Webb County Single Point of Contact (SPOC) policies and procedures. [Fund 2923 (CAA Emergency Food & Shelter/local funds)]

Issue: H-E-B has awarded check #0003814279 to Webb County Community Action Agency in the amount of $25,000.00 under My Community Investment application in support of emergency aid to Webb County residents impacted by COVID-19.

Solution: Funding will allow for home delivery of up to 8,400 shelf stable ready meals and other essentials to elderly; health compromised and handicapped/disabled residents of Webb County, Texas.

Result: These funds are intended to assist 1,200 eligible Webb County households with up to one week's worth of shelf stable ready meals as well as daily essentials to the most vulnerable population during COVID-19 pandemic.
  
 
c.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective April 14, 2020:

Issue: Slot #1217 is vacant. Grant funds are to be used for this position.

Solution: The request is being made to fill vacant Food Transporter position.

Result: The filling of slot will allow Meals on Wheels program to effectively continue to provide home-delivered meals to qualifying program consumers.
  
 
11.   Honorable Mike Villarreal, Constable Pct. 2
 
a.      Discussion and possible action to approve the retirement of K9 Hanna, and to return said K9 to previous owner Constable Adrian Cortez, and authorize the County Judge to sign all relevant documents; and any other matter incident thereto.

Issue: K9 Hanna has reached the recommended retirement age of 7 years old, she is showing signs of aging. Hanna has honorably served our department since April 25, 2016.

Solution: Retire K9 to allow for a replacement.

Result: Department will have a young and more energetic K9. K9 Hanna will retire after serving 4 years with Constable Pct. 2.
  
 
b.      Discussion and possible action to approve the exchange of a K9 Hanna a Belgian Malinois female, which was previously donated by Constable Pct. 3 (Adrian Cortez) to Constable Pct. 2 (Miguel Villarreal), due to retirement, if approved she will be exchanged for K9 Marko, a male German Shepard.

Issue: K9 Hanna has reached her retirement age, and needs to be replaced by another K9. 

Solution: Authorization to replace K9 Hanna with K9 Marko. K9 Marko was donated by the U.S. Military at no cost to the County of Webb, K9 Marko has an estimated value of $6,000.00 

Result: Cosntable Pct. 2 Department will have a young and energetic K9 on duty who will help deter crime, and assist in making  presentations at Elementary schools.
  
 
12.   Honorable Margie Ibarra, County Clerk
 
a.      Discussion and possible action to purchase two (2) laptop computers in the amount of Three Thousand Six Hundred and Eighty Dollars ($3,680.00), through the purchasing department, to be utilized by all Webb County Courts to maintain judicial functions during the COVID19 global pandemic and any related software; inventory of laptops shall be required prior to distribution of any said laptop computers, and any other matters incident thereto. Issue: A request by Judge Victor Villarreal, Administrative Judge of the County Courts at Law, that these line items be transferred back to the County Court at Law No. 1 accounts in order to have only Judicial General County Court expenses coming withdrawn from that budget. 

Solution: Transfer line items. 

Result: The Judicial General Court Courts will only have expenses for its intended budget. 
  
 
14.   Honorable Tano E. Tijerina, Webb County Judge
 
a.      Discussion and possible action to proclaim the month of April, 2020 as Child Abuse & Neglect Awareness Prevention Month.   
 
15.   Honorable Isidro Alaniz, District Attorney
 
a.      Discussion and possible action to approve the addition of a 2019 Chevrolet 1500 VIN: 3GCUY9ED0KG112726, as part of the Webb County District Attorney's Office fleet inventory, including but not limited to revising Webb County’s vehicle inventory to reflect this addition, provide the necessary insurance coverage; and any other matters incident thereto.

Issue: The Webb County District Attorney's Office is requesting to add this vehicle as part of its inventory to be use for law enforcement purposes

Solution: Approve the addition of this vehicle as part of the Webb County District Attorney's Office vehicle inventory.

Result: The Webb County District Attorney’s Office will utilize the vehicle and all available resources to continue its commitment in keeping the community safe by deterring and dismantling organized crime.
  
 
16.   Economic Development
 
a.      Discussion and possible action to authorize the acceptance of a Fiscal Year 2019 Operation Stonegarden (OPSG) grant as prepared and submitted by the Webb County Sheriff’s Office in the amount of $2,277,567 from the Office of the Governor Homeland Security Grants Division (HSGD) for overtime, applicable fringe benefits, equipment/supplies, fuel, data services, maintenance/repair of OPSG acquired assets, and other operational costs related to homeland security border operations for the Webb County Sheriff’s Office, Constable Pct. 1, Constable Pct. 2, Constable Pct. 3, Constable Pct. 4, and County Attorney Investigators; and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto.  Furthermore, this grant does not require any type of match; and, thus, will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Complex and dynamic law enforcement challenges exist in the Southwest border area of the United States, including Laredo/Webb County. For example, transnational criminals seek to exploit existing law enforcement jurisdictional boundaries by conducting their illegal enterprises across traditional jurisdictional divisions. The 2014 Texas Gang Threat Assessment expounds, “Gang activity remains widespread throughout all regions of Texas…Gang activity is also prevalent in the Texas counties adjacent to Mexico and along the key smuggling corridors, since Texas-based gangs are used for cross-border smuggling and trafficking in the state. Many transnational gangs operating in Texas….engage in criminal activity in Mexico as well as in Texas and elsewhere” (Texas Department of Public Safety April 2014).

Solution: Grant award: (1) to ensure first responders are equipped with enhanced tools/equipment/resources needed to confront well-funded criminal organizations and (2) for the coordination of law enforcement efforts between various local and federal law enforcement agencies.

Result: Enhanced capabilities of local law enforcement responders; further coordination of response across local and federal jurisdictions.
  
 
b.      Discussion and possible action to ratify the submission of a H-E-B My Community Investment Application for the Webb County Community Action Agency-Meals on Wheels Program in the amount of TWENTY-FIVE THOUSAND DOLLARS ($25,000.00). This grant does NOT require a County Match. However, a County Match of $25,000.00 is requested to maximize the benefit to Webb County's vulnerable population. All required documentation has been submitted for review to the Economic Development Department and the solicitation is compliant with Webb County Single Point of Contact (SPOC) procedures. No impact to the General Fund. [Requested by James Flores, CAA Executive Director; Fund #2470-7410]

Issue: CAA Meals on Wheels is a grant funded agency. H-E-B identified the Webb County Community Action Agency as a possible recipient for additional funding to purchase items needed during COVID-19 pandemic.

Solution: This grant will allow us to deliver up to 8,400 shelf stable ready meals and other essentials to elderly; health compromised and handicapped/disabled residents of Webb County, Texas.

Result: If approved, funding would allow Meals on Wheels Program to expand home delivery meal services and provide one week's worth per household to eligible participants of shelf stable ready meals as well as daily essentials to the most vulnerable population during COVID-19 pandemic.

Solution: Request to fill this vacant slot will allow the department to continue to operate effectively.

Issue: Approve funding increase Amendment # 2 for the CSBG Program Grant TDHCA for the Program Year 2020 in the amount of $439,540.00.

Solution: The Community Services Block Grant Program (CSBG) provides support services to eligible elderly, disabled and low income residents of Webb County.

Result: The support services are intended to assist eligible Webb County residents to transition out of poverty.
  
 
e.      Discussion and possible action to authorize the submission of a Coronavirus Emergency Supplemental Funding (CESF) grant application to the U.S. Department of Justice in the amount estimated at $58,008 and as developed, written, and submitted by the Webb County Sheriff's Office for equipment and supplies to assist the Webb County Sheriff’s Office in its ongoing efforts to help continue prevention efforts, preparation for, and response to the coronavirus pandemic in Laredo/Webb County, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The COVID-19 pandemic has negatively impacted the lives of billions of people throughout the world and continues to cause immense physical, psychological, and economic devastation to the local community. 

Solution: Through this proposed grant application, the Webb County Sheriff’s Office will be able to obtain supplemental resources of supplies and equipment to help continue preventing the spread of the coronavirus, preparing for its short and long term impacts, and responding to the increased needs in the local community. 

Result: The Webb County Sheriff’s Office will have additional resources to help serve and protect the local community.

Solution: Attempt to sell the county surplus or salvage property by public auction, dispose or destroy property that cannot be sold through auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products. 

Result: Process all surplus or salvage property in accordance with state law and Webb County Procurement Policy.

Solution: These reporting Violations are been resolved by closely monitoring our Chlorine residuals during our Disinfection Process System as ("TTHM") can be produced with Free Chlorine because there are Organic Matters in the Raw Water System.

Result: Our Annual required Maximum Contaminant Levels ("MCL") for Trihalomethanes ("TTHM") will decrease and will be below the required 0.080 mg/L by the next annual average quarter 2020 and eleminate any other violations to this matter.
