Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the virtual regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 10th day of December 2020. Present also were Mrs. Rosa E. Herrera, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  Treasurer, Mr. Raul Reyes gave a presentation of Bills and Disbursements for the period of 11/20/2020 through 12/10/2020 that included the Recap of Checks, Ratification of Checks, Liability Disbursement of County Payroll for the period of 11/20/20 through 12/03/2020 and the Casa Blanca Golf Course payroll of 12/18/2020 and 1/1/2021. 
 
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct 4 Cindy Liendo to approve the payroll estimate not to exceed $30,000.00 for the two Golf Course pay dates and the treasurer's report

  Risk Management, Samantha Sanchez gave a status update on Medical Plans, Dental and Vision Enrollment. Informed the Court of the transfer of data from Benebridge System to New World System and that the AETNA Wellness Coordinator would be stationed in the Billy Hall 2nd floor for three years.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.      Discussion and possible action to approve the transfer of the following vehicle from the District Attorney’s Office to the 406th District Court and to make the necessary adjustments to the Webb County Inventory report and any other maters incident thereto. Issue: The 406th District Court is in need of a reliable vehicle to handle the transportation needs related to court activities from said Court. Their current vehicle inventory includes two vehicles that have high mileage and are not dependable.

Solution: Approve the transfer of the vehicle to the 406th District Court.

Result: The 406th District Court will have a dependable vehicle for their transportation needs.

Issue: Funds must be moved within this grant budget's individual line items.  

Solution: Request authorization from the court to move grant funds within the overall budget.  

Result: The budget will be aligned with the budget required by the funding agency.

Issue: Line item transfer is needed to cover first payment to 2020 Certificates of Obligations and 2020 Limited Tax Refunding Bonds within allocated interest line item accounts.

Solution: With court approval of line item transfer, expenses for the remainder of the fiscal year will be covered.

Result: There will be sufficient funds to cover current payment from appropriate accounts.
  
 
c.      Discussion and possible action to ratify, by Order, end of fiscal year 2020 budget amendments; necessary to process year-end invoices or services rendered on or before September 30, 2020; and any other matters incident thereto.

Issue: Various departments and offices depleted funds within departmental budget line items; nonetheless, multiple invoices were received for goods or services after the fiscal year-end which required apply date of FY-2020.

Solution: In order to process year-end transactions and pay invoices, funding was identified as approved by Commissioners Court on September 28, 2020, to allow Auditors Office and Budget Officers to enter and post budget amendments.

Result: Funds were transferred to cover pending invoices and properly classify transactions in FY-2020.

6.   Bruni Community Center
 
a.      Discussion and possible action to accept a donation in the amount of Three Hundred Dollars ($300.00) to the Bruni Community Center Goods for Public Events Account #1001-6240-001-461003, and any other matters incident thereto.

Issue: Bruni Lions Club have given a Donation to Bruni Community Center, and as required by the court, a request is being submitted to accept the funds donated.

Solution: Approving Donation to add funds available to community Center.

Result: Donations will help with costs and expenses incurred for goods for public events.
  
 
7.   Casa Blanca Golf Course

8.   Civil Legal Division
 
a.      Discussion and possible action to approve an advertising contract between Lamar Advertising of Laredo and Webb County for the District Attorney’s Office for the service dates of January 16, 2021 through January 14, 2022 in the amount of Twenty Seven Thousand Three Hundred Dollars ($27,300.00) for various public service announcements; and authorizing the Webb County Judge to sign all relevant documents and any matters incident thereto. [Requested by District Attorney Isidro Alaniz, Account #2160-2260-001-457006 (Law Enforcement Other)]   
 
b.      Discussion and possible action to enter into the following Third Party Contracts and authorizing the County Judge to sign all relevant documents.

c.      Discussion and possible action to enter into a Three (3) year Hospital Services Agreement with Laredo Texas Hospital Company, L.P. d/b/a Laredo Medical Center. The term of the Hospital Services Agreement shall begin January 1, 2021, and will end December 31, 2023. The purpose of the agreement is to provide the medical examiner basic diagnostic histology and laboratory services. Services will be charged at One Hundred Five Percent (105%) of the Current Medicare Fee Schedule on the date of service, subject to annual budget appropriations; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. 10.   Honorable Victor Villarreal, County Court at Law 2 Judge
 
a.      Discussion and possible action to appoint Judge Victor Villarreal to the Webb County Bail Bond Board.   
 
11.   Honorable Tano E. Tijerina, Webb County Judge
 
a.      Discussion and possible action to approve the payment of a membership for a non-profit state association as required by Local Government Code Section §89.002 for the County of Webb in the amount of Five Thousand Seven Hundred Fifty Dollars ($5,750.00) Dollars to the Alliance for I-69 Texas regarding the annual membership dues. This annual membership fee will be added to the membership master list. [Requested by Tano E. Tijerina, County Judge; Account #1001-1020-001-464010 (Dues and Memberships)]
 
Issue: Local Government Code Section §89.002 requires that the Commissioners Court may spend, in the name of the county, money from the county's general fund for membership fees and dues of a nonprofit state association of counties if:
 
(1)  a majority of the court votes to approve membership in the association;
(2)  the association exists for the betterment of county government and the benefit of all county officials;
(3)  the association is not affiliated with a labor organization;
(4)  neither the association nor an employee of the association directly or indirectly influences or attempts to influence the outcome of any legislation pending before the legislature, except that this subdivision does not prevent a person from providing information for a member of the legislature or appearing before a legislative committee at the request of the committee or the member of the legislature;  and
(5) neither the association nor an employee of the association directly or indirectly contributes any money, services, or other valuable thing to a political campaign or endorses a candidate or group of candidates for public office.
 
Solution: Obtain court approval as required by State law.
 
Result: Pay pending invoices for Alliance for I-69 Texas Association.
  
 
b.      Discussion and possible action to accept the recommendation of the Webb County Historical Commission (WCHC) nominations committee and approve the following individuals for appointment/reappointment to the Webb County Historical Commission; and any other matters incident thereto: Renee LaPerriere, Jeanette Hatcher, Frank Gonzalez, Alfredo Gutierrez, Lily Perez, Jorge Santana and Mary Trevino.   
 
12.   Economic Development
 
a.      Discussion and possible action to authorize the submission of a grant application to the NRA Foundation estimated at $3,000 and as developed, written, and submitted by and for the Webb County Sheriff's Office for firearms equipment for its certified peace officers; authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]
 
Issue: The Webb County Sheriff’s Office must continually equip its sworn officer force with an important array of duty gear, other critical safety equipment, and essential, but costly expendable supplies, such as ammunition, utilizing limited local funds.  Moreover, the vast majority of federal and state grants do not allow for the purchase of firearms and/or ammunition as an eligible grant expense.

Solution: Grant application to the Friends of the National Rifle Association (NRA) Foundation by the Webb County Sheriff's Office to provide firearms as a supplemental source of this needed equipment.

Result: The Webb County Sheriff’s Office's sworn officer force will be provided with additional firearms.
  
 
b.      Discussion and possible action to authorize the acceptance of Year 3, FY 2021-2022 for the Substance Abuse and Mental Health Services Administration Grant (SAMHSA) non-competitive grant application, grant number H79TI081929-03 in the amount of $4000,000; which will allow for the continuation of the services currently being provided by the 341st Veterans Treatment Program and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. There are no matching funds required. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by 341st District Court - Veterans Program]   
 
c.      Discussion and possible action to authorize the Economic Development Department to submit Amendment No.2/Modification to contract #7219173 for the Texas Community Development Block Grant Program (TCDBG) Texas Department of Agriculture to include a contract extension request for three months or until April 15, 2021, and modification to program design.

Issue: Texas Community Development Block Grant Program (TCDBG) from Texas Department of Agriculture has authorized the extension of contract No. 7219173 and the modification for performance.

Solution: The Texas Community Development Block Grant Program (TCDBG) from Texas Department of Agriculture contract No. 7219173 deadline has been extended from January 15, 2020 to April 15, 2020 and performance modification. This contract amendment and performance modification will allow the completion assistance for up to 166 Colonia residents.

Result: This extension is intended to fully succeed the completion fo assisting Colonia residents.
  
 
13.   Engineering
 
a.      Discussion and possible action to authorize Webb County to execute an Order of Acceptance for the dedication of SIX (6) Roadway Right-of-Way and/or Public Utility Easements, (5) out of the La Presa Subdivision, and (1) from the Ranchitos Los Nopalitos Subdivision, for the purpose of acquiring these necessary easements by Webb County to perform road maintenance and/or for utility improvements in order to facilitate transportation needs and/or utility services for Webb County Colonia residents including emergency medical services, school bus pickups for students, and for the use, extension and/or provision of proper drainage, and/or utility services; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. 14.   Head Start
Disclaimer: All Head Start monies are 100% Federal funds
 
a.      Discussion and possible action to approve the Head Start / Early Head Start / Child Care Partnership Addenda for Personnel Policies and Procedures. Program Governance and Management Procedures, and Roles and Responsibilities of the Governing Body and Procedures describing how the Webb County Commissioners Court and the Policy Council will implement Shared Decision Making. Approval of the Addenda includes, but is not limited to: Procedures for Electing Policy Council Members, Reimbursement and Participation in Policy Council Activities; Standard of Conduct for Governing Body, Staff, Contractors, and Volunteers; Personnel Policies and decisions regarding employment of all program staff; Criteria for Employment and Dismissal of all Program Staff; Recruitment, Selection, and Enrollment Priorities; Budget Planning Process / Cost Allocation Plan; Selection of Independent Financial Auditors; Procedures for Reviewing Applications for Funding and Amendments; Selection of Service Areas / Delegate Agency Selection; Self-Assessment Process, to include follow-up activities.   
 
b.      Discussion and possible action to approve the Policy Council By-laws.The purpose of the Policy Council is to serve as a governing body using shared decision-making process with the Webb County Commissioners Court in all matters relating to the planning and coordination of the Head Start, Early Head Start, and Child Care Partnership programs operated by the Webb County Head Start Program.   
 
c.      Discussion and possible action to approve the posting and filling of the following Slot:

15.   Indigent Healthcare Services
 
a.      Discussion and possible action to authorize Inter-Governmental Transfer (IGT) contributions payable to the Texas Health and Human Services Commission as required under the Texas Healthcare Transformation and Quality Improvement Program/1115 Waiver in amounts not to exceed a total of Nine Hundred Thousand Dollars ($900,000) for Fiscal Year 2020-2021. IGT contributions for FY 2020-2021 may be paid out, if necessary, thru December 31, 2021, contingent upon IGT transfer dates and deadlines established by the State of Texas. [Accounts #1001-5030-001-432063-015 (Hospital Inpatient) and #1001-5030-001-432063-020 (Hospital Outpatient) from Fiscal Year 2020-2021 Budget]

Issue: Since 2006, Webb County has participated as the Inter-Governmental Transfer (IGT) entity for Laredo Medical Center and Doctors Hospital of Laredo. The IGT submitted allows hospitals to receive federal matching funds that are used to offset the cost of uncompensated care that hospitals provide to Medicaid and uninsured patients.
 
Solution: Commissioners Court approval is needed in order to submit IGT contributions on behalf of both hospitals as requested by the State of Texas.
 
Result: The authorization of IGT will allow local hospitals to access matching federal funds for FY 2020-2021 to offset uncompensated care costs as well as receive incentive payments from the State of Texas for successful completion of 1115 Waiver project requirements.
  
 
16.   Planning & Physical Development
 
a.      Discussion and possible action to grant Final Plat Approval to Simeon Park Phase IV Re-Plat being a 114.77-acre tract comprised of Tract 41, Simeon Park Phase III and 111.77 acres out of 192.52 acres in Abst. 286, Surv. 369 as described in Vol. 366, Pgs. 155-166 of the Webb County Deed Records.   
 
17.   Purchasing
 
a.      Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value for the purpose it was originally intended for and/or surplus property that that is no longer needed by the department and may have some usefulness for the purpose it was intended and would be transferred for use by another County department or auctioned online to the general public and/or donated as permitted by law.
 
Solution: Attempt to sell the County surplus or salvage property by competitive bids or auction, dispose or destroy property that cannot be sold through auction and/or competitive bids because it has deemed worthless or dispose through and/or competitive bids because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products.
 
Result: Generate revenue from sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets turned in by County departments.
  
 
18.   Honorable Raul Reyes, Treasurer
 
a.      Discussion and possible action to authorize the County Treasurer to request in writing an update of signature cards by County’s Depository, Falcon International Bank, as per Primary Depository Contract § 2.3 Accounts; and any other matters incident thereto.

Issue: Signature cards require update of the Authorized County Representative(s), effective January 1, 2021, for 10 out of the 12 demand deposit accounts maintained for the Tax Assessor Collector and listed on the contract as accounts “o” through “z”.  Accounts “o” and “x” will be closed effective December 31, 2020. Please see attached files. Tax Assessor Collector-elect Patricia A. Barrera will take office on January 1, 2021 and is not listed on the designated depository bank signature cards.
 
Solution: As per bank contract request in writing that new elected official and designees execute a new signature card and that the current signature card on file be void at end of business on December 31, 2020.
 
Result: Tax Assessor Collector elect will be able to conduct depository business starting on January 1, 2021.

Casa Blanca Golf Course
 
19.      Discussion and possible action to authorize the Purchasing Agent to seek competitive proposals for 27 carts for 24 term and in accordance with the Texas Local Government Code; Subchapter C., Competitive Bidding in General 262.021 (County Purchasing Act) and any other matters incident thereto.  [Account #9050-001-483003-280]
 
Issue: Currently the golf course is in need for additional carts to meet the demand of increased golf rounds and tournaments
 
Solution: Solicit proposals for additional carts
 
Result: The golf course will have enough carts until current lease expires.

Human Resources
 
20.      Discussion and possible action to approve guidelines regarding returning to work after COVID-19 illness and any other matters incident thereto.

Issue: Departments are in need of direction in an effort to better follow the recommendations of the Centers for Disease Control and Prevention (CDC).

Solution: Approval of these guidelines will give direction to the County Departments on criteria to follow and facilitate the operations of daily functions at high efficiency.

Result: County Departments will continue to function efficiency and effectively and better serve the citizens of Webb County.

Indigent Healthcare Services
 
21.      Discussion and possible action to authorize an exception to the 25-hour limit for part-time medical employee hired under slot #888813 Part-Time Nurse at Indigent Health Care Services Department and any other matters incident thereto. Salary for this position is paid from federal funds received under the 1115 Waiver-RHP20 Anchor Fund and will have no impact on the General Fund. [Account #2002-5100-001-412000 [Part-Time]]

Issue: With the continued increase of health services offered to the public such as TB testing, Immunizations, and the COVID-19 vaccine once it becomes available; additional medical nursing staff assistance is needed to have adequate coverage for: appointments scheduled at the main office, clinic events held at community centers or other locations in rural areas of our community, vaccine inventory, and completion of state required reporting.

Solution: Commissioners Court approval will allow our part-time nurse to work additional hours to ensure that services are available to the community without interruption.

Issue: Webb County Commissioners Court authorized the selection of Schindler Elevator Corporation to modernize all County elevators.

Result: Modernizing the elevator will improve the operation and reliability of the units.  Reduce maintenance costs, downtime and improve customer satisfaction on ride quality.

Issue: The Webb County Community Action Agency strategies and programmatic efforts have changed. The agency has various logos identifying each line of business. CAA staff have identified the need to unify all CAA lines of business under a single logo for community recognition and branding.

Solution: The agency is seeking to re-band the agency to market all lines of business with a unified logo.

Result: The brand identity vendor will assist the agency in developing a logo for the Community Action Agency for better market the programs and services.
