Let it be remembered that a special meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular virtual meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 5th day of March 2021. Present also were Mrs. Rosa E. Herrera, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  Treasurer Mr. Raul Reyes  gave a presentation of Bills and Disbursement that included the Recap of Checks, Ratification of Checks for 02/19/2021 - 03/04/2021, Liability Disbursement for 02/12/2021 - 02/25/2021 and the Casa Blanca Payroll Disbursement for 02/26/2021.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.
 
  Honorable Margie Ramirez Ibarra, County Clerk stated that the Commission from the State were received and named the Elected Officials who got them.

 
 
COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. b.      Discussion and possible action to accept a Fiscal Year 2021 United States Marshals Services supplemental funding in the amount of $1,157 for reimbursement of employee overtime incurred from Joint Law Enforcement Operations; and authorizing the Webb County Judge to sign all relevant documents; and any other matters incident thereto. Webb County Sheriff's Office state forfeiture funds will be utilized to cover the applicable fringe benefits associated with this project's employee(s) overtime.  Thus, there will be no impact to the general fund. [Account #2599-4070-001-413000 (US Marshals - Sheriff's Office)]

Issue: Collaboration between federal, state and local law enforcement agencies is necessary to pursue and dismantle organized crime organizations along the Texas border and within our community.

Solution: Accept additional federal assistance to continue local participation in U.S. Marshals-related investigations, strategic initiatives, and prosecution of organized crime.

Result: Disruption of organized criminal activity in Webb County as wel as along the Texas border.
  
 
c.      Discussion and possible action to approve the following carry over budget for the Loop 20 Extension (Texas Department of Transportation CSJ: 0086-14-058) Grant Fund 3560 in the amount of $757,268.35. Financial information has been certified by the Auditor's office; and any other matters incident thereto. This is required by court policy but does not impact the Grant. g.      Discussion and possible action to approve the following carry over budget for the grant fund 2473 in the amount of $368.25 and any matters incident thereto. This is required by court policy but does not impact the grant, and therefore, does not require notification to approval by the funding agency. 6.   Casa Blanca Golf Course
 
a.      Discussion and possible action to enter into a Master Lease Agreement (#648410L) with TCF National Bank and adopt two Resolutions authorizing negotiation, execution and delivery of Lease No. 008-0648410-100, being a forty-eight month Lease Agreement for the lease of eighty 2021 E-Z-GO RXV Elite Golf Cars together with any and all attachments included thereto in the amount of Seven Thousand Six Hundred Twenty-Two Dollars and Forty Cents ($7,622.40) monthly and Lease No. 008-0648410-302 for the lease of eighty TFM l0EX GPS Units together with any and all attachments and accessories included thereto in the amount of Three Thousand Two Hundred Seventy-Four Dollars and Forty Cents monthly (being a monthly total of $10,896.80) and further authorizing entering into an Equipment Schedule (Fair Market Value Purchase Option) for each of the aforementioned leases and any matters incident thereto; authorizing the County Judge to sign all relevant documents. 7.   Civil Legal Division
 
a.      Discussion and possible action to approve an agreement between Webb County and Badger Meter, Inc., d/b/a National Meter & Automation in the amount of $14,145.28, to buy 16,448 automated cellular registers, as needed for the Automated Meter Infrastructure (AMI), system used by the Utilities Department. Cellular register technology systems provides automatic & accurate household water consumption information data, meter readings, a customer feedback portal, monitors real-time water consumption, and give leak site information & security technology to identify and eliminate water theft, meter tampering, and/or prohibited access of meters; and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto. [Requested by Tomas Sanchez; Water Utilities Director; Account #7200-7050-001-443000-035 (Repairs & Maintenance)]
 
Issue: The Utilities Department had previously implemented a Badger Meter, Inc., automatic water meter reading system in both Rio Bravo and El Cenizo, and these additional cellular registers are needed to maintain the system. The use of this upgraded automated meter reading system significantly reduced the prior need to use up to 432 man hours to manually process & read the water meters.  The autmoated system & technology greatly reduces keypunching results, re-reading meters and human errors. The automated system also significantly reduced staff’s exposure to hazardous field conditions, heat exposure, snake, dog, and insect bites, as well as reduced staff’s physical injuries caused by holes, terrain, and/or heat exhaustion.
 
Solution: New automated technology allows Webb County to monitor water meter reading remotely by using cellular service data meters, and gives provides data on consumers daily actual per household water consumption & use, detects water leaks, illegal water taps and/or consumption, and provides feedback of exactly when and how much water is used hourly at each household to enable them to monitor and track their water use.
 
Result:  The use of this new technology has increased our revenues, saves water by significantly reducing the level of water loss and theft, & and reduces system revenue losses due to increased ability for early detection of water line leaks, meter tampering and illegal taps/connections on the system.
 
Automated water consumption technology system provides a much more detailed and accurate information accounting system, with  increased revenue, reduction in human errors due to meter reading and/or keypunch errors, and safety for our employees and accurate metered consumption.
  
 
b.      Discussion and possible action to authorize the purchase of a subscription to CotractSafe for database and contract tracking and AIssistant software services effective from March 9, 2021 through September 20, 2021 at a cost of Three Thousand Three Hundred Sixty-Three dollars ($3,663) and any matters incident thereto; authorizing the County Judge to sign all relevant documents as necessary. c.      Discussion and possible action to enter into a twenty (20) year lease agreement between Webb County and American Electric Power (“AEP”) Texas Inc. for the utilization of the AEP Calton Tower, in an amount not to exceed $10 dollars per year; and authorizing the County Judge to sign off on all relevant documents; and any other matters incident thereto.   
 
d.      Discussion and possible action to enter into a twenty (20) year lease agreement between Webb County and American Electric Power (“AEP”) Texas Inc. for the utilization of the AEP Lobo Tower, in an amount not to exceed $10 dollars per year; and authorizing the County Judge to sign off on all relevant documents; and any other matters incident thereto.   
 
8.   Community Action Agency
 
a.      Discussion and possible action to enter into a Memorandum of Understanding between Laredo College (LC) and Webb County Community Action Agency (WCCAA) to include Community Services Block Grant (CSBG) Contract Number #61210003468 for funds of a CDL Truck Driving Training classes. This project is funded through the Texas Department of Housing and Community Affairs (TDHCA) Community Services Block Grant Program (CSBG), two (2) year term, commencing March 8, 2021 and ending March 7, 2023 and authorize the County Judge to sign any relevant document. Issue: As a Texas Department of Housing and Community Affairs requirement, the agency must assist qualify Webb County residents to transition out of poverty.

Solution: Webb County Community Action Agency would enter a Memorandum of Understanding and fund the Truck Driver Training Classes with Laredo Community College.

Result: By providing the training to qualifying Webb County residents, it would increase the resident's probability of transitioning out of poverty.
  
 
b.      Discussion and possible action to enter into a Memorandum of Understanding between Laredo Health Care Training Center (LHCT) and Webb County Community Action Agency (WCCAA) to include Community Services Block Grant (CSBG) Contract Number #612210003468 for funds of Commercial Driver's License (CDL) Truck Driving Training classes. This project is funded through the Texas Department of Housing and Community Affairs (TDHCA) Community Services Block Grant Program (CSBG), two (2) year term, commencing March 8, 2021 and ending March 7, 2023 and authorizing the Webb County Judge to sign any relevant documents. Webb County Community Action Agency will utilize these funds to assist qualified Direct Energy clients. Authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. [Account #2924-5170-521-441210]

Issue: Webb County Community Action Agency received a check from Direct Energy/Central Power and Light (CPL)  Retail Energy/West Texas Utilities (WTU) Retail Energy Neighbor to Neighbor Program in the amount of $5,000.00.

Solution: Webb County Community Action Agency  will utilize these funds to assist qualified Direct Energy clients.

Result: The clients will be assisted to pay their utility bills from donation company.
  
 
9.   Economic Development
 
a.      Discussion and possible action to approve a tax abatement agreement under the Webb County Neighborhood Empowerment Zone (NEZ), Number One Program ("Program") for Mr. Jose L. Arrellano and wife Andrea L. Arrellano as owners of a single family home situated in Webb County, Texas, and being the surface only of all of lot number eight (8), in block number two hundred forty-four (244), Eastern Division, situated in the City of Laredo; also commonly known as 405 Guerrero St. Laredo, Texas 78040; due to qualifying property improvements pursuant to City of Laredo resolution No. 2017-R-63; and authorizing the County Judge to execute any and all relevant documents; and any other matters incident thereto.

Issue: A tax abatement has been approved by City of Laredo for the single family home at 405 Guerrero Street and requires approval from the Webb County Commissioners Court and is necessary for the Webb County Tax Appraisal District to issue the respective tax abatement.  

Solution: Approval of this tax abatement under the name of Mr. Jose L and Andrea L Arrellano owners of the home at 405 Guerrero St. Laredo, Texas 78040.

Result: Approval of this tax abatement will allow the Webb County Tax Appraisal District to issue the respective tax abatement under the NEZ, Number One Program.
  
 
b.      Discussion and possible action to execute Project Grant Agreement 5311-2021-WEBB CO-00032 CARES Act for FY 2021 wherein, Webb County Community Action Agency - El Aguila accepts a grant in the amount of SIX HUNDRED THIRTY TWO THOUSAND THREE HUNDRED TWENTY EIGHT DOLLARS ($632,328.00) from The Texas Department of Transportation (TxDOT). This grant does not require a County Match. All required documentation has been submitted for review to the Economic Development Department and the solicitation is compliant with Webb County Single Point of Contact (SPOC) procedures. No impact to the General Fund. [Requested by James Flores, CAA Executive Director]

Issue: The Texas Department of Transportation (TxDOT) has allotted monies as part of the COVID19 Emergency Relief Response in order to cover operational expenses at 100% for Webb County Community Action Agency El Aguila Rural Transportation with NO County Match.  

Solution: This grant is calculated to reflect average expenses for the Community Action Agency El Aguila from January 1, 2021 through December 31, 2022.

Result: Continuation of transportation services throughout the rural areas of Webb County allowing for safe and reliable response to the transportation needs of rural Webb County during the COVID19 pandemic.
  
 
c.      Discussion and possible action to authorize the submission of a Fiscal Year 2022 Local Border Security Program (FY22 LBSP) grant application as developed, written and submitted by Webb County Constable Pct. 3 Department to the office of Homeland Security Grants Division (HSGD) in the amount estimated at $72,390.76, for peace officers' overtime/applicable fringe benefits, fuel/vehicle maintenance and equipment. Grant funds shall be utilized to help provide enhanced border security in Webb County and Precinct 3 area, and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. This grant does not require a match; and thus, will not have an impact on the general fund. All required documents were sent for review through the Economic Development and the solicitation is compliant with the Webb County single point of contact (SPOC) procedures. [Requested by Adrian Cortez, Webb County Constable Pct. 3]

Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities' economies. These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.
 
Solution: Grant application to provide enhanced border security in Webb County and the Precinct 3 area in order fulfill State of Texas Local Border Security Program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.
 
Result: Enhanced/increased patrol for certified peace officers working at Webb County Constable Pct. 3.
  
 
10.   Fire Suppression & EMS Services
 
a.      Discussion and possible action to accept a donation from Medina Electric Cooperative, Inc. as per Local Government Code 81.032, in the amount of $400.00, to be utilized in the following line item: Training & Education, and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Issue: Donation check issued by Medina Electric, to support the mission of the Webb County Volunteer Fire Department.

Solution: Deposit money into appropriate line item.

Result: Continue working relationship with Medina Electric, and meet department needs.

Issue: Approved ministerial budget amendment requested to purchase an alarm system for the new Bruni Health Care Facility.

Solution: Approval of Ratification.

13.   Public Information Office
 
a.      Discussion and possible action to approve the execution of a technology support maintenance agreement for Courthouse audio visual equipment between Webb County and Ford Audio Video Systems, LLC., for a One (1) year term, commencing March 26, 2021 thru March 25, 2022, at an annual fee of $1,850.00 and authorizing the County Judge to execute all relevant documents, and any other matters incident thereto. [Requested by Larry Sanchez, Webb County Public Information Officer; Account #1001-1300-001-443000-030 (Repairs and Maintenance A/V Equipment)]   
 
14.   Purchasing
 
a.      Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.
 
Issue: Excess County property that either is salvage or surplus property because of time, accident, or any other cause is so worn, damaged, or obsolete that it has no value or some usefulness for the intended purpose is no longer needed by the department.
 
Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by State law.
 
Result: Generate revenue from public sale of property, reduce County expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.
  
 
15.   Risk Management
 
a.      Discussion and possible action to enter into a Work Experience Subsidized Employment Worksite Agency Agreement by and between Webb County and Workforce Solutions, South Texas, for intern/trainee placement in Webb County employment positions by the Webb County Risk Management Department and authorizing the County Judge to sign and execute all relevant documents; any matters incident thereto. There is no impact to the General Fund, as all intern/trainee wages and worker's compensation coverage costs shall be paid for by Workforce Solutions, South Texas. [Requested by Risk Management Director]   
 
16.   Honorable Martin Cuellar, Sheriff
 
a.      Discussion and possible action to authorize the disposal of jail law library books that are obsolete and have no value for the purpose for which it was originally intended in accordance with Sub Chapter D. Disposition of Salvage or Surplus Property, Section 263.151 and 263.152; and any other matters incident thereto. 
 
Issue: Jail library books are over 10 years old. Since 2009, the law library information is available online to all Webb County inmates.  The hard cover books are considered ‘salvage property’ because they are obsolete and are no longer needed by jail inmates and/or Sheriff's Office administration.
 
Solution: Ensure proper disposal of all jail law library books by securing approval from the Webb County Commissioners' Court prior to destruction/disposal.
 
Result: Dispose of salvage property in compliance with Texas Local Government Code requirements.

18.      Discussion and possible action to authorize the development and submission of the Texas Department of Transportation (TX-DOT) FY 2021 Transportation Alternatives Set-Aside Program, and authorizing the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in the application. This grant application requires a 20% minimum local match. All required documents were sent for review to the Economic Development and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.

Issue: Identified sidewalks located in different Colonia areas in Webb County are in need of repair and improvements.

Solution: The Texas Department of Transportation released applications for the 2021 Transportation Alternatives Set-Aside Program for bicyclist and pedestrian infrastructure.

Result: If awarded, funding will improve safety, access, and mobility for the residents of Webb County of all ages and abilities.

19.      Discussion and possible action to authorize the Economic Development Department to develop and submit a Fiscal Year 2020 Staffing for Adequate Fire and Emergency Response (SAFER) Grant application to the U.S. Department of Homeland Security for up to $2,000,000.00, and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request for funding. The purpose of the application is to supplement the Webb County Volunteer Fire Department with a minimum of Nine (9) frontline firefighters. This application does not require a cash match.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.

Issue: As the Webb County Volunteer Fire Department expands to insure the safety of Webb County residents, so does the demand for paid, certified, frontline firefighting personnel.

Solution: The acquisition of grant funds will offset Webb County personnel expenses for a three year period.

Result: A healthy budgetary outlook for Webb County and the volunteer fire department.

Issue: The sole bidders bid proposal exceeds the Project Architects estimated construction cost budget by approximately $93,350.00. In addition, the bid proposal lacks the required unit pricing form breaking down the bid amount proposed. 
 
Solution: Consider the recommendation to reject bid and authorize the Purchasing Agent to resolicit if the Commissioners Court deems necessary.
