Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 5th day of November 2021. Present also were Mrs. Rosa E. Herrera, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. Solution: The Engineering Department is proposing this Budget Transfer for approval by Commissioner Court.

7.   Civil Legal Division
 
a.      Discussion and possible action to approve a lease amendment between Webb County as Lessor and United States Department of Agriculture (USDA) as Lessee located at 8510 Mines Road, to correct name of Lessor and information U.S. Data Universal Numbering System (DUNS) to add new U.S. Federal Executive Order requiring inclusion of these COVID-19 protocol provisions to said lease commencing upon execution by both parties and authorizing the County Judge to sign all relevant documents and any other matters incident thereto. [(No-Cost)]

Issue: The Government appreciates the hard work and dedication of our Lessors. The health and safety of Government employees, contractors, Lessors, and their families is our top priority. In order to ensure the health and safety of the Federal workforce and contractor community, the President signed Executive Order 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors. The requirements in the Executive Order are being implemented via a Federal Acquisition Regulation (FAR) deviation. The clause in the FAR deviation will be incorporated into Government contracts via a bilateral modification.

Solution: Because you hold a Government contract for a leasehold interest in property below the simplified lease acquisition threshold (SLAT), the Government strongly encourages you to accept this contract modification at this time.  Based on the urgency of this issue, please return your signed contract modification as soon as possible and no later than November 14, 2021.

Result: Lease will comply with both DUNS numbering system and Executive Order for COVID-19 Protocols.
  
 
b.      Discussion and possible action to approve a Memorandum of Agreement between Laredo College and Webb County to improve literacy levels and to provide English as a Second Language (ESL), English Language Civics and High School Equivalency (HSE) classes to Webb County Citizens and their children at the Webb County Precinct 1,2,3, & 4 Community Centers, for a two (2) year term, commencing September 1, 2021 thru August 31, 2023, at no cost to the County; and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto.  [No Cost/MOA]   
 
c.      Discussion and possible action to approve a Memorandum of Agreement between Laredo College and Webb County for it’s Webb County Headstart-Early Head-Start Programs to improve literacy levels to provide English as a Second Language (ESL), English Language Civics and High School Equivalency (HSE) classes to Webb County Citizens and their children at the various Webb County Headstart Early Headstart class locations, for a two (2) year term, commencing September 1, 2021 thru August 31, 2023, at no cost to the County; and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto.  [Requested by Aliza Oliveros-Director Webb County Headstart Progam-(No Cost/MOA)]   
 
d.      Discussion and possible action to approve the ratification of a Resolution for the Border Area Nutrition Council (BANC) which will allow BANC to apply for the Texas Department of Agriculture, Texans Feeding Texans: Home Delivered Grant Program Year 2022, authorizing the County Judge to execute all relevant documents, and any other matters incident thereto.   
 
e.      Discussion and possible action to approve a Software Maintenance & Technical Support Agreement for the Jury2020Plus Integrated Jury Administration System between Judicial Systems Inc. and Webb County. The effective date is January 1, 2022 and ending December 31, 2022. The total cost of the annual maintenance shall be Nine Thousand Five Hundred Ninety Eight Dollars ($9,598.00) and authorizing the Webb County Judge to sign and execute all relevant documents; and any other matters incident thereto. 11.   Honorable Isidro Alaniz, District Attorney
 
a.      Discussion and possible action to approve a Memorandum of Understanding between Webb County for the benefit of the Webb County District Attorney's Office and Homeland Security & Investigations for reimbursement of employee overtime incurred from joint law enforcement operations, for the performance period of October 1, 2021 through September 30, 2022, in the amount of Fifteen Thousand Dollars ($15,000.00) per employee. District Attorney Forfeiture funds will be utilized to cover the applicable fringe benefits associated with this project's employee(s) overtime, therefore there will be no impact to the General Fund; and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Account #2579-2260-001-413000 (I.C.E. - DA)]
 
Issue: Collaboration between Federal, State and local law enforcement agencies is necessary to combat criminal organizations illegally exploiting America’s travel, trade, financial and immigration systems.

Solution: Accept Federal assistance to continue local participation in Homeland Security investigations, strategic initiatives and prosecution of organized crime.

Result: Disruption of organized criminal activity in Webb County and along the Texas border.
 
Background: The District Attorney’s Office would like to continue participating in the Joint Law Enforcement Task force with Homeland Security & Investigations. The primary mission of the task force is to combat criminal organizations illegally exploiting America’s travel, trade, financial and immigration systems; thereby improving public safety and reducing crime within our community.
  
 
b.      Discussion and possible action to enter into a one (1) year renewal license agreement (October 1, 2021 to September 30, 2022) between Webb County for the benefit of the Webb County District Attorney's Office and Journal Technologies, Inc. for the use of the e-Prosecutor Go Live software in the amount of One Hundred Eleven Thousand One Hundred Thirty-Two Dollars and Sixty-Six Cents ($111,132.66) and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Account #1001-1280-001-443000-110 (DA Maintenance Fees)]

Issue: Journal Technologies, Inc. is discontinuing the support for Justware which is the current software utilized by the District Attorney's Office for handing their cases. 

Solution: Journal Technologies, Inc. is able to migrate the data to their software platform called e-Prosecutor.

Result: The District Attorneys Office will be able to utilize the most up-to-date software to manage their cases.
  
 
c.      Discussion and possible action to enter into a professional service agreement to migrate the data in the legacy software known as JustWare into the new e-Prosecutor Go Live software owned by Journal Technologies, Inc. in the amount of Two Hundred Twenty Thousand Dollars ($220,000.00); and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. [Account #2161-2260-001-432001 (Professional Services)]

12.   Economic Development
 
a.      Discussion and possible action to authorize the acceptance of Year 4, FY 2022-2023 for the Substance Abuse and Mental Health Services Administration Grant (SAMHSA) award, grant number 5 H79 TI081929-04 for $400,000; which will allow for the continuation of the services currently being provided by the 341st Veterans Treatment Program and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident to it. There are no matching funds required. All required documents were sent for review through the Economic Development Department, and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by 341st District Court]   
 
b.      Discussion and possible action to authorize the submission of a FY 2022 National Crime Victims’ Right Week (NCVRW) Community Awareness Project (CAP) grant application in the amount of $5,000 to the Office for Victims of Crime (OVC) as developed, written, and submitted by the Webb County Sheriff’s Office Grant Writer, and designating the Webb County Judge as the authorized official to sign all relevant documents; and any other matters incident thereto. This grant requires no financial match, and, thus, will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: The rights of crime victims are enshrined in the federal code (Section 3771 of Title 18 of the U.S. Code, Crimes and Criminal Procedure), the Texas Constitution (Article I Section 30), and the Texas Code of Criminal Procedure (Chapter 56). However, many victims of crime are unaware of their mandated rights as well as the services that are specifically available to them to facilitate needed restitution, recovery, privacy, dignity, and justice.

Solution: Grant application to highlight the rights of and services for crime victims in the Laredo/Webb County area during the 2021 National Crime Victims’ Right Week.

Result: The general public and any victims of crime will become more aware of the services available to them in the Laredo/Webb County area.
  
 
c.      Discussion and possible action to authorize the acceptance of a grant award as developed, written, and submitted by and for the Webb County Sheriff's Office Grant Writer from the Office of the Governor Homeland Security Grants Division in the amount estimated at $1,676,618.64 for the FY 2022 Operation Lone Star (OLS) Mandated Grant Program (Grant No. 4376701) for overtime/applicable fringe benefits, part-time/temporary grant-funded employee salary/fringe benefits, equipment/software, and supplies; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires no match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue:  Local law enforcement working in international border communities must work within limited budgetary constraints to provide both proactive and responsive law enforcement services while transborder criminal organizations possess unlimited funding to access the latest technology and equipment to avoid detection/disruption of their activities utilizing their proceeds obtained through illegal but highly lucrative drug trafficking and other unlawful enterprises.

Solution:  Supplemental grant award to provide supplemental resources to assist in combating illegal drug trafficking and provide enhanced border security for the residents/citizens of Laredo/Webb County.

Result:  The Webb County Sheriff’s Office and its sworn officer force will be equipped with needed additional resources

13.   Engineering
 
a.      Discussion and possible action to authorize Webb County to execute an Order of Acceptance for the dedication of the FOUR (4) Roadway Right-of-Way (R.O.W.) and/or Public Utility Easements, as herein-below described, and as per the metes and bounds descriptions for each tract/lots. 1 ROW tract/lot from the Antonio Santos Subdivision & 3 ROW tracts/lots from the Los Fresnos Subdivision, for the purpose of acquiring these necessary ROW & utility easements by Webb County to perform road maintenance and improvements in order to facilitate transportation needs for residents including emergency medical services and school bus pickups for students, and for use, extension and/or provision of proper drainage, and/or utility services; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. Issue: Donation check issued by The Williams Companies Inc. to support the mission of the Webb County Volunteer Fire Department.

Solution: Deposit money accordingly, $1,000 into materials and supplies.

Result: Continue working relationship with The Williams Companies, and meet department needs.

16.   Public Health Services
 
a.      Discussion and possible action to approve a Resolution on behalf of Webb County in support of the ongoing collaboration between the Texas Health and Human Services Commission (HHSC) and the federal Centers for Medicare & Medicaid Services (CMS) to reach an agreement on renewal of the 1115 waiver and timely approval of directed payment programs that are essential to the long-term stability of the safety net providers that serve the Texas Medicaid and uninsured populations; authorizing the County Judge to sign all relevant documents, and any other matters incident thereto.   
 
b.      Discussion and possible action to authorize Inter-Governmental Transfer (IGT) contributions payable to the Texas Health and Human Services Commission as required under the Texas Healthcare Transformation and Quality Improvement Program/1115 Waiver in amounts not to exceed a total of Nine Hundred Thousand Dollars ($900,000) for Fiscal Year 2021-2022. IGT contributions for FY 2021-2022 may be paid out, if necessary, thru December 31, 2022, contingent upon IGT transfer dates and deadlines established by the State of Texas. Issue: Since 2006, Webb County has participated as the Inter-Governmental Transfer (IGT) entity for Laredo Medical Center and Doctors Hospital of Laredo. The IGT submitted allows hospitals to receive federal matching funds that are used to offset the cost of uncompensated care that hospitals provide to Medicaid and uninsured patients.
 
Solution: Commissioners Court approval is needed in order to submit IGT contributions on behalf of both hospitals as requested by the State of Texas.
 
Result: The authorization of IGT will allow local hospitals to access matching federal funds for FY 2021-2022 to offset uncompensated care costs as well as receive incentive payments from the State of Texas for successful completion of 1115 Waiver project requirements.
  
 
c.      Discussion and possible action to approve the interdepartmental transfer of employees and allow the posting and filling of vacant slots, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective November 8, 2021.

Issue: Interdepartmental transfers are being requested for employees to fill new slots and resulting vacant slots. 

Solution: Approval from Commissioners Court to promote employees from within the department and filling of vacant slots.

Result: The transfer and filling of the positions will alleviate work overload in the department.
  
 
17.   Purchasing
 
a.      Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned. 

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

a.      Discussion and possible action to approve a reimbursement agreement between Webb County on behalf of the Webb County Sheriff's Office and the Organized Crime Drug Enforcement Task Force (OCDETF) during the performance period of October 1, 2021 through September 30, 2022 for an amount not to exceed Sixteen Thousand Five Hundred Dollars ($16,500.00) in overtime for the Webb County Sheriff’s Office deputies through the OCDETF Investigation/Strategic Initiative and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. Estimated applicable fringe benefits in the amount of $3,900 for this overtime will be covered by State forfeiture funds; and, thus, this agreement will have no impact to the general fund. [This Money will require a new fund account number to be created by the Auditor for this OCDETF agreement, and Fund #2151 - State Forfeiture Funds to Cover Fringe]

Issue: Collaboration between federal, state and local law enforcement agencies is necessary to pursue and dismantle organized crime organizations within Webb County and along the Texas international border.

Solution: Enter into contractual agreement for an operation with federal agencies and continue local participation in joint overtime operations under the Organized Crime Drug Enforcement Task Forces Program.

Result: Disruption of organized crime activity along the Texas border and in Webb County.

Solution: Authorize the Purchasing Agent to solicit RFP as per the Texas Local Government Code.

Galo, seconded by Commissioner, Pct. 1 Jesse Gonzalez to use of compensatory time for special grant funded overtime programs for overtime calculations purposes when working grant funded overtime Programs (operation Stone Garden Local Border Security Program) or any similar Federal or State grant funded program. The County shall allow the use of compensatory Time as hours work for the calculation of grant funded overtime pay provided Federal, State and County policies so allow no other pay time off will count as hours worked. Members of the bargaining unit may use up to 16 hours of compensatory time per 14-day period or 2-week period, but they cannot use this compensatory time at the same time as the claim grant overtime hours work. Use of compensatory time requires a change to the County Policies which currently prohibits the use of overtime in this manner. Additionally, it is the intent that use of compensatory time cannot occur con-currently with the officers regular duty hours. The overtime work schedule to be done during the officers non-regular work hours.  To bring back in the next agenda to change County Policies.

Galo, seconded by Commissioner, Pct. 1 Jesse Gonzalez to delete the appendix for wage table provisions, there is a provision that said Pursuant to Civil Service Rules and Regulations the sheriff may promote an officer with at least 4 years of law enforcement experience to serve as a Corporal pursuant to Civil Service Rules and Regulations the Sheriff may demote a Corporal for just cause. This section will be deleted.
