Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 22nd day of November 2022. Present also were Ms. Amber Lecea, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

5.   Auditor
 
a.      Discussion and possible action to approve, by Order, a budget amendment to the Sheriff's Office Forfeiture Funds by increasing the expenditure budget by $21,230; said amount is available from seized funds pursuant to U.S. Department of Justice (DOJ) equitable sharing agreement; and any other matters incident thereto. [Requested by Martin Cuellar, Webb County Sheriff; Forfeiture Funds #2152]

Issue: This transfer out was originally approved on 4/25/2022 for a grant awarded in Spring 2022.  However, due to the ongoing global logistical supply chain issues, the grant-funded Body Worn Cameras (BWCs) have been encumbered since Spring 2022, but are not due to be delivered until December 2022.  Thus, an agenda item was needed to be placed for the new fiscal year in anticipation of receipt of the grant-funded equipment.

Issue: Funds are need to continue the water assistance program. Therefore, money is being allocated from the administrative account to the direct service account.

6.   Civil Legal Division
 
a.      Discussion and possible action to approve a minor boundary modification application for expansion of City of Laredo’s Foreign Trade Zone (F.T.Z.) No. 94, with the Foreign Trade Zone Board/U.S. Dept. of Commerce as requested by UNI-TRADE BROKERS, LLC., as (Lessee-Tenant) and 4G Investments, LLC., (Owner/Landlord) & the City of Laredo by adding Lot Number 4, Block 1, North America Industrial Park, Phase 1., Laredo, Webb County, Texas and commonly known as 101 North America Industrial Park, Laredo, Webb County, Texas 78045, to F.T.Z. No. 94, for approval by Webb County, and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto. [Requested by UNI-TRADE BROKERS, LLC.-Tenant/4G Investments, LLC.,/Owner-Landlord/City of Laredo]   
 
b.      Discussion and possible action to authorize Webb County to execute an Order of Acceptance for the dedication of One (1) Roadway Right-of-Way, Utility and Drainage Easement out of Lot/Tract No. 81, Ranchitos Los Mesquites Subdivision to Webb County, by Jose C. Luna, Grantor, for the purpose of acquiring these necessary easements to perform road maintenance, utilities, and/or drainage improvements to facilitate transportation needs for residents including emergency medical services and school bus pickups for students, and to authorize the County Judge to execute all relevant documents; and any other matters incident thereto. [Requested by Luis Perez Garcia, Webb County Engineer]   
 
c.      Discussion and possible action to approve a reimbursement agreement between Webb County on behalf of the Webb County Sheriff's Office and the Organized Crime Drug Enforcement Task Force (OCDETF) during the performance period of October 1, 2022 through September 30, 2023 for an amount not to exceed Ten Thousand Two Hundred Dollars ($10,200.00) to lease a vehicle at a rate of Eight Hundred Fifty Dollars ($850 dollars monthly and authorizing the County Judge to sign all relevant documents; and any other matters incident thereto. [Requested by the Webb County Sheriff's Office, Account #2600-3010-001-444200, OCDETF Fund #2600]

Issue: Collaboration between federal, state and local law enforcement agencies is necessary to pursue and dismantle organized crime organizations within Webb County and along the Texas international border.

Solution: Enter into contractual agreement for to offset cots of leasing vehicles. 

Result: Disruption of organized crime activity along the Texas border and in Webb County.
  
 
d.      Discussion and possible action to approve a One year (1yr.) Wedeco U.V. water treatment disinfection system service support and maintenance agreement between Webb County and Xylem Water Solutions USA, Inc., for the Utilities Department, at the annual subscription rate of $13,742.00 per year, commencing January 1, 2023 thru December 31st, 2023, and authorizing the Webb County Judge so sign any relevant documents, and any other matters incident thereto. [Requested by Tomas Sanchez, Webb County Water Utilities Director; Account #7200-7050-001-443000-035 (Repairs & Maintenance of Equipment)]   
 
7.   Community Action Agency
 
a.      Discussion and possible action to approve the posting and filling of the following Slot, Part-Time Temporary Caseworker - with no benefits, to be funded from the Community Services Block Grant (CSBG) Account #2368-5170-521-410000. This position will be 100% grant funded and there will be no impact to the General Fund.

8.   Economic Development
 
a.      Discussion and possible action to authorize the acceptance of a grant award from the Office of the Governor Criminal Justice Division in the amount of $35,815.92 as developed, written, and submitted by and for the Webb County Sheriff's Office for overtime and applicable fringe benefits for members of the Mental Health Unit to provide mental health services; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff; Grant Fund #2738]

Issue: The local Laredo/Webb County community continues to constitute a medically and mental health underserved area, which requires mentally ill youth and adults to travel to out-of-town facilities in order to receive these needed mental health services.

Solution: Grant award to provide training and consultant services to provide supplemental instruction on responding to crisis intervention/mental health matters for the officers of the Webb County Sheriff's Office as well as overtime and applicable fringe benefits for the Mental Health Unit to transport mental health patients to these out-of-town facilities so that they may receive the care that they require.

Result: Grant funding will allow officers of the Sheriff's Office to receive supplemental training on crisis intervention and members of the Mental Health Unit to undertake complex and time consuming activities and requirements, including execution of court orders, mental health commitments, and the actual transports to out-of-town mental health facilities, so that the mentally ill patients, their families, and the overall community can be better served.
  
 
b.      Discussion and possible action to accept a Violent Crimes Against Women Criminal Justice and Training (VAWA) grant award as developed, written, presented, and submitted by the Webb County Sheriff’s Office to the Criminal Justice Division (CJD) Office of Governor (OOG) in the amount of $7,000 for training, travel, and supplies for investigators and patrol officers working at the Webb County Sheriff’s Office serving victims of violent crimes and authorizing the County Judge to enter into the grant agreement and to execute all relevant documents; and any other matters incident thereto. This grant requires a Thirty (30%) percent cash match, or a $3,000 cash match, which will be met by the Webb County Sheriff's Office forfeiture funds. Thus, this grant will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Martin Cuellar, Sheriff; Grant Fund #2605; Cash Match Account #2151-9080-001-485005 (Transfer out from State Forfeiture Funds)]

Issue: Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area. According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766. That's almost double the amount of casualties lost during wars in Afghanistan and Iraq. Women who will be victims of severe violence by an intimate partner in their lifetimes number 1 in 4.  (“30 Shocking Domestic Violence Statistics That Remind Us It’s An Epidemic” Vagianos 10/23/2014).
Solution: Grant award to enhance the tools, techniques, and training to those investigators who follow-up to calls for assistance, conduct interviews with these victims, file incident reports, provide these victims information/referrals to service providers, initiate arrests of perpetrators, refer cases for prosecution, and prepare testimony/evidence for trial in cases of domestic violence, sexual assault, dating violence, and stalking.

Result: Enhanced law enforcement services, including investigative techniques, to deal with emergent criminal trends, such as cyber stalking, and improved efficacy of the law enforcement response to the needs of victims of violent crime.
  
 
c.      Discussion and possible action to authorize the acceptance of a Criminal Justice grant award from the Office of the Governor Criminal Justice Division in the amount of $35,815.92 for equipment, minor tools, supplies for the Webb County Sheriff's Office Code Enforcement Unit and as developed, written, and submitted by the Webb County Sheriff's Office Grant Writer; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Environmental degradation is a critical and widespread problem throughout the world, including Webb County.

Solution: Grant award to provide supplemental resources for equipment, minor tools, and supplies in support of the Webb County Sheriff’s Office Code Enforcement Division.

Result: Grant funding will allow members of the Code Enforcement to be equipped with supplemental resources.
  
 
9.   Elections Administration
 
a.      Discussion and possible action to approve the execution of an upgraded Field System Software Maintenance, Warranty and Oracle sublicense Support agreement between Webb County and VOTEC Corporation (VOTEC Election Management and Compliance Systems) in the amount of Forty Nine Thousand Three Hundred Thirty-Eight Dollars and Fifty-Five Cents ($49,338.55) with the Oracle sub-license, plus the sum of Twelve Thousand Two Hundred Forty Dollars ($12,240.00) for the Field System Software Support for a combined total of Sixty One Thousand Five Hundred Seventy Eight Dollars and Fifty-Five Cents ($61,578.55). The payment is for the October 1, 2022 thru September 30,  2023 fiscal year support coverage period, and to approve by order a discretionary exemption in accordance with the Texas Local Government Code, Section 262.024 (Discretionary Exemptions)(a.)(7) an item that can be obtained from only one source and to further authorize the County Judge to execute all relevant documents and any other matters incident thereto. a.      Discussion and possible action to issue a “Certificate of No-Plat Required” pursuant to Section 232.0015(a), Texas Local Government Code and the provision of the Webb County Subdivision Regulations Section XVI.1.A (1) to a 5.00 acre tract of land on Survey No. 2149, Abstract 594 of the RH Rains Survey, Webb County, Texas and Porcion 35, Abstract 546, of the Laureano Salinas Survey, Webb County, Texas, the same also being a portion of a 393.7 acre tract of land known as Share No. 2 as described in a Deed of Partition recorded in Volume 579, Page 483, Deed Records, Webb County, Texas, and being that certain “Share No. 4” recorded in Volume 3599, Page 548, Deed Records, Webb County, Texas, as described in Volume 5303, Pages 0596 - 0610 (ID 12334).

a.      Discussion and possible action to approve the posting and filling of the following Slot as well as any remaining vacant slot created by promoting from within, subject to the availability of payroll funds and any applicable Civil Service guidelines, as well as any and all Wage Plan Policies, effective November 28, 2022:

Result: This action will allow our department to promote from within and fill the remaining vacant slot, and will allow us to continue to function efficiently and effectively.

15.   Purchasing
 
a.      Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.
  
 
b.      Discussion and possible action to approve the payment of membership for a non-profit state association as required by Local Government Code Section §89.002 for the Webb County Purchasing Department in the amount of Seventy Five ($75.00) Dollars for one membership to the Texas Public Purchasing Association (TXPPA). [Account #1001-1310-001-464010 (Dues & Membership)]
 
Issue: Local Government Code Section §89.002 requires that (a) the Commissioners Court may spend, in the name of the county, money from the county's general fund for membership fees and dues of a nonprofit state association of counties if:
 
(1)  a majority of the court votes to approve membership in the association;
(2)  the association exists for the betterment of county government and the benefit of all county officials;
(3)  the association is not affiliated with a labor organization;
(4)  neither the association nor an employee of the association directly or indirectly influences or attempts to influence the outcome of any legislation pending before the legislature, except that this subdivision does not prevent a person from providing information for a member of the legislature or appearing before a legislative committee at the request of the committee or the member of the legislature; and
(5)  neither the association nor an employee of the association directly or indirectly contributes any money, services, or other valuable thing to a political campaign or endorses a candidate or group of candidates for public office.
 
(b)  If any association or organization supported wholly or partly by payments of tax receipts from political subdivisions engages in an activity described by Subsection (a)(4) or (5), a taxpayer of a political subdivision that pays fees or dues to the association or organization is entitled to appropriate injunctive relief to prevent any further activity described by Subsection (a)(4) or (5) or any further payments of fees or dues. 
 
Solution: Obtain court approval as required by State Law to pay for membership dues.
 
Result: General Request for Payment for non-profit state association fee will be processed for payment.
