Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 5th day of January 2023. Present also were Ms. Amber Lecea, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

County Treasurer, Mr. Raul Reyes presented the Casa Blanca Golf Course payroll of 12/30/2022 and the estimated payroll for the next pay period of 1/13/2023.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: New proceeds under Chapter 18 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The attorney representing the State can utilize the new proceeds for the official use of his Office.

Issue: New equitable shared funds have been awarded to the District Attorney's Office and may be spent after a budget for the expenditure of the proceeds has been submitted to the Governing Body. The budget must be detailed and clearly define the categories of expenditures.

Solution: Submit a budget to the Governing Body that clearly defines the categories of expenditures to be incurred with the new proceeds.

Issue: Approve the transfer of funds from CEAP Administration and Direct Services to Utility Assistance.

Solution: The Court approval will allow the Webb County Community Action Agency to continue providing utility assistance to eligible low-income residents of Webb County under the CEAP program.

Result: These funds are intended to assist qualifying clients with their home energy expenses.

Building Maintenance

 
a.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective January 9, 2023:

Solution: Approval to post and fill Slot 2279.

Result: This action will allow Building Maintenance Department to continue to function efficiently and effectively.
  
 
8.   Civil Legal Division
 
a.      Discussion and possible action to enter into an agreement with Pitney Bowes and Webb County for the Webb County Sheriff’s Office; pursuant to Sections 271.101 and 271.102, Subchapter F, Cooperative Purchasing Program (buy board Contract #656-21); said agreement is for 60 months to begin (January 9, 2023 through January 8, 2028) at an amount of $156.26 monthly (billed at $468.78 quarterly) which is subject to annual budget appropriations; and authorizing the county judge to execute any and all relevant documents; and any other matters incident thereto. [Account #1001-3010-001-444500]

Issue: The Webb County Sheriff’s Office processes a large volume of mail that needs to be sent via U.S. mail carrier.  The current device is obsolete and the next generation of equipment is available.  The Vendor has agreed to terminate the current contract that ends June 14, 2023 without penalty since they can no longer service the machine. 

Solution: The purchase of such services that utilizes the new equipment will provide Webb County Sheriff’s Office deputies access to prepaid postage to perform county business in a more effective manner.  

Result: Through the services of prepaid postage, there will be a digital accounting of outgoing mail generated by the Webb County Jail and the Webb County Sheriff’s Office. The service will also reduce employee time waiting to pay for mail at the U.S. post office.
  
 
b.      Discussion and possible action to enter into a Interlocal Cooperation Contract between Texas Department of Agriculture (TDA), Zapata County, and Webb County for the Colonia Fund: Planning & Needs Assessment (CFP) program. The term of the contract commences on the date of the last party executes the contract and ends on August 31, 2023. There is no financial impact on the general fund. [Requested by Tano E. Tijerina, Webb County Judge] 

Issue: Approve an interlocal agreement for the 2022 TxCBDG Colonia Fund: Planning & Needs Assessment.

Solution: The program will provide U.S. Department of Housing and Urban Development (HUD) funds through the Texas Community Development Block Grant (TxCDBG) program to identify the specific needs of Colonia communities in Texas.

Result: Under the CFP grant, Webb County is entitled to receive planning and needs assessment services for Colonia communities location within its geographical boundaries. Services will be provided by third-party service provider with which County will contract for services.
  
 
9.   Community Action Agency
 
a.      Discussion and possible action to accept the recommendation from the Webb County Housing Rehabilitation/Reconstruction Scoring Committee to approve the following two (2) applicants to receive assistance under the Texas Department of Housing and Community Affairs - Office of Colonia Initiatives (TDHCA-OCI) Self-Help Center program and authorize the Webb County Purchasing Agent to solicit bids and any other matters incident thereto. Housing rehabilitation/reconstruction costs to be covered by the Self-Help Center grant TCDP-7220013.

Issue: Commissioner's Court approval is required in order to solicit bids for these homes. 

Solution: Obtain Commissioner's Court authorization for the solicitation of bids by the Purchasing Agent.

Result: Successful completion of grant and the successful rehabilitation/reconstruction of these homes.
  
 
b.      Discussion and possible action to approve the posting and filling of the following Full-Time Slot with benefits, to be funded from the Comprehensive Energy Assistance Program Grant (CEAP) Account #2362-5150-33036000 and Community Services Block Grant (CSBG) Account #2368-5170-33033000. This position will be 100% grant funded and there will be no impact to the General Fund.

c.      Discussion and possible action to approve contract extension on Amendment #2 to Contract #61220003661 for the Community Service Block Grant Program (CSBG) from Texas Department of Housing and Community Affairs (TDHCA) for the fiscal year 2022. Extending contract from Dec-31-2022 to March -31-2023. Authorizing the County Judge to sign all relevant documents. This Contract will not have an impact to the General Fund. Documentation has been reviewed by Webb County Economic Development Department and is compliant with SPOC policies and procedures.  [Grant Account #2368-5170-521]

Issue: Approve submission of Grant Amendment #2 to Contract #61220003661 from Texas Department of Community Affairs (TDHCA) for the Program Year 2022 and approve contract amendment.

Solution: The Court approval will allow the Webb County Community Action Agency to provide direct services to eligible low-income residents of Webb County under the CSBG program.

Result: These funds are intended to assist qualifying clients with expenses.
  
 
d.      Discussion and possible action to approve conducting Category "B" Elections to fill current vacancy as per the Governing Regulations of the Advisory Board of the Webb County Community Action Agency. The Advisory Board Shall be composed of membership that Complies with the Community Services Block Grant-Texas Administrative Code Rule 5.215. The Election will be held for on Wednesday, January 14, 2023, for a Representative and Alternate for Area IX-Rio Bravo Community Center, 1600 Orquidia Ln. from 9:00 a.m. to 5:00 p.m.

Issue: Hold an Election to fill current vacancies for Representative and Alternate for Area IX-Rio Bravo. 

Solution: The Advisory Board shall be composed of membership that complies with the Community Services Block Grant - Texas, Administrative Code Rule 5.215.

Result: Once the election is held CAA will comply with the Texas Administrative Code Rule 5.215.
  
 
e.      Discussion and possible action to approve grant award contract #58230003850 (“Contract”) for the Comprehensive Energy Assistance Program (CEAP) from the Texas Department of Housing and Community Affairs (TDHCA) for FY-2023, in the amount of ONE MILLION SEVEN HUNDRED SEVENTY THREE THOUSAND EIGHT HUNDRED SEVENTY ONE DOLLARS ($1,773,871.00) and authorizing the County Judge to sign all relevant documents.  Contract shall commence on January 01, 2023 and shall end on December 31, 2023. This action will not have an impact to the General Fund.  Documentation has been reviewed by Webb County Economic Development Department and is compliant with SPOC policies and procedures.

Issue: The Texas Department of Housing and Community Affairs (TDHCA) has awarded Webb County Community Action Agency the amount of $1,773,871.00 under the Comprehensive Energy Assistance Program (CEAP).

Solution: The Court approval will allow the Webb County CAA to provide direct services to eligible low-income residents of Webb County under the CEAP Program.

Result: These funds are intended to assist eligible Webb County residents with up to 12 months of energy consumption.
  
 
f.      Discussion and possible action to approve grant award contract #61230003814 (“Contract”) for the Community Service Block Grant Program (CSBG) from the Texas Department of Housing and Community Affairs (TDHCA) for FY-2023, in the amount of ONE HUNDRED FIFTY THREE THOUSAND ONE HUNDRED NINETY SIX DOLLARS ($153,196.00) and authorizing the County Judge to sign all relevant documents. Contract shall commence on January 01, 2023 and shall end on December 31, 2023. This action will not have an impact to the General Fund. Documentation has been reviewed by Webb County Economic Development Department and is compliant with SPOC policies and procedures.

Issue: The Texas Department of Housing and Community Affairs (TDHCA) has awarded Webb County Community Action Agency the amount of $153,196.00 under the Community Services Block Grant Program (CSBG).

Solution: The Community Services Block Grant (CSBG) provides support services to eligible elderly, and disabled and low-income residents of Webb County.

Result: The support services are intended to assist eligible Webb County residents to transition out of poverty.

a.      Discussion and possible action to approve the submission of a Juvenile Justice Program grant application as developed, written, presented, and submitted by the Office of the Justice of the Peace, Pct. 4, Place 1 in collaboration with the Webb County Sheriff’s Office Grant Writer and in the amount estimated at $70,057 for the continued payment of salary/fringe benefits of a juvenile case manager as well as equipment, supplies, and training/travel in order to divert at-risk juveniles from entering the juvenile justice system in Laredo/Webb County; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any cash match; and, thus, there will be no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Jose R. Issue: Juvenile delinquency is a nationwide problem that negatively affects not only the delinquent youth and their families but also adversely impacts schools, neighborhoods, and the local community at large.  In addition, youth at-risk for juvenile delinquency who enter into the juvenile justice system tend to face limited future career, educational, and other socio-economic prospects, especially in the South Texas area.
 
Solution: Grant Application for continued pay of salary for Juvenile Case Manager, in order to provide prevention, diversion, and intervention strategies through the court of the Justice of the Peace, Precinct 4 in Laredo/Webb County area.
  
 
b.      Discussion and possible action to authorize the submission of a grant application completed and submitted by the Webb County Sheriff’s Office to the Bureau of Justice Assistance (BJA) for a FY 2022 State Criminal Alien Assistance Program (SCAAP) grant for reimbursement of costs already incurred for the incarceration of undocumented criminal aliens at the Webb County jail; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any cash match; and, in fact, is a reimbursement of costs already incurred. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Although immigration matters, including illegal immigration, are constitutionally established as existing under the legal jurisdiction and regulation of the federal government, state prisons and local detention facilities, such as the Webb County jail, incurs significant costs incarcerating undocumented foreign aliens who commit crimes in the United States. This includes but is not limited to supervision, housing, feeding, clothing, any medical and transportation expenses, and other associated detention costs.

Solution: Grant application to obtain reimbursement of a small percentage of the incurred correctional officer salary costs associated with detaining undocumented criminal aliens who had at least one felony or two misdemeanor convictions for violations of state or local law and who were incarcerated at the Webb County jail for at least four (4) consecutive days during the reporting period of July 1, 2020 through June 30, 2021.

Result: Webb County will be reimbursed by the federal government a limited percentage of the amount of its already incurred costs of detained foreign criminals incarcerated at the Webb County jail.
  
 
c.      Discussion and possible action to continue paying grant funded personnel under the High Intensity Drug Trafficking Area (HIDTA) Task Force Agreement, DEA Narcotics Task Force, for Ninety (90) days, until notification about grant continuation award from the U.S. Department of Justice Drug Enforcement Administration [Fund #2592]. Available matching funds for this grant is $118,998.00. [Requested by Isidro "Chilo" Alaniz, District Attorney; Account #1001-1160-001-463903-025]

Issue: Current grant funding expired on December 31, 2022. The District Attorney’s Office has not received notice of award for new grant. Unless this item is approved, employees working under said grant will not be paid after December 31, 2022.

Solution: Grant a 90-day payroll extension for employees working under this grant.

Result: The DEA HIDTA Task Force will be able to continue to disrupt the illicit drug traffic in Laredo and surrounding areas.
  
 
d.      Discussion and possible action to adjust the pay rates for personnel under the High Intensity Drug Trafficking Area (HIDTA) Task Force Agreement. The new pay rate will reflect a 5% cost of living adjustment with an effective date of January 1, 2023; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. Issue: The current annual Inflation rate stands at 7.1%. This has created an adverse financial situation for personnel under this agreement.

Solution: Approve a 5% cost of living adjustment.

Result: The 5% cost of living adjustment will alleviate the financial burden caused by the ongoing inflation crisis.
  
 
e.      Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to the Office of the Governor Criminal Justice Division in the amount estimated at $35,000 for overtime and applicable fringe benefits for members of the Mental Health Unit to provide mental health services, including commitments, executions of court orders, and transports to mental health facilities; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The local Laredo/Webb County community continues to constitute a medically and mental health underserved area, which requires mentally ill youth and adults to travel to out-of-town facilities in order to receive these needed mental health services.

Solution: Grant application to provide overtime and applicable fringe benefits for the Mental Health Unit to transport mental health patients to out-of-town mental health facilities so that they may receive the care that they require.

Result: Grant funding will allow officers of the Sheriff's Office to undertake complex and time consuming activities and requirements, including execution of court orders, mental health commitments, and the actual transports to out-of-town mental health facilities, so that the mentally ill patients, their families, and the overall community can be better served.
  
 
f.      Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to the Office of the Governor Criminal Justice Division in the amount estimated at $30,000 for Body Worn Camera (BWCs) equipment, software, and supplies; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires cash match of 25% or an estimated amount of $10,000, which will be met utilizing the Sheriff’s Office forfeiture funds (Fund #2152) for a total project cost estimated at $40,000; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The use of Body Worn Cameras have been shown in studies to be an effective strategy for law enforcement agencies, and their use has grown to be a standard and beneficial practice for sworn officers.  

Solution: Grant application to expand and leverage grant resources so that the Webb County Sheriff’s Office will be able increase transparency and accountability through the continued utilization of body-worn cameras for its sworn officer force.

Result: The Webb County Sheriff’s Office will be able to achieve greater transparency and accountability in its service and protection of the Laredo/Webb County public and taxpayers.
  
 
g.      Discussion and possible action to approve the submission of a Violent Crimes Against Women Criminal Justice and Training (VAWA) grant application as developed, written, presented, and submitted by the Webb County Sheriff’s Office to the Criminal Justice Division (CJD) Office of Governor (OOG) in the amount estimated at $7,000 for training and supplies for investigators and patrol officers working at the Webb County Sheriff’s Office serving victims of violent crimes against women and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires a Thirty (30%) percent cash match, or a $3,000 cash match, which will be met by the Webb County Sheriff's Office state forfeiture funds. Thus, this grant will have no impact to the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. Issue: Violence against women is among the most intractable and deadliest criminal justice problems in the United States, especially domestic violence and in the South Texas area. According to published statistics, the number of American women between 2001-2012 who were murdered by current or ex male partners in the United States was 11,766. That's almost double the amount of casualties lost during wars in Afghanistan and Iraq. Women who will be victims of severe violence by an intimate partner in their lifetimes number 1 in 4.  (“30 Shocking Domestic Violence Statistics That Remind Us It’s An Epidemic” Vagianos 10/23/2014).

Solution: Grant application to enhance the tools, techniques, and training to those investigators who follow-up to calls for assistance, conduct interviews with these victims, file incident reports, provide these victims information/referrals to service providers, initiate arrests of perpetrators, refer cases for prosecution, and prepare testimony/evidence for trial in cases of domestic violence, sexual assault, dating violence, and stalking.

Result: Enhanced law enforcement services, including investigative techniques, to deal with emergent criminal trends, such as cyber stalking, and improved efficacy of the law enforcement response to the needs of victims of violent crime.
  
 
h.      Discussion and possible action to authorize the submission of a grant application as developed, written, and submitted by and for the Webb County Sheriff's Office to the Office of the Governor Criminal Justice Division in the amount estimated at $35,000 for a Crime Justice (CJ) Grant Program for equipment, minor tools, supplies, software, and training/travel and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Like other local law enforcement agencies across the United States, the Webb County Sheriff’s Office utilizes limited financial, operational, and manpower resources to grapple with, deter, mitigate, and/or resolve various serious criminal justice matters that stem from a confluence of deeply rooted, difficult, and often highly complex societal problems.

Solution: Grant application to leverage other federal and  state resources to be able to provide better and more enhanced law enforcement services with a positive financial impact to local taxpayers, who also pay state and federal taxes but do not always receive the same federal/state benefits/services as other communities.

Result: Grant funding will provide supplemental enhancements to the Webb County Sheriff’s Office and its officers so that they may be better able to serve and protect the citizens of Webb County.
  
 
i.      Discussion and possible action to authorize the submission of a grant application as coordinated, developed, written, and submitted by the Webb County Sheriff's Office to the Criminal Justice Division (CJD) for a Fiscal Year 2024 Rifle-Resistant Body Armor grant in an amount roughly estimated at $300,000 for the purchase of rifle-resistant hard body armor for the Webb County Sheriff's Office and other participating Webb County Offices with eligible peace officers as defined under Article 2.12, Texas Code of Criminal Procedure; and designating the Webb County Judge as the authorized official in all matters related to this grant; and any other matters incident thereto. This grant does not require any type of match. [Requested by Martin Cuellar, Sheriff] 

Issue: In response to the notorious shooting incident of police officers on July 7th, 2016, the Texas governor and Texas legislature authorized legislation that would assist local agencies in the purchase of rifle-resistant hard body armor. 

Solution: Submission of application by the Webb County Sheriff's Office will assist eligible peace officers working at Webb County Offices to obtain rifle-resistant hard body armor for their enhanced safety.

Result: Utilizing grant funds through this proposed grant application, the Webb County Sheriff's Office will be able to secure hard body armor for eligible peace officers for their increased safety and security.
  
 
j.      Discussion and possible action to approve the submission of an application developed, written, presented, and submitted by the Webb County Sheriff’s Office to the Homeland Security Grants Division Office of the Governor for a Law Enforcement Terrorism Prevention Activities (LETPA) grant in the amount estimated at $35,000 for law enforcement terrorism prevention equipment, minor supplies, and software; and designating the Webb County Judge in all matters related to this grant; and any other matters incident thereto. This grant requires no match; and, thus, will have no impact to the general fund.  All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy.  [Requested by Martin Cuellar, Sheriff; Grant Fund #2746]

Issue: Since the tragedy of 9/11, the urgent need for expanded and enhanced law enforcement efforts to prevent terrorism in the United States was understood to help save the lives of both first responders and the people they serve.

Solution: Grant application to fund enhanced capabilities for the Webb County Sheriff’s Office.
 
Result: The Webb County Sheriff’s Office will have increased capacities and enhanced capabilities.

a.      Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.
  
 
b.      Discussion and possible action to approve a modification after award to Annual Contract - Bid No. 2023-18 “Refuse Collection” awarded to Trashco, LTD., due to solid waste rate fee increases by the City of Laredo in accordance with the Texas Local Government Code; Section 262.030 (Modification after Award) and to further authorize the County Judge to sign all relevant documents and any other matters incident thereto.
 
Issue: After award of refuse collection bid, the City of Laredo increased the solid waste rate fees, which will be increased in increments during the next four (4) years, effective November 6, 2022.  
 
Solution: Consider accepting the modification after award but before execution, as permitted by State procurement law.  
 
Result: Finalize the execution of contract with the approved modification to bid pricing if approved by Commissioners Court. Pricing will be in place until September 30, 2023.

Issue: The ESC-Region 19 Purchasing (Allied States Cooperative) is a national governmental purchasing cooperative which competitively bids and awards contracts to local, regional, and national vendors in compliance with local, state, and federal procurement laws and regulations.
 
Solution: Approve a resolution to authorize the interlocal agreement with Region 19 Allied States Cooperative.   
 
Result: This will allow Webb County to use vendors who are awarded contracts through Region 19 who have been evaluated and verified to provide a quality product or service at a competitively bid price in compliance with bidding requirements.

Issue: During the budget process for FY 22-23, the Webb County Sheriff’s Office requested the Jail Body Scanner to be funded under capital outlay.  The Body scanner will provide enhanced security during the booking process to prevent the illegal smuggling of narcotics or other prohibited items.   Scanner will detect anomalies not detectable to the human eye.       
 
Solution: Consider the approval of this budgeted capital outlay request, under a cooperative pricing contract.
 
Result: The body scanner will provide Jail staff another preventive measure against the illegal smuggling of narcotics into the County Jail.
