Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 6th day of April 2023. Present also were Ms. Amber Lecea, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  Treasurer's Chief Deputy, Geronimo Martinez presented the Liability Disbursements of County payroll for the period of 03/10/2023 - 03/23/2023.
 
  Treasurer's Chief Deputy, Geronimo Martinez presented the Casa Blanca Golf Course payroll of 04/07/2023 and the estimated payroll for the upcoming pay period for 04/21/2023.

22.      Discussion and possible action to approve the salary adjustments submitted in February for consideration to be effective April 1, 2023 as per county policy; with additional action to approve the budget amendment in the amount not to exceed $12,000 to all payroll line items required; and any other matters incident thereto. [Account #1001-1130-001-431007-015 (Wage Classification Study)]
 
Issue: As per county policy, salary adjustments are submitted during budget and in February for consideration in April, which is mid fiscal year.
 
Solution: Request court to consider the salary adjustments submitted from departments.
 
Result: Positions adjusted to meet the discretionary steps allowed within their grade and/or positions that were pending to be re-evaluated.

  Risk Management Director, Dr. Pedro Alfaro provided an update regarding the following:

1.  Webb County Clinic increase in Blood Work Days 
2.  New Program of education for his staff with staff development with department heads 
3. Increase of Insurance Enrollment and the positive impact the Webb County Clinic is providing 
4. The Coverage of the Diabetes Medication 
 
 
4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: New proceeds under Chapter 18 of the Texas Code of Criminal Procedure have been awarded and may be spent by the attorney representing the State after a budget for the expenditure of the proceeds has been submitted to the Governing Body.

Solution: Submit a budget to the Governing Body that clearly list and defines the categories of expenditures.

Result: The attorney representing the State can utilize the new proceeds for the official use of his Office.

6.   Civil Legal Division
 
a.      Discussion and possible action to enter into a two-year (April 1, 2023 to March 31, 2025) non-financial Memorandum of Understanding between Webb County and the Laredo Independent School District (“LISD”) regarding the provision of special education services by LISD to eligible Webb County Jail detainees and any matter incident thereto; authorizing the County Judge to sign all relevant documents. [There is no fiscal impact on Webb County]   
 
b.      Discussion and possible action to approve an amendment to the Software License and Professional Service Agreement between Webb County and Tyler Technologies in order for Webb County to acquire a license and professional (Project, Technical, & Implementation) services for the implementation and use of the "Enterprise Justice Attorney Manager (Prosecutor)" software program by the County Attorney's Office in an amount not to exceed One Hundred Seventy-Seven Thousand Eight Hundred Thirty Two Dollars ($177,832.00), with further approval to transfer ($177,832.00) from account #3866 Interest Income Fund, and authorize the County Judge to execute all relevant documents and any matter incident thereto. [Account #3864-7360-001-470000-180]

Issue: County Attorney is in need of a new Prosecutorial Management Software in order to conduct its business in prosecuting juveniles as the current software no longer receives service support and the software has not been updated since 2013, which poses cybersecurity. 

Solution: Approve an amendment to existing Software License and Professional Service Agreement with Tyler Technologies in order for Webb County, through the County Attorney's office, to acquire a prosecutorial software for the County Attorney's Office in order to conduct their business. 

Result: Will allow County Attorney's Office to utilize new prosecution software.
  
 
c.      Discussion and possible action to enter into a Twenty Four Month (24) month (March 1, 2023 through February 28, 2025) Software Subscription Agreement between LexisNexis and Webb County for the Webb County Sheriff's Office for Online/Practice Solutions/Software at an annual fee of FOUR THOUSAND TWO HUNDRED DOLLARS ($4,200.00), subject to annual budget appropriations and any other matters incident thereto ; authorizing the County Judge to sign and execute all relevant documents. [Requested by the Honorable Sheriff Martin Cuellar; Account #2022-4100-001-461000 (Materials & Supplies - Sheriff Inmate Commissary)]   
 
7.   Community Action Agency
 
a.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective April 11, 2023:

Issue: The slot remains open and has not been filled.

Solution: A request is being made to fill slot. 

Result: Filing slot #1133 will allow the department to continue to provide transporting services throughout the rural areas of Webb County.
  
 
b.      Discussion and possible action to approve grant increase in the amount of FIVE HUNDRED THOUSAND ($500,000.00) to Contract #34210003698 for the FY 2021 amendment #2 for The Consolidated Appropriations Act Low-Income Household Water Assistance Program (LIHWAP) from Texas Department of Housing and Community Affairs (TDHCA) and authorizing the County Judge to sign all relevant documents. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. This action will not have an impact to the General Fund.

Issue: Available data indicates that there is an abundant need in Texas for restoration of household water services. The need has increased with the expiration in June 2021 of statewide moratorium on disconnections of water and wastewater services.  

Solution: Utilize the LIHWAP grants funds to assist eligible Webb County households with a disconnection or notice of disconnection of water services.

Result: The LIHWAP grant funds will provide relief assistance to eligible low-income households in restoring water services by covering pending water charges and arrearages.
  
 
c.      Discussion and possible action to approve the acceptance of grant increase in the amount of ONE HUNDRED FIFTY THOUSAND FOUR HUNDRED NINETY NINE DOLLARS ($150,499.00) to Amendment Number #1 Contract #61230003814 for the Community Services Block Grant (CSBG) from Texas Department of Housing and Community Affairs (TDHCA) for the Program Year 2023 and authorizing the County Judge to sign all relevant documents. This action will not have an impact to the County General Fund.Documentation has been reviewed by Webb County Economic Development Department and is in compliant with SPOC policies and procedures.

Issue: TDHCA has awarded an increase to the CSBG Contract Amendment #1 in the amount of $150,499.00.

Solution: This Contract CSBG provides support services to eligible elderly, disabled and low income residents of Webb County.

Result: The support services are intended to assist eligible Webb County residents to transition out of poverty.
  
 
8.   Honorable Guadalupe Gomez, Constable Pct. 1
 
a.      Discussion and possible action to accept Constable Pct. 1 Guadalupe Gomez Texas Peace Officer License to be In compliance with the Local Government Code Section 86.0021 (2)(b).

Issue: On or before the 270th day after the date a constable takes office, the constable shall provide, to the commissioners court of the county in which the constable serves, evidence that the constable has been issued a permanent peace officer license under Chapter 1701, Occupations Code.

Solution: Record Pct. 1 Constable Guadalupe Gomez Texas Peace Officer License.

Result: Will be in compliance with the Local Government Code Section 86.0021 (2)(b).
  
 
b.      Discussion and possible action to accept Constable Pct. 1 Racial Profiling Report to be In compliance with Texas Occupations Code1701.164 and Code of Criminal Procedure Article 2.1031-2.138.

Issue: Chief administrators of law enforcement agencies that meet the criteria must submit racial profiling reports to their governing body, as well as TCOLE.

Solution: Record Constable Pct. 1 Racial Profiling Report.

Result: Will be in compliance with Texas Occupations Code1701.164 and Code of Criminal Procedure Article 2.1031-2.138.
  
 
9.   Economic Development
 
a.      Discussion and possible action to authorize the development and submission of a Texas Community Development Block Grant application to the Texas Department of Agriculture for the Colonia Fund-Construction Program in an amount not to exceed $1,000,000.00 for housing rehabilitation in Colonias Oilton, Bruni, Antonio Santos, Penitas West and Tanquesitos; and approving a resolution for authorizaation of grant submission to TDA, and authorizing the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in the Colonia Fund Construction Program. No match is required. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.

Issue: Webb County has a need for the increase and improvement of affordable housing.

Solution: Applying for Texas Department of Agriculture funds will improve suitable living conditions.

Result: Improvement in the quality of affordable housing in Webb County that is safe, decent, and sanitary.
  
 
b.      Discussion and possible action to accept the Fiscal Year 2023 Regional Solid Waste Grants award and enter into an agreement -Contract No. 23-19-02, with the Texas Commission on Environmental Quality (TCEQ) South Texas Development Council in the amount of Sixty-Nine Thousand Two Hundred Seventy-Four Dollars ($69,274.00) in grant funds and; authorizing the Webb County Judge to sign all pertinent contract documentation. The contract implementation schedule is projected to run from April 1, 2023 until July 31, 2023. 

Issue: Webb County has identified a need for litter and illegal dumping clean-up and Community Collection Events.

Solution: To carry out activities that address littering and illegal dumping, clean up and community election events.

Result: In cooperation with Community Action Agency and Road & Bridge will carry out a minimum of 5 clean up events, specifically geared towards tire collection and disposal.
  
 
c.      Discussion and possible action to approve the submission of a grant application as developed, written, and submitted by Webb County Court-at-Law II for OJJDP Juvenile Drug Treatment Court Programs Grant in an amount estimated at $750,000.00 for a period of 48 months to create and enhance juvenile drug treatment court (JDTC) programs for youth in the justice system with substance use disorders and designating the Webb County Judge as the authorized official in all matters related to this grant; and any other matters incident thereto. This grant does require a 25% cash or in-kind match and, thus, will have no impact on the general fund if approved. Through the application Webb County Court-at-Law II will submit to contribute the 25% of total grant funds through an in-kind match. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Judge Victor Villarreal, CCL #2]

Issue: Webb County is in need of a Juvenile Drug Treatment Court Program.

Solution: The objectives of this program are to improve access and availability of adolescent (and family when appropriate) substance use disorder treatment services to a larger number of clients, increase the number of individuals served, and/or propose enhancements to improve the quality of treatment services by adding workforce development strategies, evidence-based treatment approaches, or new treatment services to address unmet or emerging trends.

Result: This grant will allow Webb County Court-at-Law II to provide assistance to Juveniles by continuing judicial supervision over juveniles, and other individuals under the jurisdiction of the court, with substance abuse problems who are not violent offenders.
  
 
d.      Discussion and possible action to authorize the submission of a grant application completed and submitted by the Webb County Sheriff’s Office Grant Writer to the Bureau of Justice Assistance (BJA) for a State Criminal Alien Assistance Program (SCAAP) grant for reimbursement of costs already incurred for the incarceration of undocumented criminal aliens at the Webb County jail; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any cash match; and, in fact, is a reimbursement of costs already incurred. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Although immigration matters, including illegal immigration, are constitutionally established as existing under the legal jurisdiction and regulation of the federal government, state prisons and local detention facilities, such as the Webb County jail, incurs significant costs incarcerating undocumented foreign aliens who commit crimes in the United States. This includes but is not limited to supervision, housing, feeding, clothing, any medical and transportation expenses, and other associated detention costs.

Solution: Grant application to obtain reimbursement of a small percentage of the incurred correctional officer salary costs associated with detaining undocumented criminal aliens who had at least one felony or two misdemeanor convictions for violations of state or local law and who were incarcerated at the Webb County jail for at least four (4) consecutive days during the reporting period of July 1, 2021 through June 30, 2022.

Result: Webb County will be reimbursed by the federal government a limited percentage of the amount of its already incurred costs of detained foreign criminals incarcerated at the Webb County jail.
  
 
e.      Discussion and possible action to authorize the Webb County Volunteer Fire Department to submit a Texas Forest Service: HB 2604 training grant application for up to $12,500.00 for firefighting personnel to attend training, and authorizing the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's request for Texas Forest Service Fire Department Assistance funding. This application does not require County matching funds. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Chief Rick Rangel, Fire Suppression & EMS Services]
 
Issue: To provide firefighting personnel with reputable and cost-effective fire training.
 
Solution: Apply for Texas Forest Service (HB 2604) funding for training of firefighting personnel.
 
Result: Firefighting personnel will be provided with online and hands-on skills training. This will also assist Webb County Fire to motivate and retain firefighting personnel.

11.   Planning & Physical Development

b.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective April 11, 2023:

12.   Purchasing
 
a.      Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.
  
 
13.   Risk Management
 
a.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective April 11, 2023:

Solution: Request is being made to post and fill the vacant position. 

Result: This action will allow Risk Management Department to continue to function efficiently and effectively.
  
 
b.      Discussion and possible action to approve, and apply AETNA Wellness Funds received and approved by the Court on April 12, 2021, to pay a supplement to 3 Risk Management Employees who are rotating through the Wellness/Clinical Operations Program and serve as Certified Red Cross Instructors in Cardio-Pulmonary Resuscitation, First Aid, and the use of the Automatic External Defibrillator. The employees rotate through the clinic to maintain their clinical skills and serve as County wide instructors, as well as pursuing to be certified as First Responders aiding in providing their expertise as Licensed Texas Multi-Line Adjusters (Texas Department of Insurance) while responding to aid in the repairs of all Webb County Assets in conjunction with Building Maintenance. Said integration will allow Risk Management to work in tandem with emergency services and Building Maintenance allowing for quicker response to repair and or address safety concerns, as well as providing emergency first aid to all teams responding to damage control/repair should they be needed.  The described duties are outside the job function description of their duties.  [Account #6100-1090-001-410030 (Incentive Pay)]

Issue: A Webb County Medical and Wellness Clinic was approved by the Court with a focus to provide accessible basic health care for all enrolled employees and their dependents.  The clinic has seen unprecedented growth with the addition of a medical office assistant, phlebotomy services, and integration of additional services available to all Webb County Employees.  The use of Risk Management Personnel merge and integrate multiple functions as the specialized knowledge of claim adjusting, first aid, cardio-pulmonary Resuscitation, claims processing, and in depth knowledge to address safety concerns enhance the response to address critical issues in protecting county assets. The clinic and the use of Risk Management Staff assist in the cost savings plan of the County as all processes are in house with no need to transport, hire, and or bring in specialized personnel.  A respectful request is made to the Court for continued support and approval to continue to direct, and enhance services utilizing existing staff as new protocols/programs are initiated and continued growth is expected.

Solution: Approve the supplemental pay to Slot #2461 and Slot #2147 in the amount of $2,500.00 and Slot #3005 in the amount of $3,000.00. The Risk Management Staff annotated will serve the duality of their job duties and serve the clinic, serve as instructors, and serve as the cadre of emergency response to adjust claims as needed in the field in support of Building Maintenance.  Approval of supplemental pay to the three positions will have no impact on the general fund as these funds were allocated by AETNA, our health insurance carrier, and accepted by the court for the specific intended purpose of managing and enhancing services to the clinic and all Webb County Employees and their dependents enrolled in our health plan.  The court also authorized the County Auditor to establish a ledger account to monitor and certify all funds allocated.  The County Auditor has certified the availability of these funds as previously received and approved by the court for this purpose.

Result: The approval of the supplemental pay will allow Risk Management Staff to continue to manage, direct, sustain, and support the clinic and field operations with enhanced programs for the benefit of all Webb County Employees.  The focus is to use existing resources with no impact on the general fund as all funds are through the AETNA Wellness Program with the support of the Court.

18.      Discussion and possible action to authorize Pre-Trial Services to submit a 2023-2024 multi-year grant application to the Texas Commission on Indigent Defense. This is the 3rd year of the multi-year grant to be requested to fund the existing weekend indigent defense coordinator. All the necessary documents have been submitted for review to the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.  Webb County must provide a cash match of 60% ($13,561.20) for the total project costs of $22,602.00. [Funding source for cash match - General Fund Account #1001-1160-001-463910-005]

Issue: Webb County has implemented a weekend magistrate process at the jail. The Pre-Trial Services Department has been delegated to take charge of the manpower needed to support the appointment of attorneys to indigent offenders that qualify at the front-end to the magistrate process during the weekend.  This hinders our limited staff during the regular normal business hours of operation to provide effective, efficient and adequate services to indigent clients. 

Solution: The acquisition of the grant funds will offset the Webb County personnel expenses for a period of four years and will provide adequate staffing for the weekend and our normal hours of operations. 

Result: Webb County is required to be in compliance with all local and state legislative mandates concerning indigent defense in order to continue to receive funding.
