Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 25th day of August 2023. Present also were Ms. Amber Lecea, Recording Secretary representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: A line item adjustment was approved by the Funding Agency to cover expenses under Professional Services and Materials and Supplies.

Building Maintenance

 
a.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective August 28, 2023.

7.   Civil Legal Division
 
a.      Discussion and possible action to enter into a one (1) year (September 1, 2023 through August 31, 2024) lease extension of an Interlocal Agreement between the Texas Parks and Wildlife Department and Webb County to store patrol boats and equipment at the Lake Casa Blanca Storage Facility at a monthly storage rate of One Hundred Dollars ($100.00) for a total storage rate of ONE THOUSAND TWO HUNDRED DOLLARS ($1,200.00) over the term of the extension and authorizing the County Judge to execute all relevant documents and any matters incident thereto. No Impact to General Fund. Receivable to the County.

Issue: Game Wardens use patrol boats and equipment as part of their service to enforce state laws at Lake Casa Blanca International State Park.

b.      Discussion and possible action to enter into a Lease Amendment (extension of lease term) with the United States Department of Agriculture (USDA) extending the lease of Webb County property located at 7209 East Saunders Street, Suite 7 beginning August 1, 2023 through May 31, 2026 at an annual rate of Thirty-Three Thousand Two Hundred Seventy-One Dollars and Fifty Cents ($33,271.50) payable in arrears and any matter incident thereto; authorizing the County Judge to sign all relevant documents. [Requested by USDA, Lease of County property to Governmental Entity pursuant to §272.005, Texas Local Government Code]   
 
c.      Discussion and possible action to approve a twelve (12) month (October 1, 2023 through September 30, 2024) Services Agreement between Justice Benefits, Incorporated and Webb County to assist the Webb County Sheriff's Office in obtaining reimbursements through Federal Financial Participation at a cost determined by reimbursement amounts which are Eleven Percent (11%) for amounts up to One Hundred Fifteen Thousand Dollars ($115,000.00) and Twenty Two Percent (22%) of amounts over One Hundred Fifteen Thousand Dollars ($115,000.00) and authorizing the County Judge to sign and execute all relevant documents; and any other matters incident thereto. [Requested by Sheriff Martin Cuellar (SCAPP Grant Funding)]   
 
d.      Discussion and possible action to enter into a Professional Services Contract with Howland Engineering and Surveying Co. Inc. for material testing regarding the Pueblo Nuevo Roadway Paving Project in an amount not to exceed FIVE THOUSAND FOUR HUNDRED NINETY FOUR DOLLARS FIFTY CENTS ($5,494.50) and any matters incident thereto, authorizing the County Judge to sign all relevant documents. [Account #3521-7230-001-432001 (TDA CDV 21-0485 Street Improvement-Construction in Progress-Professional Services)]   
 
e.      Discussion and possible action to enter into work authorizations, pursuant to the Agreement for Tax Abatement Consulting dated March 27, 2023 with Capex Consulting Group, for the following Tax Abatement Projects and any maters incident thereto; authorizing the County Judge to sign all relevant documents. [No effect on the County Budget]

Work Authorization #6 for Seven Flags BESS, LLC, not to exceed Twenty-Five Thousand Dollars payable by project applicant.

Work Authorization #7 for Hecate Energy Outpost Storage, LLC, not to exceed Thirty Thousand Dollars payable by project applicant.
  
 
f.      Discussion and possible action to enter into a professional services agreement for engineering services with Top Site Civil Group, LLC for the design construction documents and construction administration services to remediate/repair damage to the: (1) county utility’s effluent line at terminus of Centeno Lane Rio Bravo, Texas and (2) the drainage channel outfall structure north of Rio Bravo, Texas at a cost of Seventy Three Thousand Five Hundred Sixty-Five Dollars ($73,565.00) and any matters incident thereto; authorizing the County Judge to sign all relevant documents.  [ARPA funded]   
 
g.      Discussion and possible action to enter into a three (3) year agreement with AT&T, beginning on the date of the execution of this agreement, for IPFlexs services at a monthly rate of ONE THOUSAND FOUR HUNDRED EIGHTY-THREE DOLLARS AND TWENTY- EIGHT CENTS ($1,483.28) and any other matters incident thereto; authorizing the Webb County Judge sign any relevant documents. [Requested by Gus Ornelas, Information Technology; Account #1001-1130-001-441001 (General Fund)]

Issue: Webb County's current contract with AT&T for IPFlexs services will be expiring.

Solution: Sign all relevant documents to enter into a new service agreement with AT&T.

Result: Webb County will have continued IPFlexs services.
  
 
8.   Community Action Agency
 
a.      Discussion and possible action to approve the extension of FY 22-23 Federal Rural Public Transportation Grant; 5311-2022-WC00082 from Texas Department of Transportation. The extension is to May 31, 2024, to allow carryover of ($192,542.00). No impact to General Fund. All required documentation has been submitted to the Economic Development Department and the solicitation is compliant with Webb County (SPOC) Single Point Contact Procedures.

Issue: Rural Public Transportation is funded by grants. 

Solution: Through the extension by Texas Department of Transportation through May 31, 2024, will allow department to exhaust funds. 
 
Result: Approval of contract extension and carryover will ensure continuation of transportation services to the rural areas of Webb County.
  
 
b.      Discussion and possible action to approve the extension of FY 22-23 Federal Rural Public Transportation Grant; STATE-R- WC00145 from Texas Department of Transportation. To allow carryover of ONE HUNDRED EIGHTY-FIVE THOUSAND NINE HUNDRED SIXTY-FOUR DOLLARS ($185,964.00). No impact to General Fund. All required documentation has been submitted to the Economic Development Department and the solicitation is compliant with Webb County (SPOC) Single Point Contact Procedures.

Issue: Rural Public Transportation is a grant funded agency. 

Solution: Through the carryover by Webb County, will allow department to exhaust funds. 
 
Result: Approval of contract carryover will ensure continuation of transportation services to the rural areas of Webb County.
  
 
c.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective August 28, 2023:

Issue: The employee in slot #1134 resigned. 

Solution: Request is being made to fill slot. 

Result: Filing slot #1134 will allow the department to continue to provide transportation services throughout the rural areas of Webb County.
  
 
d.      Discussion and possible action to approve Amendment No. 3 for the Low Income Household Water Assistance Program (LIHWAP) to Contract Number #34210003698 from the Texas Department of Housing and Community Affairs (TDHCA) for FY-2021. This Amendment will delete and replace Exhibit A. Budget with the newly attached Exhibit A. All the remaining terms of the Contract shall be and remain in full force and effect as therein set forth and shall continue to govern. 

Issue: Texas Department of Housing and Community Affairs (TDHCA) has awarded Amendment No. 3 to Contract Number #34210003698 under the (LIHWAP) Program. 

Solution: The court approval will allow Webb County CAA to provide emergency assistance to low-income households of Webb County under the LIHWAP program. 

Result: These funds are intended to assist eligible Webb County residents with prevention of disconnection and restoration of water services.
  
 
e.      Discussion and possible action to approve the posting and filling of the following Full-Time Slot Position with benefits, to be funded from the Community Services Block Grant (CSBG) Account #2368-5170-521-410000. This position will be 100% grant funded and there will be no impact to the General Fund.

f.      Discussion and possible action to approve the posting and filling of the following part-time Slots, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective August 28, 2023:

Issue: At the being of this year, 36,000 meals have been served. Currently, we have 6 fixed daily routes. Our program has increased and doubled the number of clients and is now servicing up to 476 clients per day, to continue giving the top-quality service that we have been given since the start, we need to create new routes and divide the amounts of clients from the current ones which will need part-time drivers. These slots would not affect general funds it would come from Grant funds.  
 
Solution: Requesting authorization by the court for the creation and posting of these positions allowing the Meals on Wheels Program to add additional part-time divers, so we may create new routes.
 
Result: Filling of these slots will help the timely delivery of hot nutritional meals to the elderly and disabled of Webb County.
  
 
g.     

Discussion and possible action to approve the posting and filling of the following (grant-funded) full-time position, subject to the availability of payroll funds and any applicable Civil Service guidelines; effective September 15, 2023.

Issue: Webb County CAA Social Services offers several programs that assist over 3,000 low income households in Webb County.  These programs currently include a light assistance program (CEAP), a water assistance program (LIHWAP), and a CDL license training program (TOPS).  Adequate staff is necessary to maintain the number of daily appointments required to achieve maximum assistance to qualified low income households.  This slot would not affect general funds.

Solution: Requesting authorization by the court for the approval and posting of this position to allow CAA Social Services to fill in a slot to maintain optimal services.

Result: Filling in this slot will help CAA Social services continue providing much needed assistance to low income Webb County residents.
  
 
9.   Economic Development
 
a.      Discussion and possible action to authorize the Economic Development Department to develop and submit an application to U.S. Department of Agriculture- Rural Development (USDA-RD) in the amount of FIVE HUNDRED THOUSAND DOLLARS ($500,000.00) for street improvements to Welch Rd located adjacent to State Highway 359 Colonias. This action will have no impact to the County General Fund. All required documents were sent for review to the Economic Development and the Solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.
 
Issue: Residents of State Highway 359 Colonias and emergency vehicles are oftentimes unable to safely navigate Welch Rd. during flooding events causing serious safety concerns

Solution: Improve Welch Rd. fissures and substandard conditions.

Result: The completion of Welch Rd. renovations will remove potential threats to public safety.
  
 
b.      Discussion and possible action to authorize the Economic Development Department to develop and submit an application to U.S. Department of Agriculture- Rural Development (USDA-RD) in the amount of ONE MILLION ONE HUNDRED FIFTY THOUSAND DOLLARS ($1,150,000.00) for street improvements in El Cenizo. All required documents were sent for review to the Economic Development and the Solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.This action will have no impact to the County General Fund.
 
Issue: Residents of El Cenizo and emergency vehicles are oftentimes unable to safely navigate the streets during flooding events causing serious safety concerns

Solution: Improve streets fissure and substandard streets in El Cenizo.  

Result: The completion of the road renovations in El Cenizo will improve local residents' access to the roads while removing potential threats to public safety.
  
 
c.      Discussion and possible action to authorize the Economic Development Department to develop and submit the Community Facility (CF) under the U.S. Department of Agriculture - Rural Development (USDA-RD) in the amount of ONE MILLION FIVE HUNDRED THOUSAND DOLLARS ($1,500,000.00) in grant funds and FIVE HUNDRED THOUSAND DOLLARS ($500,000.00) in Rio Bravo - ARPA funds for a total of TWO MILLION DOLLARS ($2,000,000.00) for street improvements in Rio Bravo. All required documents were sent for review to the Economic Development and the Solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures.This action will have no impact to the County General Fund Budget.
 
Issue: The streets in Rio Bravo were constructed over 20 years ago, and have not been upkept or maintained.

Solution: Repair identified streets in Rio Bravo to increase accessibility and eliminate potential threats to public safety.

Result: The completion of the road renovations in Rio Bravo will improve local residents' access to the roads while removing potential threats to public safety.

All required documents were sent for review through the Economic Development Department and the solicitation with the Webb County Single Point of Contact (SPOC) procedures. There is no impact on the Webb County General Fund.

Issue: Texas Community Development Block Grant for Colonia Fund Construction Program requires that Webb County develop and adopt guidelines for the Webb County Colonia Fund Housing Rehabilitation Project grant contract.

Solution: Webb County Commissioner's Court approves the Webb County Colonia Fund Housing Rehabilitation Project proposed guidelines.

Result: Webb County complies with the TxCDBG requirement of adopting housing assistance guidelines for Rehabilitation for the Webb County Colonia Fund Housing Rehabilitation Project contract CFC22-0089.
  
 
g.      Discussion and possible action to authorize the submission of a grant application to the NRA Foundation estimated at $8,000 as developed, written, and submitted by and for the Webb County Sheriff's Office for firearms equipment for its certified peace officers, and authorizing the County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: The Webb County Sheriff’s Office must continually equip its sworn officer force with an important array of duty gear, other critical safety equipment, and essential, but costly expendable supplies, such as ammunition, utilizing limited local funds.  Moreover, the vast majority of federal and state grants do not allow for the purchase of firearms and/or ammunition as an eligible grant expense.

Solution: Grant application to the Friends of the National Rifle Association (NRA) Foundation by the Webb County Sheriff's Office to provide firearms as a supplemental source of this needed equipment.

Result: The Webb County Sheriff’s Office's sworn officer force will be provided with additional firearms.

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

Solution: Approve award to sole respondent to RFQ, Slay Architecture, LLC.
