Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 6th day of October 2023. Present also were Ms. Michelle Garcia, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

  Treasurer's Chief Deputy, Jeronimo Martinez presented the Bills and Disbursements that included the Recap of Checks and EFT's, payments released, and payment ratifications for the period of 09/22/2023 - 10/05/2023.

  Treasurer's Chief Deputy, Jeronimo Martinez presented the Liability Disbursements of County payroll for the period of 09/08/2023 - 09/21/2023 as well as the Casa Blanca Golf Course payroll for 10/06/2023, and the estimated payroll for the upcoming pay period of 10/20/2023.
 
  Motion by Commissioner, Pct. 3 John C. Galo, seconded by Commissioner, Pct. 2 Rosaura “Wawi” Tijerina to approve the Casa Blanca payroll not to exceed $40,000

  Treasurer's Chief Deputy, Jeronimo Martinez shared a few words about his new endeavors and opportunities.
 
  Human Resources Director, Monica Flores presented the Wage and Pay Scale Budget Amendments Report.

  Risk Management Director, Dr. Alfaro provided updates on the following:
  1. Open enrollment coming up on October 23rd - November 3rd
  2. County employee, Christina Martin received a scholarship for the Public Risk Management Association
  3. All County vehicles have been accounted for
  4. MVR and Alcohol testing
 
4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: Funds will be used to pay fringe benefits for 202-2024 USDOJ - Drug Enforcement Administration. 

Solution: Submit a budget to the Governing Body that clearly lists and defines the categories of expenditures. 

Result: The department can utilize the new proceeds for the official use of this office.

Issue: Funds available in account will not cover cost needed to continue operation of service through the end of the budget year.

Solution: Approval of the line item transfer.

Solution: Create a line item transfer.

d.      Discussion and possible action to approve payment for memberships of non-profit state associations for fiscal year 2024 as required by Local Government Code Section §89.002 subject to funding availability and any other matters incident thereto.
 
Issue: Local Government Code §89.002 requires that the Commissioners Court may spend, in the name of the county, money from the county's general fund for membership fees and dues of a nonprofit state association of counties if:
(1) a majority of the court votes to approve membership in the association;
(2) the association exists for the betterment of county government and the benefit of all county officials;
(3) the association is not affiliated with a labor organization;
(4) neither the association nor an employee of the association directly or indirectly influences or attempts to influence the outcome of any legislation pending before the legislature, except that this subdivision does not prevent a person from providing information for a member of the legislature or appearing before a legislative committee at the request of the committee or the member of the legislature; and
(5) neither the association nor an employee of the association directly or indirectly contributes any money, services, or other valuable thing to a political campaign or endorses a candidate or group of candidates for public office.

Solution: Obtain court approval as required.

Result: State associations approved by Commissioners Court will be processed for payment timely.
  
 
e.      Discussion and possible action to approve, by Order, the following budget amendment (line item transfers) within the General fund, effective date September 30, 2023, to eliminate deficits for CAA Meals on Wheels ($50,000), Texas Emergency Mortgage Assistance Program ($5,375), Emergency Food and Shelter ($2,500.00) and Election Service Contracts ($47,465):

Issue: Texas Emergency Mortgage Assistance Program, Emergency Food and Shelter Program and Election Service Contracts terminated with a deficit for FY 2022 audit and Meals on Wheel will end with a deficit for this FY 2023 audit. 

Solution: Transfer from Operational Reserve to eliminate deficits.

Result: Funds will close the fiscal year September 30, 2023.
  
 
6.   Business Office
 
a.      Discussion and possible action to approve the posting and filling of the following Slots, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective October 10, 2023:

7.   Civil Legal Division
 
a.      Discussion and possible action to ratify an extension to the IGSA 70DCR18DIG000004 from September 29, 2023 to December 29, 2023 with the U.S. Department of Immigration and Customs Enforcement (“I.C.E.”) and CoreCivic for the detention of federal inmates/detainees at the Webb County Detention Center (owned and operated by CoreCivic); and authorizing the County Judge to sign any and all relevant documents and any other matter incident thereto. [Requested by Webb County Sheriff Martin Cuellar, Laredo Processing Center Account #1001-209250-180]   
 
b.      Discussion and possible action to enter into a one (1) year (September 1, 2023 through August 31, 2024) Participating Entity Services Agreement between APPRISS, Inc. and Webb County. The agreement is by and through the State of Texas, Department of Information Resources for products and related services with APPRISS, Inc. and will provide appropriate maintenance to the software used with VINE (Victim Information and Notification Everyday Program) at a total cost of Thirty Thousand Two Hundred Eighty-Five Dollars and Twenty-Six Cents ($30,285.26) that will be paid by the Office of The Attorney General. There is no impact to the General Fund, authorizing the County Judge to execute any and all relevant documents; and any other matters incident thereto. [Requested by Martin Cuellar, Webb County Sheriff, Account #2712-3010-001-443000-035]   
 
c.      Discussion and possible action to enter into a One (1) year (October 1, 2023 - September 30, 2024) service agreement between BioMedical Waste Solutions, LLC., and the Webb County Indigent Health Department for the purpose of disposing biohazardous waste at a monthly flat rate of One Hundred Twenty Dollars ($120.00), and authorizing the County Judge to sign and execute all relevant documents. [Requested by Nancy Cadena, Indigent Health Care, Account #1001-5030-001-463555]   
 
d.      Discussion and possible action to approve an Agreement for one year (October 1, 2023 – September 30, 2024) between the United States Department of Justice, Drug Enforcement Administration (DEA) and Webb County Constable Pct. 1 in the amount of $20,707.50 and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. There will be no financial impact to the general fund, as FLSA pay, and fringe benefits will be paid through State Forfeiture Fund #2181 in the total amount of $4,844.00. [Requested by Guadalupe Gomez, constable Pct. 1; Account #2583-3150-001-413000 and Fund #2181]
 
Issue: Collaboration between federal, state and local law enforcement agencies is necessary to pursue and dismantle organized crime organizations along Webb County and the state of Texas.
 
Solution: Accept federal assistance to continue local participation in Join Operations under the Organized Crime Drug Enforcement Task Forces Program.
 
Result: Disruption of organized crime activity along the Texas border and in Webb County.
  
 
e.      Discussion and possible action to enter into an Agreement between Webb County for the benefit of the Webb County Sheriff's Office and the Sames Auto Arena, an event facility owned by the City of Laredo located at 6700 Arena Blvd., Laredo, Texas 78041. The facility will be used by the Webb County Sheriff's Office for a Drug Awareness Concert (from October 17, 2023, through October 18, 2023) for a total cost of EIGHTEEN THOUSAND NINE HUNDRED SEVENTY-EIGHT DOLLARS ($18,978.00); and authorizing the County Judge to sign all relevant documents and any other matters incident thereto. This is paid through forfeiture funds; thus, there is no impact to the general fund.  [Requested by Martin Cuellar, Sheriff; Account #2151-3010-001-455501 (Drug Free Campaign)]

Issue: Owner (City of Laredo) and managing company "SMG" require a Use License Agreement to be formalized for use of facility.
 
Solution: Review, negotiate and approve a Licensing agreement for Drug Free Event Concert.
 
Result: Compliance with City of Laredo and managing company agreement requirements for use of facility (Laredo Energy Arena) while providing a public service to the community in the form of a drug awareness concert.
  
 
f.      Discussion and possible action to enter into an agreement between Webb County for the benefit of the Webb County Sheriff's Office and Marc Mero, as the motivational speaker at the Drug Free Concert on October 18, 2023, at the "Sames Auto Arena" located at 6700 Arena Blvd., Laredo, Texas 78041, in the amount of NINE THOUSAND DOLLARS ($9,000); and authorizing the Webb County Judge to sign all relevant documents and any other matters incident thereto. This will be paid through forfeiture funds; and, thus, there is no impact to the general fund. [Requested by Webb County Sheriff Martin Cuellar; Account #2150-3010-001-455501 (Drug Free Campaign)]   
 
g.      Discussion and possible action to enter into a renewal of the Memorandum of Understanding between Office of the Attorney General (OAG) of the State of Texas and Webb County in order for Webb County (OAG Contract #22-C0003) to receive monetary assistance from the OAG to upgrade the Internet bandwidth connection for Webb County at an annual fee amount of Three Thousand One Hundred Twenty Dollars ($3,120.00). In exchange, Webb County will configure a Virtual Private Network (VPN) tunnel that will allow authorize OAG employees to access Webb County’s case management and imaging and judicial software system for the term of the agreement (October 1, 2023 to September 30, 2024). h.      Discussion and possible action to approve a renewal Professional Service agreement with Recovery Monitoring Solutions, to provide continuous alcohol monitoring, breath-alcohol testing and/or drug patch services for the Webb County Pretrial Services Department commencing October 1, 2023 through September 30, 2024.  Said renewal also amends the costs of the original agreement in that participants who are being monitored will directly pay the vendor Eighty Dollars ($80) for each drug patch, Nine Dollars/day ($9.00) for the Active GPS and Eight Dollars/day ($8.00) for Passive GPS while the Pretrial Department will fund services at Seventy-Five Dollars ($75) for each Drug Patch, Eight Dollars/day ($8.00) for Active GPS and Six Dollars/day ($6.00) for Passive GPS, when services are utilized, and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. [Requested by Pre-Trial Services; Account #1001-2390-001-432001 (Professional Services)]   
 
8.   Community Action Agency
 
a.      Discussion and possible action to approve the carryover to May 31, 2024, Federal Rural Public Transportation Grant; 5339-R-2022-WEBB CO-00011 ($76,028.00). No impact to General Fund. All required documentation has been submitted to the Economic Development Department and the solicitation is compliant with Webb County (SPOC) Single Point Contact Procedures. [Account #2661-7110-521-470000]

Issue: Rural Public Transportation is a grant funded agency. 

Solution: Through the carryover by Webb County, will allow department to exhaust funds. 
 
Result: Approval of contract carryover will ensure continuation of transportation services to the rural areas of Webb County.
  
 
b.      Discussion and possible action to ratify the acceptance of Amendment No. 20 for the Health and Human Services commission (HHSC) (Contract #000158100) for additional funds for the fiscal year 2024 in the amount of SIX HUNDRED THREE THOUSAND FIVE HUNDRED TWENTY-FIVE AND FIFTY CENTS ($603,525.50), FY24 total Budget 603,525.50, and authorizing the County Judge to sign all relevant documents. This action will not have an impact on the General Fund. Documentation has been reviewed and is compliant with SPOC policies and procedures. [Grant Account #2371-5150-521-330300]

Issue: Texas Health and Human Services Commission (Region 11, HHS Contract No 000158100) is adding additional funds for the fiscal Year 2023-2024 budget by adding funding these funds we will have a total budget amount of $603,525.50 for the home-delivered meals program.

Solution: The discussion and possible action is to accept Amendment #20 with the current HHSC contract to provide Home-Delivered Meals to the elderly, home-bound residents of Webb County.

Result: The HHSC addition will provide an additional estimated 11,299 Home Delivered Meals from October 1, 2023, through September 30, 2024.
  
 
c.      Discussion and possible action to approve the carryover to March 31, 2025, Federal Rural Public Transportation Grant; 5339-D-2022-WEBB CO- 00031 from Texas Department of Transportation. To allow carryover of ONE HUNDRED TEN THOUSAND FIVE HUNDRED EIGHTY-THREE DOLLARS ($110,583.00). No impact to General Fund. All required documentation has been submitted to the Economic Development Department and the solicitation is compliant with Webb County (SPOC) Single Point Contact Procedures. [Account #2661-7110-521-470000]

Issue: Rural Public Transportation is a grant funded agency. 

Solution: Through the carryover by Webb County, will allow department to exhaust funds.

d.      Discussion and possible action to authorize the Webb County Commissioners Court to pass a Resolution designating the Honorable Tano E. Tijerina, Webb County Judge and the Honorable Rosaura "Wawi" Tijerina, Webb County Commissioner Precinct 2, as Depository/Authorized Signatories for draw requests for Texas Department of Housing and Community Affairs, Self-Help Center Program, Contract Number CSHC-23-0520.  This Resolution will have no impact to the General Fund.
  
Issue: The Texas Department of Housing and Community Affairs requires the Commissioner's Court to designate two authorized signatories by resolution for all reimbursement requests related to the Self-Help Center Program.
   
Solution: Pass a resolution that will designate two individuals as authorized signatories for the Self-Help Center Contract CSHC-23-0520 as required by the Texas Department of Housing and Community Affairs.
  
Result: Webb County will be in compliance with Texas Department of Housing and Community Affairs grant requirements.
  
 
9.   Honorable Victor Villarreal, County Court at Law 2 Judge
 
a.      Discussion and possible action to reclassify and modify Slot #2999 of Webb County Court-at-Law II DWI Court Program Assistant Case Manager to Webb County Court-at-Law II Juvenile Drug Treatment Court Program Case Manager. The reclassification is from SAMHSA Grant 1H79TI081049-01 (TI-18-008) to DOJ OJJDP Grant (Award number 15PJDP-23-GG-00869-DGCT) effective October 1, 2023.  

Issue: The DOJ awarded grant allows for Webb County Court-at-Law II to establish a Juvenile Drug Treatment Court. The Court previously approved the filling of Case Manager slot.
 
Solution: The court approved the reclassification and modification of the slot to transfer employee from SAMHSA DWI Court grant to DOJ Juvenile Drug Treatment Court Grant.
 
Result: Fill the Juvenile Drug Treatment Court Program Case Manager role to effectively begin provided services.
  
 
b.      Discussion and possible action to appoint Victor Vasquez III as Webb County Court-at-Law II Juvenile Drug Treatment Court Program Director as written, submitted and approved on DOJ OJJDP Grant (Award number 15PJDP-23-GG-00869-DGCT). The appointment to be effective October 1, 2023 with a salary adjustment of $8,400.00 per year as written, submitted and approved on the grant award.  All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy.

Issue: The DOJ awarded grant allows for Webb County Court-at-Law II to establish a Juvenile Drug Treatment Court. The court will work with many agencies to effectively fulfill its duty.
 
Solution: The court approve the appointment as stated and approved on grant application.
 
Result: The Court Director will develop and out the grant’s requirements as approved. Will work to streamline a specialized treatment plan for participants, oversee the day to day operations of the court.
  
 
c.      Discussion and possible action to adjust pay rates for Webb County Court-at-Law II DWI Court Program Staff associated with SAMHSA Grant Award Number 1H79TI085858-01 (TI-08-5858) and request County Judge to execute all other matters incident thereto. The Fiscal Year 2023-2024 budget includes an increase in the salary for the Project Director Slot, and salary increase for the Case Manager slot. Both of these positions do not fall under the County’s Wage Plan, and are funded 100% by grant funds. Both positions are also subject to annual evaluations by the Department Head, and are entitled to additional increases under the grant. There will be no impact to the General Fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy.

Issue: These proposed salaries are reflected under the SAMHSA grant in County Court-at-Law II (TI-08-5858). The Director and Case Manager slots are receiving an increase in salary.
 
Solution: The court respectfully requests approval on salary adjustments.
 
Result: Both positions will be fully operational to continue to layout DWI Court day to day operations. Effective October 1, 2023.
  
 
10.   Economic Development
 
a.      Discussion and possible action to authorize the acceptance of a Fiscal Year 2024 Rifle-Resistant Body Armor grant award from the Criminal Justice Division (CJD) in the amount of $402,013 in response to a grant application coordinated, developed, written, and submitted by the Webb County Sheriff's Office Grant Writer for the purchase of rifle-resistant hard body armor for the Webb County Sheriff's Office and other participating Webb County Offices with eligible peace officers (Offices of the Constable, Pct. 1-4 as well as the investigators of the County Attorney’s Office and District Attorney’s Office) as defined under Article 2.12, Texas Code of Criminal Procedure; and designating the Webb County Judge as the authorized official in all matters related to this grant; and any other matters incident thereto. This grant does not require any type of match. [Requested by Martin Cuellar, Sheriff]

Issue: In response to the notorious shooting incident of police officers on July 7th, 2016, the Texas governor and Texas legislature authorized legislation that would assist local agencies in the purchase of rifle-resistant hard body armor.

Solution: Acceptance of grant award by the Webb County Sheriff's Office will assist eligible peace officers working at Webb County Offices to obtain rifle-resistant hard body armor for their enhanced safety.

Result: Utilizing grant funds through this grant award, the Webb County Sheriff's Office will be able to secure hard body armor for eligible peace officers for their increased safety and security.
  
 
b.      Discussion and possible action to authorize the acceptance of a Fiscal Year 2024 Local Border Security Program (FY 2024 LBSP) grant award in the amount of $140,000 from the Office of Homeland Security Grants Division (HSGD) as specifically developed, written, and submitted by the Webb County Sheriff’s Office Grant Writer for Sheriff’s Office peace officers’ overtime and applicable fringe benefits to provide enhanced border security in the Laredo/Webb County area, and designating the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund. Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities’ economies. These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.

Solution: Grant award to provide enhanced border security in Laredo/Webb County in order to fulfill State of Texas local border security program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas.

Result: Enhanced/increased patrol and investigative capacity for certified peace officers working at the Webb County Sheriff’s Office.
  
 
c.      Discussion and possible action to authorize the acceptance of a Fiscal Year 2023 State Homeland Security Program-Local Law Enforcement Terrorism Prevention Activity (FY 2023 SHSP-LETPA) grant award in the amount of $51,283.77 from the Office of Homeland Security Grants Division (HSGD) as specifically developed, written, and submitted by the Webb County Sheriff’s Office Grant Writer for SWAT equipment and supplies, and designating the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match; and, thus shall have no impact to the general fund.  All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Since the tragedy of 9/11, the urgent need for expanded and enhanced law enforcement efforts to prevent terrorism in the United States was understood to help save the lives of both first responders and the people they serve.

Solution: Grant award to fund enhanced SWAT capabilities for the Webb County Sheriff’s Office.

Result: The Webb County Sheriff’s Office will have increased capacities and enhanced capabilities.
  
 
d.      Discussion and possible action to accept a grant in the amount of $37,721.71 from the Office of the Governor as developed, prepared, written, and submitted by the Justice of the Peace, Pct. 4 in conjunction with the Webb County Sheriff’s Office Grant Writer to continue to pay the grant-funded salary and fringe benefits of the Truancy Juvenile Case Manager in order to continue to divert at-risk truant juveniles from entering into the criminal justice system; and designating the Webb County Judge as the authorized official and any other matters incident thereto. Thus, this grant will continue to have no impact on the general fund. All required documents were sent to the Economic Development Department and were found in compliance with the Single Point of Contact (SPOC) policy. [Requested by Jose R. Issue: Truancy can be considered a gateway to juvenile delinquency and is a nationwide problem that negatively affects not only the delinquent youth and their families but also adversely impacts schools, neighborhoods, and the local community at large. In addition, youth at-risk for juvenile delinquency who enter into the juvenile justice system tend to face limited future career, educational, and other socio-economic prospects, especially in the South Texas area.

Solution: Grant award to continue to fund a currently grant-funded truancy case manager in order to continue to provide prevention, diversion, and intervention strategies through the court of the Justice of the Peace, Precinct 4 in Laredo/Webb County area.

Result: This grant will allow Juvenile Case manager to focus on diversion strategies to steer at-risk juveniles from the juvenile and criminal justice system.
  
 
e.      Discussion and possible action to accept the award from the Office of the Governor, Public Safety Office Criminal Justice Division for the Laredo/Webb County Texas Emergency Network Diversion (TEND) Court Program, Grant #4325003, Year 3, in the amount of Two Hundred Forty Thousand Dollars ($240,000.00) beginning October 1, 2023. The TEND Court program will utilize this funding opportunity to prevent the exploitation and commercial sexual exploitation of children living in foster care. This formal request shall authorize the County Judge to act as the County’s Executive Officer and Authorized Representative in all matters pertaining to the County’s participation in this grant and sign all relevant documentation. There is no match requirement for Grant #4325003; therefore, it will not impact the general fund. This contract and agreement commences on October 1, 2023, and terminates on September 30, 2024, as the grant application is submitted yearly for renewal. All required documents were reviewed by the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Notice of Award was received by the Funding Agency on 9/21/2023, and activated on 9/25/2023, now acceptance by Commissioners Court is required.

Solution: Accept the award for the Texas Emergency Network Diversion (TEND) Court Program and proceed with the continuity of the TEND Court program in Laredo/Webb County.

Result: Funding in year 3, will be utilized and continue through the Texas Emergency Network Diversion (TEND) Court program for youth ages 10 – 17 who are living in foster care and identified as having a high propensity of being exploited.
  
 
f.      Discussion and possible action to authorize the acceptance of a FY 2024 Operation Lone Star (OLS) Grant Program award from the Office of the Governor Homeland Security Grants Division in the amount of $1,417,902.50 as developed, written, and submitted by the Webb County Sheriff's Office in collaboration with Economic Development and other Webb County Dept./Offices for the Webb County Sheriff’s Office and other Webb County Offices. The Sheriff’s Office portion includes grant funding for equipment/minor tools, software/internet services, fuel, and supplies while the other Webb County offices/depts. are receiving funding for new/continuing salaries, fringe benefits, software, equipment/minor tools, and supplies; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant requires no match; and, thus will have no impact to the general fund. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: Local law enforcement working in international border communities must work within limited budgetary constraints to provide both proactive and responsive law enforcement services while transborder criminal organizations possess unlimited funding to access the latest technology and equipment to avoid detection/disruption of their activities utilizing their proceeds obtained through illegal but highly lucrative drug trafficking and other unlawful enterprises.

Solution: Supplemental grant award to provide supplemental resources to assist in combating illegal drug trafficking and provide enhanced border security for the residents/citizens of Laredo/Webb County.

Result: The Webb County Sheriff’s Office and its sworn officer force will be equipped with needed additional resources.
  
 
g.      Discussion and possible action to accept grant #2466311 titled Region 2-Border Prosecution Unit from the Office of the Governor Public Safety Office Homeland Security Grants Division in the amount of $2,265,000 with a performance period from September 1, 2023 to August 31, 2025; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require matching funds. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Issue: There is a need for additional resources to prosecute misdemeanor and felony cases, provide technical assistance and training to law enforcement agencies that operate within the Texas-Mexican Border area.

Result: The District Attorney’s Office will have an opportunity to receive additional resources that will aid in deterring and combating criminal activity within the Texas-Mexican Border.

a.      Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

The IGT submitted allows hospitals to receive federal matching funds that are used to offset the cost of un-compensated care that hospitals provide to Medicaid and uninsured patients.

Solution: Commissioners Court approval is needed in order to submit IGT contributions on behalf of local hospitals as requested by the State of Texas.

Result: The authorization of IGT will allow local hospitals to access matching federal funds for FY 2023-2024 to offset uncompensated care costs as well as receive incentive payments from the State of Texas for successful completion of 1115 Waiver requirements.
