Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Present also were Ms. Michelle Garcia, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

Issue: Title Related Services is a grant line item available for Self Help Center applicants that have property deed issues that need to be corrected.  The need for these funds did not present itself, therefore a line item transfer is being requested in order to utilize funds in accordance with grant requirements.   

Solution: Approve line item transfer so that funds can be utilized in accordance with grant requirements.

6.   Civil Legal Division
 
a.      Discussion and possible action to enter into an Agreement between Webb County, for the benefit of the Webb County Public Health Services Department, and Quest Diagnostic and Clinical Laboratories, Inc ("Quest Diagnostics") to provide authorized laboratory tests to the public through the Public Health Department and any matters incident thereto; authorizing the County Judge to execute all relevant documents. [Requested by Public Health, Account #5030-001-432063-025 (Lab/X-ray Services) and #5030-001-432063 (Medical Services)]   
 
b.      Discussion and possible action to approve a First Amendment to the Solar Lease and Easement Agreement as well as to the Memorandum to said Lease with Grandsolar Texas Two, LLC by replacing Exhibit A of said Agreement which reflected the property description of the leased property (School Lands off Highway 59) based on an abstract of title description of ownership and now being replaced with an actual surveyed metes and bounds, and authorizing the County Judge to sign and execute all relevant documents; and any matters incident thereto. There is no impact on the General Fund.
 
Issue: On December 20, 2021, Webb County entered into a lease agreement with Grandsolar Texas Two, LLC regarding a solar development project on the Webb County School Lands off Highway 59; however, the original lease that was entered into reflected the property description of the Webb County School Lands off Highway 59 based on an abstract of title description of ownership which gives a more accurate measurement of the Webb County School Lands. 
 
Solution: Grandsolar Texas Two, LLL has done an actual metes and bounds survey of the Webb County School Lands off Highway 59.
 
Result: Webb County now has a current survey of the Webb County school lands off Highway 59.
  
 
c.      Discussion and possible action to enter into a Legal Services Contract with JCA Law PLLC to provide legal services in connection with preparation of contracts and labor and employment matters to be charged on an hourly basis; authorizing the County Judge to sign all relevant documents. [Account #1001-1130-001-432001 (Professional Services)]   
 
d.      Discussion and possible action to enter into an Amendment to the agreement dated March 27, 2023, (RFP) 2023-004 ARPA Project No. 21, between Webb County and Kofile Technologies, Inc., for the benefit of the District Clerks Office in compliance with Federal Regulations §200.318 - §200.327 (General Procurement Standards) in an amount not to exceed TWENTY-NINE THOUSAND TWO HUNDRED THIRTY-TWO AND FORTY-ONE CENTS ($29,232.41); and authorizing the Webb County Judge to execute all relevant documents and any other matters incident thereto. [Requested by Esther Degollado, District Clerk; Account #2034-2290-001-460105 (preservation funds)]

Issue: The estimate to complete the original project was short by $29,232.41 for additional preserved pages and ARPA funds are no longer available to cover the difference.

Solution: Authorize the addendum payable from preservation funds so that the District Clerk can pay the remaining balance from their budget.
  
 
7.   Community Action Agency
 
a.      Discussion and possible action to approve Amendment No.1 for the Comprehensive Energy Assistance Program Emergency (CEAP) Contract Number #58240004040 from the Texas Department of Housing and Community Affairs (TDHCA) FY-2024. This amendment is a grant increase from $1,217,627.00 to $2,029,483.00, for a total increase of EIGHT HUNDRED ELEVEN THOUSAND EIGHT HUNDRED FIFTY SIX DOLLARS ($811,856.00) and authorizing the County Judge to sign all relevant documents for request and approval of contract amendment. This action will not have an impact to the General Fund. All required documents were sent for review through Economic Development and the solicitation is compliant with the Webb County single point of contact (SPOC) procedures. [Account #2362-5360-521]

Issue: Texas Department of Housing and Community Affairs (TDHCA) has awarded Amendment No. 1 to Contract Number #58240004040 under the (CEAP) Program.

Solution: The court approval will allow Webb County CAA to continue providing emergency assistance to low-income households in Webb County under the CEAP program.

Result: These funds are intended to assist eligible Webb County residents meet their immediate household energy needs.
  
 
           
b.      Discussion and possible action to accept Contract Amendment No. 2 to Comprehensive Energy Assistance Program (CEAP) Contract #58930004003 from the Texas Department of Housing and Community Affairs (TDHCA) for FY-2023. This amendment will hereby delete and replace Exhibit A budget, of this Contract in its entirety with the attached Exhibit A, allowing for the transfer of FORTY SIX THOUSAND THREE HUNDRED TWENTY FOUR DOLLARS AND SIXTY THREE CENTS ($46,324.63) from Administration to the Direct Services Utility Assistance Account. All the remaining terms of the Contract shall be and remain in full force and effect as therein set forth and shall continue to govern and authorizing the County judge to sign all relevant documents. This action will not have an impact to the General Fund. All required documents were sent for review through the Economic Development Department and the solicitation with Webb County Single Point of Contact (SPOC) procedures. [Account #2365-5360-521] 

Issue: Texas Department of Housing and Community Affairs (TDHCA) presented CAA Social Services with amendment No.2 for the Comprehensive Energy Assistance Program (CEAP).

Solution: The Court approval will allow the Webb County Community Action Agency to continue providing direct services to eligible low-income residents of Webb County under the CEAP program.

Result: Approval of the amendment will ensure the continuation of services to qualifying low-income clients.

8.   Honorable Harold Devally, Constable Pct. 4
 
a.      Discussion and possible action to accept Constable Pct. 4 Racial Profiling Report to be in compliance with Texas Occupations Code1701.164 and Code of Criminal Procedure Article 2.1031-2.138.

Issue: Chief administrators of law enforcement agencies that meet the criteria must submit racial profiling reports to their governing body, as well as TCOLE.

Solution: Record Constable Pct. 4 Racial Profiling Report. Result: Will be in compliance with Texas Occupations Code1701.164 and Code of Criminal Procedure Article 2.1031-2.138.

a.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective March 25, 2024:

10.   Economic Development
 
a.      Discussion and possible action to authorize the Economic Development Department to submit a grant application and resolution for the Texas Community Development Block Grant – Colonia Fund Construction Program to the Texas Department of Agriculture for water and/or sewer infrastructure improvements in the colonias; and authorizing the County Judge to act as the County's Executive Officer and Authorized Signator in all matters pertaining to the County's participation in the Colonia Fund Construction Program. This grant application does not require a county cash/in-kind match. All required documents were submitted to the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) policy and procedures.
 
Issue: Water Infrastructure is needed in the colonias that require improvements for optimal drinking water and adequate sewer system.

Solution: Improve water quality by installation of new water infrastructure and adequate sewer system.
 
Result: The development and submission of a Texas Community Development Block Grant application to the Texas Department of Agriculture for the Colonia Fund Construction Program for water system improvements Economic Development Department will assure compliance with requirements from funding agency.
  
 
b.      Discussion and possible action to proclaim April 2024 as the 56th Anniversary of Fair Housing Month and April 8-12 as Fair Housing Week, and to designate the Webb County Community Action Agency to monitor Fair Housing in Webb Couny.

Issue: It is a federal requirement that Webb County promotes Fair Housing within its jurisdiction in order to continue to apply for grants.
 
Solution: The promotion of Fair Housing in Webb County and the designation for a week during April will help inform citizens of Webb County of their legal rights in housing discrimination.
 
Result: The federal requirement for Fair Housing will be met by promoting Fair Housing within Webb County’s jurisdiction, thus allowing Webb County to continue applying for grants.
  
 
c.      Discussion and possible action to ratify the submission of a grant application to the Office of National Drug Control Policy for the continuation of a High Intensity Drug Trafficking Area (HIDTA) Grant estimated at $530,150 over the term of the contract. This formal request shall authorize the County Judge to act as the County's Executive Officer and Authorized Representative in all matters pertaining to the County's participation in this grant. There is no cash match requirement for this grant; however, the District Attorney's Office requests additional funding in the form of cash match to cover expenditures in excess of the grant award. The cash match is in the amount of $148,000 for the county's budget process. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. Contract Term: January 1, 2024 to December 31, 2025. [Requested by Isidro "Chilo" Alaniz, District Attorney; Fund #2592; Account #1001-1160-001-463903-025]

Issue: There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.
 
Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.
 
Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.
  
 
           
d.      Discussion and possible action to accept and enter into an agreement with the Texas Comptroller and accept the award in the amount of $275,000 through the Rural Prosecutor’s Office Salary Assistance Grant.  All required documents were sent for review through Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. This grant does not require a cash match. There will be no impact to the County's General Fund. [Requested by Isidro "Chilo" Alaniz, District Attorney]
 
Issue: District Attorney’s Offices all over Texas are having a hard time retaining and hiring employees due to the competitive salaries in the private sector and other government agencies.
 
Solution: Use the amount if awarded to pay higher salaries and be able to retain employees
 
Result: This will allow the District Attorney’s Office to retain and recruit talented employees.
  
 
e.      Discussion and possible action to authorize the acceptance of a grant award for the Fiscal Year (FY) 2023 Operation Stonegarden (OPSG) from the Office of the Governor Homeland Security Grants Division in the amount of $2,655,170 as prepared and submitted by the Webb County Sheriff’s Office Grant Writer for overtime, associated fringe benefits, equipment, supplies, fuel, helicopter maintenance/fuel, vehicle/tire maintenance, data services, Management & Administration (M&A), and maintenance of OPSG-acquired assets for Webb County local law enforcement agencies, including the Sheriff's Office, the Offices of the Constable, Pct. 1-4, and the Webb County Attorney's Office Investigators; and any other matters incident thereto. There is no cash match; and, thus, no cost to Webb County. All required documents were sent for review through the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Martin Cuellar, Webb County Sheriff]

Issue: Complex and dynamic law enforcement challenges exist in the Southwest border area of the United States, including Laredo/Webb County. For example, transnational criminals seek to exploit existing law enforcement jurisdictional boundaries by conducting their illegal enterprises across traditional jurisdictional divisions. The 2014 Texas Gang Threat Assessment expounds, “Gang activity remains widespread throughout all regions of Texas…Gang activity is also prevalent in the Texas counties adjacent to Mexico and along the key smuggling corridors, since Texas-based gangs are used for cross-border smuggling and trafficking in the state. Many transnational gangs operating in Texas….engage in criminal activity in Mexico as well as in Texas and elsewhere” (Texas Department of Public Safety April 2014).

Solution: Grant application: (1) to ensure first responders are equipped with enhanced tools/equipment/resources needed to confront well-funded criminal organizations and (2) for the coordination of law enforcement efforts between various local and federal law enforcement agencies.

Result: Enhanced capabilities of local law enforcement responders; further coordination of response across local and federal jurisdictions.
  
 
           
11.   Planning & Physical Development
 
a.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines, effective March 25, 2024:

b.      Discussion and possible action to enter into four agreements with RGM Land Management, LLC for site evaluation, design, and installation of On-Site Sewage Facilities (Septic Systems) involving four Colonia properties for the following landowners: (1) Catarina Casares, 320 Don Antonio Road, Colorado Acres, (2) Jose Israel Garcia Lopez, 150 Los Fresno Road, Ranchitos Los Fresnos; (3) Nora Villarreal, 133 Los Fresnos Road, Ranchitos Los Fresnos, and (4) Lisa Gonzalez and Antonio Gonzalez, 190 N. Ranch Road 7132E, Las Lomas Section II, Tract 227 with said property owners being third-party beneficiaries to the installation contracts in an amount not to exceed ONE HUNDRED THIRTY-THREE THOUSAND DOLLARS ($133,000.00), authorizing the County Judge to execute all relevant documents, and any other matters incident thereto. [Account #2703-5205-001-474502-101 (Infrastructure in Progress-Septic Systems Assistance Program)]
 
Issue: On September 25, 2023, the Webb County Commissioners Court approved the “First Time On-Site Sewer Facilities (OSSF) or Replacement Program” (“OSSF Program”) for eligible Colonia residents to be able to have a septic system installed on their property.
 
Solution: At the February 26, 2024 Commissioners Court Meeting, the Court awarded Invitation to Bid (ITB) 2014-004 “ARPA Project No. 6” to RGM Land Management, LLC to do site evaluation, design, and septic system installation for four Colonia  properties (two in Los Fresnos, one in Colorado Acres, and one in Ranchitos Las Lomas) that met the eligibility requirements under the county’s OSSF Program.  Under each contract, Contractor has 90 calendar days to complete the site evaluation, design and septic system installation on each of the properties.
 
Result: Four eligible county residents and landowners will receive a septic system in order for the property owners to be able to safely remove household wastewater.
  
 
           
12.   Purchasing
 
a.      Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to the public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose of or destroy property that cannot be sold through public auction because it has been deemed worthless or disposed of through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.
  
 
b.      Discussion and possible action to rescind the previous action on March 11, 2024, item 14c., due to a typo on dollar amount and to further authorize the purchase of two (2) VECTOR ALPR Rapid Deployment Trailer with a 20" mast and a Bosch PTZ Surveillance Camera to include 24V lithium batteries, delivery, installation, testing, TraffiData Software license and cloud services per camera for an amount not to exceed at the corrected amount of $279,800.00 from Jenoptik-Smart Mobility Solutions for the Webb County Sheriff's Office pursuant to the local Government Code; 262.024 (7) (A) items for which competition is precluded because of the existence of patents, copyrights, secret processes, or monopolies and any other matters incident thereto. [Account #2748-3010-001-470000 (Capital Outlay-Operation Lone Star)] 

Issue: The Sheriff's Office, with the support of Commissioners Court, continues to utilize Operation Lone Star funds for border security operations. The proposed purchase will enhance existing efforts in the collaboration between Webb County and the State of Texas Governor's office along with other participating border communities in protecting our Texas borders. 

Solution: Consideration to authorize the purchase using Operation Lone Star Grant Funds awarded by the Texas Governor's Office and approved by the Webb County Commissioners Court. 

Result: If approved, the original border security equipment can be redeployed along with the new equipment to the areas needed to enhance border security operations.

Issue: Currently the Jail kitchen operates with only one industrial-sized kettle. The purchase of additional kettle equipment will increase the efficiency of that operation and will provide kettle backup. 

Solution: Authorize the Purchasing Agent to seek formal bids or cooperative pricing for the needed purchase. This equipment is budgeted under the Jails division capital outlay account.

Issue: Critical communications are hindered during local emergencies, causing emergency responders to be unable to relay critical information to command posts and supervisors. Lack of communication during critical situations can be catastrophic. Civilian cellular phone use during emergency or critical incidents also congests the network (LTE/5G) which hinders our ability to communicate. 

Solution: The Firstnet CRD (COW) will also provide cell service for local and rural areas during emergencies where no cell service exists.

Result: Webb County personnel will be able to communicate during critical incidents, natural disasters, or incidents where the cell network is down, enhancing public safety and security.
  
 
b.      Discussion and possible action to enter into a thirteen-year licensing agreement (March 25, 2024 through May 31, 2038) with the Mirando City Water Supply Corporation for the installation of two Omni radio antennae, two microwave dishes, and assorted cabling on the Water Supply Corporation's Water Tower located off the 100 Block of J. W. Edgar Street, Mirando City, Texas, as upgrades to the Webb County Sheriff's public safety radio system, authorizing the County Judge to execute all relevant document and any other matters incident thereto. [No Financial Impact on the General Fund]

Issue: In order to perform his constitutional duties to serve and protect the constituents of Webb County, the Sheriff is seeking to install radio communication equipment in Mirando City, Texas.

Solution: Approach the Mirando City Water Supply Corporation about using their water tower as a site for the installation of its radio communication equipment.

Result: Enter into a long term licensing agreement to use the Water Supply Corporation Water Tower in Mirando City to place it radio communication equipment on said water tower.

22.      Discussion and possible action to pre-approve the qualifying applicants for Private On-Site Sewage Facility Assistance (OSSF) under ARPA Project No. 6 and authorize Planning Department staff and ARPA Project Manager to initiate the final scope of work and required specifications for the Purchasing Agent to solicit competitive bids for the installation of the septic systems for each qualifying applicant and any other matters incident thereto. 
 
Issue: Applicants that meet the criteria of the grant Guidelines are required to be approved by the Commissioners Court prior to securing competitive bids for the installation of approved septic systems for those qualifying applicants. All applicants meet the residency and property criteria outlined in the adopted Guidelines and the Planning staff recommends pre-approval.
  
Solution: Court approval will allow staff to finalize the scope of work and required specifications of septic systems for the solicitation of formal bids. 
 
Result: Qualifying applicants will receive the OSSF installation services and Guideline requirements will be met.

Issue: Oilton City residents have voiced concerns regarding automobiles speeding in the area on all sides of the park along the following county roads: Mackin Avenue, Welhausen Road, Jim Neal Avenue and Torrecillas Road. On February 12, 2024, commissioners court authorized the purchasing agent to secure Statement of Qualifications (SOQ) from interested firms for Civil Engineering Services for a speed study to address these concerns. 

Solution: Consideration to accept the rankings presented by the purchasing agent and award to the highest ranking firm in accordance with published criteria based solely on qualifications. Two firms submitted SOQ. 

Result: If approved, authorize General Counsel to proceed with negotiations to finalize the term, conditions and related fees of the professional service agreement for Commissioners Court approval.

Issue: The Webb Constable Pct. 3 inadvertently exceeded the allotted funds of the 2022 OPSG grant in the amount of $13,368.00. This occurred by a clerical mistake (internally) in budgeting the allotted funds at a deputy pay scale of $20.90 and not taking into account adjustments necessary for ranking officers working the grant at a different rate of pay.

Solution: By seeking assistance from Commissioners Court to approve line item transfer from the Operational Reserve Account #1001-1130-001-431007-010 would circumvent any issues with employees regarding wages for hours worked.
  
Result: The administrative staff of the Webb County Constables Office PCT. 3 will work closely with the assigned internal project director for OPSG grant and implement internal audits/modules and have said budget reports checked with County Auditors to ensure that this incident is avoided in the future.
