Judge Tijerina thanked the County Auditor's Office and the County Treasurer for the meetings held on Thursdays with the Fiscal Review Committee.

County Treasurer, Ms. Delia Perales presented the ratification of four (4) checks and ratification of payroll. Ms. Perales stated that Associate Judge Melissa Joy Garcia was left without a check and as a result she would be running another payroll cycle for her.

Ms. Perales presented the monthly report for August 2015.

Presentation by City of Laredo officials regarding a request to support the redevelopment of the El Portal Center located between Zaragoza and Water St. in downtown Laredo; with discussion and possible action to approve an Economic Development Performance and Grant Agreement with El Portal Center LLC, which will include a sales tax rebate incentive of up to Fifty (50%) percent as per section 381 of the Texas Local Government Code; and any other matters incident thereto.

Issue: Requesting an updated report by the Executive Director with Texas Commission on Jail Standards regarding our current Jail facility.

Solution: Update Court on current and future state inmate population trends, secure recommendation by State on size of facility that is required to house state inmates today and for future years at the Webb County Jail.

Results: Secure vital information from the State regarding state inmate population trends and any other information that would assist the Webb County Sheriff and Commissioners Court in evaluating the need for a new County Jail.

County Clerk
Webb County Clerk, Mrs. Margie Ramirez Ibarra requested two (2) employees for her courts section. Mrs. Ibarra stated that if the employees were not awarded to her, she would be forced to close the office at 4:00 p.m. from Mondays to Thursdays and at 1:00 p.m on Fridays in order to meet the demand of cases filed.

Sheriff's Office
Finance Director, Mr. Joe Lopez along with Chief Federico Garza and Commander Wayo Ruiz were all in attendance to present the Sheriff's Office FY 2016 budget request to the Commissioners Court.

County Attorney
County Attorney, Mr. Marco Montemayor requested two (2) title changes to have a Victims Assistant Coordinator and to an Administrative Coordinator. He requested two (2) personnel positions; one (1) Prosecutor II at $62,927 23/A, at ten steps $70,370 at the high end with fringe $90,134 and one (1) Legal Assistant.

Administrative Services Director, Ms. Cynthia Mares stated that the grade/scale for attorneys was: 0-2 years experience N-P $67,000 - $68,685, 3-4 years experience Q-S and so on depending on the number of years of experience.

Treasurer
County Treasurer, Ms. Delia Perales presented her FY 2016 budget request to the Commissioners Court.

Judge Tijerina stated that the Commissioners Court would be taking a recess for lunch until 1:15 p.m.

Constable Pct. 3
Constable Pct. 3, Mr. Adrian Cortez requested three (3) Deputy Constable positions.

Constable Pct. 1
Representing Constable Pct. 1, Mr. Albert Torres requested one (1) Clerk position for their office and three (3) Peace Officer positions to cover the Youth Village. Mr. Torres stated that if the positions are not awarded, they will then request a part-time line item so they may transfer the money they get back from the Board of Judges. He mentioned that their office currently has ten (10) units in their fleet with over 100,000 miles and requested that new units be awarded for replacement.

Juvenile Department
Chief Juvenile Officer, Ms. Melissa Mojica requested overtime pay to her guards, additional language regarding Holiday Pay for the Detention Officers, and an Administrative Clerk position. Ms. Mojica also mentioned that she had made a Capital Outlay request for a kitchen upgrade, surveillance cameras, and vehicles.

IT Department
IT Director, Mr. Rafael Pena requested title changes for four (4) positions. Mr. Pena stated that the amount and changes requested may be acquired without affecting the proposed budget.

Public Defender
Public Defender, Ms. Virginia Aranda requested salary adjustments for three (3) attorney positions and one (1) new Misdemeanor Attorney position.

Veterans Service Office
Veterans Service Officer, Mr. David Garza requested $88,055 to fund the Coordinator and Driver positions for a whole year for the Veterans Transportation Program.

Indigent Health Care Services
Director, Ms. Nancy Cadena presented her FY 2016 budget request to the Commissioners Court.

County Engineer
County Engineer, Mr. Luis Perez Garcia and Ms. Laura Govea were both in attendance to present the County Engineer's FY 2016 budget request to the Commissioners Court.

Planning
Director, Ms. Rhonda Tiffin presented her FY 2016 budget request to the Commissioners Court.

Tax Assessor Collector
Tax Assessor Collector, Ms. Patricia Barrera requested two (2) title changes. She asked to change Slot# 2322 from Collections Specialist to Collection Administrator and Slot# 120 from MVD Investigator Supervisor to MVD Administrator. Ms. Barrera stated there was a step correction needed on Slot# 1516 from A to E. She also recommended that the Commissioners Court allow each department to retain 15 - 20% of their payroll savings to purchase equipment and office fixtures to upgrade the offices.

Justice of the Peace Pct. 4
Judge Jose Salinas requested one (1) Traffic Clerk, one (1) Civil Clerk, and for an increase to his Part-Time account by $10,000. Judge Salinas also requested $100 incentive per month for those employees who pass the state exam.

Fire and EMS
Chief Ricardo Rangel presented his FY 2016 budget request to the Commissioners Court.

County Engineer
County Engineer, Mr. Luis Perez Garcia presented his corrected FY 2016 budget request to the Commissioners Court.

Solution: The new revised, standard contract for the community centers, include these new terms and provisions and would update the contract.

Result: Adopting the new standardized rental contract would meet the current needs of the county, the community centers, and the community of users.

Issue: There is evidence that trafficking in narcotics and dangerous drugs exists in Laredo, Texas area and that such illegal activity has a substantial and detrimental effect on the health and welfare of the people of Texas.

Solution: Gather and report intelligence data relating to trafficking in narcotics and dangerous drugs. Conduct undercover operations and engage in other traditional methods of investigations.

Result: Disrupt the illicit drug traffic in Laredo by immobilizing targeted violators and trafficking organizations.

Discussion and possible action to continue paying grant funded personnel under the High Intensity Drug Trafficking Area (HIDTA) Task Force Agreement, DEA Narcotics Task Force, for Thirty (30) days, until notification about grant continuation award from the U.S. Department of Justice Drug Enforcement Administration.

Issue: Current grant funding expires after September 30, 2015. The District Attorney’s Office has not received notice of award for new grant. Unless this item is approved, employees working under said grant will not be paid after September 30, 2015.

Solution: Grant a 30 day payroll extension for employees working under this grant.

Result: The DEA HIDTA Task Force will be able to continue to disrupt the illicit drug traffic in Laredo and surrounding areas.

Issue: Current grant funding expires after September 30, 2015. The District Attorney’s Office has not received notice of award for new grant. Unless this item is approved, employees working under said grant will not be paid after September 30, 2015.

Solution: Grant a 30 day payroll extension for employees working under this grant.

Result: The District Attorney’s Office will be able to continue its border crime prosecution.

Issue: The Drug Court Program proposes to expand its capacity from a baseline of 260 to 360 participants by adding 100 clients who are primarily alcohol dependent and have co-occurring psychiatric and substances abuse disorders.

Solution: The Drug Court Program will enhance its current services by integrating and implementing additional therapy, group and behavioral services to current and new participants.

Result: To increase availability of treatment services by expanding the population to a total of 360 in a 3 year span and enhancing the services provided to include additional group and therapy treatment services to all current and new participants.

Issue: Juvenile delinquency is a nationwide problem that negatively affects not only the delinquent youth and their families but also adversely impacts schools, neighborhoods, and the local community at large. In addition, youth at-risk for juvenile delinquency who enter into the juvenile justice system tend to face limited future career, educational, and other socio-economic prospects, especially in the South Texas area.

Solution: Grant award to staff a juvenile delinquency diversion case manager in order to provide prevention, diversion, and intervention strategies through the court of the Justice of the Peace, Precinct 4 in Laredo/Webb County area.

Result: Increased focus on diversion strategies to steer at-risk juveniles from the juvenile justice and criminal justice system.

Issue: Currently the annual contract with Dr. Homero Sanchez is $36,000.00 annually. The compensation terms require the Doctor to provide an itemized listing of all calls, patients, services provided during any given month of service. This has increased the actual cost of monthly services and is more cost effective to charge a fixed amount.

Solution: Increase contract to mirror the annual contract amount for the Jail Dentist at $42,000.00. Dr. Homero Sanchez has agreed to accept this fixed amount regardless of the number of times he takes calls from Jail staff and/or visits inmates at Jail facility to provide mental health services.

Result: Continue providing mental health services to Webb County inmates; funding for this proposed amendment is allocated under FY 2016 Proposed Budget.

Discussion and possible action to approve a professional services contract with Fontes International Solutions, LLC to provide specialized training for law enforcement personnel, pursuant to Local Government Code 262.024 (a) (4) Discretionary exemption, for a performance period of Twelve (12) months at a cost of One Thousand Five Hundred Dollars ($1,500.00) per month, effective October 1, 2015 through September 30, 2016, for an amount not to exceed $18,000.00. Issue: Webb County Sheriff requests the services of Fontes International Solutions for specialized law enforcement training and Intel gathering.

Solution: Contract former FBI agent Mr. Arturo Fontes, to assist with domestic and international Intel gathering and specialized training for members of the Sheriff's office Intel unit.

Discussion and possible action to enter and accept a grant award in the amount of $39,664.50 (BJA Grant No. 2015-DJ-BX-0581) from the Department of Justice Bureau of Justice Assistance (BJA) in response to a joint application submitted with the City of Laredo for assorted technology needs and the continued partial payment of salary and fringe benefits of a deputy/peace officer to provide enhanced border security for the Laredo/Webb County area and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any match.

Issue:   Supplemental computer equipment and supplies will allow the Webb County Sheriff’s Office to improve operational capacity in order to provide better and more enhanced law enforcement services to the Laredo/Webb County community. The County of Webb/City of Laredo continues to constitute an important part of the federally designated South Texas High Intensity Drug Trafficking Area (HIDTA), which is one of the most strategically significant cross-border drug smuggling corridors in the entire United States.

Solution:   Grant award to provide supplemental computer equipment and supplies for the Webb County Sheriff’s Office as well as the leveraging of federal grant JAG funds in order to cover the anticipated shortfall of a state funding for the currently deployed grant funded officer.

Result:       The Webb County Sheriff’s Office and its staff will be equipped with needed new, updated technology, equipment, and supplies. The certified peace officer currently funded by a state grant will be able to be deployed on a full time basis through the leveraging of Justice Assistance Grant (JAG) funds.

Discussion and possible action to enter accept a grant award in the amount of $27,715.32 (OAG Contract No. 1660661) for the Statewide Automated Victim Notification Service (SAVNS) from the Office of the Texas Attorney General (OAG) for the automated notification of crime victims for a period of Twelve (12) months beginning on September 1, 2015, through August 31, 2016, for a total amount of Twenty-Seven Thousand Seven Hundred Fifteen Dollars and Thirty-Two Cents ($27,715.32) and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. The grant agreement was sent by the OAG on September 3, 2015, and is required to be signed/returned by Wednesday, September 30, 2015. [Grant Fund Source 321]

Issue: In the past decades, many crime victims, such as victims of sexual assault and domestic violence, were unaware if their respective crime perpetrators were able to post bail and released from the corrections system. In late 1993, one particular victim who had been raped, assaulted, and stalked in Jefferson County was unaware that her former boyfriend had been released and was subsequently ambushed by him after she left work. She was shot Seven (7) times at point blank range and killed on that day, her 21st birthday.

Solution: As a result of community outrage, an automated telephone notification system for crime victims and other concerned citizens was instituted: Victim Information and Notification Everyday (VINE) Service. This nationwide system is funded for Texas counties through the Texas Office of the Attorney General (OAG) and is currently utilized by Webb County.

Result: The crime victims of Laredo/Webb County can enroll in this program and will be provided with automated notification upon an offender’s custody status change, such as release, transfer, and/or relevant district court dates.

Discussion and possible action to enter accept a grant award in the amount of $47,716.36 (CJD Grant No.1979009 - Slot #2415/Officer I) for the Operation Border Star from the Office of the Governor Criminal Justice Division (CJD) for the continued partial payment of salary and fringe benefits of a deputy/peace officer to provide enhanced border security for the Laredo/Webb County area and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. [Grant Fund Source 324]

Issue: The County of Webb/City of Laredo continues to constitute an important part of the federally designated South Texas High Intensity Drug Trafficking Area (HIDTA), which is one of the most strategically significant cross-border drug smuggling corridors in the entire United States.

Solution: Grant award to fund an existing peace officer/deputy to continue to be deployed to assist, supplement, and enhance border security in the South Texas High Intensity Drug Trafficking Area (HIDTA) as well as to continue to provide protective services to the residents of Webb County.

Result: Through the grant-funded efforts of the deputy, the patrol division of the Webb County Sheriff’s Office will be provided enhanced manpower to detect, deter, and disrupt various illegal transborder activity in the Webb County area.

Discussion and possible action to approve and implement recommendations from the Insurance Committee, regarding County's Employees Health and Retiree programs, which include changes to the current plan thereby necessitating the adoption of an adjusted benefit plan. This action by the Court, to take effect October 1st, (for County Contribution only), and January 1st, 2016, for the Employee contribution, and any other matters incident thereto, and authorizing the County Judge to sign and execute all relevant documents. [Requested by Cynthia Mares, Webb County Administrative Services Director, and Roger Garza, Insurance Consultant]

Issue: The County has experienced account deficits in both the Employee Health Plan and the Retiree Plan. Adjustments need to be made in order to secure reduced costs and in order to balance those funds so that the County reduces risk liability and thereby ensuring that those counts move from operating in deficit to positive balances for the upcoming fiscal year.

Solution: Insurance consultant and Administrative Services department were instructed by the court to look for options that would help the County move from the negative to the positive position. Consultant and staff worked diligently to look at current and past experience on these funds; worked Auditors an Budget officers, to gather data to be able to present viable options.

The Insurance committee met on September 23rd, to listen to presentations from staff, consultant, and representatives from TAC and Blue Cross/Blue Shield. Committee met for several hours to review data and recommendations on the table. The final analysis and consensus from the committee, that for the court to be solvent on these funds, "changes" to the rates and benefits plan are inevitable. The committee voted unanimously to present these options to the court at the September 28t meeting for their approval.

Recommendations:

1) Employee Health Plan:
    a)   Increase county contributions $517.50 (per month), effective October 1, 2015;
    b)   Increase the employee contribution tiers by 15%, (except the "employee +
          Child tier" --that is at acceptable rate), effective January 1, 2016;
    c)   Adjust the "waiting period" for new employees from 30 days, to "90 calendar days" effective January 1, 2016;
    d)   Adopt an 80-20 benefit plan, that will make adjustments to: deductible, co-insurance and prescription co-pays;

2) Retiree Health Plan:
    a)   Increase the County Contribution to $430.00 (per month), effective October 1, 2015;
    b)   Adjust the retiree contribution to $381.00 (per month), effective January 2016.

Result: These recommended adjustments project an expected claims reduction of approximately, $.4 million, according t TAC estimates. An increase in employee and county contributions of approximately $1,000,000 are expected to help the county balance the current deficit situation.

Discussion and possible action to enter into contract amendment number One (1) to the Rural Transportation federal fund grant agreement No. RPT 1502 (22) 39 with the State of Texas, acting through the Texas Department of Transportation, wherein Webb County accepts an increase of EIGHTY FOUR THOUSAND NINE HUNDRED SEVEN ($84,907.00) to the original grant amount of TWO HUNDRED FIFTY NINE THOUSAND TWO HUNDRED NINE ($259,209.00) for the "El Aguila" Rural Transportation program and authorizing the Webb County Judge to sign all relevant documents.

Issue: Need of funding.

Solution: Additional monies will be used for both operations and administration departments.

Result: Monies will be used in areas needed to service overall.

Result: The filling of this position will allow Food Transporter an assigned route to deliver meals to the home bound residents in Webb County. The vacant position will alleviate overload of consumers to one route and create efficiency and productivity of work within the Meals on Wheels Program.

Issue: The TDHCA requires that the CAA prepare and submit a 2015 Strategic Plan.

Solution: Webb County CAA staff and the Webb County CAA Advisory Board Planning Committee members shall prepare the 2015 Webb County Strategic Plan.

Economic Development

Discussion and possible action to authorize the Economic Development Department to develop and submit a 2015-2025 Webb County Recreational Master Plan for submission to the Texas Parks and Wildlife Department for their approval and authorize the Webb County Judge to appoint a Planning Committee to oversee the development of this plan.

Issue: The existing Webb County Recreational Plan is from 2000-2010 and needs to be updated/replaced.

Solution: Appoint a working/Planning Committee of appropriate size to work in conjunction with the Economic Development staff, oversee progress and provide direction and input into the development process.

Result: To develop a plan to be adopted by the County and submitted to the State for their approval. A State approved plan will give future project applications additional scoring points. Plan can be updated annually.

Discussion and possible action to ratify an Independent Contract Agreement for state required asbestos abatement air monitoring and project management during the demolition of the Webb County Annex Building located at 1001 Houston Street, between Webb County and Astex Environmental Services, Inc., in an amount not to exceed $11,490.00. [Account #604-0101-8103 (Building Improvements)]

Issue: On August 24, 2015, Commissioner Court received a report that the Webb County Annex building was a threat to public safety, an emergency was declared with regard to the building, and an exemption from the competitive bidding process was granted pursuant to Texas Local Government Coe 262.024 (a)(2) (an item necessary to preserve or protect public health). In order to comply with National Emission Standards for Hazardous Air Pollutants (NESHAP), Webb County must employ a licensed asbestos air monitoring service and project manager to ensure the health and safety of the community, oversee the demolition project, and comply with laws regarding the removal and disposal of asbestos products.

Solution: Contract should be ratified for the services performed by Astex Environmental Services, Inc.

Result: Air monitoring, demolition, and disposal will continue to be in compliance with all laws, rules, and regulations relating to the removal and disposal of asbestos containing materials.
