Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 8th day of January 2016. Present also were Ms. Virginia Martinez, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in th business of the Court.

County Treasurer, Ms. Delia Perales presented Corrections, Side List, and the November 2015 monthly report pending approval.

Chief Deputy Auditor, Mr. Rafael Perez was present to address the Commissioners Court on Ms. Perales' report.

5.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda.   Judge Tijerina stated that items #6 and #7 would be heard at 11:00 a.m.
 
8.      Discussion and possible action to approve a county contribution from Community Promotions Account #007-0101-7462 in the amount of $6,000.00 to the Freddie Benavides Baseball Academy. On January 16, 2016 Mr. Benavides, an assistant coach with the Cincinnati Reds, will be hosting the 2nd Annual Freddie Benavides Baseball Camp in Laredo, Webb County, Texas. 23 out of 27 major league baseball and 16 major college scouts and coaches will be present at the camp to participate and observe the talents of our local and surrounding area elite high school baseball players who are personally invited to display their talents for pitching, fielding and hitting. This showcase is free of charge to the participants and the county contribution will help defray the costs associated with shirts for the players, equipment for the workout, baseballs, and other lodging/ travel expenses for the professional scouts and college coaches.

9.      Discussion and possible action to authorize the Purchasing Agent to solicit Request for Qualifications (RFQ) for a feasibility study or best use of property proposal for the Tex-Mex property building located at 1200 Washington, Laredo, Texas; and any other matters incident thereto.

Cmr. Galo stated that the RFQ on item #9 should read as: for a feasibility study / architect.

10.      Discussion and possible action to adopt an Order prohibiting weapons in all Webb County buildings that carry on judicial functions, such as Webb County Courthouse, Criminal Justice Center and other satellite buildings; and any other matters incident thereto.
 
Issue: The Texas Legislature passed a law making it unlawful for local governments to exclude persons carrying a handgun from government buildings if they possess a handgun license. However, significant confusion lies in the application of the law as it seems to pertain only to the actual courtroom and not the entire premises of the building in which the courtroom is housed.
 
Solution: Preparing an order stipulating the basis on the prohibition of handguns makes it lawful and it better informs the public as to the reasons why the entire building must have the prohibition of handguns.
 
Result: Informing public of how the Open Carry Law does not apply to the Webb County buildings that carry on judicial functions and having the proper Order to enforce this prohibition.

11.      Discussion and possible action to rescind previous court action taken on May 12, 2014 awarding RFQ #2014-002 to Frank’s Architects for the Master Plan for “L.I.F.E” Laredo International Fair & Exposition property; and any other matters incident thereto; there is no pending or contemplated contract in place and no additional steps have been taken by county staff to require these professional services at this time.

23.      Discussion and possible action to acquire external legal counsel for the Treasurer of Webb County to be represented at a Civil Service Commission meeting scheduled for January 14, 2016 regarding a termination of an employee at the Treasurer's department. [Executive Session is requested pursuant to Texas Government Code, Title 5, Subchapter D, Section 551.071 (A) (B) (Consultation With Attorney)]

Issue: County Attorney has advised that they will not be representing me.

Solution: Having external legal counsel will help me to attain good representation as needed in the Civil Service Commission decision.

Result: I can have a complete payroll staff after the Civil Service Commission decision.

14.      Discussion and possible action to authorize Webb County to enter into a Memorandum of Understanding with Texas A&M International University (TAMIU) for five (5)  months (January 20, 2016 to May 20, 2016) to promote the TAMIU Engineering Education and Training Initiative and authorizing the County Judge to sign all relevant documents. [Requested by Cynthia Mares, Webb County Administrative Services Director]

15.      Discussion and possible action to enter into a cost reimbursement agreement by and between Webb County and A.F.W. Investments II, LTD., a Texas Limited Partnership (AFW Investments) and GAG of Laredo Investments, LLC., a Texas Limited Liability Company (GAG of Laredo), for the additional costs incurred by AFW Investments and GAG of Laredo at their Phoenix Village Subdivision, Phases I-VI, to handle the excess post development water and/or storm-water runoff created by subdivision improvements made and constructed by Webb County to the Los Altos Phase I Subdivision, Tanquesitos South Acres Subdivision, and an un-platted subdivision known as Tanquesitos II.  Phases I & II of the Phoenix Village Subdivision have been completed. The reimbursement costs for fiscal year 2016 for the completed Phases I & II of the Phoenix Village Subdivision totals to $59,154.06. The reimbursement costs for fiscal year 2016 for the uncompleted Phases III & IV of the Phoenix Village Subdivision totals to $11,326.84. The reimbursement costs for fiscal year 2017 for the uncompleted Phase V of the Phoenix Village Subdivision shall be for the sum of $55,381.24. The reimbursement costs for fiscal year 2017-2018 for the uncompleted Phase VI of the Phoenix Village Subdivision shall be for the sum of $112,942.09. The reimbursement amounts shall be made subject to verification of the completion of Phases III, IV, & V, of the Phoenix Village Subdivision by the Webb County Engineering Department. 16.      Discussion and possible action to approve the posting and filling of the following Slot, subject to the availability of payroll funds and any applicable Civil Service guidelines. The progression of the promotion will result in a final slot being "vacant" which will be posted within County and general public as required by Civil Service Rules and Wage Plan Policies:

Solution: Fill job opening of newly vacant positions in  order to adhere to any and all Civil Service Rules and Regulations (internal postings), as well as any and all Wage Plan Policies.
                                                                                               
Result: The filling of these positions will alleviate overload and allow for efficiency and productivity of work within the department.

17.      Discussion and possible action to authorize and accept $30,000.00 in form of grant monies for Fiscal Year 2016 from Local Border Security Program (FY 16 LBSP) of the Homeland Security Grants Division (HSGD) Grant in the amount of $30,000.00 to be used for peace officers' overtime and applicable fringe benefits to provide enhanced border security in the Webb County Pct. 3 (Aguilares, Mirando, Oilton, Bruni and Las Lomas) area; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require a match.

Issue: The State of Texas recognizes that border communities face urgent security challenges caused by increased activity from transnational organized criminal syndicates and their allies that are intensified by the fluidity of border crossings, heavy commercial activity, and interdependence of the international border communities economies. These socio-economic pressures place increased demands on law enforcement services and intensify the need for augmented public safety resources.

Solution:  To provide enhanced border security in Webb County Pct. 3 in order to fulfill State of Texas local border security program objectives, including overtime (OT) resources to suppress, deter, and reduce border-related criminal activity in Texas

Result:  Enhanced/increased patrol for certified peace officers working at the Webb County Constable Precinct 3 office.

18.      Discussion and possible action to accept a Local Border Security Program (LBSP) grant award from the Office of the Governor Homeland Security Grants Division (HSGD) in the amount of $115,000 for overtime for peace officers and any applicable fringe benefits to provide enhanced border security for the Laredo/Webb County community; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant does not require any type of match.

19.      Discussion and possible action to ratify and authorize the submission of a grant application to the Office of the Texas Attorney General (OAG) in the amount estimated at $7,464 for equipment and supplies for the Webb County Sheriff’s Office Internet Crimes Against Children (ICAC) task force; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto. This grant opportunity was e-mailed to the Webb County Sheriff’s Office on December 10, 2015, with a deadline of December 30, 2015, as its submission date before the next available, regularly scheduled Webb County Commissioners’ Court meeting on January 11, 2016. This grant does not require any type of match. 

Issue: The psychological, emotional, and physical damage caused by child predators and inflicted on innocent victims, their families, and communities can be deeply destructive and have far-reaching consequences that can last a lifetime. Furthermore, throughout the United States, criminal cases built against child predators can be extremely complex, technologically challenging, and legally complicated.

Solution: The Webb County Sheriff’s Office cyber crimes law enforcement unit has successfully worked with multiple federal, state, and local law enforcement agencies, including the Office of the Attorney General, to arrest over fifty (50) child predators in the Laredo/Webb County area. Grant application to supplement the successful endeavors of the Webb County Sheriff’s Office cyber crimes against children task force to protect the children and youth of the Laredo/Webb County community against child predation.

Result: The Webb County Sheriff’s Office will continue to enhance its ability to work proactively not only to catch individual child predators, but to produce an overall inhospitable environment for cyber crimes against children in Laredo/Webb County for the further prevention of child predation in our community.

20.      Discussion and possible action to enter into a memorandum of understanding (MOU) between the U.S. Department of Veterans Affairs Police and the Webb County Sheriff’s Office to outline agency responsibilities and expectations should the U.S. Department of Veterans Affairs Police require the assistance of the Webb County Sheriff’s Office at the U.S. Department of Veteran Affairs Laredo Outpatient Clinic located at 4602 North Bartlett Avenue, Laredo, Texas; and authorizing the Webb County Judge to execute all relevant documents; and any other matters incident thereto.

Issue: The U.S. Department of Veterans Affairs Police stationed at the U.S. Department of Veteran Affairs Laredo Outpatient Clinic located on 4602 North Bartlett Avenue, Laredo, Texas, may encounter certain unusual situations where the assistance of the Webb County Sheriff’s Office would be required, such as armed hostage situations, crimes involving individuals leaving the Veterans Affairs jurisdiction, vehicular accident investigations, traffic control, transport of prisoners, and other incidents which would require the assistance of additional officers.

Solution: Memorandum of Understanding (MOU) for mutual assistance between the Webb County Sheriff’s Office and the U.S. Department of Veterans Affairs Police. Result: The Webb County Sheriff’s Office will be able to assist the U.S. Department of Veterans Affairs Police should they require law enforcement support and assistance.

Building Maintenance
 
24.      Discussion and possible action to enter into an annual agreement with Simplex Grinnell for Fire and Security Alarm Monitoring Services to begin January 11, 2016 and end January 11, 2017 for the Webb County Commissioner's Courthouse in the annual amount of $638.40, to include a one-time programming fee of $650.00 ($325.00 for the fire alarm equipment: Fire-lite MS-9200udls and $325.00 for the security alarm equipment: DSC power 832 pc5010) under TxMAS-5-03FAC010.  [Account #001-0106-6401 (Repairs & Maintenance of Building)]

Issue: The security and fire alarm system panel installed at the County Courthouse is proprietary equipment and Protection One "ASG" was not able to configure the equipment in order to provide monitoring services through the annual county-wide contract.

Solution: Enter into an agreement with Simplex Grinnell, who originally installed the system panel, for monitoring services.

Result:  Receive appropriate security and fire alarm system monitoring services without having to replace the existing panel with a universal panel.

25.      Discussion and possible action to approve and authorize the Webb County Commissioners Court the appointment of Mr. Juan Vargas as the Labor Standards Officer and Designation for Civil Rights Officer to the Texas Community Block Program #7215510 grant and authorize County Judge to sign all relevant documentation.
 
Issue: Labor Standard & Civil Rights Officer must be appointed to be in compliance with funding agency requirements.         
 
Solution: Appointment will allow department to oversee the labor portion of the project and allow compliance of fair housing and equal opportunity activities with contract. 
 
Result: Department will assure compliance with requirements from funding agency.

6.      Presentation by Carole Alexander, President of Laredo Main Street Organization, regarding the upcoming UETA Jamboozie Festival with personal invitations for the Webb County Judge and Commissioners Court along with discussion and possible action to proclaim the day of January 30, 2016 as “UETA Jamboozie Day” in Webb County, Texas.   
 
  President of Laredo Main Street Organization, Ms. Carole Alexander and other representatives were all present to invite the Commissioners Court to the upcoming UETA Jamboozie Festival.

Issue:  UV Disinfection was initially designed into the original plant.  For unknown reasons this system was never operated or maintained and fell into permanent disrepair.  A new system is required to comply with the  new Long Term 2 Enhanced Treatment Rule requiring additional treatment techniques for our plant. This will require new reactors at a cost of $190,000.00 construction costs for the installation of $250,000.00 and a recommended $63,000.00 for three (3) years annual maintenance and warranty.

Solution: Sole source acquisition of the Wedeco UV Reactors, hiring of contractor with experience in the file of UV installation.

Result:  Compliance with the new Texas Commission on Environmental Quality (T.C.E.Q.) enhanced treatment rule and prevent continuous Public Notice.

Issue: Due to delay in project accounting of hours worked by the contractor, payment of these services were never submitted for payment under prior fiscal year.

Solution: Hours completed by annual contractor have been confirmed as work completed in the plants. Payment of invoices for services rendered.

Issue: Initial contract specifications projected and ability to shutdown the plant, for an extended period of time no less than 6 hours due to flow conditions approximately one year ago; however conditions at the plant operation necessitates the continued operation during installation of the screen and therefore the following change order was proposed.

Solution: Installation of flow bypass will limit our liability of not being able to treat wastewater and lessen the change of an upset at the Sewer Plant.

Result: Improved level of confidence treatment will continue uninterrupted during the installation of the equipment limiting potential violations and emergency scenarios for our employees.
