Let it be remembered that a regular meeting of the Webb County Commissioners Court was held at 9:00 a.m. at the regular meeting place with the following members present to wit:

Thus constituting a quorum, the Commissioners Court proceeded to act upon the Agenda as posted in the meeting notice of the 20th day of October 2023. Present also were Ms. Michelle Garcia, Deputy County Clerk representing Mrs. Margie Ramirez Ibarra, Ex-officio Clerk of the Commissioners Court, various officers and others interested in the business of the Court.

4.   Public Comment - This section provides the public the opportunity to address the Commissioners Court on any items on the Agenda. Members of the public wishing to participate must complete a Witness Card specifying which agenda item they wish to comment on. Each public member, individually or in a group, will be allowed a total of Three (3) minutes within which to make any/all public comments.

COURT TO DISCUSS AND ACT ON THE FOLLOWING:
 
CONSENT AGENDA: At most meetings, the Commissioners Court establishes a Consent Agenda.  It consists of those Agenda Items which are routine or non-controversial, and which neither a member of the Commissioners court has asked to be pulled for discussion.  Once the Commissioners Court has established the Consent Agenda, Agenda Items included on it will be voted upon in one vote, and will not be discussed separately unless requested by the County Judge or Commissioners.

The consent agenda has been created in order to give constituents the opportunity to view any and all pertinent backup information with reference to any item in the agenda. The objective of the consent agenda is for all Webb County constituents to be familiar with everyday county business and to demonstrate the transparency and fairness of this Commissioners Court.

The following Agenda Items are of a routine nature, and the Commissioners Court has received supporting materials for consideration. All of these Agenda Items will be passed with one vote without being discussed separately, unless a member of the Commissioners Court or the public requests that a particular Agenda Item be discussed. If so, that Agenda Item will be pulled from the Consent Agenda and discussed as part of the regular Agenda at the appropriate time. One vote will approve the remaining items on the Consent Agenda.

a.      Discussion and possible action to approve, by Order, the following budget amendment (line item transfer) to the Constable Pct. 4 State forfeiture fund by increasing the expenditure budget by $4,827.00; said amount is available from seized funds pursuant to Chapter 59 of the Texas Code of Criminal Procedure. Issue: Funds will be used to pay fringe benefits for 2023-2024 OCDETF Agreement.

Solution: Submit a budget to the Governing Body that clearly lists and defines the categories of expenditures.

Result: The department can utilize the new proceeds for the official use of this office.
  
 
b.      Discussion and possible action to approve, by Order, the following budget amendment (line item transfer) within grant funds to cover budget balances under the Program Year 2023: Low Income Household Water Assistance Program (LIHWAP). 6.   Civil Legal Division
 
a.      Discussion and possible action to approve a minor boundary modification for expansion of City of Laredo’s Foreign Trade Zone (F.T.Z.) No. 94, with the Foreign Trade Zone Board/U.S. Dept. of Commerce as requested by Ariva Homes, (Owner/Landlord/Lessor), & Coordinadora, Inc., (Lessee/Tenant) and the City of Laredo by adding Lot Numbers 1,2, & 3 Block 1, Khaledi Industrial Park, Phase 3, Laredo, Webb County, Texas and commonly known as 102 Ross Khaledi Dr., Laredo, Webb County, Texas 78045, to F.T.Z. No. 94, for approval by Webb County, and authorizing the Webb County Judge to execute any and all relevant documents and any other matters incident thereto. b.      Discussion and possible action, for the benefit of the Webb County Risk Managment Department, to enter into a One (1) year (December 1, 2023 through November 30, 2024) Preventative Maintenance & Service Agreement with Southwest Solutions Group to provide for annual service and maintenance on the Lektriever File Cabinet (SN30415) located at the Webb County Risk Management Department at an annual cost of ONE THOUSAND SEVEN HUNDRED SIXTY DOLLARS AND FORTY-EIGHT CENTS ($1,760.48); and authorizing the County Judge to execute all relevant documents and any other matters incident thereto. c.      Discussion and possible action to approve a One year  Wedeco U.V. water treatment disinfection system service support and maintenance agreement between Webb County and Xylem Water Solutions USA, Inc., for the Utilities Department, at the rate of $14,447.00 per yr. commencing retroactively October 1, 2023 thru September 30th, 2024, and authorizing the Webb County Judge so sign any relevant documents, and any other matters incident thereto. d.      Discussion and possible action to enter into a three year Master Service Agreement between Ad-Comp Systems, Inc. and Webb County for the Water Utilities Department for the payment and collection of utility payments through telephonic means. The term of the agreement shall be for commence October 1, 2023 thru September 30, 2026, commencing on the date of the first Live transaction through the service provided at a cost of seventy-five cents (.75) per call/ transaction over the term of the agreement, authorizing the County Judge to sign and execute all relevant documents, and any other matters incident thereto. e.      Discussion and possible action to enter into Work Authorization #8 with Capex Consulting Group for Tax Abatement consulting services related to the Cedro Hill Wind Repower Project and any matters incident thereto; authorizing the County Judge to sign all relevant documents. [No effect on County budget]   
 
f.      Discussion and possible action to approve a Professional Services Agreement between Webb County for the benefit of the TEND Court Program and Dr. Frances Bernat to provide grant writing, and evaluation for the Texas Network Diversion (TEND) Court, Grant #4325003, commencing Oct 1, 2023, through September 30, 2024, subject to annual grant budgetary appropriations, in the amount not exceed Seven Thousand Dollars ($7,000.00) for the 2023-2024 grant cycle; and authorizing the Webb County Judge to sign and all relevant documents, and any other matters incident thereto. Issue: An evaluator is required to monitor, evaluate and measure the achievement of the program goals and gauge the effectiveness of the program.
 
Solution: The Program evaluator will monitor the performance and compliance of the project with model fidelity to keep court personnel and all program staff aware of the program standards and issues. This includes preparing and submitting quarterly, and annual performance reports as required by the Grant.
 
Result: The evaluator will ensure the program is in full compliance with grant requirements to meet goals and objectives for the success of the program.
  
 
g.      Discussion and possible action for approve a one year (October 1, 2023 through September 30, 2024) Platinum Level Preventative Maintenance & Service Agreement between Webb County and Southwest Solutions Group to provide for annual service and maintenance for Webb County Public Defender’s Lektriever File Cabinet at an annual cost of One Thousand Four Hundred Eighty-Two Dollars and Sixty-four cents ($1,482.64) and authorizing the County Judge to execute all relevant documents, and any other matters incident thereto. [Requested by Webb County Public Defender’s Office; Account #1001-2280-001-443000-035 (Repairs and Maintenance Equipment)]

a.      Discussion and possible action to authorize the purchase of an advertisement in the ByGeorge Magazine to promote tourism in Webb County during the Washington’s Birthday Celebration festivities in the amount of $2,295. b.      Discussion and possible action to authorize the purchase of a congratulatory advertisement for WBCA's 126th year Celebration festivities in the amount of $700.00. The Webb County Commissioners Court would be featured on the official WBCA Program Book. [Account #2004-1010-001-463526 (Community Promotions)]   
 
8.   Honorable Harold Devally, Constable Pct. 4
 
a.      Discussion and possible action to approve the acceptance of overtime and fringe benefits of the grant funded State and Local Overtime and Authorized Expense/Strategic Initiative Program under the Organized Crime Drug Enforcement Task Force.  OCDETF will cover $20,708.00 in overtime from Fund Source 2602.  Also, to increase fringe benefits accounts of $4,827.00 by Constable Pct.4 State Forfeiture Fund #2201 to cover fringe benefits, therefore no impact to the General Fund.

Issue: Approval from Commissioners Court to Continue providing fringe benefits covered by Constable Pct. 4.

Solution: Approval by Commissioners Court.

Result: Constable Pct. 4 continue providing fringe benefits to the designee.
  
 
9.   Economic Development
 
a.      Discussion and possible action to authorize Webb County Economic Development Department to develop and submit a FEMA Hazard Mitigation Grant Program (HMGP) DR-4705 application for the development of a Webb County Hazard Mitigation Plan, not to exceed $500,000.00; and authorizing the County Judge to act as the Authorized Representative in all matters pertaining to the County's request for HMGP funding. This application requires a $125,000.00 cash match, account for matching funds shall be determined upon award of grant funding.  All required documents have been reviewed by the Economic Development Department and the solicitation is compliant with the Webb County Single Point of Contact (SPOC) procedures. [Requested by Emergency Management; Account #1001-1160 (Match Funds will be made with Fiscal Year 2025)]

Issue: Webb County does not have a Hazard Mitigation Plan in place for reduction of loss of life and property due to natural disaster.
 
Solution: Submission of FEMA Hazard Mitigation Grant Program (HMGP) DR-4705 application for development of a Webb County Hazard Mitigation Plan.
 
Result: A FEMA approved plan, with projects readily available for disaster funding if one occurs.

14.   Purchasing
 
a.      Discussion and possible action to authorize the Purchasing Agent to process surplus and/or salvage property in accordance with the Texas Local Government Code, Section 263.152 (Disposition) and to publish notice to public as per Local Government Code Section 263.153 (Notice) for surplus and/or salvage property being auctioned.

Issue: Excess county property that is either by definition salvage or surplus property because of time, accident, or any other cause such as, wear and deterioration, damaged, or obsolete that has no value and/or usefulness for the intended purpose and is no longer needed by the department. 

Solution: Authorize the Purchasing Agent to attempt to sell the County surplus or salvage property through public auction, dispose or destroy property that cannot be sold through public auction because it has deemed worthless or dispose through a recycling program under which property is collected, separated, or processed and returned to use in the form of raw materials of new products and/or donate as permitted by state law. 

Result: Generate auction revenue from sale of county property, reduce county expenditures by transferring surplus property to other departments and make room for future assets replacing salvage or surplus items no longer needed.

a.      Discussion and possible action to enter into a One year (October 1, 2023, through September 30, 2024) Maintenance Agreement between Smiths Detection and Webb County for the Webb County Sheriff’s Office for the maintenance of two (2) X-ray machines Model Number 6040-1PMCMS (Serial Numbers 83400 and 83399) located at the Webb County Justice Building in the amount of Eight Thousand Four Hundred Six Dollars and Seventy Eight cents ($8,406.78); and authorizing the Webb County Judge to sign any relevant documents and any other matters incident thereto. Casa Blanca Golf Course
 
16.      Discussion and possible action to authorize Webb County Purchasing agent to purchase four (4) EZ-GO 1200x Cushman 13HP Haulers, one (1) Express S6 six passenger transportation cart, and one (1) 1200 Cushman 1200 13hp Ball Picker in an amount not to exceed $83,510.00 from Mission Golf Cars (Buy-Board Contract No. 706-23) pursuant to the Texas Local Government Code; §271.101, 271.102, Sub-Chapter F. Cooperative Purchasing Program; and any other matters incident thereto. [Accounts #7100-6040-001-470000 (Capital outlay) and #1001-1130-001-470000 (Operational Reserve)]

Issue: Currently the Casablanca golf course does not adequate working transportation haulers to be able to move and work efficiently throughout the course safely. CBGC also doesn’t have a working ball picker to pick the range safely with built in cage. We are having to pick range balls unsafely throughout the day. Additionally, we need a 6-passenger utility cart for transportation needs in special events.

Solution: To authorize purchasing agent to purchase these units for the course in order to work safely and provide the necessary transportation for guests at events and tournaments.

Result: The purchase of these units will allow us to work safer, faster and provide adequate transportation to our guests.

17.      Discussion and possible action to authorize the Purchasing Agent to solicit Request for Qualifications (RFQ) for architectural services for the redesign of parking area and expansion/construction of the clubhouse and cart barn, to potentially include the relocation of the maintenance barn, at the Casa Blanca Golf Course, in accordance with the professional service procurement act; and any other matters incident thereto.
 
Issue: The Casa Blanca Golf Course is in need of additional and expanded parking at the facility. Expansion of the clubhouse is also needed to accommodate for larger capacity due to large events at the golf course. 
 
Solution: Hiring a qualified architect would allow for bids for construction of said scope of work.
 
Result: Casa Blanca Golf Course will be able to better accommodate large events being held at the facility.

  Casa Blanca Golf Course General Manager, Oscar Urdiales shared updates with the court about possible changes and renovations to the Golf Course to be brought back at a later time.

18.      Discussion and possible action to authorize the payment to Rush Truck Center, Inc. for the engine overhaul repairs to Emergency Fire truck Unit 5810 in an amount not to exceed $30,346.00 for the Fire Department and to further authorize a transfer of funds from the General Operating Reserve account (#1001-1130-001-431007-010) to the Fire Departments Repairs and Maintenance to Vehicle account (#1001-3140-001-443000-075) and any other matters incident thereto. Issue: The emergency fire truck unit was sent to the Road and Bridge Department for diagnosis and repair.  The Road and Bridge department recommendation was for the unit to be repaired by Rush Truck Center which will require an engine overhaul after performing a comprehensive diagnosis of unit.  Due to unit being non-operational, securing other price quotes is not a viable process for the repair of this unit.
 
Solution: Authorize the payment for repairs to emergency unit and corresponding diagnostic fees and approval of transfer of funds.  Utilizing the existing fire department budget would not leave sufficient funds to cover annual projected vehicle and maintenance expenses for fiscal year 2024.   
 
Result: Proceed with payment to vendor upon completion of services to repair this emergency vehicle, repairs are estimated to take up to six weeks contingent upon availability of parts.

19.      Discussion with possible action to approve the Texas County & District Retirement System (TCDRS) Plan Agreement for Plan Year 2024 with a retirement plan required rate of 13.12% effective January 1, 2024, and any other matters incident thereto.
 
Issue: The current employer retirement plan required rate for Webb County is 13.00%, The TCDRS employer required rate for 2024 is 13.12%. The employee deposit rate remains at 6.00%. This revision must be made before December 15, 2023.
 
Solution: Approval of the recommended revision at this time will help Webb County keep retirement up to par with the 2023 - 2024 budget.
 
Result: Approval of this revision will be within the TCDRS timeline and will be in line with TCDRS 's employer required contribution rate.

Issue: Recent heavy rainfalls resulted in a significant amount of water intrusion into the new Sheriff's administrative building located at 1002 Farragut Street.   In order to prevent further water intrusion and possible damage to County property an approximate 15,500 square feet of roof area needs to be repaired.    

Solution: Approve the proposed scope of work to address the roof repairs required for facility.  Vendor has an approved cooperative contract through Choice Partners meeting the competitive bidding requirements of the State as per the Local Government Code.

Result: Proceed with the execution of a construction contract and required documentation in order to proceed with the removal & disposal of non-working HVAC rooftop equipment, repairs and sealing of rooftop area to prevent further water intrusion during heavy rainfalls.
